In addition, Fidelity filed a separate case to allow flaring specifical- ly for the Pavel well in Zenith field. In its application, the company said due to the location of the well and low volumes of gas produced from the Pavel 14-23H well, it is economically infeasible to con- nect to a gas gathering facility, there is no market for the gas and equipping the well with an electrical generator to produce electricity from the gas is not economical- ly feasible. XTO Energy has submitted an applica- tion to allow flaring for wells in northwest Mountrail County. It also requests unre- stricted production of oil from wells until those can be connected to gas gathering infrastructure. The 15 applications to allow flaring come just days before a new policy becomes effective on June 1 to require gas capture plans with each drilling applica- tion in an effort to reduce flaring in the state. NDIC is expected to vote on new field rules on July 1 that would set up potential production curtailment in order to bring flaring under control and hit the 90 percent capture target by the year 2020. Continental given more time to gather gas volumes Continued from last month’s hearing, Continental Resources is submitting applications with the commission request- ing an order that determines the amount of royalties and taxes owed on the natural gas flared from numerous Williston Basin wells. Under NDIC rules, operators can flare the gas from its wells for one year and be exempt from paying royalties and taxes during that time. However, when that period is over, the operator must pay them. Continental determined a number of its wells have flared beyond the one- year period and is asking the commission to determine the volumes and value of the gas flared so it can pay the appropriate royalties and taxes. At the April hearings, Continental had information on the gas volumes for many of its wells, but not all, so the commission asked for each case to be continued to the May hearings to allow Continental time to gather the information for every well. The commission felt once all the information was presented, the cases could likely be consolidated. l PETROLEUM NEWS BAKKEN • WEEK OF MAY 25, 2014 7

North Dakota Bakken oil production by company March 2014

Derived from the preliminary March 2014 Oil & Gas Production Report published by the North Dakota Industrial Commission, Department of Minerals’ Oil and Gas Division. Note this is the oil produced by wells operated by these companies; it does not identify the percentage of oil LEGEND from the Bakken petroleum system (including Bakken, Three Forks, Pronghorn, Sanish, etc.) that is owned by each company AND it does not Field – pool – county – total monthly oil production. include production from wells operated by others, in which these companies might hold an interest. It also does not include Bakken system Monthly total for all fields. oil production from wells on confidential status. Consequently, it usually differs from what each company reports for production. The daily Daily average for all fields. average for the individual companies was derived from dividing the total production by the number of days in -ARCH, versus the numberof Numbers represent barrels of oil days wells were actually producing and rounded to the nearest whole.

The operator names used in this chart are exactly as they appear in the Oil and Gas Division records, but some of the companies and/or their Bakken assets might be owned by others. The ones we have identi- fied include Burlington Resources Oil & Gas Company, LP, which is owned by ConocoPhillips; Fidelity Exploration & Production, owned by MDU; HRC Operating, owned by Halcon Resources; Mountain Divide, owned by Mountainview Energy; Oxy USA, owned by Occidental Petroleum; Samson Resources Company, owned by KKR & Co.; and XTO Energy, Inc., owned by ExxonMobil. This chart contains initial production rates, or IPs, for active wells that were filed as completed with the state of North Dakota from May 13-19, 2014 in the Bakken petroleum system, which includes formations such as the Bakken and Three Forks. The completed wells that did not have an available IP LEGEND rate (N/A) likely haven’t been tested or were awarded confidential (tight-hole) status by the North Dakota Industrial Commission’s Department of The well operator’s name is on the upper line, followed by individual wells with Minerals. This chart also contains a section with active wells that were released from confidential status during the same period, May 13-19.
