The Chairman welcomed Members and officers to the meeting. She especially welcomed the new Director of Environment and Transport, Phil Crossland. Mr Crossland thanked the Chairman and introduced himself to Members.

027. CHAIRMAN’S UPDATE

a) Grass Cutting on the A444

The Chairman asked Mr Grierson to introduce this update.

Mr Grierson explained that this update was in response to a request from the Borough Council’s Scrutiny Committee on the issue of grass cutting in rural areas and whether it was excessive, especially on the A444.

Mr Grierson stated that basically rural grass cutting is undertaken for safety reasons and is cut twice a year. Additional cuts may be undertaken to increase visibility on bends and at side road junction splays.

Cllr K Morrell BC confirmed that he had raised this issue at the Scrutiny Committee meeting. He asked that officers investigate areas after they have been cut as he believed the cutting was excessive on the A444.

Mr Grierson explained that the grass cutting procedure was monitored and agreed to take a look when the A444 was next cut.

Cllr D C Bill CC hoped that the message did not get through that there is too much grass cutting undertaken in Hinckley and Bosworth.

Cllr J Richards CC thanked Mr Grierson and his team for promptly sorting out grass cutting issues in her area. b) Traffic modelling used to advise Hinckley and Bosworth Borough Council on the Barwell SUE

The Chairman explained that she had agreed to let two speakers speak on this issue. She asked Mrs Angela Parker, Vice Chairman of Peckleton Parish Council, to come forward.

Mrs Parker thanked the Chairman for the opportunity to speak so she then set out the following: “The principal concerns in Peckleton regard the assumptions used in traffic modelling. Today it is quite common in households for each adult to have a car. The transport model makes dramatic assumptions in predicting future social changes regarding car ownership and the use of public transport. In the peak hour between 8am and 9am the model predicts that only 388 vehicles will exit the Barwell SUE onto the A447. Between 7am and 10am it is predicted that a total of 1495 vehicles will exit the SUE. We consider that the predicted vehicle movements are significantly understated.”

“Peckleton Parish Council believes that the validity of the computer data should be confirmed by undertaking a live traffic monitoring from a mature estate, such as Hollycroft, on a weekday during peak times.”

“No workable solutions have been identified for the A47/ A447 junction nor the A447/ Rogues Lane junction. The modelling assumes that very little traffic will use the A447 north through Stapleton. If workable solutions cannot be found for the problem junctions then using the A447 and Fenn roads will become the preferred route for motorists. This will have negative consequences for those living in the affected villages on the rural road network. The modelling is also heavily dependent on improvements to the A5.”

“Peckleton Parish Council again requests that the County Council looks at the traffic implications for the village of Stapleton. The A447 north will become the preferred route if solutions cannot be identified for the roads south of the village.”

“No safety improvements have been identified for the sharp double bend at the corner adjacent to the Nags Head. It is a fact that large HGV’s cannot navigate this bend without crossing the white central road markings. Furthermore there is the danger that on exiting the village there may be unseen queues of stationary traffic at the new traffic lights.”

“The speed of traffic entering Stapleton from the north has not been considered. Additional traffic together with the lumping effect on traffic flow from the new traffic lights will make it more hazardous for traffic accessing the A447 from the village side roads. Also no provision has been made for a pedestrian crossing within the village.”

“If, as we believe, the data modelling is flawed then Stapleton and the other rural villages will bear the consequences. It is both unacceptable and will be costly to deal with these traffic problems retrospectively.”

The Chairman asked Mr Reg Ward of Stoke Golding Parish Council and a Borough Councillor in the area to speak.

Mr Ward thanked the Chairman. He explained that Stoke Golding Parish Council had met with 5 other parish councils and that they were unanimous in supporting what Angela Parker had said.

He expressed the view that this is an unsound, flawed document and will not work. If the Highways Agency reduces the funding for work on the A5 then the reasoning behind the traffic modelling is taken away. The rural villages are going to be swamped with traffic coming from the Barwell SUE.

The Chairman asked Mr Sheard to present the update. Mr Sheard explained that the model used was the and Leicestershire Integrated Transport Model (LLITM) which has been specifically built to look at growth.

The LLITM has been validated according to WebTAG guidance as published by the Department for Transport. It has been accepted by various independent inspectors during the Lubbesthorpe SUE planning committee decision making process. The model was also used to inform the Core Strategy and to successfully gain Government funding for the Inner Relief Road.

The use of the LLITM helped in getting a Core Strategy in place in order to understand the Barwell SUE.

Mr Sheard understood the concerns raised on the impact of growth on the minor rural roads. The intention is to try to keep the traffic on the main routes such as the A47 and the A447. Improvements to these networks would be undertaken to ensure traffic was kept to these routes.

Growth is massive in Leicestershire and will have a major impact on the network. Mitigation measures are being worked on with developers. By 2026, Leicestershire needs to provide 80,000 more homes.

Cllr I Ould CC confirmed that this was the third or fourth time that he had raised this issue at the Highways Forum. The modelling of the Barwell SUE was based on mitigation measures being undertaken to improve the A5 by the Highways Agency. If these measures are going to be reduced on the A5 then the modelling will not be correct.

Last week there was a meeting held between County Council, Leicestershire County Council, MIRA and the Highways Agency. Both Leicestershire and Warwickshire are concerned at the proposed changes by the Highway Agency to improvements required by the MIRA planning permission. Leicestershire County Council has written to Hinckley and Bosworth Borough Council to object to the removal of planning conditions regarding the MIRA application as currently there has been no justification that the HA’s improvement will mitigate the impact of the MIRA development.

Cllr Ould was very concerned that there were no mitigation measures affecting the division he represented. There was only a condition in the section 106 agreement to go back to the developers at a later date. This he could not accept. There would be problems in going back to the developers at a later date to ask for increased contributions.

Cllr Ould asked that the Highway Forum formally objects to the removal of planning conditions.

Mr Sheard in response confirmed that the County Council and Warwickshire County Council are in continued discussion with the Highways Agency in order to ensure that any improvements proposed by the HA do not disbenefit road users on the local road network.

Mr Crosthwaite for the Borough Council confirmed that the issues raised have been conveyed to Borough Council officers in the last week. Hinckley and Bosworth BC will be joining Leicestershire and Warwickshire to discuss with the Highways Agency issues that need resolving.

Cllr W J Crooks BC was concerned that the update states that unacceptable levels of traffic between Rogues Lane and Barwell SUE will be addressed at a future time. He was also concerned that the increase in traffic on the A447 at Stapleton Lane had backed up right into the village. There were major problems at peak times. He suggested that the junction be made larger.

Cllr D Sprason CC stated that he was always worried when any traffic models were sanctioned by the Highways Agency. Mitigation measures are only good when they are put in at the time that the developers can pay. If you go back later they may not be able to pay.

Mr Sheard stated that developers cannot be required to deal with current problems ahead of any development. They can only be required to mitigate problems arising from their new development.

Cllr Bill confirmed that he and Cllr Crooks at the planning meeting on Barwell SUE tried to ensure that transportation problems were highlighted and accepted even though Barwell SUE was going to be approved. The Barwell SUE needs to be served by the A47 or the A447.

Cllr Bill stated that the possibility of not improving Dodwells Roundabout by the Highways Agency would have major implications. Cllr J Richards CC was surprised that Cllrs Bill and Crooks had had highways issues and yet still voted for the SUE. This should have been sorted out before acceptance. The SUE will swamp local villages.

Cllr Morrell asked why the Highways Agency was backtracking on planned works on the A5. Cllr Ould confirmed that, at the MIRA meeting, it was said to be a cost saving exercise.

Mr Crosthwaite explained that when the decision was made to accept the Barwell SUE, there had been a package of mitigation measures explained before the meeting. The Highways Agency are looking to pursue a pinch-point scheme. Discussions are ongoing with them to try to ensure that the mitigation measures are upheld.

Cllr Ould asked that the Highways Forum write to the Borough Council to state that “The Highways Forum expresses its concerns that changes in the original measures proposed by the Highways Agency on the A5 makes the traffic modelling invalid on the Barwell SUE”. Members supported Cllr Ould and asked that a letter be sent. c) MIRA Cabling Works

Mr Grierson updated Members on this item. He confirmed that, as part of the development of the MIRA site, a new electricity sub-station had been planned with the cable routed along the A5. This has now been ruled out and it is proposed to run the cabling along Nutts Lane, Coventry Road, Brodick Road, Roston Drive, A47 Normandy Way, Wyken Road, through Highham village to Wood Lane.

Cllr Ould had no problem with the original programme to run the cabling along the A5. He attended a meeting 2 weeks ago when the new proposals were outlined. This will be a greater inconvenience to residents. When he asked who had to give approval to the changes he was told that no-one had to give approval. The County Council only has the powers under NRSWA to ensure that the road is re-instated correctly after the work had been completed. 7

Mr Grierson confirmed that undertakers have the right to put their services in the highway. The local highway authority cannot stop this.

Cllr Bill stated that road closures had been a plague to Hinckley over the last few years. He went on to say that he has asked a question at the next County Council meeting over what control the Council can have over undertakers entering the highway.

Mr Stevens stated that it was clear that undertakers have the right to do the work they need to do. Hinckley has suffered from major undertaker work in the last few years. Leicestershire County Council tries to co-ordinate any undertaker work in a safe manner in order to try to alleviate any disruption involved.

Cllr Ould asked if it was possible to write to Morrisons and MIRA to state “That the Highways Forum asks that the original proposal to route the cabling along the A5 be reinstated”.

Cllr B E Sutton BC commented that MIRA had no choice in this matter as it is the power company who are undertaking the work.

Members supported Cllr Ould’s request and asked that a letter be sent.

028. PRESENTATION OF PETITIONS UNDER STANDING ORDER 36

There were no current petitions.

029. RESPONSE TO PETITION: STREET LIGHTS TO BE RESTORED ON SACHEVERELL WAY, GROBY

The Forum considered a report by the Director of Environment and Transport in response to a petition requesting street lighting to be restored on Sacheverell Way, Groby. The report was introduced by Mr Stevens with a copy filed with the minutes.

Mr Stevens explained that following the receipt of the petition, the County Council recognised the high level of pedestrian and leisure activity taking place along the road and agreed to convert to part-night lighting.

Cllr Sprason asked if schemes that were originally switched off and are now to be switched back on would be affected if further cuts to street lighting through the budget process were necessary. Mr Stevens confirmed that schemes that have been reviewed would not be affected by any further cuts to the street lighting budget.

RECOMMENDATION

That the report of the Director of Environment and Transport be noted.

030. WINTER MAINTENANCE

The Forum considered a report by the Director of Environment and Transport on winter maintenance. The report was introduced by Mr Grierson with a copy filed with the minutes.

Mr Grierson confirmed that the last winter had been very severe. Gritting crews had gone out 99 times which was double the amount of times in 2011. Overall, 19,700 tonnes of salt were used in comparison to an average winter usage of 10,000 tonnes. The salt barns capacity is 16,500 tonnes which can be topped up if necessary.

Mr Grierson confirmed that, in the summer, the winter service had been reviewed, with the following tasks being undertaken;

- build on the review of the priority 1 and 2 salting routes - review the priority 3 routes - purchase new gritters in order to ensure that all 17 front line gritters are under 2 years old - service and refurbish all LCC owned snow ploughs operated by farmers

Mr Grierson went on to explain the grit bin procedure which is focused around sharp bends and steep inclines which are not already covered by the precautionary 1 and 2 salting routes. He also explained that parish councils were asked in the parish newsletter if they wished to be involved in the snow warden scheme. Finally Mr Grierson explained the improvements that have been made to the County Council’s web pages. Cllr Ould highlighted a possible problem with communications with parish councils who may have changed their web address since the County Council withdrew funding from websites.

Two parish councils in Cllr Ould’s area had been turned down for grit bins because they did not meet the criteria. He asked that local knowledge of problem areas be considered even if the area did not meet the set criteria. Common sense should be used. Cllr Ould also stated that in some areas residents take salt from the bins to use on their own driveways.

Cllr Sprason asked if requests for new salt bins would be filled before the winter. Mr Stevens confirmed that the County Council is now rolling out its programme of filling the bins. There is a commitment to increase the number of salt bins available by an extra 200 this winter. There was a problem of mis-use of salt in certain areas and Mr Stevens encouraged the use of the snow warden scheme to try to alleviate this problem.

Mr Stevens asked Cllr Ould to let him know of any parish councils that have web address problems.

Cllr Morrell was asked to give officers details of salt bin requirements by Witherley PC to officers after the meeting.

RECOMMENDATION

That the report of the Director of Environment and Transport be noted.

031. SCHOOL ENTRANCE ISSUES

The Forum considered a report by the Director of Environment and Transport on school entrance issues. The report was introduced by Mr Wright with a copy filed with the minutes.

Mr Wright explained to members the measures available to the County Council in endeavouring to lessen the effect of the parking problems occurring outside school entrances. The report explains what the County Council can and cannot do.

Cllr Bill asked if the move to academy status would mean that the County Council has less influence over encouraging schools to undertake school travel plans (STP).

Mr Wright explained that the County Council cannot force schools to undertake STPs. Schools are encouraged by STP officers to work towards STPs. This system would not be affected by schools moving to academy status. The service would be offered to them.

Mr Wright confirmed that STP officers do actively talk to schools to encourage them to have dialogues with parents and local residents on the issue of policy outside school entrances.

Cllr Crooks was concerned with paragraph 28 of the report and the provision of cycling and pedestrian training.

There was no chance of children cycling or walking to Nailstone Primary due to the very busy road and the road having no pavements. 9

Mr Wright explained that paragraph 28 was only a suggestion of possible alternative ways to travel to school.

RECOMMENDATION

That the report of the Director of Environment and Transport be noted.

ENERGY REDUCTION FOR STREET LIGHTING PROJECT

REPORT OF THE DIRECTOR OF ENVIRONMENT AND TRANSPORT

Background

1. The energy reduction for street lighting project approved at the Leicestershire County Council Cabinet meeting on 15 th December 2009 is nearing completion. This report updates Members on the current situation of the project within Hinckley and Bosworth.

Update

2. Attached is a copy of the part-night lighting progress map for December 2013. Part-night lighting has now been implemented in the majority of towns and villages across Hinckley and Bosworth, as indicated in green on the map.

3. Consultation has been completed in those areas shaded in yellow within the Borough. It is anticipated that the works will be completed on site during January and February 2014.

4. A review is undertaken in each area one year after the lighting is converted to part-night lighting. To date, the responses from the emergency services combined with the views of the Department Accident Investigation and Prevention Team have indicated that this initiative has not led to increases in crime or road traffic accidents.

5. It has been reported however, that an increase in burglaries has coincided with the change to part-night lighting in Barwell and . Incidents have actually taken place both in areas where lights have been switched off between midnight and 5.30am and, in the majority of situations, where lights have remained on all night. In order to assist the police in their surveillance and to apprehend those responsible, around 70 lights have been reverted to all-night operation in Earl Shilton and around 90 in Barwell. We will continue to work closely with the police to monitor and review the situation and anticipate that these lights will be restored to part-night operation in future.

6. Since the introduction of the street lighting energy saving project, over £1m has been saved from Leicestershire County Council’s street lighting energy bill. The works completed to date will continue to deliver full-year effect financial savings of over £600,000 and carbon savings of over 3,000 tonnes. These carbon savings will also deliver a further saving of over £48,000 due to a reduction in Leicestershire County Council’s carbon tax liability in 2014/15.

STATUTORY UNDERTAKER REINSTATEMENTS

REPORT OF THE DIRECTOR OF ENVIRONMENT AND TRANSPORT

Purpose of report

1. To inform Members of the duties placed on statutory undertakers in relation to the reinstatement of the highway following their works and the powers available to the County Council.

Background

2. Leicestershire County Council is the highway, traffic and street authority for local highways in the County. The Secretary of State for Transport is the authority for motorways and trunk roads.

3. A previous report to the Highway Forum has explained the way in which street and road works are coordinated to minimise the disruption that they can cause to traffic movements. This report focuses specifically on the requirements placed on statutory undertakers in relation to the reinstatement of the highway following their works, and the powers available to the County Council.

4. There are a number of pieces of legislation that provide the basis for the duties and powers relating to street works and other activities on the highway network. However, the main piece of legislation that covers highway reinstatements is the New Roads and Street Works Act 1991 (NRSWA).

Duties of the statutory undertakers

5. The NRSWA establishes the concept of a street works “undertaker” . This is a person or organisation with statutory or licensed rights to place, retain, and maintain apparatus in the highway. Each utility company has statutory rights to place its apparatus in the streets (or highways) and are collectively referred to as "statutory undertakers". Placing apparatus or excavating in a street (or highway) without “undertaker” rights is an offence that carries a fine of up to £1,000.

6. The NRSWA contains specific duties requiring statutory undertakers to reinstate their excavations as soon as possible following the completion of works on their apparatus. They are also required to reinstate their excavations to prescribed standards of safety, quality and performance. These prescribed standards are described in the national "Specification for the Reinstatement of Openings in Highways". 16

7. In simple terms, reinstatements are required to be undertaken using the correct materials and must not deviate from the road level, through either crowning or depression, by more than 10-25 mm, depending on their width. In addition, reinstatements must not deviate from the road level, through a combination of crowning and depression, by more than 10-20 mm, depending on their width.

Powers of the County Council to inspect reinstatements

8. The County Council has the right to inspect a structured, random sample of each statutory undertaker’s works over a 2-year guarantee period (3 years for deep excavations). These are undertaken at three defined stages, as follows:

a. Undertaken during the progress of the works; b. Undertaken within the six months following reinstatement; c. Undertaken within the three months preceding the end of the guarantee period.

These sample inspections allow the overall performance of each statutory undertaker to be established.

9. The number of inspections that the County Council can undertake each year is calculated from a rolling 3-year average of annual inspections units generated by a statutory undertaker's works. A unit of inspection is counted as each 200 metre length of a long excavation, or up to 10 excavations of less than 200 metres combined length that are undertaken as part of the same works, in the same street at the same time.

10. Around 4,500 to 5,000 reinstatement inspections are undertaken each year. Undertakers are required to pay the County Council a fee (currently £50) for all reinstatement inspections undertaken and are required to rectify any defects at their own cost and within required timescales.

11. If a reinstatement is found to not comply with the requirements of the specification, the County Council is allowed to require the statutory undertaker to undertake remedial works to rectify this defect. In doing so, the County Council is allowed to undertake three "defect" inspections consisting of:

• a joint inspection with the statutory undertaker before remedial works; • an inspection of the remedial works in progress; • an inspection of the completed remedial works.

A fee (currently £47.50) is payable for each of these inspections. Around 500 to 600 of reinstatements are reported as defective each year.

Conclusion

12. Statutory undertakers have the right to place their apparatus in streets. In doing so, they have a duty to comply with a national specification that sets the 17

standard required for the safety, quality and performance of their reinstatements. The County Council has powers to undertake sample inspections to establish a statutory undertakers overall performance in their duties at their cost. The County Council also has powers to require statutory undertakers to rectify reinstatements that do not meet this specification and can undertake additional inspections to ensure that this is done properly.

Recommendation

TRAFFIC REGULATION ORDERS RELATING TO NEW DEVELOPMENTS

REPORT OF THE DIRECTOR OF ENVIRONMENT & TRANSPORT

Purpose of Report

1. The purpose of this report is to inform members of a change in the way Traffic Regulation Orders are dealt with in respect of new developments.

Background

2. At the North West Leicestershire Highway Forum on 10 th July 2013, a question was tabled:

‘How can we improve the design and implementation of Traffic Regulation Orders on new estates to maximize their acceptability to residents who cannot be consulted prior to their implementation? What best practice examples exist elsewhere and what principles can we adopt for north-west Leicestershire?’

3. The question was prompted by issues that occurred on Adam Morris Way in , when the first that some of the residents knew about waiting restrictions on their road was when a lining crew turned up. The residents considered the restrictions imposed as being too restrictive.

Adam Morris Way – Highlighting the Problems

4. Traffic Regulation Orders (TROs) implemented in response to new developments normally run smoothly and produce the desired effect. In the case of Adam Morris Way, however, anything that could go wrong appears to have actually gone wrong.

5. The issues relating to Adam Morris Way date back to 2005, when planning permission was submitted by developers for housing on the old Stephenson College site in Coalville.

6. At the time, there was talk of North West Leicestershire District Council introducing car parking charges in the town, so concerns were raised about possible overspill parking from the town centre and nearby schools. Proposals were therefore drawn up for waiting restrictions which would be implemented once the houses were built.

7. These proposals were supported by the then County Member and the appropriate steps were taken to ensure that the developer had a legal responsibility for funding the restrictions.

8. At the same time, the developer was made aware that they were responsible under the Property Mis-descriptions Act 1991 for making residents and potential residents aware of the proposals.

9. The problems of Adam Morris Way appear to have been caused by the long timescales involved with the development. It is likely that due to the length of the build programme that re-sales occurred in between the TRO process being completed and the lines being installed on site which, again, was a longer period than is usual. As a result, some residents may have completed private sales without the developer’s involvement and may not have been made aware of the proposals for a TRO. (The legal position with this is that any instance of a resident or developer not declaring the information is a breach of the Property Mis-descriptions Act 1991. Leicestershire County Council are not and cannot be accountable for this.)

10. In terms of the TRO process relating to Adam Morris Way, a formal consultation was carried out starting on 1 st October 2011. Following this consultation and the rest of the TRO process, the scheme as proposed was given the go-ahead in April 2012 and the Order made on 8 October 2012. The waiting restrictions were not implemented on street, however, until July 2013.

11. The other potential issue raised, for which there is no solution, is the issue of local searches.

12. Anyone buying a house will normally have a search undertaken on the local area. This search may be commissioned from the County Council or any other search provider.

13. Leicestershire County Council has in place a system that will flag up any proposed TROs in an area when a search is conducted, and will always flag this up to the requestor of the search. Records show that in the case of Adam Morris Way, for every search made during the period between the TROs being proposed and implemented the potential restrictions were highlighted.

14. Unfortunately, however, private search providers do not have access to the same information as the County Council, and are under no legal obligation to ask for it. A loophole therefore exists that potential residents may buy a search from an independent company in good faith but, because the search supplier has not asked for local information from the County Council, the proposed TRO will not be picked up.

15. The final issue here is that due to the length of time between the TRO being initially proposed and it being implemented on street, there was no guarantee that the proposals would still be the correct solution for the area. In the case of Adam Morris way this was indeed the case, with the resultant restrictions being too onerous.

The way forward

16. The issue of private search providers is not one over which the County Council has any control, so no direct action can be taken over this. The problem may, however, be lessened by some of the changes detailed below.

17. The main cause of problems appears to be due to assumptions made early in the development process about the scale of potential problems, and then ‘fixing’ the problem before it is observed whether the problem does, in fact, exist.

18. In line with the Local Transport Plan, an ‘evidence led’ approach will now be taken in order to ensure that the County Council does not have to fund new TROs to fix existing TROs, paid for by developers, that turn out to be inappropriate once the development is complete.

19. This would be applied to both S38 and S278 works.

20. Section 38 of the Highways Act 1980 provides for a highway authority to adopt by agreement a road built by a third party. A road adopted under Section 38 will be maintained at public expense.

21. Section 278 of the Highways Act provides for works funded by developers to be carried out on the existing public highway with our agreement. For example, this might include constructing a new roundabout to provide access to a development or improving an existing junction to accommodate extra traffic generated by the development.

22. The system for dealing with developer-funded TROs has now been changed so that:

• Where significant parking issues that may have a safety impact occur on S278 and S38 works, the developer will still be required to cover the cost of implementing waiting restrictions as agreed by the County Council as Highway Authority

• Proposed schemes will be outlined prior to technical approval of S38 works with appropriate notes on legal and technical drawings. However, unless there is a clear and immediate safety need, TROs will not be processed until there is sufficient evidence on site that proposed measures are of an appropriate scale to deal with any problem. If there is no evidence that the waiting or other restrictions are required then the Order will not be processed and just the abortive costs incurred by the County Council will be recovered from the developer.

• Leicestershire County Council will highlight to the developer the need to keep any prospective residents informed about proposals for TROs in any sales information packs

• Once the site is occupied and evidence assessed, we will consult with the residents, both in the new development and in the surrounding area. If the evidence and consultation points to a TRO 22

being appropriate, the implementation will follow the normal statutory/LCC process.
