Executive Summary
Under the Environment Act 1995, local authorities are required to Review and Assess (R&A) air quality on a regular basis. A review of air quality means a consideration of the levels of pollutants in the air for which objectives are prescribed in Regulations 1, and estimations of likely future levels. An assessment of air quality is the consideration of whether estimated levels for the relevant future period are likely to exceed the levels set in the objectives. The first review and assessment round was completed in 2003. The main conclusion was that the national air quality objectives were not likely to be exceeded at any locations in Braintree District. Since that time review and assessments of air quality have been carried out each year. For local authorities where no exceedance is determined within updating and screening assessments (USA) carried out every three years (last USA in 2009) there is a requirement to undertake a progress report of air quality by the end of April for the two following years. In 2009 no exceedances of pollutant objective levels were determined and this was repeated in 2010. This Progress Report identifies those aspects that have changed since the last round of review and assessment, the USA and PR. The report concentrates on the progress on implementing local air quality management and achieving or maintaining concentrations below the air quality objectives. These aims are demonstrated by reporting on updated monitoring data and new local developments that might affect air quality. The report shows that as in 2009 there are elevated levels identified alongside the A12 at Hatfield Peverel and at Chipping Hill at Witham and in addition for 2010 elevated levels at the Bradwell site alongside the A120 and at two new monitoring sites at Rivenhall alongside the A12. The sites do not reflect points of relevant exposure and when corrected the maximum NO2 level predicted is 38.5 g/m 3 (for one Rivenhall site alongside the A12). There are no diffusion tube sites with annual mean NO 2 concentrations in excess of 60 µg/m 3 in Braintree and it is considered unlikely that there will be any exceedences of the hourly NO 2 objective. It is concluded that air quality objectives were not exceeded in 2010, nor is there evidence to conclude that there is a risk of exceedance in 2011 and Braintree is not therefore required to undertake any Detailed Assessments of air quality in 2011.

Braintree is a largely rural district and has the second largest geographical area in Essex, covering 612 square kilometres. Just over half of the population lives in one of the three main towns of Braintree, Halstead and Witham. The main administrative centre is the market town of Braintree. The main sources of air pollution in Braintree are busy roads, such as the A12 and A120. There are 76 industrial processes (as at 31 st March 2011) that are permitted by the Council. The majority numbering 56 comprising dry cleaners, petrol stations, small waste oil burners, vehicle resprayers and mobile concrete crushers/screens. There are three A2 processes in Witham. 1.2 Purpose of Progress Report
Progress Reports are required in the intervening years between the three yearly Updating and Screening Assessment reports. Their purpose is to maintain continuity in the Local Air Quality Management process. They are not intended to be as detailed as Updating and Screening Assessment Reports, or to require as much effort. However, if the Progress Report identifies the risk of exceedence of an Air Quality Objective, the Local Authority (LA) should undertake a Detailed Assessment immediately, and not wait until the next round of Review and Assessment. 1.3 Air Quality Objectives
The air quality objectives applicable to Local Air Quality Management (LAQM) in England are set out in the Air Quality (England) Regulations 2000 (SI 928), and the Air Quality (England) (Amendment) Regulations 2002 (SI 3043). They are shown in Table 1.1. This table shows the objectives in units of microgrammes per cubic metre µg/m3 (for carbon monoxide the units used are milligrammes per cubic metre, mg /m3). Table 1.1. includes the number of permitted exceedences in any given year (where applicable).

Braintree District Council undertook its First Round of review and assessment, including Stage 1, 2 and 3 reports, between 1999 – 2001. The main air quality issues were found to be emissions of NO 2 and PM 10 from vehicles on the A12 and A120. It was predicted that all of the air quality objectives would be achieved and that it was therefore not necessary to declare any AQMA for any pollutant. The second round of Review and Assessment was undertaken between 2003 and 2005. The 2003 USA considered the seven LAQM pollutants and found that the AQS objectives would be met by the target dates. It was however recommended that the Council expand its diffusion tube monitoring programme to include the nearest receptors to the A12, to confirm the USA findings for NO 2. The 2005 Progress Report (Braintree, 2005) showed that the Council was still meeting the AQS objectives. NO 2 and PM 10 monitored concentration levels were found to be high as expected at a site immediately adjacent to the A12 in Hatfield Peverel but there is no relevant exposure at this site. The chosen site offered safe access which was a significant consideration. The third round USA was completed in 2006 and revisited the results of previous assessments to determine whether there were any areas of concern for air quality within Braintree District Council. The USA concluded that there was still no risk of exceedence of the objectives therefore a Detailed Assessment was not required at this stage. The 2007 and 2008 Progress Reports confirmed the findings of the USA. The fourth round Updating and Screening Assessment review of 2008 monitoring data showed that one exceedence of the NO 2 annual mean objective level had been measured in 2008 at the Hatfield Peverel NO 2 diffusion tube site situated next to the A12. There is no relevant exposure within 30m of the site, but there were sensitive receptors close to the A12. A table of receptors and distance from carriage way is included in the report. Appendix 4. It should be noted that the closest sensitive residential properties in Hatfield Peverel (The Terrace) were demolished in 2009 and for other residential facades in Hatfield Peverel, the A12 is in a cutting which further increases the road to façade distance. In 2010 Progress Report no exceedances at points of exposure were determined but the conclusion was to continue to assess NO 2 levels along the A 12 to assess the impact to sensitive receptors. There are no diffusion tube sites with annual mean NO 2 concentrations in excess of 60 µg/m 3 in Braintree and it was considered unlikely that there will be any exceedences of the hourly NO 2 objective.

Braintree District Council does not operate any continuous NO 2 monitoring sites in their district and therefore a local bias adjustment factor cannot be calculated. In the absence of a local bias correction factor, the default bias correction factor for Bristol District Council Scientific Services analysis using the 20% TEA in water method has been used based on 7 studies obtained from the LAQM DEFRA website 1. The factor is calculated as 0.85 for 2010 including all the roadside locations.

Braintree District Council undertook monitoring at 12 NO 2 diffusion tubes sites in 2010. In 2010 two new sites were introduced alongside the A12 at Rivenhall to the south and northbound sides of the carriageway. There was only 58% and 42% data capture respectively. Annualising the data has given levels of 50.3 g/m 3 and 55.5µg/m 3 at the monitoring sites. The supporting lamp post for the Bradwell site was removed by county council without notice and a new monitoring point has been introduced at similar distance to the kerb about approximately 10m from the original position. This explains the low data capture and may partly explain the 15% increase in nitrogen dioxide concentration levels against the past year at the Bradwell site alongside the A120 and it will be reviewed over the forthcoming years as to whether this increase is sustained and can be linked to specific factors. The single lane road has a 40mph speed limit at the monitoring point but is a strategic link road between the A12 and the dualled part of the A120 to Stansted. The Chipping Hill site was examined in more detail in 2010 progress report. There has been a slight increase in level from 49.3 to 50.3µg/m 3 at the point of monitoring although these do not represent sites of relevant exposure.

1.2.1 Nitrogen Dioxide
Diffusion Tube Monitoring Data
The NO 2 diffusion tube data are summarised in the Table 2.2. The full dataset (monthly mean values) are included in Appendix 3 including annualisation ratios. The 2010 diffusion tube results show five monitoring location exceeding the annual mean NO 2 objective concentration: Hatfield Peverel – A12 Rivenhall Hotel – A12 Foxden, Rivenhall – A12 Witham – Chipping Hill Bradwell – A120 The Hatfield Peverel diffusion tube site is approximately 2m from the edge of the A12 south bound carriageway, south of Hatfield Peverel Village. There is no relevant exposure within 30m of the site, but there are sensitive receptors that lie close to the A12 as it travels through rural areas of the parishes Feering, Kelvedon, Rivenhall. Diffusion tubes were added at two points either side of A12 at Rivenhall. Appendix 3 shows of table of the nearest receptors on the A12. The data capture was less than 100% for all of these sites as shown in Table 2.2. The results have been annualised using automatic monitoring stations at Thurrock Stanford Le Hope, St Osyth and Cambridge as shown at appendix 1. When results are corrected to account for the relevant exposure points the levels are all less than the NO 2 objective level as shown in appendix 3. For the highest level of 38.5 g/m 3 at the Rivenhall Hotel site then the data capture was only 58% and therefore the data will be reviewed in 2011 particularly as there are other receptors close to the A12. With respect to the hourly NO 2 objective, there are no diffusion tubes sites with annual 3 mean NO 2 concentrations in excess of 60 µg/m , and therefore it is unlikely that there will be any exceedences of the hourly NO 2 objective.

2 New Local Developments
Braintree has identified the following new local development which may impact on air quality in the Local Authority area. As for 2010 report the Rivenhall Airfield incinerator This will be taken into consideration in the next Updating and Screening Assessment, scheduled for 2012.

3 Local / Regional Air Quality Strategy
Braintree District Strategic Partnership has published a sustainable community strategy entitled One District One Vision. In particular reference to road traffic pollutants then the document quotes – ‘ Local road networks also need to be maintained and improved at key points to encourage more efficient local public transport, improve air quality, and reduce local congestion If car use is to be reduced, congestion and pollution reduced and healthy lifestyles encouraged, good high quality walking, cycling and local bus links need to be made between all parts of the towns and new developments. The use of the car for local trips needs to be minimised as far as practicable, to reduce congestion, pollution, and promote healthier living.’

4 Planning Applications
The Rivenhall Airfield incinerator ECC waste planning application was permitted in 2009 following a public inquiry. This was subject to an air quality assessment and does present some concern in respect of a deterioration of air quality in that locality although predicted levels suggest that there will be no exceedances of objectives due to the distance from relevant exposure and a significant chimney height to promote dispersion. The incinerator operator is still required to submit an Integrated Pollution Prevention and Control application to the Environment Agency. There have been speculative enquiries in respect of developments for local supermarkets and industrial units and there is a continual stream of applications for small building sites.

5 Local Transport Plans and Strategies
Braintree District is covered by the Essex County Council Local Transport Plan. There are a number of general measures in the Essex LTP which are aimed at reducing the impact of road transport on air quality. The District Council is working in partnership with Essex County Council Development, Highways and Transportation department to ensure that new traffic management schemes consider the potential impact on air quality. Additional air quality monitoring programmes are being introduced as part of the monitoring requirements of the LTP. The plan has been out for consultation this year and the Essex air quality consortium has responded to the consultation as a collective response.

6 Conclusions and Proposed Actions
6.1 Conclusions from New Monitoring Data
The 2011 Progress Report of the 2010 data has shown that whilst exceedence of the NO 2 annual mean objective level have been measured at the Hatfield Peverel NO 2 diffusion tube site situated next to the A12, the Chipping Hill site in Witham, the two new A12 sites at Rivenhall Hotel and Foxden and the A120 site at Bradwell, these sites do not represent a site of relevant exposure. When corrected, the predicted levels are less than objective levels. The slightly higher level of 38.5 g/m 3 as predicted at A12 Old Chapel site is based on only 58% data capture and the residential property is protected by heavy vegetation , it is not considered appropriate to proceed to a detailed assessment based on this evidence. With respect to the hourly NO 2 objective, There are no diffusion tube sites with annual 3 mean NO 2 concentrations in excess of 60 µg/m in Braintree and therefore it is unlikely that there will be any exceedences of the hourly NO2 objective. 6.2 Proposed Actions
Proposed actions arising from the 2011 Progress report are as follows: • Continue diffusion tube monitoring in order to identify future changes in pollutant concentrations in Braintree with particular attention to the A12 receptors. • Complete an Updating and Screening Assessment in 2012 to assess all new air quality monitoring data, new developments and new industrial processes in Braintree in detail.
