    Duty to All, Duty to None Steve Papenfuhs and Eric P. Daigle The Public Duty Doctrine provides that, “absent a special relationship between the governmental entity and the injured individual, the governmental entity will not be liable for injury to an individual… the governmental entity owes a duty to the public in general. The doctrine has been commonly described by the oxymoron, ‘duty to all, duty to none.’”[1] The concept of “duty” establishes a great moral obligation in those who have taken an oath to serve and to protect the public. Officers are instilled with the principles of honor, integrity, and selflessness. As a result of these basic principles, officers often feel required to take action in certain situations when taking no action is actually the best course of action. Often, officers believe that they have a legal obligation to act above and beyond what is actually required of them. Law enforcement professionals’ lack of understanding of the legal principles of the public duty doctrine often leads to inappropriate actions on the part of the officer. In addition, the fear of liability for “failure to act,” and the personal code of honor that many sworn public servants hold, mandates that they take action at all costs to protect and defend life and property. While this desire to serve the public is commendable, police officers must understand that they have no obligation to protect any one individual unless a “special relationship” exists. Rather, an officer’s sworn duty is to the general public. As a general rule, an individual has no duty to come to the aid of another.

    Journal of Literature and Art Studies, August 2020, Vol. 10, No. 8, 676-681 doi: 10.17265/2159-5836/2020.08.006 D DAVID PUBLISHING Art and Terror in Daniel Silva’s Spy Novel The Kill Artist Maria Antónia Lima University of Évora, Évora, Portugal; University of Lisbon Centre for English Studies, Lisbon, Portugal The importance of Daniel Silva’s past, close to a Portuguese cultural environment, will be relevant to understand the psychological profile of his popular protagonist and central character, Gabriel Allon, a melancholic man haunted by his past, but also someone who is a gifted art restorer, very sensitive to the values of loyalty and fidelity, which the author assumed to have inherited from his Portuguese family. Being a spy and an art expert, Allon seems to conciliate two contradictory sides of the human personality. The connection between Portuguese and American culture, in this writer’s background, could have been responsible for the creation of a character who can be, at the same time, very sensitive and very violent; an assassin who is an Israeli secret agent and the world’s finest restorer of the Old Masters’ paintings. A perfect double who does justice to his creator’s double origin, which contributed to the success of The Kill Artist (2000), where terror is practiced as one of the fine arts by a hero very loyal and faithful to his complex cultural origins, living in a diaspora as the eternal wandering Jew. Clancy, the so called master of techno-military thrillers, was born on the 12th of April 1947 in Baltimore, Maryland / USA. He was educated at the Loyola College in Baltimore. Then he worked as an insurance broker. He is now living in his second marriage after his divorce in 1998. With his first wife he has four children. In college he dreamed of writing novels. In 1984 this dream came true and he got his first novel published, namely “The Hunt for Red October”, which was a great success. Other also well-known works followed, e.g. “Red Storm Rising” (1986), “Cardinal of the Kremlin” (1988), “Debt of Honor” (1994), “Executive Orders”(1996), “Rainbow Six” (1998) and “The Red Rabbit” (2002). Almost each of his books has been a number one best-seller. “Executive Orders” is part of the so called “Ryanverse collection” that means that in all of these books the main character is Jack Ryan or that the other characters have something to do with him. Clancy has also worked with other authors, e.g. with Steve Pieczenik to create the mini-series “OP-Centre” in 1994. All of his stories deal with military, warfare, intelligence, politics and terrorism. Tom Clancy also wrote non-fiction books about submarines, cavalry, the US Air Force and about the Marine and Airborne corps of the US Army. Four of his novels, namely “The Hunt for Red October”, “Patriot Games”, “Clear and present Danger” and “Sum of all Fears”, have been made into quite successful movies.
