Intellectual Property Law Week Open Source License Proliferation: Helpful Diversity or Hopeless Confusion? Featuring Professor Robert Gomulkiewicz University of Washington School of Law Thursday, March 18, 2010 12:30-2:00 PM Moot Courtroom Abstract: One prominent issue among free and open source software (FOSS) developers (but little noticed by legal scholars) has been "license proliferation." "Proliferation" refers to the scores of FOSS licenses that are now in use with more being created all the time. The Open Source Initiative ("OSI") has certified over seventy licenses as conforming to the Open Source Definition, a key measure of whether a license embodies FOSS principles. Many believe that license proliferation encumbers and retards the success of FOSS. Why does proliferation occur? What are the pros and cons of multiple licenses? Does the growing number of FOSS licenses represent hopeless confusion (as many assume) or (instead) helpful diversity? To provide context and color, these issues are examined using the story of his creation of the Simple Public License (SimPL) and submission of the SimPL to the OSI for certification. Professor Robert Gomulkiewicz joined the UW law school faculty in 2002 to direct the graduate program in Intellectual Property Law and Policy. Prior to joining the faculty, he was Associate General Counsel at Microsoft where he led the group of lawyers providing legal counsel for development of Microsoft's major systems software, desktop applications, and developer tools software (including Windows and Office). Before joining Microsoft, Professor Gomulkiewicz practiced law at Preston, Gates & Ellis where he worked on the Apple v. Microsoft case. Professor Gomulkiewicz has published books and law review articles on open source software, mass market licensing, the UCITA, and legal protection for software. -

April 19, 2007 Page 1/9 Exploring Open Source Options The RedMonk Going Open Source Series, Part 1 Overview Now more than ever, one of the top questions for a software company is: Michael Coté to what degree should we participate in open source? Open source is James Governor indisputably the most significant trend affecting the software world at the current time. More than any other single approach, strategy, or tactic, open Stephen O'Grady source has compelled vendors once thought to be unassailable in their respective markets - such as IBM, Microsoft and Oracle – to significantly alter their strategies. While substantial attention is paid to the source aspects of the code –the fact that it is visible, and in some cases alterable and distributable – the distribution advantages may be the most transformative, at least in the commercial world. From application servers to operating systems to programming languages to relational databases to web servers, very few categories of infrastructure software have been immune to open source competition. The packaged application market appears to be the next archipelago in the path of the tsunami, and vertical applications are undoubtedly close behind. None of this is to say that open source is necessarily the single path forward for software vendors; while that may or may not be true in the distant future, it is being actively refuted by the continuing ability of vendors such as Microsoft and Oracle to sell products that are less freely available and higher priced than their open source competition. In the case of many, if not most, of these established vendors, however, success rests more on the basis of significant market barriers to entry than on pure technical grounds. -

It is written mostly in Java and can be used to develop applications in Java and, by means of various plug-ins, other programming languages including Ada, C, C++, COBOL, Perl, PHP, Python, Ruby (including Ruby on Rails framework), Scala, Clojure, and Scheme. The IDE is often called Eclipse ADT for Ada, Eclipse CDT for C/C++, Eclipse JDT for Java, and Eclipse PDT for PHP. The initial codebase originated from VisualAge.[2] In its default form it is meant for Java developers, consisting of the Java Development Tools (JDT). Users can extend its abilities by installing plug-ins written for the Eclipse software framework, such as development toolkits for other programming languages, and can write and contribute their own plug-in modules. Released under the terms of the Eclipse Public License, Eclipse is free and open source software. It was one of the first IDEs to run under GNU Classpath and it runs without issues under IcedTea. The word ªJavaº is used to describe three things: The Java programming language The Java virtual machine The Java platform To support Java applications Fedora needs all three. What Fedora uses: GCJ and ECJ GCJ is the core of Fedora©s Java support: GCJ includes gcj, a compiler for the Java programming language. GCJ also has a runtime and class library, collectively called libgcj. The class library is separately known as GNU Classpath. ECJ is the Eclipse Compiler for Java: GCJ©s compiler gcj is not used for ªtraditionalº Java compilation. More on that later... Why libgcj? There are many free Java Virtual machines: Cacao, IKVM, JamVM, Jikes RVM, Kaffe, libgcj, Sable VM, ... There are two main reasons Fedora uses libgcj: Availability on many platforms. Ability to use precompiled native code. GNU Classpath Free core class library for Java virtual machines and compilers. The JPackage Project A collection of some 1,600 Java software packages for Linux: Distribution-agnostic RPM packages. Both runtimes/development kits and applications. Segregation between free and non-free packages. All free packages built entirely from source. Multiple runtimes/development kits may be installed. Fedora includes: JPackage-compatible runtime and development kit packages. A whole bunch of applications. JPackage JOnAS Fedora©s Java Compilers gcj can operate in several modes: Java source (.java) to Java bytecode (.class) Java source (.java) to native machine code (.o) Java bytecode (.class, .jar) to native machine code (.o) In Fedora: ECJ compiles Java source to bytecode. gcj compiles that bytecode to native machine code. -
