Turn Prohibition - at Henley Gardens Driveway, South of Kingston Road (East )

The Toronto Community Council recommends the adoption of the following report (February 9, 2000) from the Director, Transportation Services, District 1:

Purpose:

To report on the results of investigations on Victoria Park Avenue at the driveway to Henley Gardens, south of Kingston Road and to incorporate former City of Scarborough by-laws as part of the municipal code of the former City of Toronto.

Financial Implications and Impact Statement:

Funds in the amount of $1,300.00 associated with the installation of turn prohibition signs and curb adjustments is available in Transportation Services 2000 Operating Budget interim appropriations.

Recommendations:

It is recommended that:

(1) northbound right-turn movements from Victoria Park Avenue into the Henley Gardens driveway, approximately 35 metres south of Kingston Road, be prohibited at all times;

(2) that the former City of Scarborough by-law entries on the portion of Victoria Park Avenue between Kingston Road and Bracken Avenue, as identified in Appendix 1, 2, 3 and 4 of this report, be incorporated as part of the municipal code of the former City of Toronto; and

(3) the appropriate City Officials be authorized and directed to take whatever action is necessary to give effect to the foregoing, including the introduction in Council of any Bills that may be required.

Comments:

As a result of a request from residents on the west side of Victoria Park Avenue south of Kingston Road, Transportation Services reviewed turning movements at the driveway to Henley Gardens.

Henley Gardens is a private complex on the south east corner of Kingston Road and Victoria Park Avenue with a mix of high density residential and commercial uses. The commercial establishments include a grocery store and a Brewer’s Retail store, both of which generate truck traffic. Two primary driveways provide access to the commercial establishments in Henley Gardens, one on Kingston Road and one on Victoria Park Avenue. The driveway on Kingston Road currently provides full movements, whereas at the driveway on Victoria Park Avenue westbound left-turn exits are prohibited from 7:00 a.m. to 9:00 a.m., Monday to Friday, and southbound left-turn movements are prohibited at all times.

During a 4 hour turning movement study, (7:30 a.m. to 9:00 a.m., 12:00 p.m. to 1:30 p.m., and 4:00 p.m. to 5:30 p.m.) staff observed 15 vehicles disobeying the southbound left-turn prohibition into Henley Gardens. Also 27 motorists disobeyed the westbound left-turn prohibition from Henley Gardens between 7:30 a.m. and 9:00 a.m. We have requested police enforcement of these regulations as a result of this study.

During our investigations, we also noted a sign installed on a building structure at the Henley Gardens’ driveway on Victoria Park Avenue just south of Kingston Road indicating “One Way Do Not Enter”. This is not a regulatory sign and the message is not supported by city by-law. Therefore, it is not enforceable. Fifty-four motorists were recorded accessing the plaza from northbound Victoria Park Avenue during the 4 hour study.

Staff reviewed the Henley Gardens’ development application and approved 1990 site plan. On the approved site plan, this driveway is marked as “Exit Only”, and the driveway is angled in a northerly direction. The original developer did not construct this driveway according to the approved site plan.

Considering that this driveway was intended to function as “Exit Only”, it is appropriate to prohibit entry into Henley Gardens from Victoria Park Avenue at all times. Furthermore, to correspond with the original intention of the driveway in the site plan, alterations to the curb will be made to angle the driveway to the north. This alteration to the driveway will discourage westbound to southbound left turns from Henley Gardens.

Because the entire Victoria Park Avenue right-of-way in this area used to be located within the former City of Toronto, the Legal Department has recommended that proposed by-law amendments affecting this road allowance be forwarded to City Council by the Toronto Community Council. At the same time, existing traffic by-laws adopted by the former City of Scarborough should be incorporated into the municipal code of the former City of Toronto. These housekeeping amendments are proposed in Recommendation No. 2 of this report.

Henley Gardens management has been advised of this proposal and although they question the need for the alterations, they have indicated it is not their intention to object to the proposal.

Councillors Gerry Altobello and Brian Ashton are aware of this issue and concur with the recommendations contained within this report. Conclusions:

Staff are recommending that northbound right turns be prohibited into Henley Gardens from Victoria Park Avenue at all times as was the intent at the time of the original development approval in 1990. The curb work on the road allowance, required to angle the driveway in a northerly direction, will be conducted by Transportation Services in 2000, coincident with the installation of the turn prohibition. Staff will also take this opportunity to incorporate other traffic and parking regulations, that were contained in the former City of Scarborough by-law, into the municipal code of the former City of Toronto.
