1.1 Overview

The Town of Qualicum Beach is requesting proposals for the preparation of a business plan for the Town of Qualicum Beach airport. The business plan will focus on providing direction toward attaining a self-sustaining, revenue-generating airport that meets local and regional needs. The Plan will provide an analysis of the market the airport is operating in; identify opportunities for the airport; establish achievable goals and objectives; formulate an action plan for a 1, 5 and 10- year period. It is important to note:

a) The Town is not looking at Required Navigation approaches – RNP b) Nor is the Town looking at Obstacle Limitation Surfaces – OLS, per transport Canada c) The Town will consider future uses such as, cargo, emergency response, fuel and other support infrastructure d) The Town will consider airside and landside commercial areas

The airport is currently governed by the Council of the Town of Qualicum Beach and this business plan may speak to alternative options for airport governance.

1.2 Background 1.2.1 Operating Conditions: The aerodrome is certified as a public use DAY/NIGHT, VFR/IFR airport with the following restriction: "night operations are prohibited when APAPI is unserviceable".

The airport has one asphalt runway, 11/29, 3,565' long and 75' wide with displacements on each end of the runway. Elevation at threshold RWY 11 is 191'.

There are two airlines providing scheduled air service: KD Air Corp. and Ltd. Other air service tenants at the Airport include Sunwest Helicopters Ltd. and charter services. The airport is also used by approximately 30 locally based aircraft.

1.2.2 Noise Abatement Noise abatement procedures are in effect. Please refer to current Canada Flight Supplement.

1.2.5 Services (Daylight Hours): The Town of Qualicum Beach currently provides: • Fuel 100LL (AV Gas) - Currently sold for $1.60/litre

• Jet A-1 (with additives: FSII (Ice Inhibitor) & DCI4A (Corrosion Inhibitor)) - Currently sold for $1.07/litre

The airport also has an independently owned and operated restaurant “The Final Approach” that operates seven days a week in a leased terminal space.

The Town has a cautionary note to users as there are 100' trees approx. 3000' from thld 29. Only pilots familiar with local terrain should use this airport during hours of darkness.

1.2.6 Qualicum Beach Airport Users Committee An Airport Users Committee was established on January 11, 2016 to discuss and consult on airport related matters. The committee is made up of Airport business/user representatives; a representative of the Chartwell Residents’ Association; a member at large; and one Qualicum Beach staff members. This group meets at a minimum of every four months.

The Town will work with the proponents to provide statistical summary of passenger activity, aircraft movement and air cargo and operating revenue and expenditures.

1.4 Project Milestones The successful proponent should provide 1. A preliminary report on project status to be issued one month after the contract has been awarded.

2. An interim report, suitable for distribution to stakeholders to be available on September 12, 2016, and there will be an opportunity for responses to be reviewed, prior to completion of the final plan.

3. The business plan must be completed on October 17, 2016 for review and approval by the Town of Qualicum Beach Council.

1.5 Written Proposal Contents The proposal should contain the following information: - Name of the consultant/firm - Relevant experience/qualifications of the whole project team, if applicable. - References with details of work completed - A description of the approach that will be used to complete the business plan, including a detailed timeline - A description of project deliverables - A detailed budget for the project

1.6 Prices & FOB Point All prices submitted shall be in Canadian funds for the entire scope of work. The lowest price or any proposal will not necessarily be accepted.

1.7 No Claim Except as expressly and specifically permitted in this Request for Proposals (“RFP”), no Proponent shall have any claim for any compensation of any kind whatsoever relating to this RFP, including accepting a non-compliant bid. By submitting a proposal each Proponent shall be deemed to have agreed that it has no claim.

1.8 Interpretation of Documents and Questions/Clarifications Proponents shall review the RFP documents, and shall promptly report and request clarification of any discrepancy, deficiency, ambiguity, error, inconsistency or omission contained therein. Any such request must be submitted in writing, electronically or otherwise, three (3) business days before the closing date.

Where such request(s) results in a change or a clarification to the requirements of the RFP, the Town will prepare and issue an Addendum to this RFP. All inquiries are to be directed in writing by email quoting the RFP name and number to: email [email protected]. The Town will determine at its sole discretion; which enquiries require response.

1.9 Voluntary Site Visit A voluntary site visit will be held at 2:00 pm on May 17, 2016. All bidders should have a representative present, however, this is not a mandatory site visit. The meeting will start at the Qualicum Beach Airport Terminal Building located at: 1000 Ravensbourne Lane, Qualicum Beach, BC and after a brief review and question and answer session, the meeting will be adjourned.

2.0 Addenda Written Addenda are the only means of varying, clarifying or otherwise changing any of the information contained in this RFP. The Town of Qualicum Beach reserves the right to issue Addenda up to the closing date. The date set for submitting Proposals may be changed if, in the Town’s opinion, more time is necessary to enable Proponents to revise their Proposals. Addenda will state any changes to the Proposal closing date and time. Proponents should acknowledge receipt of all Addenda in their proposals. A Bylaw to establish the Qualicum Beach Municipal Airport Pursuant to Section 717 of the Municipal Act

The Council of the Town of Qualicum Beach in open meeting assembled, enacts as follows:

1. This Bylaw may be cited as "Town of Qualicum Beach Airport Establishment and Operation Bylaw No. 457.05, 1998".

2. INTERPRETATION:

Unless the context otherwise requires, the following shall mean:

"Airport" shall mean the Qualicum Beach Municipal Airport;

"Clerk" shall mean the Municipal Clerk for the Town of Qualicum Beach, or his designate, as appointed by Council;

"Committee" shall mean the Airport Management Advisory Committee as appointed by Council;

"Council" shall mean the Council of the Town of Qualicum Beach;

"Municipality" shall mean the Town of Qualicum Beach;

“Owner” shall mean the owner of an aircraft or alternatively, that as the aircraft operator, he/she is lawfully in possession and control of the aircraft;

"Supervisor" shall mean the person or persons appointed by Council to provide supervision of the Airport in the capacity of Airport Supervisor, and who shall report to the Municipal Clerk.

3. AIRPORT LANDS:

This Bylaw hereby establishes an Airport on those lands presently owned by the Municipality and known as:

Lot A, Plan 42657, D.L. 78, Nanoose District; and Lots 5, 6, 7, 8 & 9, Block 17, Plan 1694, Nanoose District

which are generally located at 1000 Ravensbourne Lane.

4. GENERAL PROVISIONS:

(1) Council may permit the construction of buildings, structures and airport facilities including, but not limited to, runways, taxiways, aprons, fuel stations, runway lights, beacons and other navigational aids for the use of the Airport by the public.

(2) All persons entering upon and using Airport facilities and services shall do so pursuant to the rules and regulations that may be established from time to time by Council.

5. AIRCRAFT OPERATIONS REGULATIONS:

(1) Aircraft landings or take-offs are not permitted at the Airport between the hours of 22:00 hours and 06:00 hours.

(2) Aircraft engines shall not be run up or tested at the Airport between the hours of 22:00 hours and 06:00 hours. The noise level is to be kept to a minimum so as not to disturb the people residing near the Airport.

(3) No commercial ultra light aeroplane operation shall be conducted at the Airport.

6. FEES & CHARGES:

Council shall and hereby levies fees, charges and rates for services, facilities and leases provided at the Airport as detailed in "Schedule A" attached hereto and forming part of this Bylaw.

7. AIRCRAFT PARKING:

Owners of aircraft parking on land at the Airport that is not leased shall be required to complete a Transient Parking Application as shown in "Schedule B" or an Aircraft Tie Down Accommodation Agreement as shown in "Schedule C" both attached hereto and forming a part of this Bylaw.

9. AIRPORT SUPERVISOR'S DUTIES AND RESPONSIBILITIES:

Council may appoint a person or persons as Airport Supervisor who will manage and supervise the day-to-day operations of the Airport in accordance with Council's rules, regulations and policies.

10. OFFENCE:

Every person who violates or breaches or who causes or allows to be violated or breached, any of the provisions of this Bylaw shall be guilty of an offence against this Bylaw and each day that such violation is caused or allowed to continue shall constitute a separate offence.

11. SUMMARY CONVICTION:

Every person who violates any of the provisions of this bylaw or who suffers or permits any act or thing to be done in contravention or violation of any of the provisions of this bylaw, or who neglects to do or refrains from doing anything required to be done by any of the provisions of this bylaw is guilty of an offence against this bylaw and liable, upon summary conviction, to a fine not exceeding Two Thousand Dollars ($2,000.00).

12. “Airport Establishment and Operation Bylaw No. 457.02, 1995”, “Airport Establishment and Operation Bylaw No. 457.02, 1995, Amendment Bylaw No. 457.03, 1997” and ”, “Airport Establishment and Operation Bylaw No. 457.02, 1995, Amendment Bylaw No. 457.04, 1998” are hereby repealed.

3. Reserved Tie-Down Space: Every owner who wishes to reserve tie down space shall be charged $38.50 for the initial purchase of a tie-down cone from the municipality, and pay an annual fee of $38.50 to retain the reserved tie down space. 4. Transient Aircraft Parking: All transient aircraft parked on the Airport overnight are encouraged to make a donation in the box provided for each overnight of parking, based on the daily fee.

5. Airport User Fee: A fee shall be levied for all flying clubs/flying schools and non-scheduled commercial or corporate air traffic that use the airport as follows:

A donation for transient aircraft parking is encouraged in accordance with the Airport Establishment and Operations Bylaw Fee Schedule for all transient airplanes parked on the Airport overnight.

In consideration of the Town of Qualicum Beach supplying accommodation for the Aircraft described above, the undersigned agrees with the Town as follows:

1. The Owner warrants that he/she is the owner of the Aircraft or, alternatively, that as the Aircraft Operator, he/she is lawfully in possession and control of the Aircraft and has proper and valid authority to enter into this Agreement on behalf of the owner.

2. The Owner agrees to observe and obey the Air Regulations and the provisions of the "Town of Qualicum Beach Airport Establishment and Operations Bylaw No. 457.05, 1998" and amendments thereto.

3. The Owner acknowledges that he/she has the sole responsibility for the tying down and securing of the Aircraft on the Airport premises.

4. If the owner defaults in performance of any of the terms and conditions of this Agreement, the Municipality, at its option, may declare this Agreement terminated.

5. The Municipality shall not be liable for any loss of or injury to the aircraft however caused.

6. The Owner hereby agrees to indemnify and save harmless the Municipality against any and all liability, loss, damages, cost or expense which the Municipality may hereafter incur, suffer or be required to pay by reason of any action, suit, demand, claim proceeding or otherwise arising from the loss of or injury to any property including the Aircraft.

7. This Agreement contains the full and complete understanding between the parties hereto with reference to the within subject matter, supersedes all prior agreements and understanding whether written or oral pertaining thereto and cannot be modified except by a written instrument signed by each of the parties hereto. The Owner acknowledges that no representation or warranty not expressly contained in this Agreement has been made by the Municipality or any of its agents, employees or representatives.

8. Time is of the essence of this Agreement.

9. This Agreement shall inure to the benefit and be binding upon the parties hereto and their respective heirs, executors, administrators, successors and assigns.

10. All words and personal pronouns relating thereto shall be read and construed as the number and gender of the party or parties referred to in each case required, and the verb agreeing therewith shall be construed as agreeing with the required word and pronoun. Where the context so requires, the singular of any word shall import the plural and the plural shall import the singular.

11. In the event that any one or more of the covenants and conditions herein shall be held to be in violation of or unenforceable because of any law, it is understood that none of the other rights or obligations herein shall be prejudiced or rendered unenforceable by reason thereof.

12. This Agreement shall be deemed to be made and construed in accordance with the laws of the Province of .

An annual or monthly fee will be charged in accordance with the Airport Establishment and Operations Bylaw Fee Schedule.

In consideration of the Town of Qualicum Beach supplying the type of accommodation selected above for the Aircraft as described above, the undersigned agrees with the Municipality as follows:

1. The Owner warrants that it is the owner of the Aircraft or, alternatively, that as the Aircraft operator, he is lawfully in possession and control of the Aircraft and has proper and valid authority to enter into this Agreement on behalf of the Owner.

2. The Owner agrees to observe and obey the Air Regulations and the provisions of the "Town of Qualicum Beach Airport Establishment and Operations Bylaw No. 457.05, 1998" and amendments thereto.

3. The Owner acknowledges that it has the sole responsibility for the tying down and securing of the Aircraft on the Airport premises.

4. In the event of an earlier termination of accommodation than that specified above, the Owner agrees to give the Municipality 30 days notice in writing, and, unless notice in writing is received of a change in ownership of the Aircraft, the Owner shall be liable for any continuing charges levied by the Municipality in respect of this Agreement.

5. Provided that the Owner is not in default of any of the provisions of this Agreement, the Municipality agrees to permit the Owner or such other person or persons as may be designated in writing by the Owner to remove the Aircraft from the Airport upon reasonable notice to the Municipality.

6. If the Owner fails to pay any sum required to be paid by this Agreement or shall make default in performance of any of the terms and conditions of this Agreement, the Municipality, at its option, may declare this Agreement terminated and the total amount due hereunder from the Owner shall at once become due and payable in full and the Municipality shall have the right to take such steps as it may be entitled for the recovery of the total amount due hereunder together with all ancillary costs incurred.

7. The Municipality shall not be liable for any loss or injury to the Aircraft however caused.

8. The Owner hereby agrees to indemnify and save harmless the Municipality against any and all liability, loss, damages, cost or expense which the Municipality may hereafter incur, suffer or be required to pay by reason of any action, suit, demand, claim, proceeding, or otherwise arising from the loss of or injury to any property including the Aircraft.

9. TOWN OF QUALICUM BEACH BYLAW NO. 448.02

A BYLAW TO IMPOSE AN AIRPORT USER FEE AT THE QUALICUM BEACH AIRPORT

WHEREAS Section 363 of the Local Government Act provides that Council may impose a fee or charge for the use of the Qualicum Beach Airport;

NOW THEREFORE, the Council of the Town of Qualicum Beach in open meeting assembled enacts as follows:

1. Every Operator (the “Operator”) of a scheduled air passenger service shall pay (448.03) to the Town of Qualicum Beach (the “Town”) for each passenger on every flight of the Operator commencing or terminating at the Qualicum Beach Airport the following airport passenger user fee:

EFFECTIVE DATE AIRPORT PASSENGER FEE January 1, 2011 $5.00 each January 1, 2012 $6.00 each January 1, 2013 $7.00 each

2. (1) The Operator shall remit to the Town of Qualicum Beach within fifteen (15) days of the end of each calendar month the total amount of airport passenger user fees which the Operator was liable under this Bylaw to pay to the Town for that month, less Twenty-five Cents ($.25) for each user fee charged in consideration of the administrative costs of the Operator.

(2) If the Operator does not remit to the Town the airport passenger user fee within fifteen (15) days of the end of a calendar month, the Operator shall remit the total airport passenger user fees payable for that month to the Town within thirty (30) days of the end of that calendar month, and shall not withhold any percentage of that total amount.

3. (1) The Operator shall file to the Town, with each payment of the fees (448.03) required under this Bylaw, a statement of the numbers of all passengers commencing and terminating flight at the Qualicum Beach Airport for each day and a total for the applicable month, and the total number of flights for the applicable month, showing in sufficient detail the information necessary to calculate exactly the fees payable under this Bylaw.

(2) The Operator shall keep proper books of account of passengers commencing and terminating flights at the Qualicum Beach Airport in a form satisfactory to the Town, and shall keep all books of account and aircraft journey log books available for inspection by any municipal official of the Town at all reasonable times. 4. A person who contravenes this Bylaw commits an offense and is punishable in accordance with the Offense Act.

5. This Bylaw shall be cited for all purposes as “Town of Qualicum Beach Airport User Fee Bylaw No. 448.02, 2003” and shall become effective January 1, 2004.

6. “Qualicum Beach Airport User Fee Bylaw No. 448.01, 1997” is repealed effective January 1, 2004.

A C A T AN A QUALIC TOWN OF QUALICUM BEACH Town of Qualicum Beach Terms of Reference Qualicum Beach Airport Users Committee (QBAUC)

1. Purpose of the Committee The Qualicum Beach Airport Users Committee (QBAUC) is a committee made up of Airport business/user representatives; a representative of the Chartwell Residents Association; a Member at Large; and one Qualicum Beach staff member. This group will meet at a minimum of every four (4) months to discuss and consult, in a cooperative spirit, airport related matters that may include but need not be limited to the following:

a. The Town of Qualicum Beach Airport plans, operations, activities, facilities and services to ensure maximum coordination and both safe and consistent service standards;

b. The Town of Qualicum Beach Airport’s short, medium and long term plans to develop and improve the airport with a view on providing an efficient and well maintained airport facility and service for the residents of and visitors to the Qualicum Beach area;

c. Airport related matters as referred to by the Council of the Town of Qualicum Beach.

2. Duties and Functions of the Committee a) Identify and discuss situations that may benefit from improved communication and/or coordination; b) Make recommendations to the Airport businesses/users (including the Town) that contribute toward the improvement of collaboration, coordination and both safe and consistent delivery of service standards; c) Make recommendations on joint activities, cross-promotion opportunities and educational programs; d) Identify and discuss opportunities that may increase the understanding of regulations and/or policies; e) When necessary forward request or make recommendations to the Town via appropriate employees.

3. Records The committee will keep records of matters that come before it to include discussed elements and actionable decisions that arise from these.

4. Meetings a) The committee will meet three times a year on the first Wednesday of October, February and May. b) Special meetings, if required. c) A quorum shall consist of a majority of members, minimum of 5. d) The committee will add procedures it considers necessary for the meetings.

5. Agendas and Meeting Reports a) An agenda will be prepared by the co-chairs and distributed, by the Town, to members prior to the meeting. b) A report of the meeting will be prepared as soon as possible after the meeting.

6. Composition of the Committee a) The committee shall consist of nine members as follows:

Town Representative 1 Member at Large 1 Chartwell Representative 1 Flying Club 1 KD Air 1 Orca Air 1 Final Approach (Airport Restaurant) 1 Sunwest Helicopters 1 T-Hangar representative 1 Private hangar representative 1 Skydive Island 1

7. Co-chairs a) The committee will elect co-chairs from its membership. b) The co-chairs shall with the support of appropriately assigned Town employees: i. Control the meetings ii. Ensure the maintenance of an unbiased viewpoint iii. Arrange the agendas iv. Review previous meeting reports and material prior to the meetings v. Arrange for the meeting place vi. Notify members of meetings vii. Prepare meeting agendas viii. Prepare meeting reports ix. Forward a copy of meeting reports to the Town for distribution

8. Responsibility of the Individual Committee Members As a member of the Committee, each member will:  Exercise good judgment and act with integrity Page 3 of 3 QBAUC Terms of Reference

 Use his/her ability, experience and influence constructively  Be available as a resource  Respect confidentiality  Understand the difference between discussing and managing, and not encroach on Town management’s or individual businesses area of responsibility  Identify potential conflict areas – real or perceived – and ensure that they are appropriately reviewed

9. Criteria for Removal as a Member A member may be considered for removal if he/she misses three (3) consecutive meetings, does not hold themselves free of conflict of interest or otherwise does not fulfill the role and responsibility of a member.
