Display This Permit While Work Is In Progress ISSUED TO: Gaston Silva, R.A., COO 689 Fifth Avenue, LLC c/o 888 7th Avenue New York, NY 10019 Pursuant to Section 25-307 of the Administrative Code of the City of New York, the Landmarks Preservation Commission, at the Public Meeting of July 29, 2003, following the Public Hearing of July 22, 2003, voted to grant a Certificate of Appropriateness for the proposed work at the subject premises, as put forward in your application completed on June 26, 2003, and as you were informed in Status Update Letter 04-0709(LPC 03- 7660), issued July 29, 2003.

The proposed work, as approved, consists of installing new bronze storefront infill in existing and enlarged ground floor openings with transoms and fixed black canvas awnings on the Fifth Avenue and East facades, as shown in drawings labeled A001 and A006, dated June 10, 2003, most recently revised June 30, 2003, and A007 and A009, dated June 26, 2003, photographs of the existing conditions, historic photographs from 1926 , 1939, and circa 1970, and photo montages, all prepared by Brennan Beer Gorman Architects, submitted as components of the application, and presented at the Public Hearing and Public Meeting.

In reviewing this proposal, the Commission noted that the designation report for this individual landmark states that 689 Fifth Avenue, the Aeolian Building, is a neo-Classical style commercial building built in 1925-27, designed by ; and that its style, design, materials, and details contribute to the special historic and architectural character of the landmark. The Commission also noted that the base of the building was altered prior to designation; and that the existing Fifth Avenue storefronts are recessed back several feet from the street, behind an arcade.

With regard to this proposal, the Commission found that no significant architectural features of the building will be removed or altered; that the proposed ground floor infill on Fifth Avenue and at the corner will restore the storefronts to their historic location at the street wall; that enlarging the openings on Fifth Avenue and at the corner of East 54th Street will not cause the removal of any historic fabric; that enlarging the East 54th Street storefront openings to match the height of the Fifth Avenue openings will create a more uniform appearance at the base of the building; that the simple modern design and bronze framing of the new infill will be harmonious with the design of the historic facade above; that the sloped profile of the fixed canvas awnings will recall the appearance of historic storefront awnings; and that the proposed work will improve the appearance of the altered ground floor, allowing it to relate better to the special historic and architectural character of the landmark. Based on these findings, the Commission determined the proposed work to be appropriate to the landmark, and voted to approve this application.

The Commission authorized the issuance of a Certificate of Appropriateness upon receipt, review and approval of two signed and sealed copies of the final Department of Buildings filing drawings for the approved work. Subsequently, the staff of the Commission received drawing labeled A001 and A006, dated June 10, 2003, most recently revised June 30, 2003, and A007 and A009, dated June 26, 2003, most recently revised June 30, 2003, prepared by Brennan Beer Gorman Architects. The Commission reviewed the drawings and found that proposal approved by the Commission has been maintained. Based on this and the above findings, the drawings have been marked approved by the LPC with a perforated seal and Certificate of Appropriateness 04-1341 is being issued.

This permit is issued on the basis of the building and site conditions described in the application and disclosed during the review process. By accepting this permit, the applicant agrees to notify the Commission if the actual building or site conditions vary or if original or historic building fabric is discovered. The Commission reserves the right to amend or revoke this permit, upon written notice to the applicant, in the event that the actual building or site conditions are materially different from those described in the application or disclosed during the review process.

All approved drawings are marked approved by the Commission with a perforated seal indicating the date of approval. The work is limited to what is contained in the perforated documents. Other work or amendments to this filing must be reviewed and approved separately. The applicant is hereby put on notice that performing or maintaining any work not explicitly authorized by this permit may make the applicant liable for criminal and/or civil penalties, including imprisonment and fines.
