INTRODUCTION

1.0 Preamble:

Hon’ble National Green Tribunal in O.A.No. 710-713/2017 dated 15.07.2019 ordered regarding constitution of District Committee (as a part of District Planning Committee under Article 243 ZD) under Articles 243 G, 243 W, 243 ZD read with Schedules 11 and 12 and Rule 15 of the Solid Waste Management Rules, 2016.

In the above said order, it is stated that among others

‘Chief Secretaries may personally monitor compliance of environmental norms (including BMW Rules) with the District Magistrate once every month. The District Magistrates may conduct such monitoring twice every month. We find it necessary to add that in view of Constitutional provisions under Articles 243 G, 243 W, 243 ZD read with Schedules 11 and 12 and Rule 15 of the Solid Waste Management Rules, 2016 it is necessary to have a District Environment Plan to be operated by a District committee (as a part of District Planning Committee under Article 243 ZD)’

In this regard, Principal Secretary to Government/Chairman(FAC) vide D.O. letter dated 26.07.2019 requested District Collectors to prepare District Environmental plans by constituting District Committee (as a part of District Planning Committee under Article 243 ZD) with representatives from Panchayats, Local Bodies, Regional Officers, State PCB and a suitable officer representing the administration, which may in turn be chaired and monitored by the District Collector/District Magistrate twice every month and shall host the same in the website for a period of one year on or before 01.08.2019 & furnish monthly progress report to Chief Secretary to Government every month and copy of the same earmarked to TNPC Board accordingly.

Namakkal District:

On 1st January 1997 a new District carved out of erstwhile and named as Namakkal District. The District of Namakkal extend over an area of 3363.35 sq. Km. The District bounded by Salem on the north, on the south, Trichy and Salem on the east and on the West. The administrative head quarters is located in Namakkal. Namakkal District comprises two Revenue divisions, Seven taluks, Thirty revenue firkas. For effective

administration, the District has been divided into 5 Municipalities, 15 Panchayat Unions, 19 town panchayats and 322 village panchayats.

The population of the District as per latest census (2011) is 17,21,179. Namakkal District contains 6 MLA constituencies and one Member of Parliament constituency. In Namakkal District, 67 high schools and 96 higher secondary school are functioning. There is no big reservoir in the District. The river Cauvery flows south and south west hugging the border.

The important major industriesl located in Namakkal district are cements, Seshasayee paper and boards, Ponni sugars and Co-gen Power Plant, Salem Co-operative sugars mill and Distillery. Namakkal finds a place of importance in the map of India because of its Lorry body Building industry, more than 150 Lorry body building workshop and with a number of subsidiary Industries of auto body works are operating since 1960. Namakkal is the major producer of Egg in southern region, hence called as ‘’Egg city’’.

1. Solid Waste Management

Preamble:

The Ministry of Environment, Forest and Climate Change, Government of India has notified the Solid Waste Management Rules, 2016. As per the Rules, the role of local body has been specified as per Rule 15 of Solid Waste Management Rules, 2016 and as per Rule 16 of the said Rules, Pollution Control Board shall enforce these Rules through local bodies.

With respect to effective implementation of Solid Waste Management Rules, 2016, Hon’ble NGT had laid down several orders, of which, Hon’ble National Green Tribunal, Principal Bench on 22nd December 2016 has passed judgment in Original Application No. 199 of 2014 filed by Mrs. Almitra Patel with regard to solid waste management.

Further, for effective implementation of the said Rules, the Hon’ble NGT in its orders dated 31.08.2018 had constituted Apex Committee, Regional Committee and State Committee. Also, as per Hon’ble NGT order dated: 16.01.2019 in O.A. No. 606/2018, State Level Monitoring Committee (SLMC) in Tamil Nadu is constituted under the Chairmanship of Dr. P. Jyothimani, Former Judge, Madras High Court, Former Judicial Member, National Green Tribunal. The State Monitoring Committee meetings were held on 12.02.2019, 22.02.2019, 29.03.2019, 30.04.2019, 30.05.2019, 10.06.2019 (hotels), 27.06.2019(hospitals).

Solid Wastes generation in Namakkal District:

In Namakkal District, there are 5 Municipalities, 19 Town Panchayats and 15 Panchayat Unions. The total quantity of solid waste generation is around 219.655 M.Tons/day and the solid waste generated from the said localbodies is being collected.The wet solid waste is eithercomposted or Verme composted.The plastic waste is collected which is partly used for recycling and partly in road laying. The inert material is disposed in to the landfill sites/lowlying area.

2. Bio-medical Waste Management

In Namakkal District, there are 8 Government Hospitals, 64 Government Primary Health Centre and around 104 private hospitals located to take care human health. Further, 3 Veterinary Hospitals, 109 Veterinary Dispensaries/Clinics and 347 Non-bedded clinics are functioning in the District to take care animal health.

All the Government and Private health care facilities and Veterinary units have made agreement with common Bio medical waste facility owned by M/s. Ramky Energy and Environment Ltd (Salem) at Thangayur village, Edappadi Taluk, Salem District.

3. Plastic Waste Management

In Namakkal District, there are 5 Municipalities, 19 Town Panchayats and 15 Panchayat Unions which comprises 633 village Panchayats, The local bodies are directed to ensure that the plastic waste generated from the all the local bodies are to be segregated and recyclable plastic waste are sold to the recyclers, low value plastic are utilized for road laying and the non- recyclable plastic waste is sent to co-incineration in Cement Plant and the remaining inerts are disposed for landfill. In order to give thrust on plastic waste minimization, source segregation, recycling, involving waste pickers, recyclers and waste processors in collection of plastic waste fraction either from households or any other source of its generation or intermediate material recovery facility and adopt polluters pay principle for the sustainability of the waste management system, MoEF&CC has notified Plastic Waste Management Rules, 2016 as amended. These rules shall apply to every waste generator, local body, Village Panchayat, manufacturer, Importers and producers. The , in exercise of the powers conferred under Section 5 of the Environment (Protection) Act, 1986 notified ban on manufacture, store, supply, transport, sale or distribution of use and throwaway plastics of the following 14 types from 01.01.2019 vide G.O. (Ms). No.84 dated 25.06.2018.

With respect to effective implementation of Plastic Waste Management Rules, 2016,Hon’ble NGT had laid down several orders, of which, Hon’ble NGT in its order dated: 12.03.2019 in Original Application No. 247/2017 among other things has directed all the States to prepare respective action plans for compliance of Rules and the same was submitted to the CPCB on01.05.2019.Awareness programmes to reduce plastic usage are being conducted regularly in Namakkal District. “Plastic Pollution Free TamilNadu - 2019” Campaign Launched at Thiruchengode, Namakkal District on 25.08.2018.

4. C&D Waste Management

In Namakkal District,municipalities and town panchayats are advised to ensure that the Construction and Demolition wastes are disposed in selected suitable abandoned quarries and ensure the wastes are disposed without affecting the nearby Environment.

5. Non Attainment Cities

There are no Non–attainment cities identified by the CPCB in Namakkal District.

6.Rejuvenation of Polluted River Stretches

Preamble:

 Central Pollution Control Board in association with State Pollution Control Boards monitors the water quality of major Rivers and Lakes under the Global Environmental Monitoring System (GEMS) and Monitoring of Indian National Aquatic Resources System (MINARS) programme.  Based on the consolidated reports of GEMS and MINARS during the year 2005 to 2011, the CPCB has identified 351 polluted river stretches in the country.

Polluted River Stretches in Tamil Nadu:  In Tamil Nadu, CPCB has identified six numbers of Polluted River Stretches based on the Bio-Chemical Oxygen Demand (BOD) values namely River Sarabanga, Vasista, Thirumanimutharu, Cauvery under priority-I (BOD > 30mg/l), River Bhavani under priority-IV (BOD - 6 to 10mg/l) & River Thamirabarani under priority-V (BOD - 3 to 6mg/l).  Hon’ble NGT (PB) has directed all the States and Union Territories to prepare action plans within 31.01.2019 for bringing all the polluted river stretches to be fit atleast for bathing purposes (i.e., BOD < 3mg/l & FC < 500 MPN/100ml) within six months from the date of finalisation of the action plans and subsequently the time limit extended for two years ie., within 31.03.2021 vide its order dated 08.04.2019. As per CPCB identification,Cauvery under priority-I Polluted River stretches in Namakkal District. Also,the TNPC Board has been directed to monitor any industrial discharge in to the said river.

GEMS and MINARS Samples collected in the River Cauvery: Every month GEMS and MINARS samples are collected along the Cauvery River at the following location of Kumarapalayam, Seerampalayam, Pallipalayam, Mohanur, Paramathi Velur and the samples are sent to the AD (Lab), AEL, TNPCB, Salem for analysis. Also, regular water sample is collected at Avathipalayam out let near Pumping station.

Status of water quality of River water and drains in the study area: In Namakkal District River Cauvery is enters at Kumarapalayam Villlage, Kumarapalayam Taluk and ends at Vaduagapatti in Oruvandhur Village Panchayat, Mohanur Taluk, Namakkal District and the River Samples & Sewage samples were collected across the River Cauvery Stretches.

Industrial Pollution  Highly Polluting (17 Category) Industries: 1) M/s. The Salem CO.OP. Sugar Mills Ltd, SF. No. 107/2,3, 108/1,2, 109/1,136, 137/2, 138, Pettapalayam Village, Mohanur Post, MohanurTaluk, Namakkal District is a 17 Category industry and is in operation. The unit has provided effluent treatment plant for the treatment of trade effluent generated from their process and treated trade effluent is utilized for on land for irrigation/gardening purposes. Online Continuous Effluent Monitoring System has been provided (OCEMS).

2) M/s. The Salem CO.OP Sugar Mills Ltd Distillery, SF.No. 135,139,140, Pettapalayam Village, Mohanur Post, Namakkal Taluk, Namakkal District is a 17 Category industry and is in operation. The unit has provided effluent treatment plant for the treatment of trade effluent generated from their process and treated trade effluent is utilized for biocomposting. Online Continuous Effluent Monitoring System has been provided (OCEMS).

3) M/s. Seshasayee Paper and Board Limited – Odapalli Agraharam Village, Kumarapalayam Taluk, Namakkal District is a 17 Category industry and is in operation. The unit has provided effluent treatment plant for the treatment of trade effluent generated from their process and treated trade effluent is utilized for on land for irrigation/gardening purposes. Online Continuous Effluent Monitoring System has been provided (OCEMS).

4) M/s. Ponni Sugars Erode Limited – Sugar Division at Odapalli Agraharam Village, Kumarapalayam Taluk, Namakkal District is under operation. The unit has provided combined Effluent Treatment Plant for the treatment of trade effluent generated from their process with M/s. Ponni Sugars Erode Limited Co-generation Power Plantand treated trade effluent is utilized for on land for irrigation/gardening purposes. Online Continuous Effluent Monitoring System has been provided (OCEMS).

5) M/s. Ponni Sugars Erode Limited – Co Gen Power plant at Odapalli Agraharam Village, Kumarapalayam Taluk, Namakkal District is under operation. The unit has provided combined Effluent Treatment Plant for the treatment of trade effluent generated from their process with M/s. Ponni Sugrs Erode Ltd., and treated trade effluent is utilized for on land for irrigation/gardening purposes. Online Continuous Effluent Monitoring System has been provided (OCEMS).

Dyeing Industry Authorized units: In Rasipuram Taluk - 12 Nos, Paramathi Velur Taluk - 1 No. Kumarapalayam Taluk - 110 Nos of Dyeing and Bleaching Industries are obtained consent from the Board. All these dyeing and bleaching industries have provided individual effluent treatment plant with Zero Liquid Discharge System. All the dyeing units have provided individual ETP for the treatment of trade effluent generated from their process and the treated trade effluent is recycled into their process and the rejects are sent to ATFD/SEP for further evaporations to achieve Zero Liquid Discharge System. Unauthorized units:

Earlier there were 236 Nos. of unauthorized Textile Dyeing and Bleaching units are identified in Rasipuram Taluk, KumarapalayamTaluk and PallipalayamTaluk, Namakkal District. The above unauthorized units were of tiny and small scale in nature and discharge their untreated trade effluent into the municipal drain. These bleaching and dyeing units were discharging their trade effluent along with the domestic sewage which reaches the River Cauvery. Therefore, the above unauthorized dyeing units were issued closure direction by the Tamil Nadu Pollution Control Board and the power supplies to these units were disconnected, Demolition/Eviction of these units are being carried out by DCC through DCCC. Continuous monitoring and demolition/Eviction is necessary to curb these unauthorized dyeing/bleachingunits to maintain the water qualityof River Cauvery. The Present Status of suchunits are being inventoriedatRasipuram, Kumarapalayam, Pallipalayam and other area of Namakkal District, byEnvironmental Engineer, Flying Squad, Erode and illegal dyeing units functioning in Rasipuram, Kumarapalayam and Pallipalayam Taluks are to be evicted then and there.

As per the Directions of Hon’ble High Court of Madras in W.P.Nos. 5494/98 and 30153/03 on 4.7.2007 and as per TNPCB B.P.Ms.No. 12, dated: 21.04.2015, Namakkal District Collector has formed District Co-ordination Committee vide Roc No. 1008/DEE/TNPCB/NML/2017-1, dated:28/10/2017 and reconstituted vide ROC. dated 06/09/2018 as per Go.Ms. No. 23, Environmental and Forest (EC.1) Department, Dated:01.03.2018 to restrain the operation of illegal units discharging the untreated effluent on land or into water bodies. Further, the Namakkal District Collector has formed “District Core

committee” headed by Revenue Divisional Officer, Thiruchengode to take immediate action to prevent illegal discharge of effluent from dyeing units into water bodies vide ROC No.1008- 2/DEE/TNPCB/NML/2017-2dated 28/10/2017.

If identified any operation of such illegal units discharging the untreated effluent on land or into water bodies immediately EB Power supply will be disconnected along with official of Revenue, TNEB and Police through District Coordination Committee. The same is also carried out on consented unit of the TNPCB through disconnection of power supply/Sealing of the machineries and intimated to the Chairman/RDO, Thiruchengode, District Coordination Core Committee.

Further, such closure/sealing of the units are revocation of closure orders is done by District Coordination Committee headed by Chairman/District Collector, Namakkal.

As per the Article 48(A) of the Indian constitution, “the State shall endeavor to protect and improve the environment and to safeguard the forests and wildlife of the country”.

Therefore, in order to comply with all the directions with respect to restoration of water and air quality in the above state, a coordinated action shall be taken by all the line Departments. The action now being taken by the DCC to curb the unauthorized units will be further intensified by filling criminal case on the land/building owners who lease/renting the land/building to the said units.

The expenses incurred for eviction, demolition etc., shall be collected from the polluter on the basis of ‘Polluter Pays Principle’.

Present/proposed CETP (Common Effluent Treatment Plant) capacity/Member units:

There are two CETP proposals under process in the office of DEE, TNPCB, Kumarapalayam Jurisdiction in order to further improvised the treatment of trade effluent and thereby to prevent the environmental degradation.

1. M/s. Green Environmental Association - (118 Members) - Proposed cost - 157 Crores - land has been Purchasednear Elanthakuttai Village. The Green Environmental Association has been issued with Terms of Reference (TOR) in the SEIAA meeting conducted on 03.08.2018.

Whereas, as per the Amendments in EIA Notification Dated: 19.12.2018, issued by the MoEF, New Delhi, the Environmental Clearance for Common Effluent Treatment Plants (CETPs) setup for or within projects or activities are exempted. The CETP is yet to applyfor Consent To Establish from TNPCB. Further it is reported by the unitauthorities that the proposal has also been submitted to the Ministry of Textiles, New Delhi for scrutinizing through the Project Scrutinizing Committee (PSC) & Project Approval Committee (PAC) 2. M/s. Kumarapalayam Green Cauvery Dyeing Cluster (92 Members) - Proposed Cost - 150 Crores. Feasibility report submitted to the Government of Tamil Nadu TWICL- 28.0 acres Land has been purchased near Elanthakutai & Sowthapuram Village, Kumarapalayam Taluk, Namakkal District.

Online Water Quality Monitoring As per the Hon’ble Minister for Environment, Government of Tamil Nadu announcement during the Budget session 2016-2017 for the betterment of Environmental Management system in River Cauvery, the Online Continuous River Quality Monitoring Station at River Cauvery have been installed at Kumarapalayam, near Kumarapalayam Municipality Raw Water pumping station (Edappadi road, Opp to the unit of M/s SSM Processing). The system is under operation from 20.04.2018.

Similarly, Online Continuous River Quality Monitoring Station in River Cauvery have been installed at Head works site of Subburayavalasu in Erode District (Downstream of Pallipalayam and Erode Towns) and Tamil Nadu News Prints and Paper Limited raw water intake well in Karur District (Downstream after confluence point of River Noyyal).

There are no Polluted Industrial Clusters identified by CPCB in Namakkal District.

8.Industrial Pollution Control

Namakkal District is known for body building operations for truck, trailer, tanker and rig unit.Particularly, Tiruchengode is known for its body building industry for rig units. Finished trucks and rig units are exported to foreign countries from Namakkal. Nearly 25000 people are employed, both directly and indirectly, in truck body building activity and about 300 units in Namakkal and 100 units in Tiruchengode are engaged in this activity. Poultry plays an important role in the economy of Namakkal. Agro based, Sagoindustry, Cotton, Woolen, Silk & artificial spinning mills, ReadymadeGarments, Paper and Paper Products, chemical/ Chemical based units, Rubber, Plastic & petro based units, Mineral units, Engineering units, Crusher and Quarry, Transport equipment and repairing &Service industries are the other type of industries in Namakkal District

This involves the following

9. Utilization of treated sewage

Preamble:

In Tamilnadu, total sewage generation is around 5600 MLD and there are 54 Sewage Treatment Plants at a total capacity of 1400 MLD are in operation at all Corporations and selected Municipalities and Town Panchayats.

CPCB and TNPCB have periodically issued directions to the urban/ local bodies to set up Sewage Treatment Plants (STPs) of adequate capacity including provision for sewerage system to cover the entire local/urban areas and the treated effluent to comply with the standards in order to prevent deterioration of surface, sub-surface and coastal waters.

The treated sewage, after ensuring that the prescribed standards for core parameters are met are either used for irrigation or let into water bodies.

As per Hon’ble NGT order dated 27.11.2018 in OA No. 148/2018 directed that all the States and Union Territories ought to prepare and furnish their action plans for utilization of treated sewage in their respective States/UTs. In this regard, an action plan for utilization of treated sewage in the State of Tamil Nadu as prepared by the Municipal Administration & Water Supply Department, Government of Tamil Nadu was submitted to the CPCB on 06.08.2019.

In Namakkal District,the following local bodies has provided Sewage treatment plant to treat the sewage generated from them.

10. Conservation of Water Bodies

The Hon’ble NGT (PB) in its order directed the States to review the existing framework of restoration of all the water bodies by preparing an appropriate action plan as per the guidelines prescribed the CPCB.

The action plan shall be prepared considering the five phases viz., i) Recognition Phase, ii) Restoration Phase, iii) Protection Phase, iv) Improvement Phase andSustenancePhase. In this regard a meeting was convened by the Chief Secretary, Government of Tamil Nadu with the Head of the concerned departments and discussed about the restoration of all the water bodies (Lakes, Tanks, Ponds, Ooranis) in Tamilnadu having area 0.5 acre or more as recorded in the revenue record by the State/UnionTerritories”.

11.E-Waste Management

The Ministry of Environment, Forest and Climate Change, Government of India has notified E-Waste (Management) Rules 2016 for safe handling and disposal of e-waste in the country. In this regard, the Hon’ble NGT (PB) in its order dated 12.02.2019 in O.A. No. 512/2018 has issued directions to the stake holders for effective implementation of the e-waste management rules. 12. Prevention Illegal Sand Mining

Preamble

The Hon’ble National Green Tribunal (PB), New Delhi in order dated 8.4.2019 in O.A. No. 673 of 2018 has mentioned in Para 15 (ix) that ‘The Task force will also ensure that no illegal mining takes place in river beds of such polluted stretches’.

The Government vide G.O (Ms). No. 135 Industries (MMA.1) Department dated 13.11.2009 has reconstituted District Level Task Forces and constituted Taluk Level Task Forces for prevention of illegal mining / transportation of minerals. Accordingly, the District Level Task Forces shall collect / review the information/cases / issues to the illegal mining / quarrying and to monitor the functions of the Taluk Level Task Forces. The District Level Task Force shall meet once in a month without fail to discuss the illegal quarrying / mining / transportation / damage caused to the environment and to send report to State Level Task Force.

The Taluk Level Task Force shall make frequent surprise checks in the mining / quarrying field and on vehicles transporting minerals so as to arrest illicit quarrying / mining / transportation of minerals by forming flying squads and submit its report to District Level Task Forces and it shall meet fortnightly.

In the event of illegal mining, the village administrative officer, Tashildar, officer-in- charge of Department of Geology and Mining at District Level and the Police officer in-charge of the area shall be held responsible for not taking proper action against the offenders and the concerned District Collector is requested to take Departmental action against them and send a report to Government.

Sand sources in Namakkal District

In Namakkal District River Cauvery is the main sources of sand mining in the district. The district administration along with Revenue department and police department is taking stringent action to prevent illegal sand mining.
