THE EXECUTIVE COMMITTEE RECOMMENDS THAT 0.34 hectares (0.84 acres), more or less, of vacant land, being Part of the West Half of Lot 31, Concession 7 and designated as Block 7 on draft M-plan prepared by Guido Papa Surveying Ltd under their reference no.07-130, City of Vaughan, Regional Municipality of York, located east of Kipling Avenue and north of Kirby Road, be purchased from Vito and Marianne Pacifico;

THAT the purchase price be $2.00;

THAT Toronto and Region Conservation Authority (TRCA) receive conveyance of the land free from encumbrance, subject to existing service easements;

As a condition of subdivision registration, Vito and Marianne Pacifico are to transfer the valleyland to TRCA.

There is currently no direct access onto the subject lands. The City of Vaughan has agreed that TRCA may use the City's storm sewer access easement for access to the subject lands.

Attached is a plan showing the location of the subject lands.

RATIONALE The subject property is valleyland. The subject property falls within TRCA’s approved master plan for acquisition for the Humber River watershed as outlined in the approved Greenland Acquisition Project 2006-2010.

TAXES AND MAINTENANCE Based on our preliminary review of the environmental criteria for lands that are eligible to receive a property tax exemption under the Provincial Conservation Land Tax Incentive Program, it would appear that all the subject property would be eligible for exemption for the 2010 taxation year. The addition of the subject parcel of land will not significantly impact TRCA's maintenance costs of this location.

RATIONALE The subject property falls within TRCA's approved master plan for acquisition for the Humber River watershed as outlined in the approved Greenlands Acquisition Project for 2006-2010. Through the review of residential subdivision 21T-76010C for proposed single lot residential development of this site, TRCA staff established the limits of the open space lands (i.e. Block 20 on Plan of Survey) which is comprised of the stream and valley corridor of the headwaters of the Cold Creek at this location. In addition, the lands are designated as Natural Linkage Area in the Oak Ridges Moraine Conservation Plan.

Toronto and Region Conservation Authority (TRCA) is in receipt of a request from Lorraine Properties Limited for the sale of a parcel of TRCA-owned land located south of 2157 Lakeshore Boulevard West, City of Toronto, Lake Ontario waterfront.

THE EXECUTIVE COMMITTEE RECOMMENDS THAT a parcel of Toronto and Region Conservation Authority (TRCA) owned land containing 0.077 acres, more of less, located south of 2157 Lakeshore Boulevard West, being Part of Water Lots in front of Lots 9 and 10, Registered Plan 1229, City of Toronto (formerly City of ) be declared surplus to the requirements of TRCA having followed established TRCA policies and appropriate public consultation process;

THAT an offer to purchase the property be invited from the abutting property owner at 2157 Lakeshore Boulevard West;

AND FURTHER THAT a report be brought forward to the Executive Committee at a future date regarding discussions with owner of 2157 Lakeshore Boulevard West. CARRIED BACKGROUND At Executive Committee Meeting #8/08, held October 3, 2008, Resolution #B117/08 was adopted:

THAT the potential disposal of a parcel of Toronto and Region Conservation Authority (TRCA)-owned land located south of 2157 Lakeshore Boulevard West, City of Toronto, be referred to TRCA staff for review in accordance with established TRCA policies;

AND FURTHER THAT a report be brought forward to the Executive Committee at a future date recommending further action.

In accordance with TRCA's disposal policy the following action has been taken: z This request was circulated to TRCA technical staff, staff of the City of Toronto Parks, Forestry and Recreation Department and staff of the Ministry of Natural Resources. The following comments were received:

TRCA's Technical Staff The subject property is not regulated by TRCA and does not have any natural heritage features.

City of Toronto Parks, Forestry and Recreation Staff The subject property is not required by the City for parks and open space purposes. City staff has no objection to the disposal of this parcel of land.

86 Ministry of Natural Resources Staff Ministry of Natural Resources staff has no objection to the disposal of this parcel of land. z TRCA's intention to consider disposal of this parcel of land was publicized in the Toronto Star and Etobicoke Guardian on March 20, 2009. z A community consultation meeting was held by the City of Toronto on February 25, 2009, at the Polish Association of Toronto, 2282 Lakeshore Boulevard West at 7:00 p.m.. The purpose of the meeting was to provide an opportunity for the community to have input on an application by the owner or 2157 Lakeshore Boulevard West for an Official Plan and Zoning Amendment to permit: a 4-storey office/commercial building on the block fronting on Lakeshore Boulevard West; a 80-unit, 8-storey residential building proposed for the centre block of the property; and, a 306-unit, 36-storey mixed use residential with ground floor retail building on the southern most block of the property. In addition to the input requested on the planning applications, there was also an opportunity for the community to have input on the request from the owner of 2157 Lakeshore Boulevard West to purchase the parcel of TRCA-owned land.

No comments were received from the community consultation meeting relating to this proposed sale. The newspaper ads generated comments from three members of the community. Two individuals had no objection to the sale. The third individual indicated that we should not be doing anything to decrease further public views and access to the lake and we must preserve all the open space and nature we have left.

A plan illustrating the location of the subject lands is attached.

RATIONALE The subject property is located on the north side of Marine Parade Drive surrounded on three sides by mixed use development and is not connected to other TRCA ownership in this area. This property does not fall within the limits of the Revised Project for the Etobicoke Motel Strip Waterfront Park (March 1993). The subject land was expropriated from Proudfoot Motels Limited solely for the purpose of grading related to the construction of Marine Parade Drive by the City of Toronto (formerly City of Etobicoke). The expropriation settlement was finalized in late 2007. Since the construction of Marine Parade Drive was completed in approximately 1999, the expropriation settlement has been completed and there is no parks and open space requirement for the property, it is recommended that the property be declared surplus to TRCA's requirements.

FINANCIAL DETAILS It is proposed that the net revenue generated from the sale of this parcel be used to offset future funding requirements from the Province of Ontario and the City of Toronto under the Revised Project for the Etobicoke Motel Strip Waterfront Park (March, 1993).

Request for Permanent Easement for the Relocation and Maintenance of Overhead Utility Lines, Mimico Creek Watershed, City of Mississauga, CFN 42101. Receipt of a request from Enersource Hydro Mississauga Inc. to provide a permanent easement for the relocation and maintenance of overhead utility lines, west of Airport Road and north of Derry Road (beside the unopened Drew Road road allowance) - Malton, Mimico Creek watershed, City of Mississauga.

THE EXECUTIVE COMMITTEE RECOMMENDS THAT WHEREAS Toronto and Region Conservation Authority (TRCA) is in receipt of a request from Enersource Hydro Mississauga Inc. to provide a permanent easement for the relocation and maintenance of overhead utility lines, west of Airport Road and north of Derry Road (beside the unopened Drew Road road allowance) - Malton, Mimico Creek watershed, City of Mississauga;

AND WHEREAS it is in the best interest of TRCA in furthering its objectives as set out in Section 20 of the Conservation Authorities Act to cooperate with the Enersource Hydro Mississauga Inc. in this instance;

THEREFORE LET IT BE RESOLVED THAT a permanent easement containing 0.032 hectares (0.079 acres), more or less, be granted to Enersource Hydro Mississauga Inc. for the relocation and maintenance of overhead utility lines, said land being Part of Lot 12, Concession 6 EHS, City of Mississauga, designated as Parts 9 and 10 on Plan 43R-32564;

THAT TRCA grant the easement across the subject land on the following terms and conditions:

(a) The easement price is to be the sum of $10,000.00;

(b) Enersource Hydro Mississauga Inc. is to pay all TRCA's legal, appraisal, survey and other costs incurred to complete the transaction;

(c) Enersource Hydro Mississauga Inc. is to fully indemnify TRCA from any and all claims for injuries, damages or costs of any nature, resulting in any way, either directly or indirectly, from the granting of this easement or carrying out construction;

(d) Any additional conditions as deemed appropriate by TRCA's solicitor.

THAT a permit pursuant to Ontario Regulation 166/06 be obtained for the construction;

THAT an archaeological investigation be conducted by TRCA Archaeology staff with any mitigative measures required being carried out at the expense of Enersource Hydro Mississauga Inc.;

89 THAT the granting of this easement is subject to written approval from the City of Mississauga Parks and Recreation Department who manage these lands on behalf of TRCA;

THAT the granting of this easement is subject to the approval of the Minister of Natural Resources in accordance with Section 21(2) of the Conservation Authorities Act, R.S.O. 1990, Chapter C.27 as amended;

AND FURTHER THAT authorized TRCA officials be directed to take whatever action may be required to give effect thereto, including the obtaining of necessary approvals and the signing and execution of any documents. CARRIED BACKGROUND Enersource Hydro Mississauga Inc. has formally requested a permanent easement for the relocation and maintenance of overhead utility lines for the future extension of Drew Road which will include the construction of an overpass of the existing railway tracks and the Mimico Creek flood control channel through this area. The railway line and flood channel run side-by-side at this location. The relocated hydro pole line across TRCA property will occur within the Regional Storm flood plain and regulated area of the Mimico Creek. A permit application pursuant to Ontario Regulation 166/06 is presently being reviewed by TRCA Planning and Development staff.

The subject property was acquired from Windom Investments Ltd. on December 31, 1975 under the Mimico Creek Channel Improvements Project.

Plantings: Through the permit approval process, all lands disturbed by construction will be stabilized and, where deemed appropriate by TRCA staff, revegetated with native woody and herbaceous plant material in accordance with existing TRCA landscaping guidelines.

A plan illustrating the permanent easement location is attached.

FINANCIAL DETAILS Enersource Hydro Mississauga Inc. will pay $10,000 as compensation for the granting of this permanent easement, and will assume all reasonable costs involved (i.e. legal, survey, etc.) in completing this transaction.

BACKGROUND TRCA's Executive Committee requested a report on Toronto region municipal trail surfacing standards for informational purposes. The following report is a compilation of the trail surfacing guidelines across the region. The TRCA trail construction guidelines are included because of the municipalities that reference TRCA guidelines as their standard.

TRCA Trail Guidelines The development of trails on TRCA-owned lands is guided by TRCA’s Trail Standards and Design Guidelines: A Handbook for an Inter-Regional Trail System in the Greater Toronto Area (1992).

Table 1 provides a summary of trail design and construction criteria included within TRCA’s Trail Standards and Design Guidelines.

Municipal Trail Surfacing Guidelines Most of the municipalities in the Toronto region have informal trail construction guidelines. Surfacing is most often determined by projected use and trail location and is decided formally on a case by case basis. The following document outlines some local and regional municipal surfacing guidelines and illustrates the factors involved in trail construction choices for some of the municipalities in the Toronto region. The focus is largely on the local municipalities, and is not exhaustive.

City of Pickering The City of Pickering does not have any approved standards for trail surfacing. Any trails that are to be heavily traveled as multi-purpose trails are typically 3.0m wide asphalt surfaces. In Pickering parks where the trails are less traveled, stone screenings on a gravel base are used. The City of Pickering has also considered using wood chips on some of the minor trail systems through wooded areas, where accessibility is not as much of a concern (Arnold Mostert, City of Pickering).

Town of Ajax Ajax trail surfacing specifications are subject to trail use and location. "Trail Corridors" which connect the subdivisions and aid transportation, are paved. Bark mulch or stone screenings are used in natural or environmentally sensitive areas (Town of Ajax; Parks Services, 2009). Currently, Ajax is trying to promote "Trails as Active Transportation" and will therefore be looking to create more paved trails. Nothing is specified about the nature of the paving materials.

93 Region of York In York Region, multi-use trails are meant to connect walking and cycling pathways throughout the region. However, there are no specifications on trail construction that apply to the York Region as a whole in the York Pedestrian and Cycling Master Plan (2008).

City of Brampton Brampton’s Block Plan Design Guidelines (2003) state that combined pedestrian/bicycle trails shall be paved but that trail development should be limited through wood lots in order to keep the existing vegetation healthy. Brampton’s Pathway’s Plan prioritizes multi-use trails and bike routes, both of which shall be paved. There is currently no exploration of permeable surfacing as a viable option in the City of Brampton trail design guidelines (City of Brampton Pathway’s Master Plan, 2002).

Town of Caledon While trail surfacing specifications are not currently included in the Caledon Trail Master Plan (2002), the plan is being updated for 2009 and will include construction and surfacing guidelines for Caledon region trails. In general, trails that connect housing subdivisions to downtown areas are paved, while trails through natural greenspaces are natural or limestone screening surfacing (Caledon Public Works, 2009).

City of Toronto The City of Toronto does not currently have trail construction guidelines but does much of its trail work in partnership with TRCA and therefore follows TRCA's guidelines and standards (Alex Shevchuk, Toronto Parks, Forestry and Recreation).

Town of Richmond Hill When considering which materials to use in a trail build, the Town of Richmond Hill takes the following factors in to consideration: z environmental protection; z safety; z accessibility; z desired trail experience; z maintenance.

Asphalt is used for surfacing main trails and some supporting connections while limestone screening or mulch is used for nature or "challenge" trails. The trail design and construction guidelines for Richmond Hill are well developed and can be found in the town’s Parks and Open Space Design and Construction Guidelines (2007).

City of Vaughan Surface options may include asphalt, concrete, granular and unit pavers, depending on the pathways intended use, setting and context. In urban areas, an asphalt surface is likely most appropriate, but it is recognized that in natural or environmentally-sensitive areas, a more natural surface type may be more suitable (City of Vaughan; Pedestrian and Bicycle Master Plan, 2008).

Town of Markham All trails are constructed using asphalt (or another hard surface) over compacted limestone screens (Lorenzo Mele, Engineering Department, Town of Markham). 94 Town of Whitchurch-Stouffville The Town of Whitchurch-Stouffville works in conjunction with TRCA on much of their trail construction projects and follows the TRCA Trail Planning and Design Guidelines (1992) when constructing trails in the area. This means that in town, trails are hard surface (i.e. asphalt) and in natural areas, trails are constructed using woodchips, or natural surfacing (Rob Raycroft, Leisure Services, Town of Whitchurch-Stouffville).

Township of Uxbridge The Township of Uxbridge uses wood chips for their trails in naturalized areas and limestone screenings through park areas. According to Town of Uxbridge staff, when these materials are compacted, both surfaces are accessible and fairly easy to maintain as well as accommodate bikes, strollers and wheelchairs for shorter distances. The Town of Uxbridge avoids the use of asphalt because of cost considerations (Bob Ferguson, Facilities, Town of Uxbridge).

RATIONALE Generally, urban trails in the Toronto region intended for multi-use, especially those designed for bikers and commuters, are paved. Nature trails and/or trails in environmentally sensitive areas are primarily surfaced with gravel or woodchips. For the most part, the municipalities do not follow regimented trail surface standard guidelines. One of the exceptions however, is Richmond Hill which has a progressive and well formulated trail surfacing protocol that can be reviewed in the Open Space Trail Design and Construction Guidelines (Town of Richmond Hill, 2007). Overall, trail surface is determined on a case-by-case basis and factors include trail location, permitted uses and user numbers.

BACKGROUND At Authority Meeting #1/09 held on February 27, 2009, Resolution #A3/09 regarding the authorization to commence a Class Environmental Assessment for the Royal Rouge Trail Erosion Control Project was approved as follows:

THAT staff be directed to commence a Class Environmental Assessment for the Royal Rouge Trail Erosion Control Project, 30 – 48 Royal Rouge Trail, City of Toronto.

Further, Councillor Glenn De Baeremaeker requested that staff provide additional information on Toronto and Region Conservation Authority’s (TRCA) involvement in the approval of the original subdivision plans for Royal Rouge Trail, and on the permit issued to the residents of 48 Royal Rouge Trail for the installation of a swimming pool.

The development and approval of the Deauville subdivision where Royal Rouge Trail is located, was reviewed by TRCA staff and approved by the City of Scarborough prior to the development of the Comprehensive Basin Management Plan, and the Valley and Stream Corridor Management Program developed and adopted by TRCA in the 1990’s.

Planning of the subdivision began in 1983 with a comprehensive site analysis and inspection. The initial inspections were conducted by the geotechnical engineering firm Soil Eng on behalf of Deauville Developments Limited, and concluded with the following recommendations: z vegetation, topsoil, and slope should remain undisturbed; z concentrated runoff should not be allowed to drain onto the slope face; and z structures should be set back at least 10 metres away from the existing top of bank.

The report also identified that there is potential for shallow slope failures in the upper section of the valley wall in the proposed area of development as the result of the water drainage pattern for the tableland.

This report was included with the draft site development plan, when circulated to TRCA staff for review in October of 1984. The compiled comments from staff regarding the draft subdivision plan addressed the following concerns: z grading; z stormwater management; z acquisition of the valley lands; z fencing; and z set back requirements for all structures. 96 TRCA comments also addressed a circulated Zoning By-Law (15907) Amendment pertaining to the Royal Rouge Trail development which specified that all buildings and structures be set back 10 metres from the rear property line, coincidental to the TRCA staked top of slope.

As part of the planning process for the subdivision, the City of Scarborough arranged the sale of the valley slope lands included in the parcel owned by Deauville Developments Limited to TRCA, to be added to the network of acquired lands within the Rouge Valley Corridor.

TRCA’s Senior Plans Analyst provided comments to the City of Scarborough in September 1985 regarding the final registration of the subdivision stating that all of TRCA’s concerns, as previously noted, had been addressed and there were no further objections regarding the proposed plan.

Final approval of the subdivision was authorized by the City of Scarborough. In conjunction with the approval of this site development plan a By-law (15907) was established for the subdivision that required a 10 metre structural setback limit from the rear property line for all major earth works including houses and swimming pools.

At that time, TRCA’s role in the approval and permitting of subdivision developments was limited to acting in a review capacity, to aid the municipality in reviewing stormwater management plans and geotechnical reports, and to provide comments and recommendations to the municipality for consideration in the approval and issuance of permits for the application.

The adoption of the Valley and Stream Corridor Management Program in 1994 marked a significant step forward in TRCA’s role in the planning of new subdivisions within the Toronto region. The Valley and Stream Corridor Management Program represents the establishment of new policy directions based on the evolution of previous planning documents including:

1980 Watershed Plan and 1986 Update; Flood Control Program; Erosion Control Program (Valleylands component only); Conservation Land Management Program; Stormwater Management Program; 1982 Environmentally Significant Areas Study; 1985 Parking Lot Policy 1987 Flood Susceptible Sites Policy; 1990 Comprehensive Basin Management Strategy for the Rouge River Watershed; and 1991 Special Policy Areas Policies.

97 The results of the adoption of the Valley and Stream Corridor Management Program represent the amalgamation of a number of updated planning policies including the introduction of designated corridors from which setbacks be required to adhere to, creating greenspace between developed parcels of land and environmentally significant areas. This program specifically promoted the establishment of a standard 10 metre buffer between the long-term stable slope crest and the proposed development area. Further, it provided TRCA with a strategic direction for the implementation of the 1989 TRCA (Former MTRCA) Greenspace Strategy. With respect to this subdivision specifically, the properties in question are immediately adjacent to Rouge Park and fall within the area that is governed by the more restrictive policies and principles of the Rouge Park Management Plan, May 1994 which was introduced the same year as the Valley and Stream Corridor Management Program. The Rouge Park Management Plan is a provincial plan which states that where comprehensive redevelopment is proposed, the park boundaries are to be extended 30 metres inland from the long-term stable slope crest

In 1998 a minor variance application to install a swimming pool in the rear lot at No. 48 Royal Rouge Trail (Lot 32) was approved by the City of Toronto. TRCA’s involvement with this process was limited to providing property clearance for the site as the proposed placement of the structure did not fall within the regulated 10 metre structural setback limit from the top of bank. The following recommendations were also provided to the City of Toronto regarding the installation of the swimming pool: z All excavated fill material from pool installation works will be removed from the site. z Under no circumstance should any pool discharge be directed to the rear, over the slope. z All discharge should be directed into the homeowner’s sanitary system.

As TRCA did not issue a permit in this instance, there is no way of assuring that the recommendations provided to the City of Toronto were incorporated as restrictions in the permit, or enforced during construction. Further, it is noted that the comments to the City of Toronto identified that residents with properties directly adjacent to the crest of the valley slope in this subdivision had been cautioned previously about developing in their rear lots, as the area may be subject to future erosion.

An in-depth review of TRCA files indicate that the approved rear property line for this subdivision was generally the visual crest of the valley slope as staked by TRCA, concurrent with the recommendations of the Soil Eng report for the original subdivision development plan, and that the permitting and approval of swimming pools within this subdivision was regulated by the City of Toronto (former City of Scarborough), with TRCA providing only property clearance, for works not located within the 10 metre setback limit from the crest of the valley slope.

At the time that the properties on Royal Rouge Trail were developed, the setback limit was applied specifically to protect structures, and not the long-term value of the properties themselves. With changes to the planning process through the introduction of the Valley and Stream Corridor Management Program, development setbacks are now applied from the long-term stable slope crest, whereby areas susceptible to natural processes such as erosion remain undeveloped.

98 As of May 2006, new regulation lines for this subdivision were put into effect requiring that a TRCA permit be obtained for any proposed site works within the regulated area under Regulation 166/06. An orthographic map of the subdivision with the new regulation line illustrated has been included for information purposes.

The Class Environmental Assessment recently commenced for this location is to prevent the significant loss of valuable tableland from erosion and slope instability, as identified in the Geotechnical Investigation and Slope Stability Analysis for 30 – 48 Royal Rouge Trail completed by Terraprobe Limited in 2008, as well as to preserve the ecological integrity of the Rouge Valley Corridor through this area.

The utility corridor will consist of the installation of a conduit above an existing concrete box culvert under Chrysler Drive in order to cross Etobicoke Creek. The conduit will be installed adjacent to an existing sidewalk above the culvert. The installation of the utility corridor will be installed via directional drilling method and the entry and exit locations are appropriately setback from the watercourse feature. As such, there are no ecology, geotechnical, hydrogeological, or flooding concerns with this application.

Control of Flooding: No excavated material is to be stockpiled within the Regional Storm Floodplain and all existing grades are to be maintained. As such, no impacts to the storage and/or conveyance of flood water is anticipated.

Pollution: Appropriate sediment and erosion controls will be installed and maintained on the subject property during all phases of construction.

Proposal: The purpose of the application is to undertake works within a TRCA Regulated Area of the Humber River Watershed in order to facilitate the construction of a right-turn lane on Torbram Road, south of Father Tobin Road, in the City of Brampton. The proposed works are associated with a commercial plaza development at the southeast corner of Torbram Road and Father Tobin Road. The works are adjacent to a tributary of the Humber River Watershed. The City of Brampton recently constructed a widening of Torbram Road, with associated drainage improvements. The Torbram Road widening works were reviewed and approved by the TRCA Executive Committee under CFN 37763 (Permit #C-06244). The road improvements proposed with this application were originally considered and reviewed under the Torbram Road widening TRCA permit, however, these works were not included in the construction contract with the City of Brampton. As such, a separate TRCA permit application has been submitted. The proposed turning lane will be constructed within the existing road allowance and no additional disturbance is proposed as a result of these works. In addition, there are no flooding, geotechnical, or ecology related concerns with this proposal.

Control of Flooding: The proposed works are located outside of the Regional Storm Floodplain. As such, no impacts to the storage and/or conveyance of flood waters are anticipated.

Pollution: Appropriate sediment and erosion controls will be installed and maintained on the subject property during all phases of construction. 103 Dynamic Beaches: Not applicable.

104 Proposal: The purpose of this proposal is to undertake works within a TRCA Regulated Area of the Humber River Watershed in order to facilitate the construction of a 2.4 metre wide gravel pedestrian pathway within an a valley corridor, between Eiffel Road and Countryside Drive, located within the City of Brampton. This proposal is 'Phase Two' of a two staged pedestrian pathway development for the Highlands of Castlemore subdivision (Draft Plan of Subdivision 21T-00015B). A TRCA permit was issued for 'Phase One' of the trail construction, which involved the construction of a paved pedestrian pathway north of Eiffel Road to Mayfield Road, within an ill-defined drainage corridor (Permit No. C-07243). This phase of the proposed trail was contemplated as part of the original approval, but later removed due to TRCA’s concerns with its original alignment. The alignment of the trail has been revised in order to address previous concerns. This project is being coordinated by City of Brampton staff. The proposed pathway alignment has been designed to preserve and enhance the existing ecological conditions to the greatest extent possible. An enhancement planting has been provided as part of this submission in order to increase the ecological functions of the natural heritage feature in this area. In addition, no in-water works are associated with this project.

Control of Flooding: A portion of the proposed trail is located within the Regional Storm Floodplain. TRCA Water Resources staff do not anticipate any adverse impacts to the storage and/or conveyance of flood waters as a result of these works.

Pollution: Appropriate erosion and sediment control measures have been proposed with this application, and will be maintained throughout all phases of construction.

Dynamic Beaches: Not applicable.

Erosion: There are no geotechnical and/or slope stability concerns associated with this proposal.

Conservation of Land: No significant vegetation will be removed as a result of construction. However, an extensive enhancement planting plan is proposed with this application. The landscape plan includes planting a diversity of native and non-invasive species within the stream corridor feature to increase the ecological functions of this area. There are no in-water works associated with this project. As such, there are no fisheries related concerns.

Plantings All proposed plantings within the stream corridor are native and non-invasive species and are consistent with TRCA's planting guidelines.

Policy Guidelines: This proposal is in conformity with Section 4.1.2 - New Resource-based Uses and Section 4.3 - Infrastructure and Servicing - of the Authority's Valley and Stream Corridor Management Program (VSCMP).

10.4 1503 STREAMSIDE COURT To change a building or structure so that it alters its use or potential use, increases its size or increases the number of dwelling units on Lot 3, Plan 40M-1638, (1503 Streamside Court), in the City of Pickering, Frenchman's Bay Watershed.

The purpose is to permit an addition to the existing attached garage.

RATIONALE The application was reviewed by staff on the basis of the following information:

Proposal: The applicant is proposing an addition to the existing attached garage. The subject site is located east of Sandy Beach Road, south of Bayly St. W and backs on to Krosno Creek within a TRCA Regulated Area of the Frenchman's Bay Watershed. The existing structure is located within the Regional Storm Floodplain, which extends beyond the Krosno Creek valleylands. The proposed addition extends closer to the defined top of bank. However, the required minimum 10 metre buffer from top of bank is maintained.

Control of Flooding: The existing structure is located within the regulatory floodplain. The applicant has satisfied TRCA concerns regarding potential flooding by dry flood-proofing the addition to the level of the regulatory flood.

Pollution: Appropriate sediment control fencing is to be installed as indicated by a TRCA redline revision on Drawing A-1. The sediment control fencing will totally enclose the area of disturbance and will prevent the escape of demolition and construction debris and sediment run-off into the adjacent conservation lands. 106 Dynamic Beaches: Not applicable

Erosion: The rear yard slope is very minor and the construction will take place approximately 20 metres from the major grade change at the creek wall. The proposed addition will not negatively affect slope stability or create additional erosion hazards.

TRCA geotechnical engineering staff are satisfied that the proposal will have no impact on the long term stability of the slope.

Conservation of Land: The proposal is not located in a significant area and no significant vegetation will be removed.

Plantings Extensive native plantings and a ravine stewardship plan will be provided for the slope and the buffer between the proposed dwellings and the top of bank.

Policy Guidelines: The proposed works are consistent with Section 4.2.1., Development and Redevelopment/Intensification Within Established Communities/Highly Urbanized Areas, of the TRCA's Valley and Stream Corridor Management Program.

10.25 60 PINE CRESCENT To construct, reconstruct, erect or place a building or structure on Lot 96, Plan M-390, (60 Pine Crescent), in the City of Toronto (Toronto and East York Community Council Area), Waterfront Watershed.

The purpose is to develop within a TRCA Regulated Area of the Don River Watershed in order to facilitate the construction of a replacement retaining wall in the rear yard of the existing single family detached dwelling. The existing retaining wall is in poor/failing condition.

The permit will be issued for the period of April 17, 2009 to April 16, 2011 in accordance with the following documents and plans which form part of this permit:
