1 INTRODUCTION

1.1 Overview and Background of the Project

1. The project aims to electrify the missing 145.1 kilometers (km) of non-electrified track linking major cities in the populous Fergana Valley with Tashkent. This will facilitate direct and efficient operation of both freight and passenger train services, and thereby promotes economic and social development of the Fergana Valley.1

2. The Project will be aligned with the following impacts: (i) stimulated economic growth in the Fergana Valley, and (ii) increased regional trade along CAREC Corridor 2. The outcome will be the level of passenger and freight service on the Pap-Namangan-Andijan railway line improved.

3. The project will produce two outputs. First, railway infrastructure along the Pap-Namangan-Andijan railway line will be upgraded. This includes electrification of 145.1 km of the main railway line to 27.5 kilovolts alternating current (including the 3.5 km line from Blok Post 136.1 to Uchkurgan), construction of 2 traction substations and dispatcher points, modernization of the locomotive depot in Andijan for it to be able to handle electric locomotives, purchase of maintenance equipment and machinery, modernization of signaling and communications facilities, and construction of external power supply facilities which will transmit electricity from the main grid to the traction substations. Six kilometers of the railway line will be realigned to bypass a section of the line that currently traverses the territory of the Kyrgyz Republic to be also electrified under the project. Second, UTY’s institutional capacity will be strengthened, especially with regards to multimodal logistics.

4. The Project includes the following components: 1) Electrification of the main track (145.1 km) between 5.2 km east of Pap Station and Andijan 1 station, and including the 3.5 km line from Blok Post 136.1 to Uchkurgan- Voltage of transmission lines will be 27.5 kV 2) Electrification of the new alignment (6.7 km)-Voltage of transmission lines will be 27.5 kV 3) Construction of two new traction substations in Namangan (Raustan) and Khakulabad, including the access roads 4) External power supply transmission line (TL) of 52km to transmit electricity to two new substations to be constructed as follows: • 110 kV TL for Khakulabad (40 km) • 220 kV TL for Namangan/Raustan (12 km) 5) Construction of Uychi Blok post new passing loop at km137 which includes: • Automobile road for passing loop (780m) • Building of Uychi Blok post • Borrow pit for construction (120m)

5. These activities are included in the project scope and will be funded through proposing loan. Besides this, the project includes components considered as associated and existing facilities, which is implemented through Government own sources. Such facilities cover: • Construction of the 6,7 km bypass, • Construction of additional maintenance floor within Andijan Depot.

6. Per ADB SPS (2009), these activities are considered as associated facilities which are not funded as part of the project (funding may be provided separately by the borrower/client or by third parties), and whose viability and existence depend exclusively on the project and whose goods or services are essential for successful operation of the project. However, the ADB’s SPS requires to carry out a due diligence of the implemented social safeguards activities and will provide recommendations (if any) including corrective actions, such that ADB’s reputation is not compromised vis-à-vis the associated facility.

7. As part of Project’s social safeguards due diligence, for this associated facility (namely 6.7 km new alignment), due diligence assessment has been conducted and recommendations and proposed actions are provided in Social Due Diligence Report (SDDR)-Corrective Action Plan (CAP) prepared and approved by ADB in February 20172.

8. This SDDR Implementation Completion Report (CR) is covering the full implementation of SDDR- CAP (including the land for land compensation) with demonstration of its compliance with approved SDDR, as well as clear indication of issues emerged during the implementation process, including the GRM.

1.2 Construction of New 6.7km Alignment

9. Constructed new track starts from km 125+700 (Uychi station) to km 132+400 (Khakkulabad), the route runs along a new direction of length 6.7 km. Rectification will divert the railway line that crosses the border with the Kyrgyz Republic that currently is creating difficulties with track maintenance in term of accessing to the territory of neighboring country.

10. From the point of unlocking the railway track with 620 m radius extends to the right and passes irrigated lands on the PC 1272 + 22 crosses the North Fergana Canal (NFC). Before the NFC railway track crosses the highway. Right Bank Canal is densely populated residential area and partially has been resettled. Tunnel type overpass 96,61m length was constructed to cross highway. Construction of concrete bridge length of 64.6 m was planned for crossing the NFC. An automobile road runs along the left bank of the NFC and railway overpass length of 53.2 m was constructed to cross it. Then the railway route comes to the Naryn River, which is one of the main water sources of the Ferghana valley. Naryn river splits into two branches at the project area. It was built concrete bridge over right branch (length 270.80 m). The left branch was reverted into the right branch through construction of dams. The left branch of NFC and flood plain was passed by construction railway embankment. Further railway track passes irrigated land and at point PC 1295 + 34.5 crosses Hakulabadsay (smaller canal) concrete bridge length of 57,5m was constructed to cross it. At the point PC 1297 + 35.5 railway track crosses the South Fergana Canal (SFC), by construction of concrete bridge length of 64.6 m. Then the railway track route passes through farmland and at the point PC1311 crosses highway 4R116. A railway overpass length of 53.2 m was built for intersection railway with automobile road. Further 600 m radius of the track of the railway line adjacent to the checkpoint at the PC 1361 of the existing railway line. At the intersections of railway with smaller roads, at the PC in 1296 and + 82 + 45 PC 1301 protected and unprotected passes was constructed. A scheme of new alignment is provided in Figure 1.

1.3 Summary of impacts defined by SDDR

11. The new alignment (6.7km) traverses through Uychi and Uchkurgan districts of Namangan Province and passes mostly through agricultural lands and some parts of residential area (Kizil Ravat village and Uchkurgan city) affecting 13,96 ha of land plots, of which 11.82 ha are farm lands, 2 non- residential buildings and relocation of 25 residential houses.

12. In this regard, land allocation procedures were initiated by UTY and khokimiyats according to the national legal requirements based on which in total 2.45 (residential) and 0.246 (non-residential) lands have been allocated by khokimiyats for the persons losing buildings.

13. According to the District Decisions by Uychi and Uchkurgan Khokims, in total 13,96 ha of land plots will be affected by this component, of which 12.22 ha of agricultural land plots (farmland) used by 9 users. Meantime, there are in total 25 residential and 2 non-residential buildings to be demolished, of which 8 houses (13 households) are located in and 17 houses and 2 non-residential buildings are located in . The total number of AHs is 41.

14. The summary of land impacts based on District Decisions, field verification and Cadaster is presented in the Table 1 below.

1.4 Legal Framework and Entitlements for Compensation

15. The legal and policy framework of the project is based on national laws and legislations related to land acquisition and compensation policy in Uzbekistan, and ADB’s Safeguard Policy Statement 2009 (SPS). Based on the analysis of applicable laws and policies and ADB’s Policy requirements, project related land acquisition and resettlement (LAR) principles have been adopted. APs entitled for compensation or at least assistance provisions under the project are (i) All APs losing land either covered by legal title/traditional land rights, legalizable, or without legal status; (ii) Tenants and sharecroppers whether registered or not; (iii) Owners of buildings (as and when applicable), crops, plants, or other objects attached to the land; and (iv) APs losing business, income, and salaries.

16. In order to ensure the proper implementation of land acquisition and resettlement of affected people for the construction of new 6.7 km alignment several issues were identified during social due

diligence exercise, as a result of which needed corrective actions and mitigation measures proposed. The list of this issues and already implemented actions are summarized in Annex 3.

2 MONITORING OF SDDR-CAP IMPLEMENTATION

2.1 Monitoring objective and scope

17. SDDR implementation is routinely be monitored internally by the UTY (PIU) with outcomes reported to ADB in relevant Completion Reports (CR), as well as in semi-annual social monitoring reports (SSMR). The key objective is to ascertain the compliance of full SDDR-CAP implementation, including the delivery of compensation and allowances (including the land for land compensation), consultation and grievance redress. The CR contains: (i) accomplishment to-date, (ii) proof of compensation and land allocation, (iii) problems encountered, grievances received and addressed, consultations carried out during the implementation, and (iv) suggested options for corrective measures. 18. An international consulting firm (Italferr) has been engaged by the PIU as a Project Management and Supervision Consultant (CSC). The scope of CSC services is extended with involvement of international and national resettlement specialists (IRS and NRS) who will provide overall assistance to PIU in managing and implementing the project and ensuring safeguards compliance with the project implementation plan, the loan agreement, and the project agreement(s) in terms of social safeguards and resettlement, particularly in implementation and monitoring of LARPs, LARP addendums, SDDRs including the preparation of implementation Compliance Reports (CR), Semi- annual Social Monitoring Reports (SSMR) and other required progress reports under the Project.

2.2 Internal Monitoring Methodology

19. Fulfillment of the targets in the implementation process has been monitored through setting up indicators. The vital indicators monitored include the contents of the activities and entitlement matrix. The SDDR contains indicators for achievement of the objectives under the resettlement program. The indicators for achieving the proposed objectives during the implementation of the SDDR are of two types: (i) Process Indicators (indicating project inputs, expenditure, staff deployment, etc.) and (ii) Output Indicators (indicating results in terms of numbers of APs compensated, and assistances provided. The monitoring indicators applied for the monitoring of SDDR implementation are presented in Table 2 below.

20. Internal monitoring data has been collected through the following methods: (i) Desk review and verification of census and entitlement data for the APs during and as a result of implementation; (ii) Desk review and verification of delivery of compensation to all AHs in payment orders in the manner defined in the SDDR-CAP (iii) Consultation and informal interviews with APs; (iv) The grievance redress register; (v) Desk review of other related documents; and (vi) Direct field observations.

3 SDDR-CAP IMPLEMENTATION PROCEDURES AND RESULTS

3.1 SDDR-CAP Implementation Preparatory activities

21. SDDR-CAP implementation actually started at the end of November 2017. Prior to the SDDR implementation, the following preparatory activities were carried out by the UTY (PIU):

(i) Disclosure of approved SDDR on Project’s (UTY’s) website. (ii) Disclosure of final approved SDDR in affected districts via khokimiyats: UTY sent an official letter to Namangan province khokimiyat by indicating the link to the webpage of disclosed final SDDR in two languages Russian and English for their information and dissemination in affected districts. (iii) Communication of the compensation data with khokimiyats: Official letters have been sent to khokimiyats with provision of data on compensation packages for each AH. (iv) Consultations with khokimiyats regarding the allocation of relevant budget and procedures for the compensation delivery (including the land allocation by khokimiyats), (v) Preparation of notification letters and face to face notification to each AH regarding the defined compensation amount. (vi) Preparation of information leaflets for the notifications to each AH.

3.2 Payment of compensation

3.2.1 Land Allocation to Physically Relocated AHs (Land for Land Compensation)

22. In the scope of country regulations on LAR, the first stage of LAR implementation is the adoption of District (Khokim) decision on allocation of land plots for construction of residential houses and social facilities belonging to natural and legal persons that were subjected to demolition. 23. The following two Uychi District Decisions have been signed: (i) No 9 dated 13 January 2017 “Decision on allocation of land plots for construction of houses and social objects for the citizens, whose house and social objects are subject for demolition, located in the territory of Electrification of “Pap-Namangan-Andijan“ railway track (between PK -1257-PK-1324/1361+00 Block-post-Uychi) and constructing new railway part based on the Decree of the President of the Republic of Uzbekistan dated 14 April 2016 No. R-4636 “On measures to facilitate implementation of investment projects supported by international financial institutions and bilateral donors”, (ii) No 10 dated 13 January 2017 “Decision on demolition of houses located in the land of new contracting track and electrification of “Pap-Andijan-Namangan” track based on the President’s Decree Nr R4636 dated 14 April 2016 “On measures to facilitate implementation of investment projects supported by international financial institutions and bilateral donors”. 24. The following two Uchkurgan District Decisions were signed:

(i) No 1207 dated 6 December 2016 “Decision on demolition of residential houses and social structures located between PK -1257-PK-1324/1361+00 Block-post-Uychi” (ii) No 1209 dated 7 December 2016 “Decision on allocation of land plots for construction of residential houses and social facilities belonging to natural and legal persons that were subjected to demolition and located between PK -1257-PK-1324/1361+00 Block-post- Uychi”. 25. On the basis of the above-mentioned Decisions the 32 AHs were allocated with the 2.046 ha land plots in lieu of the land plots that were released for construction of the bypass railway line from the reserved district lands of Khokimiats. Out of 32 AHs, 0.06ha land plots were allocated to each 30 AHs were being physically relocated and 0.096ha and 0.15ha land plots to 2 AHs having non- residential impact. In addition to total allocated land plots to AHs, 0.25ha and 0.40ha land plots required for roads and ditches were allocated as well in Uychi and Uchkurgan districts respectively. District Decisions by Uychi and Uchkurgan Khokims, including the lists of affected properties and persons are given in Annex 1. 26. 13 AHs from Uychi have been relocated to Rovot town, Yangiyer mahalla and 19 AHs from Uchkurgan to Chorvador str., Mustakillik makhalya. All AHs have been relocated to the new allocated plots during the period of April-July 2018 immediately after construction is completed. New locations of allocated land plots are close to the previous locations with maximum distance of 3-4km respectively and the basic services and facilities remain the same for all AHs.

3.2.2 Payment of Compensation for the Loss of Profit to Farmers and Relocation of the Residential Houses

27. Several meetings have been held with Uychi and Uchkurgan khokimiyats, as well as Namangan cadaster office authorities, concerning the compensation for affected farmlands. Calculation of compensation was done by financial departments of khokimiyats. Then khokimiyats started preparation of the decisions on transferring the amount. These decisions had been agreed on region level authorities and then approved by Namangan province level authorities. With support of ADB consultants the UTY sent letters to Uychi and Uchkurgan khokimiyats on 25 of June 2018 to expedite the payment of compensation to farmers. The payment orders for relocated AHs as well as for the compensated farmers are attached in Annex 2. 28. As a result of SDDR-CAP implementation, in total compensation of 18,139,870.00UZS as a loss of profit has been paid to all 8 farmers and 716,378,989.38 UZS has been paid for residential houses and non-residential structures affected both in Uychi and Uchkurgan regions. The breakdown of implementation results is provided in table 4 and 5 below.

4 DEMOLITION WORKS AND RELOCATION OF AHs

29. The land allocation has been completed both in Uychi and Uchkurgan and compensation is paid. All the affected structures were demolished within March-May-2018, particularly: (i) In Kizil Ravat village demolishing took place end March and in April after payment of compensation, compensation was paid from December 2017 to January 2019. (ii) In Yoshlik village demolishing took place in the period from April to May 2018.

30. The schedule of demolishing has been coordinated with the APs so that they can take the salvaged materials. 31. The construction of new residential houses was started before the demolition works in March 2018. The relocation of AHs has started from May 2018 when the main targeted rooms with all facilities and sufficient living conditions were built and commissioned and it ended in July 2018 (see photos of completed houses in Annex 4). Taking into account that the construction works were implemented in a tight and strict schedule in compliance with simultaneously phases of AHs relocation, the need of rental allowance to be provided to relocated AHs was not emerged.

5 PUBLIC CONSULTATIONS AND INFORMATION DISCLOSURE

32. Before construction of the new alignment, Public Consultations were not conducted by local government and/or UTY. Within the preparation of draft LARP of the Project, as part of Public Information Disclosure, representatives of Kyzyl Ravat and Yangiyer settlements affected by this associated project’s components participated at the Public Consultations on November 23, 2016. 33. During the PC the population affected by the Project, including people living on the new bypass 6,7 km section, was informed and consulted on all important aspects of the Project. However, it was clearly noted, that the LAR-related activities for the new alignment section are not included in the draft LARP prepared for the suggested Project components to be financed by ADB. 6 GRIEVANCE REDRESS MECHANISM

34. The GRM has been established prior the start of SDDR implementation. 7 CONCLUSIONS

35. The desk review and field visit suggest that in general, SDDR-CAP implementation is fully completed in accordance with provisions set in SDDR-CAP and with satisfaction of APs. 36. The impacts have been fairly listed and compensated for affected assets/structures/trees and land plots. In total, the 40 AHs received 734,518,859.38 UZS compensation, which was paid through bank transfers. 37. Project level GRM has been established and is well functioning. To date 2 complaints (1 verbal and 1 written) have been received and both of them are resolved. Grievance logs are maintained at local level and data on grievances collected and analyzed regular basis. 38. During the internal monitoring, interviews have been carried out with the farmers and physically relocated APs. The APs confirmed that they are aware of their entitlements and eligibility for compensated impact, as well as about the GRM procedures of presenting of complaint at all accessible level as a result of numerous phone discussions during SDDR-CAP implementation period. The APs felt satisfied with the resettlement process implementation which was related to the adequate and sufficient amount of compensation. The highest level of satisfaction from the Project was observed among the physically relocated AHs to each of them 0.06 ha land plots was allocated by Khokimiyat despite of the fact that in some cases 2 or 3 AHs were living in 1 house under the same roof. This was considered by APs as a development of their living standards. The provided compensation was sufficient to build completely new houses with more spacious rooms and with better living conditions that they had before. The APs satisfaction was confirmed by the written statements attached in Annex 5. 39. As a result of monitoring, based on above presented findings, the SDDR-CAP has been satisfactory and effectively implemented in accordance with SDDR-CAP provisions, requirements of ADB SPS 2009 and the consent of APs.
