    (Slip Opinion) Testimonial Immunity Before Congress of the Former Counsel to the President The immunity of the President’s immediate advisers from compelled congressional testimony on matters related to their official responsibilities has long been recognized and arises from the fundamental workings of the separation of powers. This immunity applies to former senior advisers such as the former White House Counsel. According- ly, the former Counsel is not legally required to appear and testify about matters relat- ed to his official duties as Counsel to the President. The President does not waive an adviser’s immunity from compelled congressional testimony by authorizing disclosure of any particular information. The disclosure’s impact on executive privilege does not ultimately bear on any underlying immunity from compelled testimony. Because Congress may not constitutionally compel the former Counsel to testify about his official duties, he may not be civilly or criminally penalized for following a presiden- tial directive not to appear. The same rationale applies equally to an exercise of inher- ent contempt powers against a senior aide who has complied with a presidential direc- tion that he not provide testimony to a congressional committee.     The 'Culture Wars' Reloaded: Trump, Anti-Political Correctness and the Right's 'Free Speech' Hypocrisy Dr. Valerie Scatamburlo-D'Annibale University of Windsor, Windsor, Ontario, Canada Abstract This article explores how Donald Trump capitalized on the right's decades-long, carefully choreographed and well-financed campaign against political correctness in relation to the broader strategy of 'cultural conservatism.' It provides an historical overview of various iterations of this campaign, discusses the mainstream media's complicity in promulgating conservative talking points about higher education at the height of the 1990s 'culture wars,' examines the reconfigured anti- PC/pro-free speech crusade of recent years, its contemporary currency in the Trump era and the implications for academia and educational policy. Keywords: political correctness, culture wars, free speech, cultural conservatism, critical pedagogy Introduction More than two years after Donald Trump's ascendancy to the White House, post-mortems of the 2016 American election continue to explore the factors that propelled him to office. Gabrielle Adjerad In light of what has been institutionalized in the nineties as “intersectionality” (Crenshaw, 1989), but emanated from a long tradition of feminism fostered by women of color (Hill-Collins, Bilge, 2016), feminist theory has increasingly shed light on the plurality of women’s experiences, the inseparable, overlapping and simultaneous differences constituting their identities, and the materiality of the various dominations engendered. At the turn of the twenty-first century, this paradigm seems compelling to address fictional diasporic narratives addressing the diverse discriminations encountered by migrant women and their descendants in the United States. However, adopting an intersectional feminist approach of literature, for research or in the classroom, raises methodological issues that this paper contends with. Some thinkers have considered the double pitfall of considering, on the one hand, the text as a mimetic document of plural lives and, on the other, of essentializing a symbolical “écriture feminine” (Felski, 1989). Some have highlighted the necessary critical movement between the archetypal dimension of gender and the social and historical individuals diversely affected by this ideology (De Lauretis, 1987). Yet, beyond this tension between an attention paid to abstraction on the one hand and experience on the other, we can consider that hegemony is made of different ideologies that may contradict one another (Balibar, Wallerstein, 1991).

    The People Shaping the Trump Administration Despite Running on a Pledge to ‘Drain the Swamp’ and Crack Down on Special Interests, Donald Trump Has Filled His Transition Team With Lobbyists and Others With Potential Conflicts November 16, 2016 – Donald Trump rode to the White House by raging about alleged rampant corruption in Washington and pledging to “drain the swamp.” Each of the five points in the ethics platform he issued in October focused on diminishing the influence of lobbyists.1 These included a promise to impose a five-year ban on former executive branch officials lobbying the federal government. Trump further promised to crack down on special interest-influence by expanding the definition of lobbyist to include consultants and others who trade on inside government information and expertise.2 But Trump’s nascent transition team, which will shape his administration, is swarming with lobbyists and other special interests. Many of the lobbyists are working for the transition on areas for which they currently are lobbying the federal government. Meanwhile, many of those who aren’t lobbyists appear to have potential conflicts of interest. Vice president-elect Mike Pence reportedly said on November 15 that the transition team would be purged of lobbyists, but the transition team has not made the point official.3 Even if true, that remedy would not address cases such as a defense contractor working on defense interests, or a lawyer for health care interests working on health care reform.
