MATTER BEFORE THE PLANNING COMMISSION: Preliminary Plat and Final Plan Elk Creek Condominiums at Grand Park, Planning Area 4W

ACTION REQUESTED: The applicant, Grand Park Development LLC., is requesting Preliminary Plat and Final Plan approval of Elk Creek Condominiums at Grand Park. This is being proposed under our existing code as we received the application prior to the effective date of the new Land Development Code which is May 5th, 2018.

BACKGROUND: This subdivision application is being processed as a Major Subdivision in accordance with Section 17- 5- 10 of the Fraser Municipal Code. The purpose of a major subdivision plat is to divide one ( 1) or more lots or parcels of land into a total of five ( 5) or more lots or five ( 5) or more dwelling units.

www.frasercolorado. com According to the Final Plan narrative, the applicant is proposing to create 7 condominium buildings with 12 units in each building, for a total of 84 units on 9. 2 acres. The Final Plan is being processed per our Planned Development District ( PDD) Ordinance. The Grand Park PDD, Reception # 2005- 012709 is included in the packet. This planning area is 4W and the PDD allows for an average density on 9. 3 units per acre, 100 attached residential units and 105, 800 square feet ( SF) of commercial. The Land Use and Development Notes on sheet 3 of 11 of the PDD state the following: " 4W is approximately 11. 2 acres situated along Old , south of the Fraser Valley Center, adjacent to the 5- acre inholding parcel and adjoining Elk Creek meadow. Planned for commercial site planning considerations include its relationship to Old Victory Road." The development standards suggest a mixed- use land use, with a 45' height maximum, 10' front yard setback, 6' side yard setback, 10' rear yard setback and 10% open space requirement.

Staff received the following comments from Rod McGowan, Town Attorney: 1. The proposed condo project includes parcels previously subdivided on the Elk Creek Filing 1 plat. Specifically, the median area of Elk Ranch Road was identified as Tract G on the Filing 1 plat and is shown as Tract A on the new Final Planned Development Plan FPDP). Tract J shown on the Filing 1 plat is not shown on the new FPDP but would be part of Lot 3. The FPDP recorded with Filing 1 showed this as a site for a detention pond.

2. Note 13 on the FPDP should be deleted. This is not a development permit. The condominium final plat is what allows development to proceed.

3. There could be an overlap with the area included in the " North Retail" development permit application.

4. It has been called to our attention that the draft preliminary plat and FPDP do not appropriately reflect an existing 35- foot access and utility easement to the Sumrall

That easement is referred to in the Title Insurance Commitment under Exception # 15, with reference to the instrument recorded at Reception # 94007475 copy attached to briefing). All subdivision plats must include the location, dimensions and recording information for existing easements. Please have your surveyor revise the preliminary plat and FPDP to incorporate the existing access and utility easement.

Staff offers the following comments: 5. As referenced above, this is not a development permit so general notes 11- 13 on the Final Plan sheet 1 of 8 need to be deleted.

6. The site plan chart on the Final Plan sheet 3 of 8 parking calculations appear to meet Town Code. Label/ number garage and parking spaces to ensure required parking is indicated on site plan.

7. CDOT is requiring a traffic study. See email correspondence from Dan Roussin, CDOT Permit Unit Manager for Traffic and Safety.

8. Section 17- 5- 40 lists additional Preliminary Plat requirements for condominiums, townhomes and apartments. Revise plat and plat notes ( 10- 12) accordingly.

Other review comments are in the packet, including Town Engineer, Tim Gagnon; CDOT, Dan Roussin; Grand Fire Protection District No. 4, Dennis Soles; Steve Sumrall, adjacent property owner.

RECOMMENDATION: Pending any issues that may arise at the public hearing, staff recommends approval of this Preliminary Plat and Final Plan with conditions. We will prepare a resolution based on the conditions listed above.
