(a) Whether the latest census data shows that manual scavenging is still prevalent in the country; (b) if so, the reasons therefore and the States which have not been able to abolish the practice of manual scavenging; (c) whether the Government is considering to bring a new legislation to abolish the practice of manual scavenging; and (d) if so, the details thereof and the time by which it is likely to be introduced?

(a) to (d) A statement is laid on the Table of the House. Statement in reply to parts (a) to (d) of the Lok Sabha Starred Question No.352 for 30.4.12 by Shri B.B. Patil and Shri Arjun Meghwal regarding `Eradication of Manual Scavenging`. (a) & (b) Houselisting and Housing Census, 2011 data released by the Registrar General of in March, 2012, has inter alia, provided number of hoseholds by type of latrine facility, including latrines from which night soil is manually removed. According to this data, such latrines existed in all States/UTs except in the States of Goa & Sikkim, and the UTs of Chandigarh and Lakshadweep. Existence of manually serviced latrines in the remaining States/UTs points to the fact that the practice of manual scavenging is yet to be eliminated there. (c) & (d) Government is preparing a new bill for, inter alia, eliminating manual scavenging and insanitary latrines, and rehabilitation of manual scavengers in alternative occupations so that they are able to lead a life of dignity. The Bill would be introduced in Parliament as early as possible.

(a) & (b) The Secretary, Ministry of Social Justice & Empowerment, in his capacity as the Chairman of the R&R Sub-Group of Narmada Control Authority, wrote to the Government of Maharashtra on 25.2.2011, 20.6.2011 and 14.7.2011 for early completion of Resettlement and Rehabilitation (R&R) work by way of (i) allotment of one hectare additional land to major sons of Project Affected Families (PAFs) at the present dam height of EL 121.92 meters, and (ii) in respect of declared PAFs remaining for R&R between present dam height and the Full Reservoir Level. (c) A meeting of the R&R Sub-Group, fixed for 6th February, 2012 was postponed at the request of certain State Governments. Next meeting of the Sub-Group has been fixed on 29th May, 2012.

IRREGULARITIES IN GRANTING SANCTION TO NGOS

(a) to (c) Complaints have been received against three officials of the Ministry since December 2010. In respect of two officials, the veracity of the complaints could not be established due to incomplete/vague or fake addresses of the complainants and these have been closed. Complaints against one official are under examination. The Ministry is strictly following the guidelines prescribed in the CVC Manual, dealing with complaints and curbing the corrupt practices.

ERADICATION OF MANUAL SCAVENGING 13th August 2012

(a) whether the Government has conducted any survey recently to ascertain the number of dry toilets and manual scavengers in the country; (b) if so, the details thereof, State-wise; (c) whether the Government has prepared any action plan including introduction of a new legislation to eradicate manual scavenging in the country and rehabilitation of manual scavengers and their family members; (d) if so, the details thereof along with the funds allocated and utilized for various programmes/schemes for eradication of manual scavenging during the last three years; (e) whether the guidelines issued by the National Commission for Safai Karamcharies for utilization of funds, are effectively being complied with; and (f) if not, the reasons therefor and the corrective action taken in the matter?

MINISTER OF THE STATE IN THE MINISTRY OF SOCIAL JUSTICE AND EMPOWERMENT (SHRI MUKUL WASNIK)

(a) to (f): A statement is laid on the Table of the House. Statement in reply to parts (a) to (f) of the Lok Sabha Starred Question No. 41 for 13.8.12 by Shri Pradeep Majhi and Shri Basudeb Acharia regarding `Eradication of Manual Scavenging`. (a) & (b): Houselisting and Housing Census Data-2011 released by the Registrar General of India in March, 2012, has, inter alia, provided the number of Households (HHs) having latrines from which night soil is removed by humans. The number of such HHs is 7,94,390. The State/UT wise details are given at Annexure.

The ongoing Socio Economic Caste Census (SECC), 2011, in rural India is, inter alia, capturing the data about the manual scavengers in rural areas, including the non-statutory towns. A fresh survey of the manual scavengers in the statutory towns, is also being planned. (c) & (d): A multi-pronged strategy has been followed for eradication of manual scavenging and rehabilitation of manual scavengers. This, inter-alia, consists of:- (i) Administration of the Employment of Manual Scavengers and Construction of Dry Latrines (Prohibition) Act, 1993; (ii) Conversion of dry latrines into water seal toilets, and

(iii) Rehabilitation of manual scavengers and their dependents, into alternative occupations. The Self-Employment Scheme for Rehabilitation of Manual Scavengers (SRMS) was launched in January, 2007 for providing financial assistance to the manual scavengers and their dependants for undertaking alternative occupations, through the State Channelising Agencies. Under the Scheme, an amount of Rs.173.50 crore has been released to the State Channelizing Agencies. Utilization of Rs.147.61 crore has been confirmed by them so far. Under the “Integrated Low Cost Sanitation Scheme”, subsidy is provided to Households, in urban areas, belonging to the economically weaker sections for conversion of dry latrines into low cost pour flush latrines and to construct new ones where none exist. During the last three years, an amount of Rs.215.16 crore (Central subsidy under the Scheme) has been released to the States/UTs for this purpose, out of which Rs.113.91 crore has been utilized by the States. Total Sanitation Campaign (now revised and renamed as Nirmal Bharat Abhiyan(NBA)), inter-alia, aimed to accelerate sanitation coverage in rural areas by providing access to toilets to all. During the last three years, an amount of Rs.4009.25 crore has been released to the States/UTs, as Central share under the Scheme, out of which an expenditure of Rs. 3844.86 crore has been incurred, including Rs.2568.72 crore as Central share of incentive for individual household latrines. The Government is contemplating bringing a new legislation with more stringent provisions for eliminating manual scavenging. (e): The National Commission for Safai Karamcharis has not issued any guidelines for the utilization of funds. (f): Does not arise.

(a) the details of the rehabilitation schemes being run by the Government for manual scavengers in the country along with the number of beneficiaries thereof;

(b) whether the Government proposes to bring a legislation to put a blanket ban on manual scavenging in the country and if so, the details thereof;

(c) whether the Ministry has received a proposal from the Ministry of Railways that they may be exempted from the purview of the proposed legislation and if so, the reasons and the details thereof along with the response of the Government in this regard;

(d) whether the newer forms of manual scavenging such as sewer manhole and septic tank cleaning are still in practice;and

(e) if so, the steps taken by the Government to abolish the said practice?

Statement in reply to parts (a) to (e) of the Lok Sabha Starred Question No. 41 for 26.11.12 by Shri L. Raja Gopal and Shri Sugumar K. regarding `Manual Scavenging`.

(a) Self-Employment Scheme for Rehabilitation of Manual Scavengers (SRMS) was launched in January, 2007 for providing financial assistance to the manual scavengers and their dependants for undertaking alternative occupations, through the State Channelising Agencies. Main components of the Scheme are skill training and financial assistance (loan and subsidy) for self-employment, as per following details:

(i) Skill training for a period upto one year, with payment of stipend @ Rs. 1,000 per month.

(ii) Loan at concessional rate of interest for self employment projects costing upto Rs. 5 lakh with provision of interest subsidy to provide for the gap between the banks` rate of interest and the rate of interest provided under the scheme (4-6% p.a.)

(iii) Capital subsidy @ 50% of the project cost, for projects upto Rs. 25,000, and @ 25% for projects above Rs. 25,000, with a minimum of Rs. 12,500 and maximum of Rs. 20,000.

79,454 beneficiaries have been covered under the scheme so far.

(b) `The Prohibition of Employment as Manual Scavengers and their Rehabilitation Bill, 2012` has been introduced in Lok Sabha on 3.9.2012. The main features of the Bill are given at Annexure.

(c) No specific request has been made by the Ministry of Railways for exemption from the purview of the Prohibition of Employment as Manual Scavengers and their Rehabilitation Bill, 2012.

(d) & (e) The Bill, inter alia, prohibits the employment or engagement of persons for hazardous cleaning of sewers and septic tanks. It casts a responsibility on the employer to provide protective gear and other cleaning devices to such persons and ensure the observance of safety precautions.

(b) if so, the names of Non-Governmental Organisations (NGOs) which have not submitted Utilization Certificates (UCs) in respect of grants released;

(c) the time frame by which the NGOs can submit their utilization certificate before taking action for its recovery;

(d) whether any action has been initiated of the recovery of grant in aid/subsidy, etc., where utilization certificates have not been received even after the expiry of maximum time allowed; and

(e) if so, the details thereof and if not, the reasons therefor?

(a) & (c) As per the General Financial Rules, 2005, the Utilization certificate in respect of non-recurring grants given to a Non-Governmental Organization should be submitted within 12 months of the closure of the financial year. Similarly, further release of recurring grants is subject to submission of the utilization certificates of grants of previous year.

The organizations, which do not provide the Utilization Certificates (UCs) are not released further financial assistance under the Scheme till the UCs are received from them.

MISUSE OF FUNDS 26th November, 2012

(d) whether there are cases where funds have been released on the submission of fake or manipulated documents particularly in UP and Bihar and if so, the details thereof;

(e) whether Government has fixed any responsibility and penalized those NGOs officials who have been found responsible for such mis-utilisation of funds;

(f) if so, the details thereof; and

(g) if not, the reasons therefor?

(a) & (b) : State-wise, scheme-wise details of funds released to Non-Governmental Organisations during last three years is given at Annexure.

(c) & (d) : The Ministry ensures the utilization of funds under various schemes/programmes in the following ways :-

(i) Fresh/subsequent releases of grants to NGOs during a year are made only on receipt of Utilization Certificates in respect of previous grants sanctioned which have become due.

(ii) Review of schemes/programmes by the officers of the Ministry during their tours to States.

(iii) The Ministry also sponsors evaluation studies from time to time through independent evaluation agencies, inter alia, to check proper utilization of funds by the implementation agencies under various Schemes/Programmes.

(iv) Inspection by National Institutes of the Ministry.

(v) The Schemes/Programmes implemented through NGOs are also expected to be monitored by respective State Governments/ UT Administrations.

(vi) In the event of proven misappropriation of funds by an NGO, the Ministry initiates action to blacklist the NGO.

(e) & (f) : 67 complaints have been received against the NGOs in the Ministry during last three years and the current year. The complaints received are referred to the concerned State Governments requesting them to investigate and furnish enquiry report. Necessary action is taken on the basis of enquiry report received from the State Governments and further grants-in-aid are released only after receipt of satisfactory enquiry report from the State Government.

(a) whether the Government has prepared any list of blacklisted NGOs in consultation with Intelligence Bureau (IB), Central Economic Intelligence Bureau (CEIB) & (ED);

(b) if so, the details thereof;

(c) whether a sub-group comprising officials of various intelligence agencies has been set up to track remittance of suspect NGOs in coordination with RBI; and

(d) if so, the details thereof ?
