Chapter - 1 EXECUTIVE SUMMARY

1.1. Introduction - Project and Public Purpose

Urbanization of Kochi is happening at a fast pace. Due to progressive increase in vehicles and vehicular movement, the roads of Kochi city is hard liable to cater traffic smoothly, especially on main roads. These lead to many adverse impacts in different parameters in terms of time, maintenance of road, pollution etc. Vytilla – Thripunithura stretch is one of the main roads, which witness high range of mixed traffic flow daily towards Kochi city and vice-versa. Hence through expert studies conducted by the consultants deployed by Kochi Metro Rail Ltd, the first phase of the metro corridor will be passing through this road, in the form of Mass Rapid Transit system for the public. This Mass Rapid Transit System (MRTS) will facilitate people to have faster and comfortable movement within the corridor. There is a proposal to integrate all modes of transport to provide seamless mobility. Since the study reveals that the agglomeration of vehicles on this road may not be controlled just by providing MRTS service but other options to alleviate the traffic through road should be adopted by widening the existing road to four lane road after constructing the metro corridor.

KMRL (Kochi Metro Rail Limited) is a joint venture with equity participation of Government of India and Government of Kerala. A Special Purpose Vehicle (SPV) has been formed for implementation of the project. First phase of the project comprises the section between to Petah with fully elevated corridor for length of 25.612 km and a depot. This Mass Rapid Transit System (MRTS) facilitate people to have faster and comfortable movement within the corridor.

This SIA study is conducted at ‘Affected area of Vyttilla - Petah Road Widening Project of Kochi Metro Rail Project. The project being divided into three reaches. Vyttilla- Petah is the southern end of Reach 1.

1.2. Location

The project phases being divided into three reaches, Vyttila - Petha, Petah - Thripunithura (Road Widening and Station).The SIA has been conducted at Vyttila -

Petah (Kunnara Park to Petah-1.5 km) Road Widening Project. The affected area belongs to Village in KanayannoorTaluk of District.

1.3. Size and Attributes of Land Acquisition

The proposed project will involve acquisition of 1.4723 hectare land. Out of the total land requirement 0.0600 hectare is government owned property and 1.4123 hectare is under private acquisition. The total area composition of affected families in which SIA study conducted comprised to 0.7630 hectare area of land.

1.4 Alternatives Considered

Due to progressive increase in vehicles and vehicular movement, the roads of Kochi city are not able to bear the load of traffic smoothly especially in main roads. These led to many adverse impacts in different parameters in terms of time, maintenance of road, pollution etc. Vytilla – Petah stretch is one of such main roads, which witness high range of mixed traffic flow daily towards Kochi city and vice- versa. Hence through expert studies conducted by the consultants deployed by Kochi Metro Rail Ltd, the first phase of the metro corridor will be passing through this road, in the form of Mass Rapid Transport System for the public. This Mass Rapid Transit System (MRTS) will facilitate people to have faster and comfortable movement within the corridor. There is a proposal to integrate all modes of transport to provide seamless mobility. Since the study reveals that the agglomeration of vehicles on this road may not be controlled just by providing MRTS service but other options to alleviate the traffic through road should be adopted by widening the existing road to four lane road after constructing the metro corridor.

The corridor of Kochi Metro project is from Aluva to Petah through NH 544 - M.G. Road - South Station Railway station - Vyttila- Petah (through the Vyttila – Petah stretch of PWD Road). The DPR is approved after elaborate and extensive feasibility study. Viaduct is passing through the Kunnara Park to Petah stretch of the road. Hence the proposed improvements to this portion have become essential. The acquisition of the majority of land for the Kunnara Park to Chambakkara Bridge has been completed and the remaining portion is already proposed to be acquired for the completion of the same. Hence examination of the alternative route is redundant at this stage.

1.5 Social Impacts and Mitigation Measures

The identification of key impacts and an assessment of their significance is an important step in SIA process, in which the significance of each impact is assessed. If impacts appear to be adverse, SIA must clearly suggest a course of action to be followed, including their mitigation.

• Many affected families which had to suffer as their livelihood was blocked as a result of various procedures related to land acquisition, which did not happen till date are to be paid appropriate compensation with retrospective effect. • Surveys and interactions with the primary stakeholders revealed that their condition for complying with the acquisition was that it has to be done as early as possible without any further delay and the property which becomes non viable by partial acquisition should be acquired completely by the Government. • Possibilities can be considered to reduce the loss of structure of 3 affected Titleholders by realigning if possible to minimize the agony caused by it. This can in turn benefit the implementation agency by reducing the cost of rehabilitation. • Women who will lose the livelihood can be supported for self employment by linking them to Kudumbashree or similar organizations. • Modernization of the market can be initiated by linking with other agencies and the people who lose their livelihood can be given priority. • Concerned authority has to take preventive measures to address the health and sanitation issues due to in-migration as well as link the in-migrants to governmental and nongovernmental organisations. • The safety risks to the employees and public at different stages of the Project are to be addressed by the concerned execution agencies by sensitization activities and precautions. • Restoration of beautification of Kunnara Park with a theme base. Chapter - 2 DETAILED PROJECT DESCRIPTION

2.1. Background of the Project

Kochi also known as Cochin is a major port city on the South-West coast of India by the Arabian Sea and the Lakshadweep and is part of the district of Ernakulam in the state of Kerala. It is often called Ernakulam, which refers to the specific district. With a corporation limit population of 612,343 and metropolitan population of 2.1 million, Kochi city is also a part of the Greater Cochin region and is classified as a Tier-II city by the Government of India. The civic body that governs the city is the Kochi Municipal Corporation, which was constituted in the year 1967, and the statutory bodies that oversee its development are the Greater Cochin Development Authority (GCDA) and the Goshree Islands Development Authority (GIDA).

Kochi has been ranked the sixth best tourist destination in India according to a survey conducted by the Nielsen Company on behalf of the Outlook Traveler Magazine. Kochi was one of the 28 Indian found to be among the emerging 440 global cities that will contribute 50% of the world GDP by the year 2025, in a 2011 study done by the McKinsey Global Institute.

Kochi City has the reported highest number of vehicles in the State of Kerala. Traffic problems are mainly due to growth of motor vehicles and also the absence of a quality public transport system to cater to large intra city demand. The road infrastructure in Kochi has not been able to meet the growing traffic demand and hence traffic congestion is a major problem in the city. Based on the traffic study carried out by CDM Smith in May 2013, it is projected that Kochi will generate 1.41 million road transport based passenger trips in 2018, which is likely to increase to 2.87 million passenger trips in 2048.

As per the report ‘Road Accidents in India: 2010’ by Ministry of Road Transport & Highways, India during 2010, Kerala ranked 3rd with 102 number of road accidents per lakh of population. Kochi is one of the 23 cities accounted for a much higher share of 27% in total vehicles registered in the country in 2009. In the year 2010, Kochi was

ranked 10th on road accident profile of prominent cities with accident severity was noted to be 9.3.The Kochi Metro is an under-construction metro rapid transit system for the city of Kochi, intended to considerably ease traffic congestion in the city and its surrounding metropolitan area.

2.2 Project Rationale

• The Government of India approved the implementation of a rail based mass rapid transit system for Kochi called Kochi Metro Rail Project with financing of Government of India and Government of Kerala on 12.07.2012 A fully elevated corridor from Aluva to Petah with 22 Metro stations is envisaged in the project. The project from Aluva to Maharajas College is in the final stage of completion. The works in the remaining portion is in progress.

• Initially land required for Metro project was acquired under the Land Acquisition Act 1894 (the old Act). In 2013 the Land Acquisition Act was replaced by the ‘Right to Fair Compensation and Transparency in Land Acquisition, Rehabilitation and Resettlement Act, 2013 (the new Act). The new Act came into operation from 01-01-2014. But the ‘Rules’ for the implementation of the new Act was published by the Government only on 23.9.2015. In the intervening period, considering the urgency of completing the project, the Government authorized the District Collector, Ernakulam to acquire land for Metro project and preparatory works on the basis of negotiated purchase.

• As per Government Order (Rt) No.40/10/PWD dated 07.01.2010 sanction was accorded by Public Works Department for acquisition of 1178.50 Cents of land for widening of Vyttila-Petah road. As per Government Order G.O (Rt) No.4843/13 /RD dated 30.07.2013.sanction was accorded by the Revenue Department for initiating land acquisition proceedings. Finally as per Government Order G.O. (Ms) No. 22/14/Trans dated 04.03.2014 administrative sanction for acquisition of 908 cents of land was accorded for widening of a two kilometer stretch of Vytilla - Petah road in 26m ROW in the first phase as part of preparatory work of the Metro project.

• The project we are entrusted to conduct the SIA study is Vytilla - Petah Road widening. In fact the portion from Kunnara Park to Petah (1.5 km) is being

widened in to 26 m RoW as a work preparatory to the implementation of Metro project. This was initially proposed to be 35m which was further reduced to 26m by the District Collector after analyzing and accounting the volume of structures that have to be acquired and disposed in such a densely populated commercial stretch. This portion is the feeder line of NH 49 from Kochi to Madurai. Widening is being implemented by acquiring land more or less equally from either side of the existing road. Hence it a linear acquisition from a commercially important area. For this project 182 cents was already acquired up to December 2015 by way of negotiated purchase as permitted by the Government. The sale price was determined in the DLPC which was not acceptable to few affected persons and they wanted compensation as per the new RFCTLARR Rules 2015. Government also decided to work according to the new law where it became mandatory to conduct SIA study as the first stage of land acquisition process. The Executive Engineer PWD (Roads Division) is the requisitioning Officer in this case. The Spl. Tehsildar (LA) NH III, Vytilla is the Land Acquisition Officer.

• On 23.09.2015 the Government of Kerala had published the Right to Fair Compensation and Transparency in Land Acquisition, Rehabilitation and Resettlement (Kerala) Rules, 2015. The Government also published the State Policy for land acquisition. As per the Act and Rules SIA study is mandatory for every land acquisition. The road is to be widened to maintain traffic during and after construction of the viaduct. The advantages resulting from the widening project are:-

2.3 Examination of Alternatives

2.4 Phases of Project Construction

Widening of Road from Vytilla to Petah will be done in one phase excluding Chambakkara Bridge. The bridge shall be constructed along with Metro Corridor. This bridge is supposed to be constructed along with this road widening project to ensure the smooth flow of traffic and the land shall be acquired simultaneously.

2.5 Core Design Features

Nearly 23 meters land is proposed to acquire for the widening of Vytilla – Petah road along the metro alignment. It consists of dedicated pre cast duct and drain on either side of the road with defined foot path for the pedestrians. All the utility cables are proposed to be laid through the ducts. All 11KV overhead lines are converted into UG cables.

2.6 Need for Ancillary Infrastructural Facilities

As it’s a road widening project no need to provide ancillary infrastructural facilities. However, parking facilities for bicycles, two wheelers or four wheelers and integration of other mode of transport system like water metro can be planned after constructing metro corridor. When the project is completed there will be the facility of two-way standard four- lane road on either side of the metro viaduct. It is definitely a boost to the socio-economic development of the area, besides meeting the traffic requirements in the near future.

2.7 Work Force Requirements

Considering the traffic flow in this stretch, nearly 138 man power with variant skills are required to work daily to complete this project within two years at Rs.12.5 Crores cost. Most modern equipments and experienced engineers are needed to achieve the milestones of the project in the stipulated time. The project is expected to cater to the employment opportunities to the work force in the area.

2.8. Studies Conducted Earlier

Amongst the earlier studies, ‘Structure Plan’ for the Central city for the year 2001 prepared by the Greater Cochin Development Authority (GCDA) is of foremost importance. Other important studies include the Kerala Urban Development Project sponsored by the World Bank, Vypeen Bridges Project by the Goshree Islands Development Authority (GIDA) and Master Plan for Development of Kochi Port by the Kochi Port Trust. M/s RITES also conducted a ‘Comprehensive Study for Transport System for Greater Cochin Area, in 2001. All the above studies accept the Comprehensive Study for TransportSystem for Greater Cochin area conducted by RITES in 2001 recommended projects for improvement to road infrastructure, including provision of ROBs /Flyovers. While, a few ROBs / Flyovers have been completed, the rest of the improvements to road infrastructure are still in planning stage.

RITES Study of 2001 recommended provision of LRTS between Aluva to Thripunithara as a long term measure, in addition to short term and medium term measures for improvement to road infrastructure.

Social Impact Assessment study was conducted for KMRL by AARVEE Associates Architects Engineers and Consultants Private Limited, Hyderabad in June 2015 for Aluva – Petah corridor for the proposed metro alignment. Total 310 properties, 225 families and 1006 people were affected due to this project in total. Environmental Impact Assessment Study & Environment Monitoring Plan for KMRL was done by SENES Consultants India Pvt. Ltd. during December 13 to January 14 to assess the baseline environmental status of the proposed area. Primary baseline monitoring was conducted at various locations for prominent environmental attributes like air, water, noise and soil. The study also assessed the impact due to project location, project design, project construction and project operation. Chapter - 3 STUDY APPROACH AND METHODOLOGY

3.1 Background

As per the Notification No.A5-1355/2016 dated 20.12.2016, Administration has selected RAJAGIRI outREACH as the SIA Unit to study the Social Impact Assessment in the area of Road Widening of Vyttila – Petah for Kochi Metro Rail Project.

The objective of Social Impact Assessment (SIA) is to enumerate affected land and structures, affected families and persons, to identify social impacts, and to prepare Social Impact Management Plan (SIMP). In order to capture data for the present exercise, both primary as well as secondary sources were systematically tapped. As a part of SIA, census socio-economic survey has been conducted by experienced members of SIA Unit in the Vytilla – Petah road widening project area to list out the adverse impacts of the project.

3.2 SIA and SIMP Preparation Process

Social Impact Assessment and Resettlement Action Plan are required when the project results in either physical or economic displacement of the people. Resettlement plan must ensure that the livelihoods of people affected by the project are restored to levels prevailing before inception of the project. While preparing an effective SIA and SIMP, the study team followed some essential components and steps which are (i) identification of socio-economic impacts of the project (ii) public/community consultations (iii) legal framework for land acquisition and compensation (RTFCTLARR Act 2013), (v) organizational responsibilities

Figure 3.1 presents approach and methodology of SIA study in the form of flow chart and various steps involved in the study have been described in detail in the following paragraphs.

3.3 Desk Research

The study team reviewed the relevant documents, reports and project alignment drawing. The team also carefully reviewed the earlier studies available on various aspects for KMRL as well as other SIA studies in development sector.

3.4 SIA Unit Team

The study team is headed by Project Director of RAJAGIRI outREACH who is the Chairman of SIA Unit. A team of 15 members having experience in conducting Social Impact Assessment Study and Socio Economic Surveys were assigned for field level data collection, monitoring of data collection and co-ordination of the study. The service of Gender Expert, Consultants from Development Sector and Law was also utilized in conducting the study and preparation of the report. Representatives from Revenue Department also supported the investigators to identify the affected families.

3.5 Data from Secondary Sources

Secondary sources information were collected from various concerned departments, and a host of other literatures. Thus, the secondary sources information complemented the primary data elicited through field survey from the affected people and other stakeholders. Understanding was created about the physical, social, economic, and cultural set-up of the project area before undertaking detailed field investigations.

3.6 Site Visits and Information Dissemination

Before starting the detailed Social Impact Assessment study, the field visits and Pilot Study of the Socio Economic Survey was conducted where few respondents were administered the Interview Schedule and their feedbacks were collected. The team then inculcated the necessary addition and deletions in the interview schedule. During the first week of January 2017, SIA team visited the sites along with officials from Revenue Department to verify the alignment drawings on the ground and to identify the affected

areas. After identifying the affected areas SIA unit consulted with different stakeholders at the project area and organized meetings with them to generate awareness about the study. The survey team collected the data from January 4th to 7th 2017. Later during the Public Hearing Meeting it was observed that there were many sites where the formalities of acquisition, of the affected land were not completed, hence they were to be enumerated under the SIA study. The data of these families were collected in the first week of February 2017.

3.7 Socio Economic Survey

Before the actual household Socio Economic Survey, all the properties that were likely to be affected by the project were identified considering the alignment drawing prepared by the KMRL. The survey interview schedule was pre-tested (Annexure 3.1). The survey was conducted through door-to-door personal interview. In thisinterview, size and shape of building,type of construction of the structures were recorded. The details of affected families, possession of legal documents (if any, towards the claim of property and tenancy),data related to social profile, family details, occupation, source of income, family expenditure, household assets, information on affected structure, commercial/self employment activities, employment pattern were collected. Most part of the interview schedule has been pre-coded except those reflecting the opinion and views of PAFs, which have been left open-ended. Before filling the questionnaires, the affected families were asked to have a copy of the necessary documents they need to produce as proof of their existence in that particular structure and place. So documents like- Aadhar Card, Ration Card, Voter’s Identity Card or any other documents were verified whichever made available.

Survey forms duly filled were consolidated and entered into a database. This information was updated on a regular basis as and when data for incomplete forms were filled in. The data were later shared with the SIA Unit team to cross-check if anyone has been left out due to some reasons or if extra counting has been done.

3.9 Data Analysis and Report Writing

Once the data were collected and finalized with all the necessary changes, analysis of collected data was done.

3.10 Community and Public Consultation

Discussions were conducted by SIA unit with various primary and secondary stakeholders in order to obtain their views and suggestions of the potentially affected persons to minimize adverse social impacts. Special care was taken during the study to hold discussions with women group to elicit the adverse effects they are anticipating due to the project and their suggestions in this regard for mitigating the foreseeable adverse effects. During public hearing, issues related to land acquisition, compensation, income restoration, employment generation, information flow, grievance redressal, safety, role of administration etc. were discussed. The methods which were adopted for conducting

public consultation were (i) Informal personal consultation (iii)Focus Group Discussions (FGD) with different groups of affected people, (iv)In-depth individual interviews,(v)Discussions and interviews with key informants. (ii)Public Hearing.

LSG Meeting

The SIA unit was very particular to include the Local Self Government representative in the study. This Vytilla – Petah road widening project covers the area which comes under 49, 50, and 51 Divisions of Kochi Municipal Corporation and Mr. P.S. Shine, Mr.V.P. Chandran, Mr. A.B. Sabuare the councilors respectively. As the councilor were very familiar with the proposed project their suggestions were very relevant and to the point. Their valuable suggestions and concerns were included in the study at various stages. They provided critical feedback regarding the draft report presented on 16/1/2017 to the District Collector. A meeting was also convened at Deputy Collector’s (LA) KMRL chamber on 27/1/2017. Few suggestions given by the councilors were

• Modernization of Chambakara Market • Restoration of livelihood opportunities for the affected population • Restoration and beautification of Kunnara Park • Widening of the Vytilla to Kunnara Park Road. • Preference for the affected population in KMRL employment opportunities. • Speedy completion of the acquisition procedure and implementation of RR package.

Public Hearing

SIA Unit took special care to inform the affected people in the area about Public Hearing by taking various steps likeNotification for conducting public hearing as per Form 5 Rule 14 (1) of the RTFCTLARR Act, 2013. The notification was published in two News Papers - DeepikaDaily and Deshabimani Newspaper 2 weeks prior to the Public Hearing and distributed to all affected families, Tehsildaroffice and other stakeholders including press and media. Posters were also displayed at various junctions where people gathered around the land proposed to be acquired for the awareness of public in general. One copy was placed in the District Collector’s office.

Adequate copies of the SIA draft report and summaries were made available on the day of the public hearing in both English and Malayalam. The major highlights of the study were presented in local language through Power Point Presentation by Project Coordinator, SIA Unit.

Remarks of Requiring Body on the Views of the Affected Families

Section 5 ofRight to Fair Compensation and Transparency in Land Acquisition, Rehabilitation and Resettlement Act, of 2013envisages that whenever a SIA study is required to be prepared the Government shall ensure that a Public Hearing is held at the affected area to ascertain the views of the affected families to be recorded and included in the SIA Report. Rule 14 of the Rules2015 have prescribed detailed procedure for the conduct of the public hearing. The Rule requires that as soon as may be after the Public Hearing, the SIA Unit shall seek the remarks of the Requiring Body on the views or objections raised by the affected families or by any other person at the public hearing or received by it in writing. Sub rule 15.2 prescribes that on receipt of the communication from the SIA unit the Requiring Body shall answer each of the objection or views required to be answered by it.

RAJAGIRI outREACH, which is conducting the study for the Vyttila - Petta Road widening as a preparatory work of Kochi Metro Rail project, had held the public hearing of the affected families in two sessions on 30.01.2017 at Chambakkara - morning session for the landowners and other interested persons and the afternoon session for the tenants of commercial and residential buildings affected by the acquisition. The public meeting was held in Malayalam and was video recorded and transcribed. By letter dated 04.02.2017 the agency has forwarded the recorded remarks/views off the participants for the views of the Requisition Body. The Executive Engineer, PWD (Roads Division) Ernakulam is the RB in this case. We have gone through the records and following are remarks pertaining to them

In general, none of the participants have objected the public purpose of the acquisition. On the contrary they have requested to expedite the acquisition process as fast as possible as it is a fait accompli and they are to be given due compensation and R&R package. Most of the participants chose to express their personal concerns about the adequacy of the amount of the proposed package, the time when they will be forced to quit (in some cases), none of them had objection to the inclusion of a particular person or other in the study. A few persons/entities have put up their claimfor inclusion in the study. Common Responses:

1. Package for employees

As per LARRA affected family includes a family residing any land in the urban area for preceding 3 years or more prior to the acquisition of the land or whose primary source of livelihood for 3 years prior to the acquisition of the land is affected by the acquisition of such land. Employees for the shops may get R & R package if they were working in an establishment for preceding 3 years subject to records to prove.

2. Tenants who have shifted from earlier building to new building with in 3 years.

In their case it can be considered that their conducting business more than 3 years prior to acquisition since acquisition proposal was pending for a long time.

3.11 Limitations of the Study

During social survey in project affected areas the survey team has faced some limitations which are as follows:

1. The respondents were very apprehensive regarding the study as similar studies and procedures were not a welcome situation for them. The uncertainty pertaining to the land acquisition had made the situation worse. 2. The investigators had to visit repeatedly to the various houses again and again in order to record accurate and complete information. 3. Collection of information about owners who have rented their properties was difficult as they were not available during survey and the tenants also hesitated to provide information about owners in some cases. 4. Total families to be interviewed were 170, but only 156 families could be covered. 14 families could not be interviewed as they were not residing in the affected area, few owners were out of station and few did not cooperate with the investigator. 5. The duration of conducting SIA study was only for seven weeks. Within this short span of time period it was really tough to complete the study. In spite of all these problems every effort has been made for making this study very realistic to the existing situation.

Chapter - 4 LAND ASSESSMENT BACKGROUND

A socio-economic survey covering all affected families was carried out in January and February 2017. A structured interview schedule was used to collect detailed information on affected property, impacts on private assets, income and livelihood for a full understanding of impacts. The objective of the survey was to assess social impacts on the people affected by the project,their socio-economic profile,type of property, ownership of property, type of impact and its magnitude and details of affected property. The major findings and magnitude of impacts are discussed in the following sections.

4.1 Entire area of impact under the influence of the project

Table 4.1 indicates overall project impacts. Total 1.4723 hectares of land shall be acquired for the purpose of permanent usages. 1.4123 hectares of land is under private ownership and 0.06 hectares of land is under government possession. Total 161 properties shall be affected. Based on the property identification, the number of PAFs has been determined. There are 149 affected families consisting 671 persons. Out of total 149 affected families, 84 PAFs are titleholders and 65 are non-titleholders. The property of 20Residential users and 88 Commercial users shall not be viable after the acquisition. One community structure is also likely to be affected.

4.3 Land requirement for the project

The proposed Road Widening Project for Kochi Metro Rail Project shall require land for the implementation of the project. Acquisition of land shall happen to make affected families landless, houseless, and jobless in most of the cases. Therefore every effort has been made to keep land requirements to the barest minimum by realigning at critical cases.

Table 4.2 reveals that the proposed project will involve acquisition of 1.4723 hectare land. Out of the total land requirement 0.0600 hectare is government owned property and 1.4123 hectare is under private acquisition. The acquisition of 108 title holders had been already completed for the purpose of the project, which were not coming under the purview of the study. Hence the total area composition of affected families in which SIA study conducted comprised to 0.7630 hectare area of land.

4.4 Use of Public Land The proposed Vyttila Petah road widening project is being carrying out on land adjacent to the existing feeder road (Vyttila –Petah) to Kochi Madurai NH 49. The project is implemented dovetail to the proposed Kochi Metro Rail Project at Vyttila Petah corridor. For the purpose of implantation of the Metro Rail Project, Kunnara Park (recreational park) earlier owned by Kochi Municipal Corporation had been acquired by the concerned authority for the Metro Rail Project.

4.5 Land Already Purchased

The proposed Kochi Metro Rail Project was initiated in the area on 2012 and by the acquisition procedure carried out by the Revenue Administration 50 percent (approx.) held by 108title holders had been already purchased by the concerned authority.

Table 4.3 reveals that 27 families are losing land area of 0.005 hectare where 38 families are losing area between 0.005 – 0.015 hectare. 0.015 to 0.025 hectares of land shall be acquired from 8 familieswhereas more than 0.035 hectares shall be acquired from 4 families. Theinformation about the extent of land area acquiring of 8 title holders is not available at Land Acquisition Office and the respondents are not sure of their area of land to be acquired. Hence this data is not included in this study.

Table 4.4 depicts the use of property as well the magnitude of the impact. 24 families are residing in the affected area among them 6 shall be fully affected by the proposed while 18 shall be partially affected. 68 commercial entities among the total of 99 would be fully affected while 26 of them shall be partially affected. 10 families use the properties for residential as well commercial use while 3 clinic/dispensary 3 religious properties and 3 community utilities which include two bus stops and one ATM are affected. Kunnara Park, Warehousing Corporation, Navel Quarters are the Govt. properties partially affected by the proposed project.

Table 4.5 reveals that among the 149 families surveyed for the project 56 are residing /operating in a pucca structure while 73 are using a semi-puccatype of construction. Since 2003, it was presumed that KMRL would procure the land for widening of roads as a result no maintenance was undertaken by the owners of the buildings in project area.

4.7 Previous transactions in the area

As per the information given by the respondents, no transactions had been taken place in the affected area for the last three years.

Chapter - 5 ESTIMATION AND ENUMERATION Introduction

This chapter comprises of livelihood affected, scale of impact on families i.e., directly affected families and indirectly affected families. It also mentions about the loss of inventory in the affected.

5.1 Directly Affected

Among the affected families, livelihood 78 families are directly affected by the proposed land acquisition. The affected area comprises of a fish market in which 7 merchants are engaged in fish businesses (retail and wholesale) and their 45 employees shall be directly affected by the project. Total 66 families who are engaged in business activities in the area shall be affected by the project implementation. 5 families each in private sector and small scale industry sector shall be affected by the project.

In addition, 148 employees are working in the commercial entities in the area whose livelihood is also directly affected by the project.

There are 156 properties likely to be affected by the project. Among them 24 properties are used for residential purpose whereas 98 properties are used for commercial purpose and 10 families who are using the same property for residential as well as commercial purpose. The affected area also comprises 4 religious owned properties and 3 health clinic.

Among the total of 671 affected persons 26 members are labourers, while 19.2 percent i.e., 129 members are engaged in business activities for their livelihood measures. 18 members are employed in government sector while 69 members are self employed.

The table also shows that 121 members are engaged in household family duties hence not engaged in other economic activities. Out of the total 422 unemployed 77 members are elderly and 187 are students.

6.3 Vulnerable Group

Among the total 671 affected persons in the area 346 are women, 159 children and 127 elderly who all are vulnerable population in the area. 31 women who are the head of their families and 3 physically challenged persons are also to be considered as vulnerable population.

6.5 Factors that Contribute to Local Livelihoods

The affected area comprises of fish market (Champakkara Fish Market) in which 40 business entities functions. The same pave for livelihood of 100 persons within the market. Among the employees, many female members are also working. The same provides opportunity for women members in the society to earn a reasonable wages by working in the business units in the market.

Chapter - 7 SOCIAL IMPACT MANAGEMENT PLAN

7.1 Framework and Approach to Identifying Impact

SIA seeks to assess, in advance, the social repercussion that are likely to follow from projects undertaken to promote development, such as metro, highways, airports, urban development, etc. It is a tool that can help decision makers to foresee the likely negative impacts of their actions so that steps necessary to prevent or at least to contain them could be taken in time. As an aid to the decision making process, SIA provides information on social and cultural factors that need to be taken into account in any decision that directly or indirectly affects the lives of people in the project area.

The process of conducting Social Impact Assessment was designed in a manner which involved all stakeholders in systematic approach to assess the impact of proposed acquisition.

7.2 Some of the Opinions of the Stakeholders are as under:

1. Health: People are satisfied with the existing health facilities in city. Many Private and Public Multi specialty hospitals are in the vicinity of the affected area to cater to their needs 24 hours a day. 2. Water: Drinking water is available throughout the year but people were very apprehensive about the disruption of water supply during the construction of the proposed project. 3. Drainage System: As the land acquisition is interrupted at various places the drainage system is also blocked at many places. The chances are very high that during the rainy season clogging of the drainage and the other ducts may lead to stagnation of waste water on the main road and adjacent land which may lead to contamination of drinking water would be a public health issue. 4. Income restoration for women: Many women are earning their living by cleaning fish on daily wages in the market. Their income source would be disrupted and the social status would come down. They suggested that they may also be included in the affected category and income restoration alternative to be designed as part of the project.

5. Livelihood:People whose livelihood is disturbed, but are above the age to learn new skills to survive should be given opportunity to continue their small business in the nearby places.

• No major negative impacts were found regarding the secondary stakeholders. • Surveys and interactions with the primary stakeholders revealed that their condition for complying with the acquisition was that it has to be done as early as possible without any further delay and the property which becomes non viable by partial acquisition should be acquired completely by the Government. Consequently the remaining property would not be left of much value to owners once the acquisition has taken place.

7.4 Measures stated by the Requiring Body in Project Proposal

No mitigation or management or any other measures were stated by the requiring body in the project proposal.

7.5 Measures to Avoid, Mitigate and Compensate Impact

• While providing RR package the preferences is to be given to displaced families, Women Headed Households, Dependent widows, Person with Disability by speedy disbursement of compensation. • Many affected families which had to suffer as their livelihood was blocked as a result of various procedures related to land acquisition, which did not happen till date are to be paid appropriate compensation with retrospective effect. • Women who will lose the livelihood can be supported for self employment by linking them to Kudumbashree or other organizations. • Possibilities can be considered to reduce the loss of structure of 3 affected Titleholders by realigning if possible to minimize the agony caused by it. This can in turn benefit the implementation agency by reducing the cost of rehabilitation. • Modernization of the market can be initiated by linking with other agencies and the people who lose their livelihood can be given priority. • Concerned authority has to take preventive measures to address the health and sanitation issues due to in-migration as well as link the in-migrants to governmental and nongovernmental organisations. • The safety risks to the employees and public at different stages of the Project are to be addressed by the concerned execution agencies by sensitization activities and precautions.

• Restoration of beautification of Kunnara Park with a theme base. A park based and run on renewable energy, Eco Park, species garden, butterfly garden, innovative reuse of disposed materials are few examples to site. • As per the existing plan Kunnara Park to Petah Junction road widening is being implemented excluding Vytilla to Kunnara park area. Vyttila is a main junction in Kochi city and the traffic is very high here, if the widening of road from Kunnara Park is not extended the whole purpose of road widening would not yield the expected and required result.

Awareness and Opinion about the Project

The affected populations have expressed their concerns towards the in migration of labourers in the project area which would increase the chances of spreading of communicable diseases. Concerned departments has to take adequate steps to make sure that the in migrants related to the project such as the labourers should provided with necessary preventive measures to reduce the incidence of spreading of communicable diseases by linking them to Government and Non-Governmental agencies working in this field.

The affected population also commented about the negative impacts of the project and 64.1 percent of them opinioned that pressure on existing land shall increase while 34 percent believes that there will be more influx of outside population in the city. Also 39.7 says that the project shall pave way to increase in the density around the metro.

Final Conclusion

The proposed land Acquisition at Vyttila-Petah( Road Widening) Project falls under the definition of “Public Purpose” under the RTFCTLARR Act 2013.The major social impacts on the primary stakeholders identified through the study are Families of Property Owners ( Land & Structures), Commercial Tenants, Labour in the project affected area for the last three years. Provisions of Land Acquisition as per the RTFCTLARR Act 2013 should be fixed in order to mitigate these impacts.

The following Table depicts the number of project affected families and employees to be considered for Compensation as per the Act. The dependent widows are to be considered for special R&R package. Specific Details of the same are given in Annexure 8.1 & 8.2

Chapter - 9 SOCIAL IMPACT MANAGEMENT PLAN INSTITUTIONAL FRAMEWORK

9.1 Institutional Structures and Key Persons

RTFCTLARR Act, 2013 defines the Administrator appointed by the State Government would be the person responsible for Preparation of Rehabilitation and Resettlement Scheme for affected families of Land Acquisition. Subject to the superintendence, directions and control of the appropriate Government and the Commissioner for Rehabilitation and Resettlement, the formulation, execution and monitoring of the Rehabilitation & Resettlement Scheme shall vest in the Administrator.

In the proposed Vyttila-Petah Road Widening Project, the major mitigation measures from the acquisition can be handled by providing the appropriate compensation under the RTFCTLARR Act, 2013.

As per G.O. (Ms) No.485/2015/RD, dated 23/09/2015, The Kerala State Policy for Compensation and Transparency in Land Acquisition,
