iv ELECTIONS NOVA SCOTIA Introduction

Four by-elections were held in the year 2019. The first was in the electoral district of Sackville-Cobequid on June 18, 2019. The remaining three by-elections were held on September 3, 2019, in the electoral districts of Argyle-Barrington, Northside-Westmount, and Sydney River-Mira-Louisbourg.

The Sackville-Cobequid by-election was called because of the resignation of Dave Wilson (NDP) as a Member of the Legislative Assembly on November 16, 2018. On May 15, 2019, pursuant to an Order of the Lieutenant Governor in Council, a writ of election was issued under the Elections Act (the Act) by Richard Temporale, Chief Electoral Officer (CEO), to the acting returning officer (RO) for the electoral district of Sackville-Cobequid, ordering that an election be held on Tuesday, June 18, 2019. On June 20, at the Official Addition, (PC) was determined to have the most votes. On Friday, June 28, 2019 he was declared elected with the return of the completed writ of election.

On July 31, 2019, three Members of the Nova Scotia Legislative Assembly, Chris d’Entremont (PC), Eddie Orrell (PC), and Alfie MacLeod (PC), resigned from their seats to run in the October 2019 Federal election. This left vacancies in the electoral districts of Argyle-Barrington, Northside-Westmount, and Sydney River-Mira-Louisbourg. On August 2, 2019, pursuant to an Order of the Lieutenant Governor in Council, writs of election were issued under the Act by the CEO, to the ROs for these electoral districts ordering that elections be held on Tuesday, September 3, 2019. On September 5, at the Official Addition, the following candidates were determined to have the most votes and were declared elected with the return of the completed writs of election on Friday, September 13, 2019: • Argyle-Barrington – Colton LeBlanc (PC) • Northside-Westmount – Murray Ryan (PC) • Sydney River-Mira-Louisbourg – (PC)

The CEO published an election calendar for each event, copies of which are shown in Appendix A. The calendars identify important dates such as date of writ, voting opportunities, close of nominations, election day and return of writ of election.

This report contains the statement of votes, financial information, and statistics for all four by-elections.

PROCEEDINGS OF BY-ELECTIONS IN 2019 1 Voting Opportunities

Electors in all four by-elections had several voting opportunities available to cast their ballot. Voting was available prior to election day through write-in ballots, continuous polls at each returning office, and at advance polls. On election day voters could cast their ballot at their designated poll location or at their district’s returning office. Mobile polls were also held on election day to allow voters in residential centers better access and voting assistance if needed.

In each by-election, applications for a write-in ballot were available to all electors upon the opening of the returning offices. Write-in ballot teams visited the homes of voters who could not make it to a poll location during the election period.

A continuous poll was held at the returning office in each district during these by- elections. The continuous polls were available every day (except Sundays) from the opening of the returning offices through to election day.

Advance polls were held for seven days as indicated in the election calendars in Appendix A. Advance poll locations were set up in each district except Sydney River-Mira- Louisbourg.

For the by-elections in Argyle-Barrington, Northside-Westmount, and Sydney River-Mira- Louisbourg, electors could vote in any of the three districts prior to election day just like in a provincial general election (PGE).

Table 1 provides a summary of the number of votes cast by each voting opportunity in each electoral district that held a by-election.

Voter Participation

During each by-election, voters could register and be added to the list of electors. Revisions were made to the list throughout the by-elections.

There are three versions of the list of electors certified by the returning officer. The preliminary list of electors must be certified by Day 22 of the election calendar (Appendix A) and may be distributed to nominated candidates. The revised list of electors is certified by Day 11, the first day of advance polls. The official list of electors is certified by Day 2 and is used at the election day polls. After the writ of election is returned, the final list of electors is completed and made available to the political parties that ran candidates and the newly elected members for each district.

A personalized Voter Information Card (VIC) was mailed to each voter on the preliminary list. The VIC package included information about all available voting opportunities and the choices of candidates by name and party.

Table 3 shows the participation of eligible electors in each by-election, by age group.

Early Voter Turnout over 10 years

The trend of voting before election day continues to grow. In general elections early voting has increased from 15% in 2009 to 25% in 2013 and 30% in 2017. By-elections have followed a similar trend. Increased opportunities to vote have been a factor that have contributed to the rise in early voting. In 2016, legislation was amended to increase the number of days for advance polls from 2 to 7 days. Table 5 shows early voter turnout in by-elections over the last 10 years.

Rejected Ballots

During the count after the close of polls on election day, ballots that are not clearly marked for one of the registered candidates are reported as ‘rejected’.

We acknowledge that this accounting is not relevant to determining who won the election. In the context of why we encounter rejected ballots in the electoral process, their scrutiny after the fact is informative, and therefore, worth reporting. ENS reviews the rejected ballots after each election to understand the reasons ballots are rejected and to improve the ballot and voting processes.

Table 6 provides the number of rejected ballots by voting opportunity for each electoral district.

Number of Seats in the House of Assembly

Prior to the by-elections in 2019 the distribution of 51 seats in the Nova Scotia House of Assembly was: 27 NSLP, 17 PC, and 7 NDP. The vacancy in Sackville-Cobequid made the seat count in the House: 27 NSLP, 17 PC, 6 NDP, 1 vacancy.

During the writ prior for the Sackville-Cobequid by-election, the Member for Truro-Bible Hill-Millbrook-Salmon River (Lenore Zann) declared herself independent on June 7, 2019. This made the distribution of seats as follows: 27 NSLP, 17 PC, 5 NDP, 1 independent, and 1 vacancy (Sackville-Cobequid).

At the conclusion of the June 18, 2019 Sackville-Cobequid by-election, the distribution was: 27 NSLP, 18 PC, 5 NDP, and 1 independent.

Following that by-election, on June 24, 2019 the Member for Cape Breton-Richmond () was removed from the PC Caucus and became independent. This left the seat distribution as follows: 27 NSLP, 17 PC, 5 NDP, and 2 independent.

On July 31, 2019, the Members for Argyle-Barrington (Chris d’Entremont), Northside- Westmount (Eddie Orrell), and Sydney River-Mira-Louisbourg (Alfie MacLeod) resigned their seats. This left the seat distribution as follows: 27 NSLP, 14 PC, 5 NDP, 2 independent, 3 vacancies.

At the conclusion of the September 3rd by-elections in Argyle-Barrington, Northside- Westmount, and Sydney River-Mira-Louisbourg the distribution of 51 seats in the Nova Scotia House of Assembly was: 27 NSLP; 17 PC, 5 NDP, and 2 independent.

On September 12, 2019, Lenore Zann vacated her seat in Truro-Bible Hill-Millbrook- Salmon River. This left the seat distribution at follows: 27 NSLP, 17 PC, 5 NDP, 1 independent, and 1 vacancy.

The reporting of election expenses is important to ensure that all election spending stays within the legislated limits as defined by theAct as they are key components of the electoral finance regime in Nova Scotia.

Registered Parties’ Expense Limits

The Act sets out formulas by which registered party spending limits are established. Within 120 days of the date of the return of the writ of election, the official agent of each registered party that fielded a candidate is required to file a report of election expenses with supporting receipts and an independent auditor’s opinion respecting the report. The Act does not provide for the reimbursement of registered party election expenses. The CEO waived the requirement for registered parties to have an audit of their expenses if costs incurred were less than $500 for these by-elections.

The votes cast per party candidate in a by-election do not alter the amount of public funding each registered party receives annually through ENS. This amount is based on the votes cast for all party candidates throughout the province in the last PGE.

Table 7 shows the expenses for the registered parties that endorsed candidates in these four by-elections. The table includes the spending limits set for registered parties in each by-election and the date each party filed their report.

* The first submission was received from the NDP Party in October 2019 and following the in-depth review, further information and supporting documentation was requested, particularly for the invoices charged to the candidate by the NDP party. An amended report was received on January 24, 2020 that met the requirements for supporting documentation and included an audit report. Based on the issues encountered with this file, ENS has provided additional training to the party’s team on the requirements of the Act.

The Act provides the formula for calculating the maximum amount that a candidate may incur for election expenses. The final limit is based on the greater of the number of electors on either the preliminary or final lists of electors.

A candidate who receives at least 10% of the valid votes cast in their electoral district is eligible to receive reimbursement of election expenses. The amount of reimbursement is the lesser of the maximum reimbursement amount or the candidate’s actual election expenses. Table 8 provides the candidate expense and reimbursement limits for the four by-elections based on the final list of electors for each district.

Candidates, Official Agents, and Report Filing

The Act requires each candidate to appoint an Official Agent (OA) and provide their name and address on their nomination papers. The OA of a candidate is responsible for all financial aspects of the campaign and is required to file reports detailing election expenses, political contributions, and tax receipts. If candidate expenses exceed $500, an audit must be conducted for certain reports. The Act requires the auditor appointed by the candidate be an accountant licensed to audit with Chartered Professional Accountants of Nova Scotia (CPANS).

Table 9 provides a listing of reports that must be filed by the OA of a candidate including the statutory reference, the audit requirement, and the filing deadlines. In addition to the listed filing deadlines, unused tax receipts must be returned to ENS within 30 days of election day.

ENS staff offered local training sessions in advance of each by-election to assist the OAs in understanding their duties and the preparations of the required reports.

12 ELECTIONS NOVA SCOTIA Candidate Nomination Deposit

When a candidate files their nomination papers with the RO, theAct requires the candidate provide a deposit of $200. Following the 2017 PGE and based on the Court of Queen’s Bench decision in Alberta ruling that the nomination deposit requirement for federal elections infringe on section 3 of the Canadian Charter of Rights and Freedoms, the CEO recommended removing the requirement for the nomination deposit. Based on this recommendation, the CEO waived the nomination deposit requirement for by- elections held since 2017 including all four of these by-elections.

In the Spring 2020 session of the House of Assembly, the Legislature passed amendments to the Act based on the CEO’s recommendations from the 2017 PGE. The elimination of the nomination deposit was not included in these amendments and remains in the Act.

Candidate Audit Fee

Under Section 18 of the Tariff of Fees and Expenses (Tariff), the OA of a candidate can be reimbursed for all or a portion of their costs for audit fees. Where a candidate’s election expenses amount to less than $500, an audit report is not required. A candidate’s eligibility to be reimbursed for audit costs is not conditional on receiving a minimum threshold of the valid votes cast. The amount of reimbursement a candidate may receive is the lesser of $828.22 or the auditor’s fee. The audit fee reimbursed to each candidate is shown in Table 11.

Summary of Candidate Election Expenses and Reimbursements

The election expenses report filed by the OA of a candidate receives a detailed compliance review by the financial staff of the CEO. All expenses reported must meet the definition of election expenses in the Act. Pursuant to the Act any payment of $25 or more for election expenses must be evidenced by a receipt. Table 11 shows each candidate’s expenses as categorized in their election expenses report (Form 2-3E and 2-3F) as amended by the detailed compliance review.

ENS makes every effort to record and report all costs associated with the delivery of each election. Costs associated with election service delivery can be categorized as either direct costs or indirect costs.

Direct costs are costs that can be specifically identified with a returning office. For reporting purposes, direct costs are consolidated into various categories.

Indirect costs are those overhead costs associated with the by-election’s administration and election operations incurred by ENS as part of election service delivery.

A third party is an individual or group that is not a candidate, registered party or electoral district association that has chosen to publicly voice an opinion that could affect the outcome of the election. The Act requires third parties to register and report their spending if they have spent $500 or more on election advertising. Election advertising is a message that promotes or opposes a registered party or candidate or takes a position on an issue associated with a registered party or candidate. According to the Act, the limit for third party advertising in these by-elections was set as follows: • June 18, 2020 Sackville- Cobequid - $2,261.58 • September 3, 2019 Three By-elections - $6,784.73

No third party advertisers registered for the by-elections in 2019.

18 ELECTIONS NOVA SCOTIA Compliance

The CEO is responsible for enforcing fairness, impartiality and compliance with the Act, and may investigate matters during an election period that might constitute an offence under the Act. During the by-elections in 2019 there were two incidents that arose requiring the CEO to investigate and respond.

Sackville-Cobequid

On May 16, 2019, Elections Nova Scotia (ENS) received a complaint that Steve Craig, the PC candidate in the Sackville-Cobequid by-election and the Municipal Councillor for District 15 (Lower Sackville) in the Halifax Regional Municipality (HRM), may have breached the Act by taking advantage of municipal resources to promote himself as a candidate in a provincial by-election. The complaint contained two allegations.

The first allegation was that Mr. Craig distributed a newsletter in the election period using municipal funds which was election advertising and did not include an indication that the advertising was authorized by the official agent of the candidate.

The second allegation was that Mr. Craig attended an event on May 15, 2019 where he gave a $20,000 cheque from the municipal district capital fund to a local community group and that the cheque was made in exchange for receiving votes of one or more persons.

On May 17, 2019, the CEO launched an investigation under the authority of subsections 4(a), 5(p) and 287 of the Act.

Based on the investigation, the CEO came to the following conclusions: • For the first allegation regarding the newsletter distribution it was determined that the newsletter was distributed before the election period began (prior to the issuance of the writ on May 15, 2019), therefore the allegation was dismissed. • For the second allegation, the CEO concluded that the funds provided by Mr. Craig from the municipal District Capital Fund to the local community group was done as part of his responsibilities as an HRM councillor and was not intended to promote Mr. Craig as a candidate in the Sackville-Cobequid by-election.

Although it was determined that Mr. Craig had not breached the Act, the CEO felt that the provision of funds by an elected official in one level of government should not be permitted while that official is running for election at another level of government. The CEO made recommendations to this regard in a report published on May 29, 2019. Those recommendations are also included in this report.

PROCEEDINGS OF BY-ELECTIONS IN 2019 19 Northside-Westmount

On August 7, 2019, voting began for the September 3rd by-elections as the Act requires voting to be established on the 27th day prior to election day. When voting began, Danny Laffin was registered as the PC candidate for Northside-Westmount.

As specified by the Act, nominations close at 2pm on the 20th day before the election. Nominations for the September 3rd by-elections closed at 2 pm on August 14, 2019. However, before the close of nominations, the PC party withdrew their endorsement of Mr. Laffin and endorsed a new candidate, Murray Ryan whose nomination papers were accepted by the RO on August 14. Mr. Laffin continued to contest the by-election in Northside-Westmount as an independent candidate.

There were 135 ballots cast at Northside-Westmount returning office prior to the close of nominations. There was also one out-of-district vote cast prior to the close of nominations in the Sydney River-Mira-Louisbourg district by a voter from Northside-Westmount. In total, 136 ballots were cast prior to the close of nominations in the Northside-Westmount by-election.

These early votes were all cast using the write-in ballot format which included the registered party names and provided a space for voters to write a candidate’s name if they so choose.

The CEO determined the process for counting the votes and shared that process with the registered parties, candidates, and the public on August 21, 2019. The ballots were subsequently counted as follows: • A ballot marked only for the PC party name was counted towards the PC candidate, Murray Ryan. • A ballot that included only Danny Laffin’s name as a candidate was counted towards Mr. Laffin. • A ballot that included both Danny Laffin’s name as a candidate and was marked for the PC party was counted towards Mr. Laffin.

Following the 2017 PGE, the CEO, in his report to the Legislature made the following recommendations for legislative change regarding voting before the close of nominations: • Voting commence at 4:00 pm, two hours after nominations close on Day 20 so that voters may be made fully aware of all nominated candidates contesting the election in their home electoral district; and • Any elector who cannot attend a poll after nominations close on Day 20, apply and be pre-approved to be sent a write-in ballot kit on Day 19 along with a list of the candidates contesting the election in their district.

These recommendations were not included in the amendments to the Act approved by the House of Assembly in the spring 2020 Legislative session.

In addition to these recommendations, the CEO made modifications to the write-in-ballot to emphasize writing the candidate’s name if known over the party name in order to improve the clarity of the intention of the voter.

20 ELECTIONS NOVA SCOTIA Chief Electoral Officer Recommendations

Sackville-Cobequid Recommendations

Based on the investigation into the alleged breaches of the Act by Steve Craig in the Sackville-Cobequid by-election, The CEO made the following recommendations:

Recommendation 1: The CEO recommends that the Elections Act be modified to require elected local officials and members of other legislative assemblies to, at minimum, take a leave of absence from their other elected position during the election period.

Recommendation 2: The CEO recommends that HRM consider updating their guidelines to reflect updates to theElections Act.

These recommendations were published on May 29, 2019, on the ENS website and that report was shared with Member of the Legislative Assembly.

In response to these recommendations both HRM and the Provincial Department of Municipal Affairs introduced policy changes and legislative amendments to protect against potential conflicts of interest. In June 2019, HRM made a resolution to require Councillors to take a leave of absence if they register as a candidate in an election at another level of government. During the fall 2019 session of the House of Assembly, amendments were made to the House of Assembly Act to require members of the Legislative Assembly to resign if they are running for office for another level of government, and amendments to the Municipal Elections Act were made to require municipalities to establish policies that address councilors running for other levels of government.

ENS is committed to making our reports easy to read and understand. To achieve this, we measure and work to improve the readability of our reports, manuals, and other public- facing content and report on our progress.

We have selected the Flesch-Kincaid Grade Level tool to help determine readability. The Flesch-Kincaid measures the years of schooling that is estimated to be needed to understand a document. We strive for our reports to be high school level 12.0.
