CLOSURE ORDER WITH DISCONNECTION OF ELECTRICITY.

WHEREAS a complaint petition was received by the West Bengal Pollution Control Board (hereinafter will be referred to as the `State Board'), on 20­04­2012 against a metal Bangles manufacturing unit namely M/s Chota Bhai, located at 55 Madan Mohan Burman Street, Kolkata Municipal Corporation(KMC) ward no.: 41, P.O. & P.S. , Kolkata­700 007, alleging environmental pollution due to activities of electroplating and other related work.

AND WHEREAS the unit was called for hearing on 11­06­2012 by the State Board to attend with all statutory licenses, including ‘Consent to Establish/Consent to Operate’ of the State Board and nobody appeared on behalf of the unit.

AND WHEREAS, inspection of the said unit was conducted by the State Board official on 01­08­ 2012 and it was observed during inspection that the unit used 1(one) nickeling machine and 1(one) buffing machine and discharging the raw effluent such as spent acid, water of rinsing etc. to the KMC drain without any treatment. The unit could not produce any statutory licenses including ‘Consent to Establish’/ `Consent to Operate' of the State Board. Moreover, this type of unit belongs to Special Red Category of Industry according to State Board’s industrial categorization and not allowed to operate in municipal areas within KMA.

AND WHEREAS the unit was called for hearing again on 07­09­2012 and nobody appeared on behalf of the unit.

NOW THEREFORE, considering present siting policy of State Board that this type of unit not allowed to operate in KMC area and also operation of the unit without valid Consent of the State Board, that M/s Chota Bhai, is hereby directed to close all kinds of operation at the present location with immediate effect

Electricity connection of the said unit is ordered to be disconnected forthwith.

The General Manager­Operation (C&M), CESC Ltd., is requested to take necessary steps to disconnect the electricity connection of the unit immediately.

Closure order will take immediate effect and the Officer­in­Charge, Burrabazar Police Station, under is requested to execute the closure order against the aforementioned unit and submit the compliance report to the State Board within seven days from the receipt of this memo.

This direction has been issued to the Officer­in­Charge, Burrabazar Police Station and the General Manager­Operation (C&M), CESC Ltd., in conformity with the orders of the Hon'ble High Court, Calcutta, dated 21­08­1998 and 28­04­1999 respectively.

The Environmental Engineer, Camac Street Regional Office of the State Board is requested to take necessary steps for proper execution of the closure order and ensure the disconnection of electricity of the said unit. He/ she is also requested to visit the unit involving the local police authority, if situation demands. ­2­

This direction has been issued in exercise of the powers conferred under the Water (Prevention & Control of Pollution) Act, 1974, the Air (Prevention & Control of Pollution) Act, 1981 and Environment (Protection) Act, 1986 and Rules made thereunder.
