Re: Request for Temporary Waiver of Installation of CAP-compliant EAS Equipment

Dear Ms. Dortch:

On behalf of Port St. Lucie Broadcasters, Inc., licensee of Stations WPSL, Port St. Lucie, , and WJNX, Ft. Pierce, Florida; and Broadcasters, Inc., licensee of Station WSTU, Stuart, Florida (collectively, the owners of these commonly-held stations are referred to as the "Licensees"), it is respectfully requested that the Commisison grant the Licensees a temporary waiver of the June 30, 2012, deadline for the installation of CAP-compliant EAS equipment, as the equipment ordered has not yet been delivered.

The Licensees initially ordered the necessary equipment from Broadcasters General Store ("BGS"), their regular broadcast equipment vendor, in late April, 2012, and were promised a delivery date around mid- to late May, which would have afforded ample time for the installation and testing necessary to begin using the equipment before the installation deadline.

When delivery had not occurred within the time frame proposed, the Licensees again contacted BGS, and were advised by the vendor's staffthat the original order could not be found and had apparently been misplaced along with a number of other orders placed at or about the same time as the Licensees'. A new order was immediately placed with BGS on May 23, 2012, at which time the vendor advised the Licensees that the equipment was "back-ordered" and would not likely be delivered until approximately mid- to late July, 2012. BGS offered to expedite the order as much as possible since the original order had been lost. The Licensees also contacted another vendor with which they have done business in the past, BSW in Seattle, Washington, and they were told that the equipment was "back-ordered" there as well. The second order was left with BGS, as its promise to expedite and proximity to the Florida stations permitted over-night delivery once the equipment was received by the vendor.

Although the Licensees have learned that some orders have been recently fulfilled by BGS, it is apparent that the stations owned by the Licensees will not be able to meet the CAP requirements by June 30, 2012. Accordingly, it is respectfully requested that the Commisison grant the Licensees a temporary two month waiver of the installation deadline, through August 31, 2012. The Licensees will advise the Commission as soon as the equipment is delivered, installed, and operating correctly.
