WHT on all dividend distributions including liquidation proceeds – Reduction by applicable double tax treaty (0% or 5% under most treaties) – No WHT on the distribution of capital contribution reserves (if accounted for separately) – No WHT on royalties – Basically no WHT on interest – Treaty anti-abuse provisions – One-time capital duty – 1% on the issuance of shares by, and capital securities – Restructuring reliefs available 17.6.2013 8 Corporate tax reform III / latest developments – CTR III was initiated in 2008 by the Swiss Federal Council – CTR III focuses on improving the position of Switzerland in the international tax competition – Possible measures of the reform are: – Modification or abolition of the cantonal tax privileges such as the mixed company regime – Improvement of the participation exemption (no minimum threshold of 10% share capital) – Abolition of the issuance stamp tax on equity – Elimination of fiscal barriers of group financing – Option of waiving capital tax at a cantonal level – Extension of the tax loss carry forwards (e.g. possibility to include losses of subsidiaries) 17.6.2013 9 Corporate tax reform III / latest developments – According to the press conference of May 17, 2013 the following suggestions and measures could be applied related to the increasing pressure on the Swiss tax privileges: – Introduction of compliant tax regimes (i.e. equal treatment of domestic and foreign source income) – Innovation or license box regime – Deemed interest deduction on equity – No loop holes for international non taxation – Justifiable from a tax systematic point of view or introduced in at least in one EU member state 17.6.2013 10 Old versus new tax incentives Existing tax privileges – Holding company status – No cantonal/communal income tax – For federal income tax, participation relief applies – Reduced capital tax – Requirements: – 2/3 of assets or income derived from participations – Only minor business activities in Switzerland – Challenged by the EU 17.6.2013 11 Old versus new tax incentives Existing tax privileges – Mixed company status – 5% to 20% of foreign source income is subject to cantonal/communal income tax – Swiss source income is ordinary taxed – Income from participation is exempt – Reduced capital tax – Requirements: – 80% of income derives from foreign source and 80% of the expenses are paid to abroad – Challenged by the EU 17.6.2013 12 Old versus new tax incentives New tax regime – Licence box regime (already implemented in the Canton of Nidwalden) – Net licence income: Costs that are linked to the IP are deductible (taxes, administrative costs, depreciation etc.) – Net licensing income from Swiss and foreign sources from the right to use IP will be taxed separately at 20% of the ordinary cantonal and communal income tax rate – Cantonal and communal income tax rate of 1.2% on net license income; i.e. the effective corporate tax rate (including federal tax) is 8.8% – Requirements: – Only applicable upon request for companies having their domicile or branch in the canton of Nidwalden – Appropriate substance (offices, qualified personal, management etc.) is required – Not compatible with holding or mixed company regime 17.6.2013 13 Old versus new tax incentives New tax regime – Licence box regime (already implemented in the Canton of Nidwalden) – Benefits compared to mixed company regime: – No distinction between Swiss and foreign source income (EU has criticised the mixed company regime for giving unfair advantage to foreign companies) – Active company which is considered as an ordinarily taxed entity – Established fiscal practice applied in other European countries (e.g. Netherlands, Spain, Luxembourg, France, UK (in total 12     Behavioral Responses to Wealth Taxes: Evidence from Switzerland* Marius Brülhart† Jonathan Gruber‡ Matthias Krapf§ University of Lausanne MIT University of Lausanne Kurt Schmidheiny¶ University of Basel October 10, 2019 Abstract We study how reported wealth responds to changes in wealth tax rates. Exploiting rich intra-national variation in Switzerland, the country with the highest revenue share of an- nual wealth taxation in the OECD, we find that a 1 percentage point drop in the wealth tax rate raises reported wealth by at least 43% after 6 years. Administrative tax records of two cantons with quasi-randomly assigned differential tax reforms suggest that 24% of the effect arise from taxpayer mobility and 20% from house price capitalization. Savings re- sponses appear unable to explain more than a small fraction of the remainder, suggesting sizable evasion responses in this setting with no third-party reporting of financial wealth. * Previous versions of this paper circulated under the titles ‘The Elasticity of Taxable Wealth: Evidence from Switzerland’ and ‘Taxing Wealth: Evidence from Switzerland’. These include applying more equal tax treatment to different forms of savings, moving to a flat-rate tax on corporate profits in all cantons and making greater use of environmental taxes. It is recognised that Switzerland’s highly decentralised federal structure and system of direct democracy can slow reforms, although these features also increase the legitimacy of reforms, reducing the risk of policy reversals.     Capital gains taxation Evidence from Switzerland PETER KUGLER AND CARLOS LENZ Capital gains taxes on the sale of company shares and other so- called movable property, which were collected by most cantons in the past at the household level, were completely abolished in Swit- zerland in recent years. However, the persistent stock market boom of the 1990s generated pressure by trade unions and the social dem- ocratic party to reintroduce capital gains taxation at the confedera- tion level. Nevertheless, the federal government did not include a capital gains tax in its 1998 measures to close loopholes in income taxation. The outbreak of the Asian crisis and the resulting stock- market crash in the autumn of 1998 led to a decreasing interest in capital gains taxation but the stock market recovery of the last two years brought this issue again on to Switzerland’s political agenda. The trade unions and the social democratic party recently started an initiative referendum to introduce this tax at the confederation lev- el; the initiative referendum, if supported by a sufficient number of citizens, will be the subject of a future referendum.     SWITZERLAND 1 │ Taxing Energy Use 2019: Country Note – Switzerland This note explains how Switzerland taxes energy use. The note shows the distribution of effective energy tax rates – the sum of fuel excise taxes, explicit carbon taxes, and electricity excise taxes, net of applicable exemptions, rate reductions, and refunds – across all domestic energy use. It also details the country-specific assumptions made when calculating effective energy tax rates and matching tax rates to the corresponding energy base. The note complements the Taxing Energy Use 2019 report that is available at http://oe.cd/TEU2019. The report analyses where OECD and G20 countries stand in deploying energy and carbon taxes, tracks progress made, and makes actionable recommendations on how governments could do better to use taxes to reach environmental and climate goals. The general methodology employed to calculate effective energy tax rates and assign tax rates to the energy base is explained in Chapter 1 of the report. The official energy tax profile for Switzerland can be found in Chapter 2 of the report. Chapter 3 additionally shows effective carbon tax rates per tonne of CO2, and presents the corresponding carbon tax profiles for all countries. Structure of energy taxation in Switzerland As at 1 July 2018, the main taxes on energy use in Switzerland are the following: • The CO2 tax applies to solid, liquid, and gaseous fossil fuels when used for heating purposes and to fuel stationary motors at a uniform rate of CHF 96 per tCO2. • The Tax on Mineral Oils (impôt sur les huiles minérales) applies to liquid and gaseous fuels.
