CALL TO ORDER Dr. Simmons called the meeting of the Georgia Composite Medical Board to order at 7:30 a.m.

AGENDA Dr. Retterbush made a motion, seconded by Dr. Norman to approve the agenda of the April 1, 2021 meeting. The motion carried unanimously.

MINUTES Dr. DeLoach made a motion, seconded by Dr. Retterbush to approve the minutes of the March 4, 2021 meeting. The motion carried unanimously.

EXECUTIVE DIRECTOR’S REPORT LaSharn Hughes, Executive Director, presented the following report:

Ms. Hughes gave the Board members a copy of Governor’s Kemp Executive Order 01.14.19.03(5) regarding Conflict of Interest Policy. Dr. Simmons asked the members to review as a refresher.

Department of Public Health regarding HB 1125 that provides a list of factors that identifies individuals as having a high risk for breast cancer. The Legislature requires assistant from the Board. The Board agreed to post to its website and include information for physicians in the Board’s newsletter.

The Board reviewed an email from Michele Madison, JD, regarding whether PAs and APRNs can supervise CT and MRI with contrast. The Board asked the staff to notify her that this can be done under 1

Stephen C. Jacob, MD – requesting formal written clarification on the delegation to paramedics, EMTs, and nurses. Refer to the Office of the Attorney General for advice.

Roz Cordini – Medical assistants - does the physician need to be in the office at the time such medical tasks are being delivered by an MA such as injections. See rules. The physician must be in the building.

Revisit – John Mansour responded to the Board’s request for additional information on pharmacist performing IV injections. The Board considers this the practice of medicine.

NURSE PROTOCOL ADVISORY COMMITTEE Dr. Norman presented the Nurse Protocol Report:

The Board took the following actions:

The Committee recommended the following: 1. I need clarification on whether PAs and APRNs can supervise CT and MRI with contrast. Answer: Not an issue as long as it is approved by the physician, with a protocol or job description.

2. Is it possible for a GA licensed MD who lives outside of GA (like NY) to supervise GA licensed nurse practitioners (who also live outside of GA) who are practicing via telemedicine? Answer: The physician has to be in Georgia or within in 50 miles of where the protocol agreement is being used.

3. My question is that we have a NP-C with a Delegating Physician as well as a Designated Physician. Does the Designated physician have to “physically” see the patient on these Class III-V 12

Does the Delegating Physician have to "physically" see the patient on these class of medications on at least a quarterly basis or is the MD reviewing and signing off on the charts is sufficient? Answer: They must physically see the patient.-Refer to the rules.

4. Section 3708 of the Cares Act allows a Medicare -eligible home health patient to be under the care of a NP, PA, CNS who is working in accordance with state law. These changes were effective March 1, 2020. Medicare allowed these changes for social distancing and timely attention to home bound needs. These changes have nothing to do with pharmaceutical change. Only those advance practice providers with NPI and DEA In the Medical composite state board I ask that definition of treatment include Home health services start of care by certification by NP, PA and recertification as medically necessary per Medicare definition of home bound patients. Answer: There is not a law prohibiting nor granting. If the information is provided in the protocol agreement or the job description to order home health.

5. If a radiologist who moonlights as an urgent care physician can be the delegating physician for APRNs practicing in the same clinic? Answer: If the physician is functioning as an Emergency MD then yes, if the physician is doing radiology, then no.

6. I know there are many RNs in Georgia practicing aesthetics. I need to know who has implemented the regulations for their practice, or where to find this information? Answer: The CRNA would need an NP license in GA and a protocol agreement.

3. The Committee reviewed and discussed the email from John Lewis, who currently has a temporary license and has failed his Boards. The Committee made the following recommendations: 1) He will need to cease practicing genetic counseling in the state until he gets a new current supervisor to sign for him.

2) If he doesn’t pass the boards in August, 2021, he would not qualify for a full license in the state.

4. The Committee discussed moving the May 31, 2021 meeting date since that day is a holiday. The Committee agreed on May 24, 2021 as the new date.
