Executive Summary

UndertheEnvironmentAct1995,localauthoritiesarerequiredtoReviewand Assess(R&A)airqualityonaregularbasis.A review ofairqualitymeansa considerationofthelevelsofpollutantsintheairforwhichobjectivesareprescribed inRegulations 1,andestimationsoflikelyfuturelevels.An assessment ofairqualityis theconsiderationofwhetherestimatedlevelsfortherelevantfutureperiodarelikely toexceedthelevelssetintheobjectives. Thefirstreviewandassessmentroundwascompletedin2003.Themainconclusion wasthatthenationalairqualityobjectiveswerenotlikelytobeexceededatany locationsinBraintreeDistrict. Sincethattimereviewandassessmentsofairqualityhavebeencarriedouteach year.Forlocalauthoritieswherenoexceedanceisdeterminedwithinupdatingand screeningassessments(USA)carriedouteverythreeyears(lastUSAin2009)there isarequirementtoundertakeaprogressreportofairqualitybytheendofAprilfor thetwofollowingyears.In2009noexceedancesofpollutantobjectivelevelswere determinedandthiswasrepeatedin2010. ThisProgressReportidentifiesthoseaspectsthathavechangedsincethelastround ofreviewandassessment,theUSAandPR.Thereportconcentratesonthe progressonimplementinglocalairqualitymanagementandachievingormaintaining concentrationsbelowtheairqualityobjectives.Theseaimsaredemonstratedby reportingonupdatedmonitoringdataandnewlocaldevelopmentsthatmightaffect airquality. Thereportshowsthatasin2009thereareelevatedlevelsidentifiedalongsidethe A12atHatfieldPeverelandatChippingHillatandinadditionfor2010 elevatedlevelsattheBradwellsitealongsidetheA120andattwonewmonitoring sitesatalongsidetheA12.Thesitesdonotreflectpointsofrelevant exposureandwhencorrectedthemaximumNO2levelpredictedis38.5g/m 3(for oneRivenhallsitealongsidetheA12). TherearenodiffusiontubesiteswithannualmeanNO 2 concentrationsinexcessof 60 µg/m 3inBraintreeanditisconsideredunlikelythattherewillbeanyexceedences ofthehourlyNO 2objective. Itisconcludedthatairqualityobjectiveswerenotexceededin2010,noristhere evidencetoconcludethatthereisariskofexceedancein2011andBraintreeisnot thereforerequiredtoundertakeanyDetailedAssessmentsofairqualityin2011.

Braintree is a largely rural district and has the second largest geographical area in Essex,covering612squarekilometres.Justoverhalfofthepopulationlivesinoneof the three main towns of Braintree, Halstead and Witham. The main administrative centreisthemarkettownofBraintree. The main sources of air pollution in Braintree are busy roads, such as the A12 and A120.Thereare76industrialprocesses(asat31 st March2011)thatarepermittedby theCouncil.Themajoritynumbering56comprisingdrycleaners,petrolstations,small wasteoilburners,vehicleresprayersandmobileconcretecrushers/screens.Thereare threeA2processesinWitham. 1.2 Purpose of Progress Report

Progress Reports are required in the intervening years between the threeyearly UpdatingandScreeningAssessmentreports.Theirpurposeistomaintaincontinuityin theLocalAirQualityManagementprocess. They are not intended to be as detailed as Updating and Screening Assessment Reports,ortorequireasmucheffort.However,iftheProgressReportidentifiestherisk ofexceedenceofanAirQualityObjective,theLocalAuthority(LA)shouldundertakea Detailed Assessment immediately, and not wait until the next round of Review and Assessment. 1.3 Air Quality Objectives

The air quality objectives applicable to Local Air Quality Management (LAQM) in England aresetoutintheAirQuality(England)Regulations2000(SI928),andtheAir Quality(England)(Amendment)Regulations2002(SI3043).TheyareshowninTable 1.1.Thistableshowstheobjectivesinunitsofmicrogrammespercubicmetre µg/m3(for carbonmonoxidetheunitsusedaremilligrammespercubicmetre,mg /m3).Table1.1. includesthenumberofpermittedexceedencesinanygivenyear(whereapplicable).

Braintree District Council undertook its First Round of review and assessment, includingStage1,2and3reports,between1999–2001.Themainairqualityissues werefoundtobeemissionsofNO 2 andPM 10 fromvehiclesontheA12andA120.It was predictedthat all of theair quality objectives would be achieved and that it was thereforenotnecessarytodeclareanyAQMAforanypollutant. The second round of Review and Assessment was undertaken between 2003 and 2005.The2003USAconsideredthesevenLAQMpollutantsandfoundthattheAQS objectives would be met by the target dates. It was however recommended that the Council expand its diffusion tube monitoring programme to include the nearest receptorstotheA12,toconfirmtheUSAfindingsforNO 2.The2005ProgressReport (Braintree,2005)showedthattheCouncil wasstillmeetingtheAQSobjectives.NO 2 andPM 10 monitoredconcentrationlevelswerefoundtobehighasexpectedatasite immediatelyadjacenttotheA12inHatfieldPeverelbutthereisnorelevantexposureat thissite.Thechosensiteofferedsafeaccesswhichwasasignificantconsideration. The third round USA was completed in 2006 and revisited the results of previous assessments to determine whether there were any areas of concern for air quality within Braintree District Council. The USA concluded that there was still no risk of exceedenceoftheobjectivesthereforeaDetailedAssessmentwasnotrequiredatthis stage.The2007and2008ProgressReportsconfirmedthefindingsoftheUSA. ThefourthroundUpdatingandScreeningAssessmentreviewof2008monitoringdata showed that one exceedence of the NO 2 annual mean objective level had been measuredin 2008attheHatfieldPeverelNO 2diffusiontubesitesituated nexttothe A12. There is no relevant exposure within 30m of the site, but there were sensitive receptors close to the A12. A table of receptors and distance from carriage way is included in the report. Appendix 4. It should be noted that the closest sensitive residentialpropertiesinHatfieldPeverel(TheTerrace) weredemolishedin 2009and forother residentialfacades in Hatfield Peverel,the A12 is in a cutting which further increasestheroadtofaçadedistance. In2010ProgressReportnoexceedancesatpointsofexposureweredeterminedbut the conclusion was to continue to assess NO 2 levels along the A 12 to assess the impacttosensitivereceptors. There are no diffusion tube sites with annual mean NO 2 concentrations in excess of 60 µg/m 3inBraintreeanditwasconsideredunlikelythattherewillbeanyexceedences ofthehourlyNO 2objective.

In2010twonewsiteswereintroducedalongsidetheA12atRivenhalltothesouthand northboundsidesofthecarriageway.Therewasonly58%and42%datacapture respectively.Annualisingthedatahasgivenlevelsof50.3g/m 3and55.5µg/m 3 atthe monitoringsites.ThesupportinglamppostfortheBradwellsitewasremovedbycounty councilwithoutnoticeandanewmonitoringpointhasbeenintroducedatsimilar distancetothekerbaboutapproximately10mfromtheoriginalposition.Thisexplains thelowdatacaptureandmaypartlyexplainthe15%increaseinnitrogendioxide concentrationlevelsagainstthepastyearattheBradwellsitealongsidetheA120andit willbereviewedovertheforthcomingyearsastowhetherthisincreaseissustained andcanbelinkedtospecificfactors.Thesinglelaneroadhasa40mphspeedlimitat themonitoringpointbutisastrategiclinkroadbetweentheA12andthedualledpartof theA120toStansted.TheChippingHillsitewasexaminedinmoredetailin2010 progressreport.Therehasbeenaslightincreaseinlevelfrom49.3to50.3µg/m 3atthe pointofmonitoringalthoughthesedonotrepresentsitesofrelevantexposure.

BraintreeDistrictStrategicPartnershiphaspublishedasustainablecommunitystrategy entitledOneDistrictOneVision.Inparticularreferencetoroadtrafficpollutantsthenthe documentquotes–‘Localroadnetworksalsoneedtobemaintainedandimprovedat key pointstoencouragemoreefficientlocalpublictransport,improveair quality,and reducelocalcongestionIfcaruseistobereduced,congestionandpollutionreduced andhealthylifestylesencouraged,goodhighqualitywalking,cyclingandlocalbuslinks needtobemadebetweenallpartsofthetownsandnewdevelopments.Theuseofthe car forlocal trips needsto be minimisedasfar aspracticable,to reduce congestion, pollution,andpromotehealthierliving.’

4 Planning Applications

TheRivenhallAirfieldincineratorECCwasteplanningapplicationwaspermittedin 2009followingapublicinquiry.Thiswassubjecttoanairqualityassessmentanddoes presentsomeconcerninrespectofadeteriorationofairqualityinthatlocalityalthough predictedlevelssuggestthattherewillbenoexceedancesofobjectivesduetothe distancefromrelevantexposureandasignificantchimneyheighttopromote dispersion.TheincineratoroperatorisstillrequiredtosubmitanIntegratedPollution PreventionandControlapplicationtotheEnvironmentAgency. Therehavebeenspeculativeenquiriesinrespectofdevelopmentsforlocal supermarketsandindustrialunitsandthereisacontinualstreamofapplicationsfor smallbuildingsites.

5 Local Transport Plans and Strategies

BraintreeDistrictiscoveredbytheEssexCountyCouncilLocalTransportPlan.There areanumberofgeneralmeasuresintheEssexLTPwhichareaimedatreducingthe impactofroadtransportonairquality. TheDistrictCouncilisworkinginpartnershipwithEssexCountyCouncilDevelopment, Highways and Transportation department to ensure that new traffic management schemesconsiderthepotentialimpactonairquality.Additionalairqualitymonitoring programmesarebeingintroducedaspartofthemonitoringrequirementsoftheLTP. TheplanhasbeenoutforconsultationthisyearandtheEssexairqualityconsortium hasrespondedtotheconsultationasacollectiveresponse.

6 Conclusions and Proposed Actions

6.1 Conclusions from New Monitoring Data

The2011ProgressReportofthe2010datahasshownthatwhilstexceedenceofthe NO 2annualmeanobjectivelevelhavebeenmeasuredattheHatfieldPeverelNO 2 diffusiontubesitesituatednexttotheA12,theChippingHillsiteinWitham,thetwo newA12sitesatRivenhallHotelandFoxdenandtheA120siteatBradwell,thesesites donotrepresentasiteofrelevantexposure. Whencorrected,thepredictedlevelsarelessthanobjectivelevels.Theslightlyhigher levelof38.5g/m 3aspredictedatA12OldChapelsiteisbasedononly58%data captureandtheresidentialpropertyisprotectedbyheavyvegetation,itisnot consideredappropriatetoproceedtoadetailedassessmentbasedonthisevidence. WithrespecttothehourlyNO 2objective,Therearenodiffusiontubesiteswithannual 3 meanNO 2 concentrationsinexcessof60 µg/m inBraintreeandthereforeitisunlikely thattherewillbeanyexceedencesofthehourlyNO2objective. 6.2 Proposed Actions
