The Brady Campagn to Prevent Gun Violence (Brady Campaign) hereby files ths complamt against the National mfle Association (NRA), a 501(c) (4) corporation located at 11250 Waples Mill Road, Fairfax VA 22030 and the National fifle Association Political Victory Fund, a federally registered separate segregated fund (COO0535 53) connected to the NRA.

1' Complainant herein, the Brady Campaign, a non-profit 501 (c)(4) corporation, is asking the FEC to mvestigate whether the NRA is in violation of Federal Election Commission regulations and Federal Election Campaign Laws, whether the National €Me Association has engaged in electioneenng, and whether it has made illegal in-kind contnbutions to federal candidates by expressly advocating the election or defeat of federal candidates to the general public through it web activities

The www.N€WPVF.ORG website is not a password protected website and is accessible to the general public through the Internet. The undersigned has personally accessed ths site without the use of a password on a nearly daily basis since the first week of October

1 1) Information communicating the N€WPVF's 2006 federal endorsed candidaies to the general public, beyond its restncted class, through thls non-password protected website. The endorsements also serve as a portal with links to the websites of endorsed candidates. The NRAPVF is making endorsements in a large number of races for the U.S. House of Representatives and the U.S. Senate. (Attachment #1 - Screen shot of www.NRAPVF org, website home page. Examples of the endorsement pages are included. Endorsements are available for all 50 states; we have included sample pages for MO, VA and PA. 8) The NRA's action alerts have been posted on numerous non-connected websites which direct visitors to the www.NRAPVF.org website, allowing the general public to view the electioneering information without a password. (Attachment #7 - Screen shot from www fieehunters ora)

I In addition, the publicizing of endorsements, publicizing of political advertisements, and links to candidate websites on www NRAPVF org constitute in-kind contnbutions to those candidates, which have not been reported to the FEC.

We have additional evidence and documentation, in hard copy and electronic form, available.

For the reasons stated, Complainant Brady Campaign to Prevent Gun Violence hereby submits this Complant agamst Respondents National Rzfle Association and National Rifle Association Political Victory Fund asking the FEC to determine if violations of federal Campaign Laws and Federal Election Commission regulations occurred in the manner described above and if so to take appropnate action.

THE PASSING OF A PATRIOT

The pro-Second Amendment community lost a true friend last week, with the passing of Herman Richard Daniel of Irmo, S.C. "Rick died due to complications from aortal heart issues. He was 45.

An NRA Life Member, Rick's pro-gun resume was long and distinguished and included:

. IOyears as President, and currently Legislative Director, of Gun Owners of South Carolina, NRA's state affiliate;

NRA-ILA Election Volunteer Coordinator for South Carolina's First, Second, and Fourth congressional districts;

- Being appointed by NRA President Sandy Froman to serve on the NRA Board of Directors' Grassroots Development Committee;

First ever America's 1st Freedom magazine's "NRA Member of The Year;"

Only non-legislator in South Carolina to be named "Defender of Freedom" by NRA;

Honored by South Carolina Senate and House in 2001 with Resolutions

In addition to practicing what NRA preaches on volunteerism, Rick also dedicated his professional life to public service, as he served four statewide elected officials, including serving in the former S.C. Attorney General's Office as an investigator. Additionally, at the time of his passing, Rick served as a State Constable Officer in S.C. State Guard (Special Liaison Unit) and was a longtime aide to South Carolina Comptroller General, Richard Eckstrom (R). He was eulogized by, among others, Lt. Governor Andre Bauer (R), and the service was attended by other elected officials.

Not only was Rick among the top pro-gun activists in the country, but he was a friend to many of us in the NRA family. His activism, wit, friendship, guidance, and professionalism will be sorely missed, and our remain with his family and friends.

The son of Evelyn Spires and the late Herman Daniel, Rick is survived by his loving wife Esther and two daughters, Heather Rhea and Kara Nina; his brother Jim and wife Tonette, with niece Jamie; and sister Linda and her husband Charley Butler.

HALBROOK DEMOLISHES ANTI-GUN PROPAGANDA

When it comes to the debate over the Right to Keep and Bear Arms, few, if any, have contributed more than constitutional scholar and attorney, Stephen Halbrook. His books and law review articles are “must reading” for all (including other scholars) who are interested in the origin of the right to arms and the Second Amendment.

Now, Halbrook has come to the defense of the right to arms once again. This time, he responds to arguments currently being pushed by Ohio State University (OSU) history professor, Saul Cornell.

Most of the academics who once believed that the Second Amendment protects something other than an individual right have changed their minds or gone silent, due to the overwhelming evidence presented by Halbrook, Joyce Lee Malcolm, David Hardy, Don Kates, Sanford Levinson, Robert Cottrol, William van Alstyne, Akhil Reed Amar, Nelson Lund, and many others over the last 20-odd years.

Not Cornell. He IStrying to create a niche for himself as a conspicuous dissenter, heading up the Second Amendment Research Center (SARC) at OSU. While the SARC purports to be a “nonpartisan center promoting scholarship on issues concerning the Second Amendment to the United States Constitution and firearms regulation,” it receives funding from the radically anti-gun Joyce Foundation.

Cornell is pushing the idea that the Second Amendment requires gun control and imposes a civic duty to possess arms while serving in a militia. And he says that those who believe that the amendment protects an individual right misinterpret the writings of Judge St. George Tucker, author of the first and foremost treatise on our Constitution and Bill of Rights.

To the contrary, Halbrook points out, Tucker considered the Second Amendment the “palladium of liberty” and self-defense “the first law of nature.’’ Tucker I lamented that under the infamous British Game Laws, only well-to-do Englishmen were permitted to hunt, but “no others can keep a gun for their defense; so that the whole nation are completely disarmed, and left at the mercy of the government, under the pretext of preserving the breed of hares and partridges, for the exclusive use of the independent country gentlemen.”

By comparison, Tucker said, under the Second Amendment our Congress has “no power to regulate, or interfere with the domestic concerns, or police of any state,’’ “nor will the constitution permit any prohibition of arms to the people.”

DEER MANAGEMENT PLAN FOR CUYAHOGA VALLEY NATIONAL PARK, OHIO

The Cuyahoga Valley National Park announced that it will be preparing a management plan to address overpopulation of white-tailed deer. An environmental impact statement (EIS) will be prepared and the preliminary management options are: landscape management, fencing, reproductive control, direct reduction, or a combination of these options. The use of hunters is not mentioned because hunting is not permitted in the Park. However, the Park should “contract” people with hunting skills to assist them in any reduction plan. The Park is accepting comments on the preliminary options until November 6. The Park will be holding public meetings and when a draft EIS is prepared, it will be made available for public comment. Hunter participation in wildlife management has proven to be the most cost effective tool available. Let the

CALIFORNIA On Tuesday, October IO, the City of Santa Clara withdrew its proposal to ban gun shows on city property. The City Council claimed it received a “huge volume” of e-mails from NRA Members across the State of California. A special thank you to all *NRA members for your calls and e-mails against this threat to your Right to Keep and Bear Arms!

Also, on Saturday, October 21, at 9.00 a.m., the U.S. Forest Service (USFS), with assistance from PLINK, a cooperative program of the NRA Members Council, El Dorado Rod & Gun Club, and the USFS, will be cleaning up shot shells and targets from Tiger Creek Quarry. Volunteers are needed to preserve this valuable shooting sports resource. Volunteers will gather at the Firehouse Cafe in Diamond Springs at 7:30 a.m., for a complimentary breakfast prior to caravanning to the site. If you are unable to attend for breakfast, but can help with the clean-up, take Highway 88 about 18 miles east of Jackson to Buckorn, then turn south (right) on Tiger Creek Road. At the Reservoir, keep driving east above the PG&E houses on the one lane paved Salt Springs Road for a bit over one mile, then turn right 500 yards down into the quarry. ILLINOIS When Cook County voters go to the polls this Election Day, November 7, they will be faced with the opportunity to vote on Countywide Advisory Referendum Manon-binding referendum that seeks to urge the State of Illinois to ban countless semi-automatic rifles, shotguns, and handguns, as well as all 50 caliber rifles. The Cook County Board could just as easily have given the voters of Cook County an opportunity to voice their support for any number of proven crime-fighting measures, but certain anti-gun extremists on the Board have chosen to promote a statewide version of the federal gun ban that was such a complete failure in combating violent crime that Congress allowed it to expire two years ago. Targeting law-abiding gun owners instead, the referendum uses buzzwords and phrases (“For the health and safety of children...”) that could have been lifted directly from the websites of gun-ban extremists such as the Brady Campaign, which has endorsed the proposal. Joining the Brady Bunch in support of the referendum at a September event were several anti-gun politicians, including Cook County Commissioners Larry Suffredin (D-I 3) and John Daley (D-I 1); State Senator Antonio Munoz (D-I); State Representatives Edward Acevedo (D-2) and Esther Golar (D-6); and Alderman Todd Stroger (D- 8). NRA opposes passage of Countywide Advisory Referendum 1, urges its members in Cook County to vote against it, and to spread the word to oppose this effort to prohibit the law-abiding citizens of Illinois from possessing firearms commonly used for personal protection, hunting, and sporting purposes.

ONE MONTH TO GO- WHAT (MORE)CAN YOU DO?

With the November 7 elections just around the corner, here are some activities in which pro-Second Amendment activists must be involved to assure victory for pro-gun candidates on Election Day While we can’t expect every gun owner to do everything, we must work to ensure every gun owner does something!

YARD SIGNS: The key to placing yard signs is location, location, location. Put signs where large numbers of people will see them, but out of right of ways. Ask fellow firearm owners who have property that would make a good sign location to post a sign, and make sure the “natural resources of the pro-gun community’’ (gun shows, gun shops, shooting ranges, and gun and hunting clubs) have signs prominently displayed. Don’t put signs on private property without permission, and don’t tamper with the opposition’s signs! And, of course, make sure you have a pro-gun candidate’s sign in your yard or on your property! ’

LITERATURE DROPS: Literature drops are an extremely effective way for Second Amendment supporters to get out their message regarding pro-freedom candidates. Again, take advantage of the “natural resources” of the pro-gun community. Gun shows are the best venue to conduct a literature drop. Check with the show promoter to set up a literature table or share one with a fellow NRA member or pro-gun supporter. Or, better yet, hand out pro-gun candidates’ literature to all attendees as they enter the show. If distributing literature in neighborhoods, never put materials in a mailbox! Remember, the goal of this activity isn’t to debate with anti-gun voters, but rather, to distribute as much material to as many potential voters as possible!

BUMPER STICKERS: Make sure every vehicle you own has a pro-gun candidate’s (and/or NRA) bumper sticker on it. Then, work to ensure the vehicles of your friends and fellow firearm owners are proudly displaying a sticker(s) as well!

G LETTERS TO THE EDITOR: Please submit at least one letter to the editor of your local newspaper in support of a pro-gun candidate between now and Election Day. Consult your paper’s deadlines, as some papers stop accepting political letters to the editor on a certain date prior to the election. You can find media contact information by visiting our homepage- www.NRAILA.org-- and accessing the “Take Action” section and then clicking the “Write The Media” link. (.: Your goal in writing should be to ensure that pro-gun candidates are receiving positive media in these final days leading up to November 7.

GET OUT THE VOTE & ELECTION DAY ACTIVITIES: Now that we are in the final month of the campaign season, candidates are focusing their efforts on Get Out The Vote projects, and laying the final groundwork for a barrage of Election Day activities. These activities require assistance contacting voters by phone, walking precincts, volunteering to drive pro-gun voters to the polls, and putting up signs and handing out literature at polling locations on Election Day.

ATTEND FINAL “LISTENING SESSION ON COOPERATIVE CONSERVATION”

The Departments of the Interior, Agriculture, Commerce and Defense, the Environmental Protection Agency, and the White House Council on - Environmental Quality are holding their final “listening session” to exchange ideas on incentives, voluntary programs, and regulations that can improve results and promote cooperative conservation.

This final session will provide a vital opportunity for NRA members and the hunting community to ensure that their voices are heard.

The discussion topics will include how the Federal government can:

- Better respect the interests of people with ownership in land, water, and other natural resources;

Enhance wildlife habitat, species protection, and other conservation outcomes through regulatory and voluntary conservation programs;

- Enhance cooperation among federal agencies and with states, tribes, and local communities in the application of environmental protection and consewation laws;

Work with states, tribes, and other public- and private-sector partners to improve science used in environmental protection and conservation, and;

Work cooperatively with businesses and landowners to protect the environment and promote conservation. /

This final meeting will guide the federal government in the development of future policy proposals that build upon the success of cooperative conservation.

CALIFORNIA On Friday, September 29, Governor Arnold Schwarzenegger (R)protected the Second Amendment by returning SB59 to the State Senate and AB2714 to the State Assembly without his signature. SB59, sponsored by Senator Alan Lowenthal (D-27) would have expanded the definition of the term “firearm” to include the frame or receiver of the gun for purposes of the offense of failure to report a stolen or lost firearm. This bill would also have made it a crime for any person whose handgun is stolen or irretrievably lost to not report the theft or loss to a local law enforcement agency within five working days after discovering the loss or theft; or within five working days after the date he or she should have reasonably known of the theft or loss. Additionally, SB59 would have allowed local governments to impose even stricter reporting requirements.

AB2714, sponsored by Assembly Member Alberto Torrico (D-20), would have 1 required that no ammunition (or reloaded ammunition) be sold in a retail transaction unless the purchaser personally presents evidence of his or her identity and age, as specified, to the seller of the ammunition. It also would have severely unde rmi ned California’s state preemption law.

PENNSYL VANIA , The House, meeting to consider crime-fighting proposals this past Tuesday, rejected every gun-control measure on the agenda, including bills to limit gun purchases to one a month and to impose a statewide ban on so-called assault weapons. They were defeated on the House floor. Representative (D-Alleg heny) proposed a statewide ban on “assault weapons” but the legislation failed by a vote of 63-124, as did a plan offered by Representative John Myers (D-Philadelphia) to ban such firearms in Philadelphia only, which lawmakers rejected in a 57-128 vote.

The House also rejected several gun-control measures last week, including legislation that would have imposed reporting requirements on gun sellers, supposedly to prevent “straw” buying, as well as bills to mandate child safety locks on firearms and allow Philadelphia to regulate the sale of guns and ammunition.

The gun-control debate came during the course of a rarely used legislative procedure known as the Committee of the Whole. Each lawmaker was given an opportunity to offer crime-fighting measures in the committee, and informal votes were taken to determine which proposals would be considered in regular session. Over the three days of debate, the House plowed through nearly a I00 proposals of the crime-focused Committee of the Whole. Lawmakers endorsed many bills toughening criminal penalties or buttressing law enforcement, including a plan to add up to 10,000 new police officers to local forces by 2010, with a mix of state and local funding.

Elections matter. Precisely because of our work and success in the 2002 and I 2004 elections, we were able to lay the groundwork for the victories that you will read about below. Now the question before us is, ‘What will the future hold?” Two years from now, will we be reporting on more victories in our quest to protect and preserve the Second Amendment? Or, will our update contain bad news for gun owners? Election Day -- Tuesday, November 7 -- will be when the next chapter in the history of the Second Amendment will be written. Your work in the coming weeks will be what spells the difference between pro- and anti-gun ’ candidates on Election Day. Thus, you will write the future legislative history of the Second Amendment.

Following is a list of the major federal victories we have seen during the 109th Congress:

1 Enactment of the “Disaster Recovery Personal Protection Act.’’ Within a year of Hurricane Katrina hitting the Gulf Coast, Congress passed the NRA-backed H.R. 5013, sponsored by Representative Bobby Jindal (R- La.), by an overwhelming 322-99 vote. This bill amended federal emergency laws to prohibit federal, state, and local authorities from confiscating lawfully-owned firearms during emergencies or disasters Senator David Vitter’s (R-La.) amendment to prohibit the use of funds appropriated under the Homeland Security appropriations bill (H.R. 5441) for the confiscation of lawfully possessed firearms during an emergency or disaster passed the U.S. Senate by an historic 84-16 vote. The Jindal bill was substituted for the Vitter amendment in the conference committee and President Bush signed it into law on October 4.

9 Enactment of the “Protection of Lawful Commerce in Arms Act.” President Bush, marking the culmination of six years of hard work by NRA-ILA and gun owners nationwide, signed “The Protection of Lawful Commerce in Arms Act” (S. 397) into law on October 26, 2005, thus ending the campaign of politically motivated lawsuits designed to bankrupt law-abiding American firearm manufacturers and retailers. The Senate passed S. 397 by a 65-31 vote on July 29,2005 and then by the House by a 283-144 vote on October 20, 2005.

Enactment of the “Tiahrt Amendment.” This amendment protects gun owners’ privacy by prohibiting the release of firearm trace data to any 1 entity except a law enforcement agency conducting a bona fide criminal investigation involving the firearm.

Enactment of a tax exemption for custom gunsmiths. During the same week the Senate passed S. 397, NRA-ILA helped win an important but less-publicized victory for small custom gunsmiths. A massive highway construction bill (which President Bush promptly signed into law)

PRESIDENT BUSH SIGNS NRA-BACKED “DISASTER RECOVERY PERSONAL PROTECTION” MEASURE INTO LAW

President George W. Bush recently signed legislation that included language based on H.R. 5013, the “Disaster Recovery Personal Protection Act,” to prohibit the confiscation of legal firearms from law-abiding citizens during states of emergency. Passage of this legislation became a top priority of NRA following confiscations of lawfully-owned firearms by local officials in New Orleans in the aftermath of Hurricane Katrina. Prior to the President’s recent action, NRA led the charge in passing “emergency powers” laws in 10 states. This new law was part of the Department of Homeland Security appropriations bill.

“I want to thank President George W. Bush for signing this vital measure into law,” declared NRA-ILA Executive Director Chris W. Cox. “The chaos and civil disorder our country witnessed in New Orleans after the city effectively suspended the Second Amendment confirmed every law-abiding gun owner’s worst fear - that gun confiscations can happen right here in America. As promised, NRA set out to pass legislation at both the federal and state levels to protect the Second Amendment rights of law-abiding American citizens.” i The Homeland Security amendment was based on H.R. 5013, the “Disaster Recovery Personal Protection Act,” which was introduced in the House by Congressman Bobby Jindal, R-La., and passed the House on July 25 with a broad bi-partisan margin of 322 to 99. Sen. David Vitter, R-La., introduced the Senate version of the bill. Sen. Vitter also championed the first Senate action on a different version of the appropriations amendment, which passed in July by an 84 to 16 vote, one the lahest margins of victory ever for an NRA-backed measure.

Citizens throughout New Hampshire are counting on you to contact your Mayor TODAY! On October 11, by a vote of 6 to 2, the Jersey City Council passed Ordinance #06-116. This was Jersey City’s latest attempt to rewrite its illegal “one-gun-a- month” law, which passed in June and is the subject of a pre-emption lawsuit commenced by the Association of New Jersey Rifle & Pistol Clubs. The two votes against the rationing scheme came from Councilman Michael Sottolano (E- mail: [email protected]; Phone: (201) 547-5098), and Councilwoman Viola Richardson (E-mail: [email protected]; Phone: (201) 547-5338). Although Councilwoman Richardson originally supported the ordinance in June, she expressed doubts about its effectiveness at reducing crime and changed her vote at the October 11 Council meeting. Members are encouraged to contact Councilman Sottolano and Councilwoman Richardson and thank them for their courage and integrity. The new ordinance was apparently intended to correct technical defects in the original law, but failed to address the law’s fatal defect-- the fact that it is pre-empted by New Jersey state law and violates equal protection. It continues to leave Jersey City residents unable to defend themselves if their firearm requires repair or is stolen within four weeks of purchase. The new ordinance goes even further than the original by adding a new provision making Jersey City residents criminals if they lawfully purchase, or even apply to purchase, more than one handgun within 30 days. It further targets Jersey City’s federal firearm licensees by imposing an impossible burden of trying to ascertain whether a purchaser has, in fact, purchased or made application to purchase a handgun within the previous 30 days. The Association of New Jersey Rifle & Pistol Clubs (NRAs New Jersey State affiliate) will continue to challenge the illegal ordinance in Court. Jersey City continues to be defended for free by a private law firm whose services were secured by CeaseFire New Jersey.

Also, the Association of New Jersey Rifle & Pistol Clubs’ annual meeting banquet will be held tomorrow, Saturday, October 14, 2006, at 6.00 p.m., at the Ramada Inn Somerset, 60 Cottontail Lane, Somerset, NJ 08873. The event is being
