Facts 1. Since its dedication in 2002, Barney Schwartz Park (BSP) has been the popular daily site for youth and adult sports, tournaments, family gatherings, and events. 2. Apart from the four soccer fields, four softball fields, two playgrounds, fishing lake, picnic pavilions, and walking trails, only a small ½ acre area to the east of the lake remains undeveloped. Original concept plans for the park show this area as irrigated landscape which was not installed during park construction (Attachment 2). 3. REC Foundation, through its Dale Schwartz Memorial Endowment Fund for Barney Schwartz Park, has voted to fund the design and construction of a state-of-the-art bicycle pump track on the undeveloped ½ acre. The non-profit foundation has previously funded a BBQ pavilion, shade structures, trail mile markers, lighting maintenance, parking lot paving, replacement of both playgrounds and other needed projects at BSP. The group is a key supporter of community-wide recreation efforts including the replacement of the City Park playground, Centennial Pool reopening, Salinas River Corridor, Sherwood Forest Park playground, Sherwood Dog Park, Municipal Pool and Centennial Pool shade structures and many more recreation-enhancing projects in Paso Robles. 4. Pump tracks were first introduced to the bicycle community in the 1970s and have steadily increased in popularity. Tracks can now be found across the and the world. 5. A pump track is a small, looping asphalt trail system with rhythmically connected rollers and banked turns that can be ridden continuously without pedaling. Riders use their arms and legs to pump their bikes around the track. As riders improve, the tracks are designed to provide the option for more challenges without needing to change construction. 6. Adding a pump track to BSP is suitable for an outdoor sports park as the activity is: • Safe; • Suitable for users of all ages; • Appropriate to be placed in close proximity to its users; • Needs minimal maintenance; and • Responds to local requests for a pump track in Paso Robles. 7. The City Parks and Recreation Advisory Committee has endorsed the construction of a pump track at Barney Schwartz Park. 8. On January 27, 2021, the City issued an Invitation to Submit Proposals to Provide Design Services for a Pump Track at BSP. 9. Proposing firms were asked to consider the design of a pump track that is challenging, yet rider friendly, and appealing to all ages and skill levels. Ease of maintenance is a primary concern. 10. Three firms submitted proposals, two of which met the basic qualifications as stated in the Invitation to Submit Proposals. The two qualifying firms were asked to interview with a panel representing REC Foundation, the bicycling community, and the City: Chris Taranto, Brandon Medeiros and Mike Rundstrom representing REC Foundation; Jed Dawson representing the bicycling community; and Freda Berman, City Maintenance Superintendent. Both firms were evaluated on (1) a creative vision for the pump track project; (2) appropriate pump track features; (3) their consideration of ease of maintenance; and (4) an understanding of the challenges of designing a new amenity in an existing public park.

11. The review committee recommends retaining California Skateparks to provide design services for the pump track at BSP. This recommendation is based on qualifications, proposed approach, and other criteria as listed in the City’s request for proposals.

Options 1. Take no action; 2. Award a contract for Design Services for a Pump Track at Barney Schwartz Park to California Skateparks; or 3. Provide alternative direction to staff.

Analysis and Conclusions California Skateparks has demonstrated an excellent understanding of both the priorities and possibilities in designing a pump track for Barney Schwartz Park. Moreover, their extensive community outreach plan will not only solicit design input but also communicate back to the public with design opportunities and constraints in developing the concept plan. The negotiated fee for service is appropriate for the scope of services provided.

The concept plan will be reviewed and approved by REC Foundation and then approved by the Parks and Recreation Advisory Committee and City Council prior to preparation of construction documents.

Design is estimated to be complete in November 2021 and construction complete in June 2022.

Fiscal Impact The City will not experience any financial impact as a result of this project, as the REC Foundation will cover the costs of the design and construction of the pump track.

Recommendation Approve Resolution 21-XXX awarding a contract for Design Services for a Pump Track at Barney Schwartz Park to California Skateparks in the amount of $49,200 and authorize the City Manager to execute the contract, subject to any minor, technical, or non-substantive changes as approved by the City Manager and City Attorney.

RESOLUTION OF THE CITY COUNCIL OF THE CITY OF EL PASO DE ROBLES AWARDING A CONTRACT FOR DESIGN SERVICES FOR A PUMP TRACK AT BARNEY SCHWARTZ PARK TO CALIFORNIA SKATEPARKS

WHEREAS, since its dedication in 2002, Barney Schwartz Park has been the popular daily site for youth and adult sports, tournaments, family gatherings and events; and

WHEREAS, a ½ acre area to the east of the fishing lake, originally planned as irrigated landscape, remains undeveloped; and

WHEREAS, REC Foundation, through its Dale Schwartz Memorial Endowment Fund for Barney Schwartz Park, voted to fund the construction of a state-of-the-art bicycle pump track on the undeveloped ½ acre; and

WHEREAS, the City circulated an invitation to submit proposals for design of a pump track at Barney Schwartz Park; and

WHEREAS, three firms submitted proposals of which two were interviewed by a panel consisting of members of REC Foundation, the bicycling community and City staff; and

WHEREAS, the panel is recommending that California Skateparks be retained to provide the requested design services.

NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF EL PASO DE ROBLES DOES HEREBY RESOLVE AS FOLLOWS:

Section 1. All of the above recitals are true and correct and incorporated herein by reference.

Section 2. The City Council hereby awards a contract in the amount of $49,200 for Design Services for a Pump Track at Barney Schwartz Park to California Skateparks and authorizes the City Manager to execute the Agreement, subject to any minor, technical, or non-substantive changes as approved by the City Manager and City Attorney.

Key Issues and Resolutions

California Skateparks understands that every project has its own set of unique issues that need to be addressed in order to complete the project on time, within budget, and without any adverse impacts. Our management and design teams are all well-versed in a variety of practices and techniques needed to efficiently address and combat these site-specific issues. The Barney Schwartz Pumptrack Project presents several potential issues, including extreme weather and safety concerns. These concerns are common issues put forth by our clients, and California Skateparks is fully capable of addressing each of these concerns.

California Skateparks has years of experience developing projects in California where extreme temperatures, various soil conditions, challenging site conditions, and other extreme elements are common. Our team has worked with a vast array of clients and contractors in this region and fully understand the practices required to create a controlled and comfortable facility. Through this knowledge and experience, California Skateparks guarantees that the Barney Schwartz Pumptrack Project will provide the proper amenities to help users beat the dry and hot summer conditions found throughout Central California.

California Skateparks takes athlete safety extremely seriously and guarantees that our design will abide by all local safety standards. Our team understands that action sports can be an inherently dangerous activity and will take all the required steps to ensure that the final design doesn’t contribute to any unnecessary injuries. Furthermore, our design will impede blindside collisions and promote unidirectional flow. Safety fencing and lighting will also be considered in order to promote security and allow officials to monitor the pumptrack after hours.

Overview

California Skateparks’ design process is inclusive of the community, various stakeholders, and city staff. Our Landscape Architects will work closely with the City of Paso Robles to ensure that there is seamless coordination of ideas and concepts consistent with the overall master plan.

California Skateparks’ Landscape Architects and skatepark designers will take the ‘high level’ ideas from the City of Paso Robles, marry those ideas with those gained from the community, and craft an accommodating, well-studied compromised solution for an action sports facility. Additionally, our team will perform an in-depth site analysis to fully understand the immediate and surrounding environment. This site analysis will lay the foundation for our entire design process.

Once California Skateparks has reviewed the site analysis, our design team will begin to develop a custom design that echoes the needs and wants of future users, reflects the local culture, and plays off of existing grades and elevations. Our goal as a skatepark designer is to create landscapes that are not only enjoyed by a variety of action sport athletes, but to provide an aesthetic environment that can be appreciated by both spectators and pedestrians. Additionally, California Skateparks always strives to incorporate sustainable elements and materials to guarantee that our parks can be enjoyed by future generations.

Schedules and Timelines

California Skateparks establishes schedules conforming to the project timeline for meetings, tasks, and design products. Timely meetings with our consulting team and the City of Paso Robles will be regularly scheduled to review concept designs, costs, and progress. Prior to the start of the project, a master schedule will be developed to define all pertinent tasks, subtasks, duration, milestones, meetings, and submittals. This process will ensure the City of Paso Robles and the California Skateparks’ consulting team understands the project scope and task durations.

The timeline supports our commitment to the project with a vision to open the pumptrack on schedule. We will maintain consistent communication protocol with the Client from the beginning of design through construction observation services. All project deliverables will schedule time for internal budget control, quality assurance, and quality control. All review comments and questions will be documented and provided with responses.

Excluded from the timeline are opportunities to phase construction and assist the allocation of separate funding sources and possible partnerships with concessionaires that are brought on late in the design phase.

Public Input / Client Communication & Reporting

California Skateparks is excited about the opportunity to engage with the community regarding the design of the new Barney Schwartz Pumptrack. The City of Paso Robles and stakeholders are the driving forces behind this process, and will be included and involved in every aspect of the design phase. California Skateparks fully intends on working closely with the City of Paso Robles and stakeholders to craft a final plan that is responsive to the desires of the community. Public meetings are also extremely important to the success of this project. California Skateparks will present numerous concept designs to the public and encourage community feedback on these preliminary designs. This process will ensure that our end product truly reflects the wants and needs of the local community.

California Skateparks is committed to providing the City of Paso Robles with an organized communication approach to assist in smooth coordination between all parties. We will set up communication channels at the start of the project that can be used throughout the entire duration of the project. Conference calls and GoTo meetings (a free conference calling and screen sharing program) will be hosted by California Skateparks throughout the project. During meetings we will discuss project status, design, progress, milestones, and deadlines. California Skateparks will distribute meeting minutes along with task lists to all participants after each meeting. California Skateparks will also distribute Auto CAD files, schedules, community outreach material, preliminary designs, 3D renders, construction documents, technical specifications, opinion of probable costs, bidding assistance, and construction administration / observations services to all parties involved with the project.

One-of-a-kind Projects

California Skateparks is always striving to create projects that are innovative, iconic, and memorable. By working closely with professional athletes and analyzing pumptrack industry trends, California Skateparks is able to consistently craft modern and intriguing designs. These designs not only implement new and creative design solutions, but push the boundaries of what action sports entail. Recently, these design trends tend to focus on the development of fun, interactive, and artistic features that can be enjoyed by athletes of all skill levels.

Furthermore, California Skateparks takes inspiration from local cultures to develop features that pay homage to the places in which they are located. Take the San Luis Obispo Skatepark for example. This skatepark pays homage to the cities’ deep-rooted surfing culture by implementing a large concrete wave into the snake run. Additionally, San Luis Obispo’s natural, Spanish, and skate cultures are all portrayed throughout the many features found within the park. Regardless of the project, park concepts will be thoroughly explored and developed through California Skateparks 3D rendering capabilities, and be shared with the city officials and stakeholders for review. By exploring this design process, California Skateparks ensures that all of our projects will become memorable, iconic, and cultural facility for all to enjoy.

Another aspect that sets California Skateparks apart from our competitors is our ability to collaborate with local artists to create iconic, action sport-friendly sculptures. Not only do these art sculptures add to the usability of our projects, but allow local artists to get involved in the creation of a valuable community assets. Additionally, these art pieces provide a perfect opportunity to promote the local culture of the surrounding environment. One recent example of when California Skatepark coordinated with local artists to create a memorable action sport-friendly art sculpture is at the Des Moines Skatepark in Iowa. Our design team worked closely with a local sculptor and metal worker to create an iconic “WOW” sign that serves as a central focal point for the project. This massive art installation also serves as a ridable feature and was implemented into the design to improve flow and provide users with essential turnaround points. Even though the Des Moines Skatepark is still under construction, the “WOW” sign has already become an iconic landmark for the City of Des Moines.

Value Engineering

Our cost management system is highly disciplined and integrated into several other management reporting systems we use. This ensures that all aspects of our projects completely coincide with each other, and that all are accurate in real time. Our value engineering begins early on in the design process. We anticipate details even prior to receiving final plans from the professional surveyors. This allows us to evaluate costs from the beginning, as well as to ascertain the true value versus a perceived cost. There are always a variety of options and the cost versus benefit ratio is in constant flux. We evaluate, interpret, and present options to the client in clear terms. Our past projects clearly demonstrate how our value engineering methods have already provided time and money savings to our many clients, all while creating world class public spaces on time and under budget.

In order to truly understand the site, we use our in-house 3D site modeling capabilities. We create 3D models based on either CAD or line data from plans. This model can incorporate sub-grade adjustments, as well as any wall over excavation and layback. We can then overlay Google Earth imagery to note any specific conflicts or problems. Downloading this information to hand-held GPS devices allows our team to walk the site and see the final plans in the real world, providing yet another way to identify potential conflicts before breaking ground.

Sustainability

California Skateparks understands that sustainable practices are at the core of strengthening local communities. By partaking in environmental, social, and economical sustainability practices, CSP ensures that our final products will have as little impact on the surrounding natural environment and the most influence on local communities, all while limiting the overall cost to the Client. These three cornerstones of sustainability and their corresponding practices are how we at California Skateparks aim to limit our carbon footprint, and create a social fabric that provides for everyone associated and involved with the action sports community.

To help meet our sustainability goals, California Skatepark pursues a variety of green initiatives and guidelines, including both LEED and SITES frameworks. By following the guidelines presented by these certifying agencies, California Skateparks ensures that our projects are designed, built, and operated in the most sustainable way possible.

The following pages have further descriptions of each of the three sustainability cornerstones and the different strategies that are taken to ensure that our company and projects encompass these green initiatives.

Environmental Sustainability

Minimizing California Skateparks’ environmental impact and reducing our carbon footprint is at the core of this sustainability cornerstone. In order to achieve environmental sustainability, California Skateparks closely follows both LEED and SITES guidelines. The environmental practices outlined by these certifying agencies include energy efficiency, water conservation, site selection, material selection, day lighting, and waste reduction; all of which are strongly taken in to consideration whenever California Skateparks is developing any skatepark project. A perfect example of a California Skatepark project that followed LEED and SITES outlines was the Dubai Hills Kids Flowpark. This project utilizes a variety of green technologies and design techniques, including a water retention / bio-infiltration area that cuts through the middle of the park and a native plant palette that is integrated throughout the entire project. Furthermore, the park was built with a variety eco-friendly materials and methods that are conducive to other LEED and SITES certified projects. Since its opening, the Dubai Hills Kids Flowpark has quickly become known as one of the most sustainable and progressive skateparks in the world. In addition to the many sustainable methods and practices that California Skatepark already employs, our team is constantly exploring new eco-friendly materials and sustainable practices to incorporate into our future projects. The following list showcases a variety of design strategies and construction procedures outlined in the LEED and SITES guidelines that California Skatepark utilizes to ensure environmental sustainability.

Social Sustainability

California Skateparks believes the most important reason to build an action sports park is the positive impact it has on the social fabric of a community. Whether it be providing an inclusive place where at-risk youth can freely express themselves or a safe environment that promotes both physical and mental health, these facilities have a unique, natural ability to create social sustainability in every community. Furthermore, action sports parks can become home to many educational opportunities and social resources for teens, families, and athletes of all ages. Whether an individual is just learning to skate, a seasoned athlete, or an intrigued pedestrian; an action sports park provides a variety of social usages for a diverse set of users. California Skateparks is able to further promote social sustainability by working closely with outreach programs and non-profit organizations, like The Tony Hawk Foundation. These programs help local municipalities create and fund public facilities that will in turn provide for the action sports community. Another example of how CSP was able to give back to the community is through the creation of the Lake Havasu City Tinnell Memorial Sports Park. This park is dedicated to a local fallen soldier and BMX rider, Patrick Tinnell; along with Colin Sasseen, a 14-year-old who lost his life skating in his front yard. After hearing of the community’s tragic losses, California Skateparks donated a portion of the project to create a safe environment for the local community of Lake Havasu. California Skateparks promotes economical sustainability through constant coordination and collaboration with its many clients, stakeholders, sub-contractors, and employees. CSP follows a variety of initiatives, including the B Corporations and OSHA guidelines, to ensure that our company promotes proper corporate governance and risk management. Quality assurance and Quality control programs are used to ensure that our project deliverables and final products will be up to the highest of standards. In addition, CSP utilizes stringent construction safety training to guarantee that our employees are well versed in site safety and all disciplines of risk management. Dave King has over 15 years of experience and is acclaimed to be one of the world’s best bikepark builders. As a kid, Dave started building trails and jumps in his backyard. These early projects laid the foundation to go on and help build the world renowned BMX trails, NAM and Catty Woods. Although NAM is long gone, Catty Woods still attracts riders from around the world. Bringing together like- minded individuals over the shared passion of cycling cemented Dave’s lifelong mission to construct facilities for other riders to enjoy. After providing years of unincorporated build services across the nation, Dave formally established DirtSculpt in 2009. Since then, Dave has had the amazing experience of working with organizations, local governments, and corporations from around the world to cultivate cycling experiences for all to enjoy. Additionally, the DirtSculpt Crew is comprised of professional riders that transcend multiple riding styles. A Gathering Place For Tulsa Skatepark and Pumptrack

Location: Tulsa, Oklahoma Located along the Arkansas River, A Gathering Place provides the local community with a fun environment Size: 48,500 SF for action sport enthusiast of all ages and skill levels. The skatepark also features sport lighting to allow action sport athletes to ride late into the night. With the combination of all these amenities, A Gathering Place provides Tulsa, Oklahoma with a one- of-a-kind facility that can be enjoyed by all.

Woodward West Pumptrack

Location: Tehachapi, California As the newest addition to Woodward Camp, the Woodward West Pumptrack offers all action sport Size: 13,700 SF athletes a fun place to learn and grow basic bike/ board control skills, all while providing essential Completed: March 2020 features that challenge even the most seasoned of athletes. This new concrete pumptrack replaced the Contact: Woodward Camp Inc. old dirt pumptrack, which required annual, monthly, Gary Ream and weekly maintenance in order to keep the track (814) 883-5635 running. Now that the pumptrack is made out of garyream@ concrete, there is little maintenance required and the woodwardcamp.com park can be enjoyed year-round.

California Skateparks’ design team did not completely forget about the old, beloved pumptrack. Many of the iconic features that were found in the original design, including the volcano and rainbow rail, where redesigned and incorporated into the new layout. Although the pumptrack hasn’t seen much use due to the COVID-19 pandemic, many Woodward campers, coaches, and visitors are extremely excited for the opportunity to experience this revolutionary pumptrack.

Alaia Chalet Skatepark and Pumptrack

Location: Lens, Switzerland Alaia Chalet is a privately owned action sport facility that provides individuals of all ages and skill levels a Size: 42,600 SF place to freely practice their desired sport. EXHIBIT D INSURANCE

Design Professional shall, at all times it is performing services under this Agreement, provide and maintain insurance in the following types and with limits in conformance with the requirements set forth below. Design Professional will use existing coverage to comply with these requirements. If that existing coverage does not meet the requirements set forth here, Design Professional agrees to amend, supplement or endorse the existing coverage to do so. Design Professional acknowledges that the insurance coverage and policy limits set forth in this section constitute the minimum amount of coverage required. Any insurance proceeds available to Design Professional in excess of the limits and coverage required in this agreement and that is applicable to a given loss will be available to City.

1. Commercial General Liability Insurance, occurrence form, using Insurance Services Office ("ISO") "Commercial General Liability" policy form CG 00 01 or the exact equivalent. Defense costs must be paid in addition to limits. There shall be no cross liability exclusion for claims or suits by one insured against another. Limits are subject to review, but in no event shall be less than $2,000,000 each occurrence, with an aggregate of not less than $4,000,000. If such insurance contains a general aggregate limit, it shall apply separately to this Agreement or be no less than two (2) times the occurrence limit;

2. Business Auto Coverage on ISO Business Automobile Coverage form CA 00 01 including symbol 1 (Any Auto) or the exact equivalent. Limits are subject to review, but in no event shall be less than $1,000,000 each occurrence. If Design Professional or its employees will use personal autos in any way on this Project, Design Professional shall provide evidence of personal auto liability coverage for each such person.

3. Workers Compensation on a state-approved policy form providing statutory benefits as required by law with employers liability insurance, with minimum limits of $1 million per occurrence.

4. Excess or Umbrella Liability Insurance (Over Primary) if used to meet limit requirements shall provide coverage at least as broad as specified for the underlying coverages. Any such coverage provided under an umbrella liability policy shall include a drop down provision providing primary coverage above a maximum self-insured retention for liability not covered by primary but covered by the umbrella. Coverage shall be provided on a "pay on behalf of" basis, with defense costs payable in addition to policy limits. Policy shall contain a provision obligating insurer at the time insured's liability is determined, not requiring actual payment by insured first. There shall be no cross-liability exclusion precluding coverage for claims or suits by one insured against another. Coverage shall be applicable to City for injury to employees of Design Professional, subconsultants or others involved in the Project. The scope of coverage provided is subject to approval of City following receipt of proof of insurance as required herein.
