CREATION OF DISTRICT DIVISIONS AND ESTABLISHMENT OF COURTS FOR SUCH DIVISIONS: MAGISTRATES' COURTS ACT, 1944

Under section 2 of the Magistrates' Courts Act, 1944 (Act 32 of 1944), and upon report of the Public Service Commission referred to in section 3(3) of the said Magistrates' Courts Act, 1944, I hereby-

(a) create the district divisions consisting of the number of districts as set out in column 2 of the Schedule, and declare the name by which such district division shall be known, which name is set out in column I of the Schedule opposite to each such district division; 2 Government Gazette 17 February 1994 No. 799

(b) appoint the places as set out in column 3 of the Schedule opposite each such district division, as a place within such district division for the holding of a court for such district division;

(c) specify one place as set out in column 4 of the Schedule opposite each such district division, in addition to the places as aforesaid, as the seat of the magistracy for the holding of a court for that district division;

(d) establish a court for each such district division; (e) repeal Government Notice 93 of 1986, and any amendments thereof; and

(f) determine 28 February 1994 as the date of coming into operation of this Government Notice.

MINISTRY OF JUSTICE No. 23 1994 REDEFINITION OF THE LOCAL LIMITS OF DISTRICTS AND CREATION OF NEW DISTRICTS IN NAMIBIA: MAGISTRATES' COURTS ACT, 1944

Under section 2 of the Magistrates' Courts Act, 1944 (Act 32 of 1944), I hereby- (a) redefine the local limits of the districts referred to in column I of the Schedule as set out in the annexure referred to in column 2 of the Schedule opposite each such district;

(b) declare that such districts shall from the date of coming into operation of this notice be known by the name set out in column 3 of the Schedule opposite each such district;

(c) establish a court for each such district; (d) appoint the places set out in column 4 of the Schedule opposite each such district as places for the holding of a court for such district, and where more than one place is appointed, specify in the said column 4 one place as the seat of magistracy; (e) appoint the places set out in column 5 of the Schedule as places for the holding of a periodical court, and prescribe as set out in the annexure referred to in column 6 of the Schedule opposite each such place the local limits within which such periodical court shall have jurisdiction;

(f) detach as a subdistrict the portions of a district as set out in the annexure referred to in column 7 ofthe Schedule to form the area of jurisdiction of a detached court, and declare that such subdistrict shall be known by the name set out in column 8 ofthe Schedule opposite each such subdistrict;

(g) annex for court purposes - (i) to the district of Rehoboth, that part of the district of Windhoek as set out in the annexure referred to in column 6 of the Schedule and which has been included in the local limits of the periodical court at Nauchas; (ii) to the district of Mariental - (aa) that parts ofthe districts of Rehoboth and Windhoek as set out in the annexure referred to in column 6 of the Schedule and which have been included in the local limits of the periodical court at Kalkrand; and

(bb) that part ofthe district of Windhoek as set out in the annexure referred to in column 6 of the Schedule and which has been included in the local limits of the periodical court at Derm; and No. 799 Government Gazette 17 February 1994 5

(iii) to the district ofOndangwa, that part of the district ofTsumeb as set out in the annexure referred to in column 6 of the Schedule and which has been included in the local limits of the periodical court at Okatope; (h) repeal Government Notices 1148 of 1972 and 2428 of 1972, and any amendments thereof; and (i) determine 28 February 1994 as the date of coming into operation of this Government Notice.
