Property No. 377 LAND IN THE PLYTRA AREA MUNICIPALITY OF THE PREFECTURE OF

PROPERTY LOCATION The property falls within the settlement of Plytra in the Municipality of Monemvasia in the Prefecture of Laconia, in the west of the third (eastern) leg of the . Plytra is a seaside, sparsely built settlement which lies 19 km from Monemvasia on a straight line, but 33 km by road. The area can be accessed by the Molai-Plytra provisional road which is narrow with curves in certain sections, and parts that pass through other villages. Plytra beach lies very close to Papadianika in the Municipality of Monemvasia (4 km away). It lies 290 km from Athens and 73 km

from Sparta. It can be accessed from Athens via the modern Athens - Tripoli National Road (the E65) and then via the Tripoli - Sparta National Road and then via the Sparta - Monemvasia National Road, and by turning off on to the Moloai - Plytra provincial road.

DESCRIPTION OF PROPERTY This is a coastal, public property (No. 377) located within the boundaries of the settlement of Plytra. It is sited on the coastal road of the settlement of Plytra just 14 m from the demarcated foreshore (Government Gazette 209/D/1970). The settlement of Plytra was demarcated by Government Gazette 713/D/1989. Within the settlement, there is one section with an approved street planning scheme. Property No. 377 is located outside of the approved street plan but within the boundaries of the settlement of Plytra. The property lies very close to the sandy beach of Plytra (just 100 m) but the beach just in front of the property is rocky. It offers a clear view out across the bay of Laconia. According to the August 2002 survey diagram prepared by Hellenic Republic Real Estate Corporation, the surface area of the property is approximately 15,000 m2 following concession of a strip of land 9 m wide on the seaward side to the Municipality to create a coastal road, car park, green areas and seating (HRREC

deed of concession and Asopos Municipal Council Decision No. 180/2003). That area covered 1,620 m2. Following concession of a section of land of 963.07 m2 on the north and west of the plot to create a municipal road (Joint Ministerial Decision No. 1013748/1005/Α0010/11-09.2006 of the Minister and Deputy Minister of Economy & Finance), due to reduction of the surface area of the plot because of the siting of the northern municipal road, the current surface area is around 12,000 m2. A survey diagram is being prepared.

PLANNING STATUS The planning status for the area is set out in the following issues of the Government Gazette: 1. Government Gazette 713/D/1989, decision on categorisation and demarcation of boundaries of the settlement of Plytra in the Community of Papadianika, Prefecture of Laconia, setting of construction terms, conditions and restrictions. In addition to demarcating the settlement, this decision also defines the planning requirements for plots located outside the approved street planning scheme and the section of Plytra located within the boundaries of the settlement, stating the a plot must measure 1,000 m2 (derogation: any plot size was permissible on 3.5.1985). The maximum permissible height was set at 7.5 m + 2 m for the roof. Special construction terms and conditions were laid down and it was clarified that in order for a building permit to be issued anywhere within the demarcated settlement it was necessary to obtain the consent of the 5th Ephorate of Prehistoric and Classical Antiquities of Sparta after a check of the foundations was made. 2. Government Gazette 477/D/1992 amending Decision No. Π- 1857/88/13.11.89 of the Prefect of Laconia on categorisation and demarcation of boundaries of the settlement of Plytra in the Community of Papadianika, Prefecture of Laconia, setting of construction terms, conditions and restrictions. 3. Government Gazette 879/D/2003, decision amending the special construction terms, conditions and restrictions for the coastal settlements of Plytra and Archangelos in the Municipality of Asopos. 4. Government Gazette 209/D/1970 laying down the boundaries of the foreshore at Plytra. Government Gazette 181/D/1985 as amended by Government Gazette 289/Compulsory Purchase Orders & Planning Issues/2011 on the method for designating the boundaries of settlements nationwide with a population of up to 2,000 residents, categorisation thereof and designation of construction terms, conditions and restrictions. Article 1(1) of Government Gazette 289/Compulsory Purchase Orders & Planning Issues/2011 states that the minimum length of a plot's façade is 10 m for plots with a surface area of up to 500 m2, and 15 m for plots over 500 m2. Article 6(7) of President Decree 24/31.5.1985 (Government Gazette 181/D/1985) states that where there is a designated foreshore line, buildings must

be located at a distance of at least 15 m from the foreshore line. Article 6(4) also states that it is permissible on plots which are fit for building on an meet planning law requirements, to increase the area that can be built, provided that a section of the plot is left as a continuous strip along the length of the façade of the plot and conceded to the Community free of charge by the owner to create a communal area. The area that can be built on as part of this increase is 30% of the section of land conceded. The increase cannot be more than 300 m2 and the whole thing must be effectuated by notarial deed.

On plots over 700 m2 in size, it is permitted to construct a building for any use (Article 1(2)(b.2) of Government Gazette 289/Compulsory Purchase Orders & Planning Issues/2011). As far as permissible land uses are concerned, Article 7(3) of Government Gazette 181/D/1985 prohibits the construction of high or average nuisance industrial or craft facilities within the boundaries of settlements or within a 500 m zone around them.
