Chapter 1

INTRODUCTION

The most remembered phrase from Lincoln's Gettysburg address is 'Government of the people, by the people, for the people'. It has become the definition of democracies all over the world. Knowledge is power and the Right to Information Act 2005 has brought this power to people, without which no democracy can retain its intrinsic character. In a vibrant democracy, citizens are the custodians of power.

The Right to Information is enshrined in the Constitution of Article 19(1)(a), which states that every citizen has the freedom of speech and expression. The Supreme Court judgment, in Raj Narain v State of Uttar Pradesh (1976), stated that people cannot express themselves unless they know. Freedom of speech and expression, if exercised without information, loses its strength. Also, if information is not available to all in democracy, it will also chip away the other rights, guaranteed by our Constitution.

The Right to Information Act 2005 lays down the substantive as well as procedural right to obtain information. The Act empowers every citizen to inspect and ask for copies of public records, works, and seek any information in any other form like samples, drawings, models, data material held in electronic form etc. he/she wants from the government. It applies to all bodies constituted under the Constitution of India or under any other law made by Parliament and State Legislature or under any government notification including non-governmental organisations that are substantially financed by the government. Its enactment and implementation has made a positive change by bringing transparency and openness in the way of administrative machinery.

PUNJAB STATE INFORMATION COMMISSION: A BRIEF INTRODUCTION

As provided under section 15(1) of the Right to Information Act, 2005, Punjab Govt. constituted the State Information Commission Punjab on October 18, 2005 and Sh.Rajan Kashyap IAS, who retired as Chief Secretary of government of Punjab, was appointed its first Chief Information Commissioner. After the 2

superannuation of Sh.Rajan Kashyap on 29.07.2008, Sh.P.K.Verma, State Information Commissioner was appointed as officiating Chief Information Commissioner vide Punjab Govt. Notification No.2/41/2005-1AR/573-581 dated 07.08.2008 and he continued as such till 28.06.2009. He was succeeded by Sh.R.I.Singh IAS, Chief Secretary (Retd.), who assumed charge as Chief Information Commissioner on 29.06.2009.

In the year under report, six more State Information Commissioners, namely, Sh. Parveen Kumar, Sh. Ravinder Singh Nagi, Sh.Satinder Pal Singh, Sh. Harinderpal Singh Maan, Sh. Surinder Awasthi and Sh. Narinderjit Singh were appointed. During the same year, Mrs. Ravi Singh, Sh.P.P.S. Gill and Sh.Kulbir Singh superannuated. Chapter -2 COMMISSION OFFICE:-

The State Information Commission is presently housed in two rented buildings. The main office is located in SCO.84-85, Sector 17C, Chandigarh. Besides, the Chief Information Commissioner, four State Information Commissioners, namely, Sh.Bidhi Chand Thakur, Sh. Ravinder Singh Nagi, Sh. Satinder Pal Singh, Sh. Parveen Kumar, along with their personal staff sit in this building. This building houses one court room, Commission’s administrative wing, registry, library etc. in this building.

The other building is in SCO.32-34, Sector 17C, Chandigarh, situated at a short distance from the main building. It has one court room, chambers of five State Information Commissioners, namely, Mrs. Jaspal Kaur, Sh.Chander Parkash, Sh. Narinderjit Singh, Sh. Surinder Awasthi, Sh. Harinderpal Singh Mann and their personal staff. 4

Section 16 of the Right to Information Act, 2005, provides for the terms of office and conditions of service of the State Chief Information Commissioner and State Information Commissioners. Sub-section (5) of section 16 provides that the salaries and allowances 5

payable to and other terms and conditions of service of (a) the State Chief Information Commissioner shall be the same as that of the Election Commissioner and (b) the State Information Commissioner shall be the same as that of the Chief Secretary to the State Government.

Additional Staff of the Commission

With the increase in number of State Information Commissioners and work-load, it was felt that more staff was required for efficiently carrying out the work in the Commission. The Commission corresponded with the Government for providing adequate staff. In spite of vigorous efforts made by the Commission, the requisite adequate staff has not been provided, which adversely afftects the efficiency of the Commission.

Systems and Website

Punjab State Information Commission was the first State Information Commission in India to launch its website: www.infocommpunjab.com.

Punjab State Information Commission has developed an information system in consultation with National Informatics Centre (NIC), Punjab and Technorite Consultants, Mohali, Punjab. To enable the storage and retrieval of huge volumes of information, a three-tier system has been developed and adopted.

Local Area Network (LAN)

All Punjab State Information Commission computers have been linked up through LAN allowing fast data transfer and sharing.

The Management Information Software (INCOMS) system can generate the following reports:

- Daily case register/ cases registered within a certain period; 6

- Allocation of cases to various benches; - Issue of Notice of Hearing; - Details of cases in progress; - Cause list; - Status/history of a case; - Department-wise distribution of cases; - Public Authority-wise distribution The Punjab State Information Commission website contains information on the RTI Act, Punjab State Government Rules and Forms, cause lists and MIS, like number of appeals/ complaints registered and disposed of etc.

INTERNAL TRACKING OF APPEALS

Punjab State Information Commission has implemented an IT system for tracking the appeals/complaints filed in the Commission. The status of each appeal/complaint is updated online. This system also generates all required reports for the Commission.

INTERNS AT SICP

Over the years increasing number of young students from various academic institutions have been approaching the Commission with a view to undergoing internship in the Commission. It has now become a regular feature; and these interns/ students are exposed to the basic nuances of the RTI Act and its implementation. During 2011-2012 SICP had interns from various Universities/Educational institutions, namely:-

VIDEO CONFERENCING FACILITY

The video conference facility was launched by H.E.Governor of Punjab, S.Shivraj V Patil on 3rd March 2011. Funds for this facility were provided by the Government of India and the project was executed by National Informatics Centre (NIC). The four border districts of Amritsar, Ludhiana, Gurdaspur and Ferozpur have been covered through video conferencing. Hearing of the cases is conducted in the office of the respective Deputy Commissioner. Gradually the facility is proposed to be extended to the remaining districts of the State provided the required staff and court room are made available. This facility saves lot of money, time and energy of the complainant, appellant and the PIO’s, as they are not required to come to Chandigarh to attend the hearing of their cases. The facility has also resulted in early delivery of justice to the parties concerned at their door steps. 8

Chapter -4 Budget of the Commission

B. SEMINARS TO CREATE AWARENESS ABOUT RTI ACT under Centrally Sponsored Scheme

In order to create awareness, strengthen and build capacity for effective implementation of RTI Act, the Commission spent Rs.2,50,000/- on conducting seminars and inter-active sessions, workshops etc in the year under report. These programmes were conducted at the following places:-

Chapter -5 Meetings of the Full Commission

To address various issues concerning the Commission and for effective implementation of the RTI Act, six meetings of the Full Commission were held on 18/01/2012, 18/04/2012, 27/07/2012, 17/09/2012, 08/10/2012, 20/11/2012. The proceedings of these meetings are annexed at I, II, III, IV, V and VI. The proceedings are also available on the Commission’s website. 10

Chapter -6 Adjudicatory functions of the Commission

While performing adjudicatory role as per sections 18 and 19 of the RTI Act 2005, during the period under report, 5413 appeal/complaint cases were decided. The closing balance on 31.12.2012 was 1543 cases. 5667 cases were instituted during the period. Out of a total of 5667 appeal/complaint cases, 5413 were decided during the year 2012 which left a balance of 1543 cases to be carried forward to the next year 2013. The following chart depicts this position clearly:-

MINUTES OF 11TH MEETING OF THE FULL COMMISSION HELD ON 18.01.2012 UNDER THE CHAIRMANSHIP OF THE HON’BLE STATE CHIEF INFORMATION COMMISSIONER, PUNJAB. ***

ITEM NO.1: To review the progress of Court Work.

The position regarding pendency and disposal of court work was reviewed from 01.01.2011 to 31.12.2011. At the end of the year as on 31.12.2011 only 1289 case were pending.

ITEM NO.2: The request dated 18.11.2011 of Sh. Sanjay Kumar Mishra to recall the SIC, Punjab (Management) Regulations 2010.

It was decided to have a fresh look at the State Information Commission, Punjab (Management) Regulation, 2010. For this purpose a Sub Committee will be constituted by the Chief Information Commissioner, Punjab. It will look into all aspects and submit its recommendations.

Proceedings of 12th Meeting of Full Commission of State Information Commissioner Punjab, Chandigarh held on 18.4.2012 at 12.30 P.M. under the Chairmanship of Chief Information Commissioner.

The following were present:

The agenda items were discussed and the following decisions were taken.

Item No. 1: Review of Court Work as on 31.3.2012.

The Commission noted that 1531 appeal/complaint cases were pending as on 1.4.2012. Now that the 4 newly appointed State Information Commissioners, who were earlier sitting in Double Benches, are holding courts independently in single Benches with effect from 16.4.2012, it is expected that disposal will get further speeded.

Item No. 2: Proceedings of the Meeting of Sub-Committee of the Commission Regarding State Information Commission, Punjab (Management) Regulations 2012 Held on 10.4.2012 at 12.45 P.M.

The Commission considered the agenda note and the minutes of the meeting of the sub-committee held on 10.4.2012. The decisions of the Patna High Court referred to by the sub-committee in its minutes were also noted

(Saiyed Hussain Abbas Rizwi Vs State Information Commission (AIR 2010 Pat

57) and decision of DB in Saiyed Hussain Abbas Rizwi Vs State Information Commission (AIR 2011 Pat 103).

On consideration of the matter, the Commission approved, in principle, the proposal of the sub-committee as contained in Paragraph 3 of the minutes of its meeting dated 10.4.2012. It directed the office to unbundle the existing management regulations and bring three separate draft orders for approval of the Commission, keeping the recommendations of the sub-committee in mind. These orders may address issues relating to (1) Appointment, powers and functions of the Registrar and registry; (2) Working hours, sittings and vacations of the State Information Commission; and (3) Registration, abetment / hearing of appeals / complaints and constitution of Benches for hearing appeals and complaint cases u/s 18 and 19 of the RTI Act.

Item No. 3: Increase in the salary of the official of the Punjab State Information Commission on the pattern of Right to Service Commission, Punjab.

The Commission noted that the existing staffing pattern and salary structure is highly unsatisfactory. The employees are being hired through a service provider at dismally low wages and as a result, the Commission does not attract the best talent. Even this staff leaves the Commission at the first opportunity they get for better emoluments and security of service. The Commission has, in fact, become a training ground for the work force provided by service provider, as they leave the Commission, after acquiring experience. Recently, the Commission lost few persons to the newly constituted Punjab Service Commission, which has offered higher emoluments than being paid by the Information Commission.

The Commission deliberated on the issues and the following decisions were taken :-

(i) The Government be requested to provide permanent regular staff on Punjab Government Pay Scales. The Commission has been created under an Act of Parliament and is a permanent body. There is no

justification to operate the Commission by a work force on low daily wages through a private service provider.

(ii) As it make take some time to create permanent posts in Punjab government scales, the recommendations contained in para 4 of the Agenda note are approved. The case may be referred to the Government for enhancing the basic salary with annual increment enhancement from 5% to 10% on the pattern of Punjab Right to Service Commission.

(iii) The proposal for creation of additional posts in the Commission was sent to the Punjab government long time back and has been pending with it. Shortage of staff directly affects the working of the Commission. The government should therefore be reminded for early clearance of the proposal.

Item No. 4 The Punjab State Information Commission (Destruction of Judicial Records) Office Order 2011.

The Commission noted the contents of the reference received from the government vide its letter No. 2/98/2009/IPA/06 dated 4.1.2012, conveying that as per the provisions of Section 15 (4) of the RTI Act, there is no need to take approval of government for notifying The Punjab State Information Commission (Destruction of Judicial Record) Office Order, 2011.

The Commission recalled that earlier it had approved, in exercise of powers under Section 15 (4) of the RTI Act, the destruction of judicial records Office Order. However, actual work of destruction of record has not been undertaken so far as a reference on this issue had been made to the government. Now that the Administrative Department has conveyed that no approval is required at the government level, the Commission resolved that the work of destruction of judicial record should be taken up without further delay, in accordance of the policy laid down in the Office Order.

Since the office would be taking up this work for the first time, to ensure strict compliance with the approved procedure and smooth operation, a sub-committee of the Commission with the following members is hereby

20 constituted to overview, assist and guide the implementation of destruction of records, as per instructions contained in the above office order:-

3. Shri Harinderjit Singh Maan, State Information Commissioner, Punjab;

Other Items

The Information Commissioners pointed out that the vehicles allotted to them have outlived their prescribed life span. Being old, the vehicles are not giving smooth service and need to be replaced.

The Commission resolved that the vehicles be got replaced as per the government policy / instructions on the subject and a case should be moved to the Government for allocation of funds for purchase of new vehicles for State Information Commissioners, against condemned old cars.

The Commission noted that State Information Commissioners are equated with Chief Secretary to Government of Punjab and new vehicles should be as per entitlement of vehicle to Chief Secretary to Government of Punjab, as approved by the vehicle board.

MINUTES OF 13st MEETING OF THE FULL COMMISSION OF THE STATE INFORMTION COMMISSION, PUNJAB HELD ON 27.07.2012 AT 3.00 P.M. UNDER THE CHAIRMANSHIP OF SHRI R.I.SINGH, CHIEF INFORMATION COMMISSIONER, PUNJAB.

Item No. 1 - Review of Court Work.

The position regarding the pendency and disposal of court work from 01.01.2012 to 30.06.2012 was reviewed. As on 30.6.12, only 1531 cases were pending for disposal with the Commission.

Item No. 2 State Information Commission Punjab (Management) Regulations 2012.

The Commission hereby repeals with immediate effect the existing State Information Commission, Punjab (Management Regulations), 2012.

Further, on consideration of the proposal, the Commission approved the following three draft Office Orders and directed that henceforth these shall be followed in letter and spirit. The three draft Office Orders are:-

1. Registration, Abetment or Return of Appeal/Complaint and Related Matters. 2. Working Hours, sittings and vacations etc. 3. Composition of Registry of the Commission and Related Matters.

Item No.3 The Punjab State Information Commission (Destruction of Judicial Records) Office Order 2011.

The minutes dated 26.07.2012 of Sub-Committee constituted by the Commission to overview destruction of record was placed before the Commission.

The Commission noted that record of appeal / complaint cases has not been destroyed since inception of the Commission. Consequently, old files have piled up without any record room or a regular Record Keeper. The available space with the Commission is extremely limited. It was also noted that the Central Information Commission and some of the State Information Commissions regularly undertake the exercise to destroy old records.

On consideration of the matter, the Commission decided that it would be desirable not to further delay destruction of record, which has fallen due for destruction. The Commission, therefore, directed that periodic exercise to weed out / destroy old records should be under taken, in accordance with the Destruction of Judicial Records Office Order, 2011.

To overcome the shortage of staff to undertake this exercise, the Commission resolved that the required manpower may be hired on a purely temporary basis for short periods through the service provider, with the approval of CIC.

Item NO.4- Voluntary disclosure of Property Returns.

The Commission noted the contents of the agenda note.

Item No5.- 7th Convention of Central Information Commission to be held on 12th & 13th Oct. 2012 at New Delhi.

The contents of the letters received from the Central Information Commission were brought to the notice of the Full Commission for appropriate action.

Item No.6- Details of expenditure and Grant received during the financial year 2011-12

The Commission noted the details of grant/s received and expenditure incurred by the

Commission.

Item No.7- Banking Facilities- opening of Smart Banking Current account and Total Freedom Salary accounts.

The Commission perused the agenda item along with the explanatory notes placed before it and decided that a total freedom salary account with the Punjab National Bank Sector 16 Branch, Chandigarh could be opened once the office of the Commission shifts to the new building under construction in the Red Cross Building, Sector 16, Chandigarh. Until then, the present arrangements may continue. It was further decided that in the meantime, clarification regarding the tax

liability on interest accrued on amount lying in Smart Banking Current Account be ascertained from the Income Tax Department.

Any other Item:

After conclusion of the regular agenda items, the following items were discussed / decided:-

A) The State Information Commissioners intending to avail ex-India leave / earned leave may send their leave application/s sufficiently in advance, preferably at least 15 days before the due date. It was further desired that while applying for casual leave, it is desirable that the concerned Commissioners indicate the number of days of leave due, leave already availed of and the balance leave to credit.

B) The website of the Commission needs to be made more user-friendly. It was decided that a sub-committee of the Commission be constituted by CIC to oversee this exercise and to ensure that the website of the Commission is upgraded and updated regularly.

Item No. 1: Regarding implementation of the Hon’ble Supreme Court decision in Writ Petition No.210 (Civil) of 2012, decided on 13.09.2012 in Namit Sharma vs. Union of India.

On consideration of the matter at length, it was decided that opinion of the Advocate General, Punjab, Chandigarh be obtained specifically on the issue whether in view of the decision of the Hon‟ble Supreme Court of India in Namit Sharma vs. Union of India, it would be legally permissible to continue hearing of cases by Commissioners,, in view of the fact that at present there is no judicial member on the strength of the State Information Commission, Punjab. The present strength of the Commission is one Chief Information Commissioner and nine Information Commissioners and there is only one vacancy at present.

The Commission resolved that till legal opinion of the Advocate General is received, it is advisable to defer hearing of the cases by “expert members”/Commissioners, to avoid any contempt of the Hon‟ble Supreme Court.

It was further resolved that the Hon‟ble Governor of Punjab may be kept apprised.

Item No. 2: Payment of Rent and arrear thereof in respect of SCO No. 32, 33, 34, Sector 17-C, Chandigarh.

On consideration of the recommendations of Infrastructure Committee, the Commission approved the proposal regarding payment of rent in respect of SCO No.32- 33-34, Sector 17-C, Chandigarh.

Item No. 3: Annual Report of the State Information Commission for the year 2010.

This item was deferred.

Item NO.1 Review of disposal of cases (as on 31.10.2012.

The position regarding the pendency and disposal of court work as on 31.10.2012 was reviewed, 2120 cases were pending for disposal with the Commission. The old pending cases, if any, upto 2011 be disposed of at priority level before the end of current calendar year.

Item No.2 Scope of Section 18 & 19 of RTI Act 2005.

The Legal Advice given by the Legal Advisor of he Commission and judgment of Hon‟ble Supreme Court of India in Civil Appeal No.10787-10788 of 2011 (arising out of SLP (C) No.32768-32769/2010) was noted.

Item No.3 Annual Draft Report of the State Information Commission Punjab for the year 2010.

The Commission considered and approved the draft Annual Report for the year 2010 as placed before it. It was desired that further action in getting 300 copies of the Report printed from the Government Press U.T. Chandigarh as per practice of the last year and submitting to the Administrative Department be completed expeditiously.

Item No.4 Hiring of two officials equivalent to the post of D.E.O. for one month on D.C.Rates for destruction of record as per Punjab State Information Commission (Destruction) Judicial Record Office Order 2011.

The Full Commission considered the recommendations of the Sub Committee as placed before it and approved hiring of two officials equivalent to the post of Data Entry Operators through the official outsource agency of the Commission for a period not exceeding one month. These officials will be paid remuneration at D.C.Rates from the „Non-Salary‟ head. These officials will work under the direct and close supervision of the Deputy Registrar who will ensure that the work of destruction of identified record is accomplished within one month positively.
