FAYETTEVILLE ACADEMY Offering exceptional opportunities since 1970

March 3, 2017

Fayetteville Academy Family and Friends,

I would like to welcome all of you to our Auction 2017 - "Down the Stretch." Once again, we are excited to be hosting this important, biennial event, and we hope you enjoy a wonderful night of derby-themed fundraising and "friend-raising."

Whether you are interested in the silent auction, tuition raffle, live auction, wonderful food and drink, or just great company and spirit, there should be many ways to make your evening memorable.

This event would not have been possible without the incredible dedication of time and leadership from our 2017 auction chair, Christy Combs, the hard work of Sonya Bruffey and Emily Schaefer, the time and talents of countless committee chair volunteers, and all of our sponsors and donors. We thank every one of you for the work you have done and for the generosity you have shown to make this night such a special one for our school.

Thank you again for your support, and I hope you have a great time at the auction. It's derby time at Fayetteville Academy, and down the stretch they come!

Sincerely,

Ray Quesnel Head of School

Rules Governing the Auction

1. You will be able to view all auction items and begin placing bids on Silent Auction items at 6:00 p.m. 2. The check-out table will be open all evening. Your credit card may be processed at the check-out table throughout the entire evening. Payment in full on the evening of the auction is required and may be made by cash, check, MasterCard, or Visa. 3. All sales are final. There can be no exchanges or refunds from donors or from Fayetteville Academy. Unless otherwise specified, all auction items and services must be used within one year after the date of the auction. Unless otherwise specified, dates and times are to be arranged at the mutual convenience of the donor and the buyer. 4. The Auction Committee has endeavored to catalog and describe the items and services correctly, but every item is sold “as is.” Certain auction items and/or services may have restricted use or other qualifications which may affect value. For example, the vacation homes and condominiums may have specific dates to be used and are non-transferable. Also, security and cleaning deposits, when required by the donor, must be paid directly to the donor and are not included in your bid. Purchasers are bound by the precise restrictions specified by the donors. The terms are not negotiable. Please read carefully any specifications or limitations. 5. The Auction Committee makes no express or implied warranties or representation of any kind or nature with respect to property or services, and in no event shall it be responsible for the accuracy of description, genuineness, authenticity, or condition of the property or services. No statement in this program, bill of sale, invoice, or statement made at the time of the sale shall be deemed as a warranty or representation or as assumption of liability. By one’s purchase, the buyer waives any claims for liability against either Fayetteville Academy or the donor of the property or services, and neither Fayetteville Academy nor the donor is responsible for any personal injuries or damages to property that may result from utilization of property or services sold. 6. Values set forth for auction items are estimates of retail value. Fayetteville Academy does not warrant any value for general or tax purposes. 8

Live Auction 1. You will find bid paddles placed around the room. To enter a bid, the bidder must attract the attention of the auctioneer by raising his bidding paddle. Each bid legally obligates the bidder to pay his bid price in full at the end of the evening if the auctioneer has deemed his bid to be the high bid at the fall of the auctioneer’s gavel. 2. The high bidder will be acknowledged by the auctioneer. The recorder will record the high bidder’s number and bid amount, which will be held by the cashier for check-out. 3. The auctioneer retains the right to announce the conditions of sale for any item. If the auctioneer determines that an opening bid or any subsequent bid is non-commensurate with the value of the item offered, he may reject the same and withdraw the item from sale. There may be a minimum bid on some items. The auctioneer shall be the sole and final arbiter of any dispute.
