REGULATION FOR SURVEY AND PROCESSING OF SURVEY DATA

I. GENERAL PROVISIONS

Article 1 This Regulation prescribes the manner of carrying out the survey, the form and the content of the geodetic reports for the conducted survey, the form and the content of the statement for identification and the manner of processing of data for the real estate subject of survey. Article 2 Real estate survey and processing of data from survey is carried out at the state coordinate system.

REAL ESTATE SURVEY

Purpose of the survey

Article 3 (1) Real estate survey is done for the purpose of systematic registration of real estate rights, sporadic registration of real estate rights, registration of unregistered rights in the established real estate cadastre and in a service of maintenance of real estate cadastre. (2) Real estate survey in a service of systematic registration of real estate rights shall be done ex officio, and the survey in a service of sporadic registration of real estate rights, registration of unregistered rights in the established real estate cadastre and in a service of maintenance of real estate cadastre, is done at client‟s application. (3) Geodetic report shall be prepared for the conducted real estate survey referred to in paragraph (1) of this article.

Methods of conducting real estate survey

Article 4 (1) Real estate survey generally is conducted by the following numerical methods: - polar method; - Method of global satellite positioning – GNSS (Global Navigation Satellite System) method; - aero photo-grammetry method; Official Gazette of RM, No 28 dated 4.3.2011

(2) As exception of paragraph (1) of this article, the real estate survey can be conducted by combination of methods under paragraph (1) of this article, or can be conducted survey from known detailed points: - measuring tape with at least three measurements; - X-axis measuring; or - measuring in the extension of the line.

Data collection from legal basis

Article 5 During the survey shall be collected data for the real estate and for the real estate right holders, contained in the attached legal basis presented on inspection by the client, and number and date of the legal basis.

Data used in the real estate survey

Article 6 Depending on the type of geodetic report, the following data shall be used for the real estate survey: - coordinates of points of the geodetic basis; - coordinates of detailed points; - a copy of the cadastre map; - a copy of photo sketch; - a copy of the sketch of cadastre parcel survey; - a copy of orthophoto map; - photocopy of sketch of survey of inner surface of a building, separate part of a building and another object; - property/possession list; - list of indications for cadastre parcels; - other data.

Manner of conducting real estate survey

Article 7 The real estate survey shall be conducted in a manner of acquisition of spatial and descriptive data for cadastre parcels and for buildings, separate part of buildings and another object.

II. CADASTRE PARCEL SURVEY

Data for cadastre parcels subject of survey

Article 8 The cadastre parcel survey is a procedure of acquisition of spatial data for the borderlines of the cadastre parcel and for the footprint of the building, and descriptive data for: place , street and house number, manner of land use, cadastre class and Official Gazette of RM, No 28 dated 4.3.2011

indications for the cadastre parcel right holder (name and //address/registered seat and EMBG (unique identification number for citizens)/ EMBS (identification number for companies).

Article 9 (1) For the performed survey under article 8 of this regulation, a sketch of survey of the cadastre parcel shall be prepared in approximate scale on which the borderlines of the cadastre parcel and the footprint of the building are drawn, and following data are entered: number of cadastre parcel, number of building at the parcel, place name/street and house number of the real estate, manner of land use and cadastre class of the land. (2) At the preparation of sketch of survey of paragraph (1) of this article, the existing cadastre situation is presented in black color, and the emerging changes are presented in red color. (3) The identified differences, i.e. discrepancies of the spatial data for the real estate collected with the survey, with the data comprised in the legal basis and in the existing cadastre records, that are greater than the acceptable differences of article 146 of the Law on real estate cadastre, are drawn on the sketch from paragraph (1) of this article in purple color with broken line. (4) Sketch from the survey from paragraph (1) of this article shall be prepared in electronic and printed form, and is integral part of the geodetic report for real estate survey. (5) The form and the content of the sketch for survey of cadastre parcel are given in Appendix no. 1 which is integral part of this regulation.

Survey of borderlines of cadastre parcel

Article 10 (1) The survey of the border lines of the cadastre parcel is performed by measuring the breaking points which define the cadastre parcel. (2) At the survey of curved border lines, an approximation shall be done with polygon of tendon. The maximum deviation between the curve line and the tendon shall not be greater than 0.02mm*M where M is the denominator of the scale of mapping. (3) At the survey of long straight lines, shall be measured detailed points that are at mutual distance not longer than 50 meters and all the characteristically vertical breaking points. (4) Border line of a road, railway, canal and artificial lake shall be measured by selection of detailed points according to the completed marking of the expropriation line. (5) At the survey of high demarcation as a border line between cadastre parcels, shall be measured detailed points of the upper and lower side of the demarcation, which shall be determined by the right holders of the neighboring cadastre parcels. (6) When the footprint of a building is borderline or part of a borderline of cadastre parcel, the border of the cadastre parcel shall be measured to the footprint of the building or to the eaves of the building, which shall be determined by the real estate right holders. Survey of footprint of building

Article 11 (1) Footprint of a building is the tangent line of the building with the land. (2) Collecting spatial data for the footprint of the building shall be done with at least two detailed points from the footprint of the building that enables constructing the shape of the building. Detailed points with the lines that show the shape of the building shall be drown on a sketch for survey as per article 9 of this regulation. (3) Buildings under a same roof which represent a separate whole, separated by special vertical walls from the foundation to the roof shall be measured separately. (4) The use of the building, i.e. separate part of the building shall be presented on the sketch of survey from article 9 of this regulation by entering an appropriate topographic sign.

Survey of consoles, passages and other objects

Article 12 (1) Consoles over the buildings over the foundation larger than 0.5*М, where M represents denominator of the scale of mapping, shall be displayed with broken line on the sketch of survey from article 9 of this regulation. (2) Facilities that are not constructed of a solid material (concrete, brick, wood, metal-glass etc.) and are not placed on stable foundations (smaller pavilions, kiosk, eaves, roosts, sheds, outhouses and other constructions of fragile material) shall not be subject of survey. (3) Passages in buildings shall be displayed on the sketch of survey with broken line. (4) Silos, pools and overhead reservoirs, as well as greenhouses, farms and ancillary facilities in agriculture shall be measured and drawn on the sketch of survey from article 9 of this regulation. (5) Temporary objects set on the basis on an approval shall be measured and drawn on the sketch of survey from article 9 of this regulation.

Measuring fronts

Article 13 (1) During the survey of cadastre parcels, on the spot with measuring tape shall be measured the lengths between the detail points (fronts and admeasurements) and shall be displayed on the sketch of survey from article 9 of this regulation. (2) During the survey of footprints of buildings, for the purpose of construction and control all fronts shall be measured and are displayed in centimeters accuracy on the sketch of survey from article 9 of this regulation. (3) In the survey of line facilities the fronts shall not be measured. (4) Slanting measured lengths of the field shall be drawn on the sketch of survey from article 9 of this regulation, i.e. on the photo sketch with sign (k), and their reduction on the horizon shall be drawn in red color under the slanting measured length.

Survey of rivers and lakes

Article 14 (1) During the survey of border lines of a river or a stream, as border lines of the cadastre parcels shall be selected detail points of the upper side of the steep bank of both sides of the water flow. (2) Lakes shall be measured by selection of sufficient number of detail points on the edge of the water mirror and the line of expropriation.

Survey of roads

Article 15 (1) Survey of roads includes survey of roadway, bridges and entrances in tunnels. (2) Survey of railroads includes survey of middle line between the two rails, bridges and entrances in tunnels. (3) Survey of airports includes survey of take off – landing runways. (4) On the survey sketch form article 9 of this regulation for the survey of roads, shall be recorded the type, marking of the road and final destinations of the traffic facility.

Survey of canals, aligned river beds, pools and ponds

Article 16 (1) During the survey of canals the two edges of the constructed part of the canal, bridges, aqueducts and entrances in tunnels shall be recorded. (2) Natural and aligned river beds shall be surveyed with detail points on the two edges of the constructed part of the alignment. (3) Canals and pits narrower than 0.5*M where M is the denominator of the scale of mapping, shall be measured with one point of the middle of the object. (4) During the survey of ponds and pools the edges of the object shall be recorded. (5) During the survey from paragraph (2) of this article, in the sketch of survey from article 9 of this regulation shall be registered the name of the natural and aligned river beds and the direction of the flow shall be marked.

Survey of borderlines of the manner of use of the land

Article 17 (1) Borderlines for the manner of land use shall be surveyed according to the actual situation on the spot and for each limited area of the land, by one way of land use a separate cadastre parcel shall be established. (2) Borderlines for the manner of land use from paragraph (1) of this article shall be drawn on the sketches of survey from article 9 of this regulation, and the cadastral culture shall be marked in a circle with the following abbreviations.

II.2. SURVEY OF BUILDINGS, SEPARATE PARTS OF BUILDINGS AND OTHER OBJECT

Data on buildings, separate parts of buildings and other objects subject of survey

Article 18 During the survey of buildings, separate parts of buildings and other objects shall be collected spatial and descriptive data on the buildings, separate parts of buildings and other objects (silos, pools, overhead reservoirs as well as greenhouses, farms and ancillary facilities in the agriculture and more).

Acquiring spatial and descriptive data

Article 19 (1) For buildings, separate parts of buildings and other objects, shall be acquired: - descriptive data on the right holders; - descriptive data for the number of cadastre parcel where the building, separate part of building or other object is located; - descriptive data for the address (street and number of the building); - descriptive data for the number and use of the building; - descriptive data for the entrance, number of floor of the separate part of the building, number of the separate part of building, and data for the use of the separate part of the building; - data on the inner surface of the separate part of the building. (2) For other objects (silos, overhead reservoirs pools and more) for which can not be acquired data for the inner surface, along with the descriptive data on the right holders shall be acquired descriptive data for the volume of the objects.

Use of the building and other objects

Article 20 Depending on the use, buildings and other objects shall be marked as buildings for: Housing: A0 - housing in residential houses with special regime A1 - housing in residential houses A2 - housing in residential buildings A3 - group housing A4 - temporary accommodation

Use of separate parts of buildings

Article 21 (1) Depending on the use, separate parts of buildings and other objects shall be marked as: AP - apartment AS- ancillary spaces (terraces, balconies) A - ancillary object G - garage Official Gazette of RM, No 28 dated 4.3.2011

BP - business premises CS - corridors with stairs EL - elevator OCP - other common premises. (2) Data on the use of the building, separate part of a building and other objects, shall be obtained during the survey by inspection on the site and inspection in the legal basis document for registration, i.e. the act of the competent authority.

Method of survey of inner surface in the service of sporadic registration, registration of real estate with unregistered rights and registration in the maintenance of the real estate cadastre

Article 22 (1) Survey of inner surface of building, separate parts of buildings and other objects in the service of sporadic registration, registration of real estate with unregistered rights and registration in the maintenance of the real estate cadastre, shall be performed by measuring from wall to wall, with accuracy in centimeters and by calculating the surfaces according to regular geometric figures. (2) Data on the inner surface of terraces, balconies shall be obtained by measuring of their base. (3) During measurement from paragraph (1) and (2) of this article shall be also obtained data from the legal basis.

Method of survey of inner surface of buildings, separate parts of buildings and other objects without legal basis, in the service of systematic registration

Article 23 (1) Inner surface of buildings, separate parts of building and other objects without legal basis in the service of systematic registration shall be attained in the manner that the surface of the base of the building or the other object shall be multiplied by a factor of 0.75 for each floor separately. (2) In the case of paragraph (1) of this article for the acquired inner surface shall not be prepared a sketch of survey of inner surface of building, separate part of building or other object, but the data for the inner surface shall be recorded in the inventory list.

Method of survey of inner surface of buildings and other objects that are recorded in the land cadastre in the service of systematic registration

Article 24 (1) During the survey in the service of systematic registration of real estate rights, the inner surface of buildings and other objects recorded in the land cadastre shall be attained in the way that the surface of the base of the building or the other object shall be multiplied by a factor of 0.75 for each separate floor. (2) In the case of paragraph (1) of this article for the attained inner surface shall not be prepared a sketch of survey of inner surface of building, separate part of building Official Gazette of RM, No 28 dated 4.3.2011

or other object, but the data for the attained inner surface shall be recorded in the inventory list. (3) If the surface of the base of the building or other object from paragraph (1) of this article does not correspond entirely to the surface recorded in the land cadastre, the surface of the base of the building which is in discrepancy with the recorded one in the land cadastre, shall be separately multiplied by a factor of 0.75, whereas the data on the bases and for the attained surfaces shall be displayed i.e. entered in the sketch of survey of inner surface of a building, separate part of building or other object, and in the inventory list.

Method of survey of inner surface of buildings and other objects with/without legal basis in the service of systematic registration

Article 25 (1) Data on the inner surface of building, separate part of building or other object for which legal basis for registration exists, during the survey in the service of systematic registration of real estate rights shall be attained in a way that the same are undertaken from the legal basis for registration and entered in the inventory list, whereas sketch for survey of inner surface of building, separate part of building or other object shall not be prepared. (2) For the part of the building and other object which is identified that is in discrepancy with the legal basis for registration, the inner surface shall be acquired in a way that base of the part of the building and the other object which differs shall be multiplied by a factor of 0.75 for each floor separately. Data for the bases and for the surfaces shall be displayed i.e. entered on the sketch for survey of inner surface of building, separate part of building or other object and in the inventory list.

Determining the floors of the building

Article 26 (1) When determining the number of the floor of the separate part of a building, as a floor shall be also considered the ground floor. (2) Buildings and separate parts of building located under the level of the basement, shall be marked with ordinal number with negative algebraic sign starting from basement -1. Obtained data for the floors in the building shall be entered with short title. (3) The form and the content of the full title and abbreviations of the floors in the building are given in appendix no. 2 which is integral part of this regulation.

Article 27 (1) Data on the inner surface of building, i.e. separate part of building or other objects obtained by the survey that refer to the same real estate right holder, as well as the Official Gazette of RM, No 28 dated 4.3.2011

data for the volume of silos, pools and overhead reservoirs shall be displayed on the sketch of survey of inner surface/volume of building, separate part of building and other object, whereby these data shall be arranged according to the use, entrance and floor. (2) On the sketch from paragraph (1) of this article the part from the inner surface for which legal basis does not exist, shall be separated and drawn in purple color.

Preparation of sketch of survey of inner surface of buildings, separate parts of buildings and other objects

Article 28 (1) Sketch of survey from article 24 of this regulation shall be prepared in electronic and printed form and is integral part of the geodetic report from the survey. (2) The form and the content of the sketch of survey of inner surface of buildings, separate parts of buildings and other objects are given in appendix no. 3 which is integral part of this regulation.

Obtaining descriptive data during the survey of buildings, separate parts of buildings and other objects

Article 29 During the survey of buildings, separate parts of buildings and other objects the following descriptive data for the real estate right holders shall be obtained: identification number for citizens or companies (EMBG/EMBS), name and surname/title and address of residence (street and house number/registered seat) based on the data from the ID, i.e. decision for registration or other document for establishing the identity of the real estate right holder.

II.3. CLASSICAL SURVEY WITH POLAR METHOD

Data for the survey with polar method

Article 30 (1) Survey with polar method shall be carried out from the geodetic basis. (2) For obtaining coordinates of detail points during the survey with polar method the following data shall be used: - number and coordinates of the cellular point; - height of the instrument; - number and coordinates of points of orientation; - height of the signal of the point of orientation in case when using one point of orientation; - number of detail point; - horizontal direction to the detail point; - vertical angle to the detail point ; - slanting length to the detail point; - height of the signal of the detail point.

Manner of conducting survey with polar method

Article 31 (1) During the survey using polar method orientation of at least two points of the geodetic basis shall be taken. (2) The difference between the horizontal direction among the first and second position at horizontal view, shall not be bigger than 20. (3) The maximum length to the detail point shall not be bigger than 350m. (4) On every 100th detail point control orientation shall be taken. (5) By the completion of measurements of cellular point, final view shall be taken. (6) Numbering of detail points is unique for the area subject of recording.

Ancillary points of geodetic basis

Article 32 (1) When survey of the detail can not be performed from the points of the geodetic basis, may be determined up to two additional points for the purpose of survey. (2) Additional points shall be determined from known points of the geodetic basis, by measuring the horizontal directions, vertical angles in two gyri and slanting length.

II.4. SURVEY WITH GNSS METHOD

Ways of GNSS positioning

Article 33 (1) Real estate survey by applying the method of global satellite positioning (hereinafter GNSS method) shall be performed in one of the following ways: - kinematic positioning in real time (hereinafter RTK (Real Time Kinematic)) and - kinematic positioning with additional data processing (hereinafter PPK Post Processing Kinematic)).

RTK way of positioning

Article 34 (1) RTK positioning when performing real estate survey can be performed: - by classical RTK positioning ( base-rover) and - by network RTK positioning.

Classical RTK positioning

Article 35 (1) Real estate survey applying classical RTK positioning shall be done with at least two GNSS devices, with appropriate antennas, one of which during the survey is static (base) and the other is mobile (rover). (2) GNSS devices from paragraph (1) of this article shall be of geodetic type, dual-frequency with possibility for simultaneous reception of signals from at least four satellites. (3) During real estate survey with classical RTK positioning, the maximum length of the vector base-rover shall be lesser or equal to 5 kilometers and the achieved accuracy of RTK positioning in the global coordinate system (3D accuracy) shall be lesser or equal to 0.05 meters, and it shall be recorded in the list of coordinates of detail points in the geodetic report. (4) In case when the static GNSS device (base) is set on unknown point, the same shall be determined by at least three known geodetic points.

RTK network positioning

Article 36 (1) MAKPOS (Macedonian positioning system) is a system of the Agency for real estate cadastre and is unique system of permanent GNSS stations in Republic of Macedonia which may be used for performing geodetic works within the scope of activities of Agency for real estate cadastre. (2) By using the services of MAKPOS system shall be determined coordinates of points in the ETRS89 system (European Terrestrial Reference System 1989) epoch 1989.0. Article 37 (1) Real estate survey applying RTK network positioning (using MAKPOS RTK service) shall be performed with one GNSS device (rover). (2) GNSS device from paragraph (1) of this article shall be of geodetic type, dual- frequency, with possibility for simultaneous reception of signals of at least four satellites. (3) When applying RTK network positioning, for the purpose of obtaining flat solution, mandatory shall be used network adjustment obtained from the MAKPOS system. (4) The accuracy of RTK network positioning in the global coordinate system (3D accuracy) shall be lesser or equal to 0.05 meters, and it shall be recorded together with the list of coordinates of detail points, enclosed to the geodetic report.

PPK way of positioning

Article 38 (1) Real estate survey applying PPK positioning shall be performed according to the same methodology as the RTK positioning, whereby the results from measurements are not achieved in real time, but in additional data processing, after performed measurements. (2) GNSS device which are applied during the PPK positioning shall be of geodetic type, single-frequency or dual-frequency, with possibility for simultaneous reception of signals from at least four satellites. (3) Criteria for accuracy at PPK positioning are the same as for RTK positioning, and they are defined in article 31 paragraph (3) of this regulation.

Transformation of coordinates

Article 39 (1) At the real estate survey using the GNSS method, coordinates of the recorded detailed points obtained in the global coordinate system shall be transformed into state coordinate system by using of appropriate parameters for transformation. (2) Transformation parameters shall be determined by the Agency for real estate cadastre, and if there are no defined transformation parameters for the surveyed area, temporary transformation parameters shall be determined by fitting in the recorded detail in the local environment in terms of known geodetic points. (3) Minimum number of geodetic points required for fitting the recorded detail in the local environment shall be four, one of which is controlling, and the size of the filed for transformation may not be bigger than 10 x 10 kilometers. (4) GNSS measurements in the service of determining temporary parameters for transformation may be implemented by a static method or with network RTK positioning (using MAKPOS RTK service). (5) Transformation of coordinates from global into state coordinate system shall be done based on 3D transformations. (6) Geodetic report shall be prepared and approved by Agency for real estate cadastre for the performed determination of temporary parameters fro transformation.

Controlling measurements in conducting survey with GNSS method

Article 40 (1) When conducting survey with GNSS method, for the purpose of control of the parameters for transformation the user is obliged to perform at least one controlling measurement of a point from the geodetic base. The difference between the coordinates obtained by control measurements and the original coordinates of the point of the geodetic base, on each of the coordinate axes should be within the following limits: - +/- 0.15 m if the transformation parameters are determined by the points of state trigonometric network and - +/- 0.10 m if the transformation parameters are determined by the points of city trigonometric network, (2) When conducting survey with GNSS method, mandatory control shall be performed on the measurement of detail points that define the borderlines of the cadastre parcels, by comparing of two or more independent measurements of the same detail point, or by measuring the fronts between the detail points. (3) Independent measurements of the same detail points may be achieved by implementing an independent initialization of GNSS device, at each individual measurement or by determining a detail point with vectors from different bases. (4) The difference of the coordinates obtained from independent measurements shall not be bigger than 0.05m, and the difference of the length of the measured front between two detail points and the same obtained from coordinates, shall not be bigger than 0.07m.

II.4. SURVEY WITH AERO PHOTO-GRAMMETRY METHOD

Article 41 (1) The scale of the survey with aero photo-grammetry method depends on the accuracy required for preparation of cadastral maps. (2) Prior commencing the aero photo-grammetry survey, a flight plan of the plane shall be prepared on a topographic map in a scale of 1 : 25 000. (3) The flight plan for each row defines: direction, beginning, end and direction of recording, number of the row and absolute height of the flight. (4) Transversal overlap between the rows shall not be lesser than 20%, and longitudinal overlap in photo-grammetry in an image shall not be lesser than 60%.

Orientation of stereo pairs

Article 42 (1) For relative and absolute orientation of stereo pairs photo signalization of the current points of the geodetic basis shall be performed and of sufficient number of other orientation points, prior commencing the survey with aero photo-grammetry method. (2) Selection of additional orientation points and their spatial determination shall be done after the conducted recording.

Photo signaling

Article 43 (1) Photo signaling of detail points shall be done with photo signals in white color which have shape of a square. Dimensions of the square “d” depend of the scale of recording and shall be calculated by the formula:

(2) Photo signaling of the points of the geodetic basis shall be done with photo signals in white color with a shape of a cross with the following dimensions:

Performing survey with aero photo-grammetry method

Article 44 Survey with aero photo-grametry method shall be performed according to the plan of the flight of the plane, at good daylight on the ground, in early spring or late fall for flat areas, or in late spring for high terrains.

Products form the survey with aero photo-grammetry method

Article 45 (1) The following products shall be obtained from the conducted survey with aero photo-grammetry method: - recordings in analogue or digital form; - slides; - --- - photo sketches. (2) After conducted survey with aero photo-grammetry method a graphic layout of the realized flight plan shall be prepared.

Decryption of the real estate

Article 46 (1) At the decryption of the real estate subject of survey with aero photo- grammetry method on the photo sketches shall be drawn and written data from article 8 of this regulation. (2) For scale of mapping 1:1000 all fronts shall be measured, and for a scale of mapping 1:2500 only the cross fronts less than 10 m shall be measured.

Additional survey

Article 47 All detail points that are not visible on the photo sketch, shall be additionally surveyed by measuring with a measuring tape, polar or GPS method.

Mapping data from survey with aero photo-grammetry method

Article 48 (1) Mapping of data from survey with aero photo-grammetry method shall be done with stereo model, obtained with orientation of aero photo-grammetry recordings and from the data contained in the photo sketches. (2) Acquiring digital data during the survey with aero photo-grammetry method shall be performed in an interactive mode.

Acceptable differences in the orientation of the stereo-pair

Article 49 (1) When mapping in the model coordinate system, for transformation of the model into state coordinate system, shall be applied equations of spatial transformation. Medium square values of the repairs of model coordinates from the settlement shall not be larger than 15μ Rs m * on the coordinate axes of the state coordinate system (where Rs is the scale of recording), and on the z- coordinate shall not be larger than 0.00015*h, where h is the relative height of the flight. (2) When mapping in graphical coordinate system, for transformation of the graphical into state coordinates shall be used the co-linearity equations. Medium square values of the repairs of graphical coordinate from the settlement shall not be larger than 10 μ m on the coordinate axes of the graphical coordinate system.

Data on the orientation of the stereo-pair

Article 50 (1) Data on the orientation of the stereo-pair from aero photo-grammetry recordings are placed in ASCII files. (2) ASCII file from paragraph (1) of this article shall comprise following data: name of the person that has prepared the orientation, date and time of the orientation, data on the orientation elements, coordinates of the orientation points, their weights, measured coordinates of the points, the alignment of repairs, average error of unit weight and average square values of the repairs on coordinate axes.

III. GEODETIC REPORTS FROM REAL ESTATE SURVEY

Types of geodetic reports

Article 51 (1) Geodetic reports shall be prepared for the performed real estate survey, such as: - geodetic report from the performed survey in a service of systematic registration of real estate rights; - geodetic report for sporadic registration of real estate rights; Official Gazette of RM, No 28 dated 4.3.2011

- geodetic report for registration of real estate rights which remained unregistered in the systematic registration; - geodetic report for registration of changes and correction of errors in the maintenance of real estate cadastre; (2) Geodetic report from paragraph (1) point 1 of this article, shall be prepared ex officio in printed and electronic form. (3) Geodetic report from paragraph (1) points 2, 3 and 4 of this article, shall be prepared at the request of the client in printed and electronic form.

Verification and approval of the geodetic report

Article 52 (1) The developer of the geodetic report signs and stamps all the pages that are integral part of the geodetic report, and the authorized surveyor registered as sole proprietor - authorized surveyor, i.e. employee in trade company for geodetic works, signs and verifies the cover page of the geodetic report. (2) The cover page of the geodetic report shall be approved by and an expert from geodetic direction, authorized by the Director of the Agency for real estate cadastre. (3) Geodetic report shall be prepared in electronic and paper form. (4) Geodetic report in electronic form shall be prepared in one document in PDF format, signed by an authorized surveyor with digital certificate issued by and authorized publisher and contains as appendix graphic data in appropriate format. (5) Geodetic report from paragraph (4) shall be submitted electronically. (6) Data obtained from the Agency for real estate cadastre in electronic form, signed by a digital certificate issued by an authorized publisher, shall be printed and verified by the authorized surveyor registered as sole proprietor - authorized surveyor, i.e. employee in trade company for geodetic works, and they are used only as an appendix to the geodetic report. (7) Geodetic report in paper form shall be sewed with thread (thread in yellow-red color) and the thread ends are glued on the first page with sticky white paper stripe on which both sides are stamped by the developer of the geodetic report.

Geodetic report from survey in a service of systematic registration

Article 53 (1) Geodetic report from the survey in a service of systematic registration consists of three parts: (2) The first part comprises data on the geodetic network, such as: - cover page with data on the type of the geodetic report, verification/approval and data for the developer; - page with table of contents of the geodetic report; - technical report containing information on the area where the survey was performed, geodetic instruments and methods used for the survey and other characteristics, in accordance with the technical specification; - an overview sketch where the geodetic basis is presented; Official Gazette of RM, No 28 dated 4.3.2011

- original field surveys; - description of the position of the geodetic points – TO 27; - list of coordinates of geodetic points – TO 25; - and more. (3) The second part comprises data for the Digital cadastral map (DCM), such as: - cover page with data on the type of the geodetic report, verification/approval and data for the developer; - page with table of contents of the geodetic report; - technical report containing information on the area where the survey was performed, software used for preparation of DCM, persons who prepared DCM, and other data; - spatial and descriptive data for the border line of the Cadastre Municipality or part of the Cadastre Municipality which was covered by survey; - sketch of cadastre parcel survey; - sketch of survey of inner surface; - DCM in electronic and printed form in accordance with the technical specification; - sketch for identification (graphic layout of the discrepancy of surfaces for each real estate); - data on the conducted orientation of stereo-pairs, when the survey is performed with aero photo-grammetry method. (4) The third part comprises: - cover page with data on the type of the geodetic report, verification/approval and data for the developer; - page with table of contents of the geodetic report; - technical report containing information on the name of the Cadastre Municipality, total number of inventory lists, the total surface area of the part of the Cadastre Municipality for which the inventory lists are prepared and else; - inventory lists; - alphabetical overview of the real estate right holders - list of cadastre parcels with surface; - summary of inventory lists; and - list of real estate for which no spatial data were collected from the legal basis.

Geodetic report for sporadic registration of real estate rights

Article 54 Geodetic report for sporadic registration of real estate rights, depending on the real estate subject of registration, may comprise: - cover page with data on the type of the geodetic report, verification/approval and data for the developer; - page with table of contents of the geodetic report; - technical report; - sketch of cadastre parcel survey; - sketch of survey of inner surface; Official Gazette of RM, No 28 dated 4.3.2011

- Digital cadastral map for the cadastre parcel in electronic form; - inventory list; - possession list; - list of data used from GCIS for the appropriate geodetic report; - and other data.

Geodetic report for registration of real estate rights which remained unregistered in the systematic registration

Article 55 Geodetic report for registration of real estate rights which remained unregistered in the systematic registration, depending on the real estate subject of registration, may comprise: - cover page with data on the type of the geodetic report, verification/approval and data for the developer; - page with table of contents of the geodetic report; - technical report; - sketch of cadastre parcel survey; - sketch of survey of inner surface; - list of data used from GCIS for the appropriate geodetic report; - inventory list; - and other data.

Geodetic report for registration of changes and correction of errors in the maintenance of the real estate cadastre

Article 56 Geodetic report for registration of changes and correction of errors in the maintenance of the real estate cadastre, depending on the real estate subject of registration, may comprise: - cover page with data on the type of the geodetic report, verification/approval and data for the developer; - page with table of contents of the geodetic report; - technical report; - sketch of cadastre parcel survey; - sketch of survey of inner surface; - list of data used from GCIS for the appropriate geodetic report; - Digital cadastral map for the cadastre parcel in electronic form; - property list; - list for conditional registration of a construction; - evidence list; - draft proposal of a new situation; - verified copy of the cadastre map; - and other data.

Geodetic reports for determination of parameters for transformation

Article 57 Geodetic report for determining parameters for transformation shall comprise: - cover page with data on the type of the geodetic report, verification/approval and data for the developer; - page with table of contents of the geodetic report; - technical report; - sketch of known points which determine parameters for transformation with measured vectors; - original and RINEDZ data from field surveys; - list of verified coordinates of given points from geodetic basis; - data from the performed calculations; - calculated parameters for transformation; - and other data.

Appendixes to the geodetic reports

Article 58 (1) The form and the content of the cover page with data on the types of geodetic reports of articles 53, 54, 55, 56 and 57 of this regulation are given in Appendix 4, which is integral part of this regulation. (2) The form and the content of the page with the table of contents of the geodetic reports of articles 53, 54, 55, 56 and 57 of this regulation are given in Appendix 5, which is integral part of this regulation. (3) The form and the content of the technical report of the geodetic reports of articles 53, 54, 55, 56 and 57 of this regulation are given in Appendix 6, which is integral part of this regulation. (4) The form and the content of the list of verified coordinates for the points of the geodetic basis of articles 53, 54, 55, 56 and 57 of this regulation are given in Appendix 7, which is integral part of this regulation. (5) The form and the content of the list of verified coordinates for detailed points of articles 53, 54, 55, 56 and 57 of this regulation are given in Appendix 8, which is integral part of this regulation. (6) The form and the content of the proposal for new situation as per article 56 of this regulation are given in Appendix 9, which is integral part of this regulation.

Statement for identification

Article 59 (1) The geodetic report of articles 54, 55 and 56 of this regulation, shall comprise a statement for identification of the performed comparison between the data for the cadastre parcel, for the buildings, separate parts of buildings and another objects collected by the survey and the data contained in the current cadastre records and the data comprised in the legal basis document. (2) The form and the content of the statement for identification under paragraph (1) of this article are given in Appendix 10, which is integral part of this regulation.

Transitional provisions

Article 60 The provisions of article 53 and article 54 of this regulation, shall apply until the establishment of real estate cadastre at the territory of the Republic of Macedonia.

IV. FINAL PROVISIONS

Article 61 On the date of entering into force of this Regulation, the Regulation for survey, processing and formatting of survey data “Official Gazette of Republic of Macedonia“ No 118/2008, 5/2009, 85/2009, 71/2010 and 149/2010, shall no longer apply, except the provisions from chapter IV. PROCESSING AND FORMATTING OF REAL ESTATE DATA SUBJECT OF SURVEY, which shall apply until adoption of bylaw to regulate this matter.

Article 62 This regulation shall enter into force on the next day of its publication in the “Official Gazette of Republic of Macedonia“.
