Introduction to Metropolitan Region Scheme minor amendments

The Western Australian Planning Commission (WAPC) is responsible for keeping the Metropolitan Region Scheme under review and initiating changes where they are seen as necessary.

The Metropolitan Region Scheme (MRS) sets out the broad pattern of land use for the whole Perth metropolitan region. The MRS is constantly under review to best reflect regional planning and development needs.

An amendment proposal to change land use reservations and zones in the MRS is regulated by the Planning and Development Act 2005. That legislation provides for public submissions to be made on proposed amendments.

For a non-substantial amendment, often referred to as a minor amendment (made under section 57 of the Act), the WAPC considers all the submissions lodged, and publishes its recommendations in a report on submissions. This report is presented to the Minister for Planning for approval. The amendment takes legal effect with Gazettal of the Minister’s approval.

In the process of making a non-substantial amendment to the MRS, information is published as a public record under the following titles:

Amendment report This document is available from the start of the public advertising period of the proposed amendment. It sets out the purpose and scope of the proposal, explains why the amendment is considered necessary, and informs people how they can comment through the submission process.

Environmental review report The Environmental Protection Authority must consider the environmental impact of an amendment to the MRS before it can be advertised. While formal assessment would be unlikely for a non-substantial amendment, were it required then an environmental review would be undertaken and made available for information and comment at the same time as the amendment report.

Report on submissions The planning rationale, determination of submissions and the WAPC’s recommendations for final approval of the amendment, with or without modification, is documented in this report.

1 Introduction

At its December 2018 meeting, the Western Australian Planning Commission (WAPC) resolved to proceed with this amendment to the Metropolitan Region Scheme (MRS) in accordance with the provisions of Section 57 of the Planning and Development Act 2005.

The amendment was initiated as a minor amendment to the MRS as the proposal was considered to be relatively minor in nature. The reasons for that decision are included in the previously published Amendment Report for this amendment.

2 The proposed amendment

Purpose

The amendment proposal was described in the previously published Amendment Report and a description of the proposal is repeated below.

The purpose of the amendment is to rezone approximately 19.3 hectares of land from the Rural zone to the Urban zone in the Bellevue locality in the MRS, as shown on Amendment Figure - Proposal 1.

The proposed Urban zoning will allow for future residential subdivision of the land following detailed structure planning and subdivision approval.

3 Environmental Protection Authority advice

The proposed amendment was referred to the Environmental Protection Authority (EPA) for advice on whether environmental assessment would be required. The EPA advised that the proposed scheme amendment does not require assessment under Part IV Division 3 of the Environmental Protection Act 1986.

Nonetheless, the EPA notes that future development has the potential to impact on the and foreshore and would be subject to aircraft and road noise given the proximity of the amendment area to Perth Airport and , and that these impacts can be appropriately managed through the implementation of:

• The approved District Water Management Strategy. • A legal agreement which requires the landowner to rehabilitate and manage land along the Helena River. • State Planning Policy 5.1: Land use planning in the vicinity of Perth Airport (SPP 5.1) and State Planning Policy 5.4: Road and rail noise (SPP 5.4), to manage noise issues.

A copy of the notice from the EPA is in Appendix A of the Amendment Report.

1 4 Call for submissions

The amendment was advertised for public submissions from 31 May 2019 to 2 August 2019.

The amendment was advertised for public inspection during ordinary business hours at the:

i) Western Australian Planning Commission, 140 William Street, Perth ii) Shire of Mundaring iii) iv) State Reference Library, Northbridge.

During the public inspection period, notice of the amendment was published in the West Australian and relevant local newspaper/s circulating in the locality of this amendment.

5 Submissions

Fourteen submissions were received on the amendment. An alphabetical index of all persons and organisations lodging submissions is at Schedule 1.

Three submissions supported the amendment, one submission objected to the amendment and ten submissions contained neutral comments, non-objections or general comments on the amendment (primarily from government agencies). There were no particularly significant issues raised in submissions which required further consideration.

A summary of each submission with WAPC comments and determinations is at Schedule 2. A complete copy of all written submissions is contained in this report.

6 Determinations

The responses to all submissions are detailed in this report. It is recommended that the amendment be adopted for finalisation without modification.

7 Co-ordination of region and local scheme amendments

Under section 126(3) of the Planning and Development Act 2005 the WAPC has the option of concurrently rezoning land that is being zoned Urban under the MRS, to a "Development" zone (or similar) in the Local Planning Scheme.

The Shire of Mundaring requests that Local Planning Scheme No. 4 be concurrently amended to transfer the amendment area to the "Development" zone. The WAPC supports the concurrent amendment to Local Planning Scheme No. 4.

8 Conclusion and recommendation

This report summarises the background to MRS minor amendment 1352/57 and examines the various submissions made on it. The WAPC, after considering the submissions, is satisfied that the advertised amendment as shown generally on the figure for Proposal 1 in Schedule 3, and in detail on the MRS Amendment Plan listed in Appendix 1, should be approved and finalised.

2 The WAPC recommends that the Minister for Planning approves the amendment as advertised.

9 Ministers decision

Amendments to the Metropolitan Region Scheme using the provisions of section 57 of the Planning and Development Act 2005 require the WAPC to provide a report and recommendation to the Minister for Planning and Infrastructure for approval. The Minister may approve, approve with modification or decline to approve the proposed amendment.

The Minister, after considering the amendment, has agreed with the recommendation of the WAPC and approved the amendment.

MRS Amendment 1352/57 is now finalised as advertised and shown on WAPC Amending Plan 3.2724 and has effect in the Metropolitan Region Scheme from the date of notice in the Government Gazette on 3 April 2020.

The Submitter provides the following comments on the amendment:

(a) Water supply and wastewater disposal - any development is to be connected to scheme water and reticulated sewerage and be in accordance with the Government Sewerage Policy - Perth Metropolitan Area; and

(b) Medical entomology - the amendment area may be prone to mosquitos as a river and wetlands are in the vicinity. Stormwater management infrastructure should be designed to eliminate mosquito breeding opportunities.

Summary of Submission: OBJECTION

The submitter objects to the amendment and provides the following comments:

(a) There is insufficient detail in the documents to show that Wangalla Brook is protected and not encroached upon. The natural flow of Wangalla Brook should be restored and natural creek lines should be rehabilitated, to create habitat for local flora and fauna and all mature trees should be protected.

(b) How can there be construction on site where there is only permission granted for earthworks in Stage 1?

(c) The future Parks and Recreation lots should be created on the Stage 1 deposited plan to give residents peace of mind that no further minor amendments are requested during the construction.

(d) It is vital for all of the flood plain area to remain in public ownership, to ensure that structures downstream will be protected from flood damage during high rainfall events. This area has historically flooded and slowed water flows of the Helena River.

(e) The creation of public open space along the Helena River through to the Swan River must become a priority of the Shire of Mundaring and the City of Swan.

(f) The Australian Noise Exposure Forecast (ANEF) lines shown on the Lot 50 Wilkins St Bellevue submission of September 2014 have changed. These may change at any future time, being controlled by a Federal Government agency.

Planning Comment:

(a) The impact of development works on Wangalla Brook is outside the scope of the MRS amendment process and is most appropriately considered in the structure planning and subdivision stages of the planning process. Nonetheless, the District Water Management Strategy Addendum, prepared in support of the amendment, states that Wangalla Brook will be realigned to its original flow path and will pass through a constructed wetland before discharging to the Helena River, and that the foreshore area will be planted with native species to encourage flora and fauna to return.

(b) Any earthworks within the amendment area or on adjacent land would generally be required to be undertaken in accordance with a subdivision or development approval issued by the WAPC or the Shire of Mundaring. Whatever the approval requirements may be, this matter is beyond the scope of the MRS amendment process.

(c) The landowner has entered into a deed of agreement with the WAPC, in which it has agreed to transfer ownership of Parks and Recreation reserved land within the site to the WAPC. Furthermore this land is designated as 'Open Space' in the North-East Sub- regional Planning Framework. For these reasons, the WAPC would be unlikely to support any further amendments to the MRS which propose to reduce the extent of the Parks and Recreation reservation over this site.

(d) Revised flood modelling has been undertaken for the amendment area. The District Water Management Strategy Addendum states that this modelling indicates that there is no increase in the flood risk upstream or downstream of the site.

(e) The reservation of the Helena River foreshore outside the amendment area as Parks and Recreation or public open space is beyond the scope of the current MRS amendment.

(f) Perth Airport is required to review its ANEF every five years, pursuant to the requirements of the Airports Act 1996. Its current ANEF (Perth Airport Ultimate Practical Capacity ANEF) was endorsed by Airservices Australia in July 2019. The extent of the current ANEF in the Bellevue locality is different to previous ANEFs and it is possible its extent may change in the future. However, it is unlikely that its extent would significantly increase in the future given it is based on the ultimate practical capacity of Perth Airport.

The Department of Education raises no objection to the amendment and advises that it wishes to liaise with the Shire of Mundaring and/or the developers at the initial stages of any future structure plan. This will assist the Department in analysing the potential student yield and assessing the student accommodation demand for nearby primary and secondary schools.

Summary of Submission: COMMENT

Main Roads Western Australia raises no objection to the amendment and provides the following comments:

(a) A structure plan should be prepared prior to any development of the site and should include a detailed traffic impact assessment prepared in accordance with the WAPC's Transport Impact Assessment Guidelines and an acoustic assessment prepared in accordance with SPP 5.4. The traffic impact assessment must include the impact of increased traffic volumes on Clayton Street and treatments required to increase its capacity and broader road connectivity improvements to facilitate access from the amendment area to the broader road network.

(b) Advice note: The amendment area is highly constrained with limited road access and connectivity externally. The intensification of urban land use in this area must consider the access issues and it is Main Roads' view that significant network rationalisation is required to improve the road network in this location.

Summary of Submission: COMMENT

The Shire of Mundaring provides the following comments on the amendment:

(a) The Shire previously provided preliminary comment on the amendment where it recommended the amendment not be initiated unless firm commitments were made to achieve the objectives of the Shire of Mundaring Foothills Growth Strategy (the Foothills Growth Strategy), to ensure properly coordinated development in the locality.

(b) The amendment is generally consistent with the Shire of Mundaring Local Planning Strategy and the Foothills Growth Strategy.

(c) The planning consultants for the amendment area and for Lot 254 Helena Valley Road have been advised that in order to consider further structure planning in the locality, traffic assessment is required which explores the concept of a park road (non-public road) linking Katharine Street with Helena Valley Road. This concept is identified in the Foothills Growth Strategy and requires further exploration to ensure that orderly and proper planning occurs in the locality.

(d) It is recommended that the WAPC confirm whether the ANEF Special Control Area, as it is currently shown in Local Planning Scheme No. 4, will prevent future rezoning which would be required to align this Scheme with the amendment. (e) It is recommended that the proponent be advised that prior to consideration of structure planning, a traffic impact assessment will be required, which includes consideration of a 'park road' between Katharine Street and Helena Valley Road.

Planning Comment:

(a), (b) & (c) Comments noted.

(d) The provisions of the Aircraft Noise Exposure Forecast Special Control Area in LPS 4 do not prevent land within the amendment area from being rezoned in this Scheme. In this respect, the amendment area is located between the 20 and 25 ANEF contours for Perth Airport.

For these areas, SPP 5.1 recommends that buildings types identified as 'Conditionally Acceptable' (i.e. residential dwellings and schools) should be subject to discretionary control under local planning schemes. The provisions of the Special Control Area are consistent with SPP 5.1 as they require development approval to be obtained for single dwellings and for the Shire to have regard for this policy when considering development applications.

(e) The proponent has been advised of the Shire of Mundaring recommendation regarding transport planning requirements for any future structure planning of the amendment area.

Thank you for your letter of 27 May 2019 requesting comments from the Department of Health (DOH) on the above proposal. The DOH provides the following comment:

Water Supply and Wastewater Disposal The amendment is to require that any development is to be connected to scheme water and reticulated sewerage and be in accordance with the Government Sewerage Policy - Perth Metro olitan Region .

Medical Entomology The amendment area may be prone to mosquitoes as river and wetlands are in the vicinity. Stormwater management infrastructure such as culverts, road drainage systems, etc. should be designed to eliminate mosquito breeding opportunities, be in accordance with the Department of Water publication Stormwater Management Manual for Western Australia , to the satisfaction of local government (tittp://www.water.wa.gov.au/ data/assets/pdf_file/0020/4772/44217.pdf).

Bellevue Farm Helena Valley

There are insufficient topographical plans and water course plans in the WAPC documents to show that Wangalla Brook is protected and not encroached upon. All mature trees along this creek line should be protected.

The WAPC document plan showing Proposal 1, Urban Zone, minor amendment, appears to follow the contours. On inspection on 23rd July the Wangalla Brook has been realigned by survey stakes to reflect some engineering design.

Restore the natural flow of Wangalla Brook (now obstructed by limestone block retaining walls). Rehabilitate natural creek lines and created wetlands by removing the limestone walls and replacing them with riparian vegetation to create habitat for local fauna & flora.

How can there be construction on site, when there is only permission granted for earthworks in stage 1?

The future Parks & Recreation lots should be surveyed and created on the Stage 1 Deposited Plan, thus giving the residents of the Shire of Mundaring peace of mind that no further “minor amendments” are requested during construction This is essential along the Helena River flood plain on the southern boundary.

It is vital for all the Flood Plain area to remain in public ownership. This ensures that structures downstream will be protected from flood damage during high rainfall events. This area has historically flooded and slowed water flows of the Helena River.

The creation of Public Open Space along the Helena River through to the Swan River must become a priority by the Shire of Mundaring & City of Swan.

The Australian Noise Exposure Forecast (ANEF) lines as shown in the Lot 50 Wilkins St, Bellevue submission of September 2004 have change. These may change at any future time, being controlled by a Federal Government Agency.

REFERRAL RESPONSE - METROPOLITAN REGION SCHEME - PROPOSED AMENDMENT 1352/57 - PART LOT 799 KATHARINE STREET, BELLEVUE

Thank you for the opportunity to provide comment on the above Amendment.

The Shire provided preliminary comment on the Amendment in its letter dated 11 September 2018. The letter recommended that the Amendment not be initiated unless firm commitments are made to achieve the objectives in the Shire’s Foothills Growth Strategy to ensure properly coordinated development in the locality.

The initiated Amendment is generally consistent with the Shire’s adopted planning strategies, including its: - Local Planning Strategy (2014); and - Foothills Growth Strategy (2017)

The owner of the subject property and 335 (Lot 254) Helena Valley Road have engaged consultants to act on their behalf - Burditt Krost (Strategic Planning Institute) and Henry Dykstra (Harley Dystra) respectively.

The consultants have been advised that in orderto consider further structure planning in the locality, traffic assessment is required which explores the concept of a park road *(non-public road) linking Katherine Street with Helena Valley Road to the proposed future ovals.

This concept is identified within the Foothills Growth Strategy (2017) (refer attached plan) and requires further exploration to ensure orderly and proper planning occurs in the locality. Senior WAPC officer, Tim Hillyard, has also indicated a willingness to be involved in the planning and potential part funding of a park road.

It is recommended that:

1. The WAPC confirm whether the ANEF Special Control Area, as it is currently shown in Local Planning Scheme No. 4 (LPS4), will prevent future rezoning which would be required to align LPS4 with the Amendment;

The applicant be advised that prior to consideration of structure planning, a traffic impact assessment will be required which includes consideration of a ‘park road’ between Katharine Street to Helena Valley Road.
