AYRSHIRE ROADS ALLIANCE DEVELOPMENT CONTROL UPDATE - ROAD BONDS

Report by the Interim Head of Roads - Ayrshire Roads Alliance

PURPOSE OF REPORT

1. The purpose of this Report is to update the Joint Committee on the position regarding road bonds held by the Ayrshire Roads Alliance on behalf of East and South Ayrshire Councils.

BACKGROUND

2. The Roads () Act 1984 requires that, for any road not constructed by a roads authority, the appropriate consent from the local roads authority is obtained to undertake this work. This is generally referred to as the Road Consent (RCC). The Ayrshire Roads Alliance maintains a register of all RCCs under the remit of the Ayrshire Roads Alliance.

3. Where new roads are being constructed for housing developers are required to provide the roads authority with security to cover the cost of constructing the roads should the developer default. The provisions are set out in the Security for Private Road Works (Scotland) Regulations 1985, as amended. This security may take the form of a cash deposit but it is generally in the form of a road bond. The security is retained by the Roads Authority until completion of the consented works, although the value may be reduced as the works progress.

4. The Joint Committee, at its meeting on 23 May 2014, remitted the Head of Roads to undertake a review of road bonds more than three years old and report to a future meeting of the Joint Committee. An annual report is now presented to the Joint Committee summarising the road bond position and providing other updates on the development control process as required.

CURRENT RESIDENTIAL ROAD BONDS

5. A list of all RCCs and their associated road bonds for each Council area is shown in Appendix 1. As of 19 August 2020, ARA manages 39 road bonds with a current value of £12.841m in East Ayrshire, and 21 road bonds with a current value of £6.378m in South Ayrshire.

6. Appendix 2 provides details of completed road bonds and/or road adoptions since the previous report to Joint Committee on 25 April 2019, and Appendix 3 shows new bonds received since the previous report.

7. The current review has found that the value of the road bonds held in Appendix 1 is adequate to complete the outstanding road works on each development site across both East Ayrshire and South Ayrshire.

8. In the 25 April 2019 report the Joint Committee was advised of a development at Rigg Road in Cumnock by Campbell Homes where the developer had commenced housebuilding on Phases 3 and 4 of the development without first obtaining RCC. Following escalation of the matter to East Ayrshire Legal Services the matter was resolved and RCC for Phase 3 (EAC/CC/19/003) was issued on 2 May 2019 and RCC for Phase 4 (EAC/CC/19/005) was issued on 22 November 2019. Following re-calculation of road bond values the remaining cash bond of £168,830 for the development was of sufficient value to cover the remaining roadworks for Phases 1-4 inclusive, allowing the RCCs to be issued. However, the developer has now proceeded to commence Phase 5 of the development without RCC. The Ayrshire Roads Alliance met with the developer on site and advised East Ayrshire Legal Services of the situation in March 2020. The Ayrshire Roads Alliance again met the developer on site in August 2020 following lockdown easing and the developer advised that they plan to finish road surfacing in Phases 1-4 in September/October 2020 to allow part of the remaining cash bond for Phases 1-4 to be transferred to Phase 5 to allow the RCC to be approved. The road bond will be re-calculated and the value of the cash bond reviewed so that the security is sufficient for the amount of roadworks remaining for all five phases of the development. It may be found that the developer requires to submit a further cash amount to top-up the bond. House building in Phase 5 continues as Building Warrants have been issued by EAC Building Control but roadworks have ended within Phase 5 until the RCC is approved. It should also be noted that Scottish Water Technical Approval will be required for Phase 5 prior to RCC being granted.

BONDS CALLED-IN

9. At its meeting on 25 April 2019 the Committee was informed that road bonds for developments by Carleton Homes at Lace Mill Wynd (06/025) and Loudoun Court (07/018) in Darvel had been called-in and that ARA had subsequently completed the roadworks in March 2019. Since the previous report to Committee full payment of ARA costs was subsequently made by the developer’s bond provider (Bank of Scotland) and payments of £16,133 and £21,755 were received on 17/06/19 for the Lace Mill Wynd and Loudoun Court developments respectively. The development roads have now been adopted and added to the list of public roads.

10. At its meeting on 25 April 2019 the Committee was also informed that East Ayrshire was continuing to pursue a historic bond call-in for a site at Woolmill Place in Sorn (CC/S/05/08). The roadworks were completed by the Ayrshire Roads Alliance and the roads were adopted in July 2015. The bond provider (HCC International) subsequently disputed aspects of the validity of the bond and the matter was referred to East Ayrshire Legal Services. Since the previous report to Committee the bond provider finally agreed to meet the costs of the roadworks and full payment of £64,115 was made on 19 February 2020.

NON-RESIDENTIAL ROAD BONDS

11. A report on road bonds and other financial guarantees held by ARA for non- residential developments was submitted to the Joint Committee on 29 August 2019. Roads authorities have a general power under section 96 of the Roads (Scotland) Act 1984 to recover maintenance costs arising from damage caused by excessively heavy, or other extraordinary, vehicles or traffic. The type of development where this applies are Wind Farms or major infrastructure projects.

12. The current status of non-residential bonds and financial guarantees is set out in the table below. In each case the bond value held has been assessed as being sufficient to cover the cost of potential works arising from extraordinary damage to roads infrastructure.

13. Construction works in relation to the Afton Wind Farm have all been completed with the exception of the replacement of a cattle grid on Afton Road. Discussion is currently ongoing with Afton Wind Farm Limited regarding discharging (subject to payment to the Council of £25,000 to cover the cost of replacing the cattle grid) or modifying the obligation to maintain the construction road bond.

14. The Greenburn OCC is in its restoration phase and the outstanding matters relate to the RCC for the reinstatement of the U720 road and the use of the haul road bridge as part of the realigned public road. Further technical design information has now been submitted to ARA to address the outstanding matters and the RCC is expected to be issued imminently to allow the roadworks to commence.

INTERNAL AUDIT OF ROAD BOND PROCEDURES

15. At its meeting on 25 April 2019 the Committee was advised that East Ayrshire’s internal audit section had carried out an audit of road bonds in 2017. The audit report concluded with an opinion of “Limited Assurance: audit found control weaknesses presenting risks of failure to secure amounts due, primarily relating to bonds entered into prior to the establishment of ARA and primarily to bonds in East Ayrshire”.

16. Following the 2017 internal audit a thorough review of case-working practices, management processes and reporting arrangements was undertaken. An internal audit follow-up review was undertaken in May 2019 and found significant improvement and recorded ARA management’s commitment to further review to address remaining issues.

17. A further internal audit of ARA’s new processes for managing RCCs and road bonds was undertaken in late 2019/early 2020 and the audit report received in August 2020 provided “Sound assurance in most areas - key controls exist and are applied consistently and effectively in most areas. Non-compliance has only been identified in low risk or medium risk areas”. The audit report identified some remaining scope for improvement and set out a number of recommendations which will be addressed by ARA and processes and QA procedures will be updated accordingly.

20. The management of the development control function and continued review of road bonds will be undertaken within existing resources.

FINANCIAL IMPLICATIONS

22. Inadequate road bond values expose the roads authority to a potential shortfall if the roadworks have to be completed by them should the developer default. An RCC is valid for three years and the developer may ask the roads authority for an extension if the site is incomplete after this period. The value of road bonds that are more than three years old will therefore continue to be reviewed to determine their adequacy to complete the outstanding works required to comply with the RCC.

23. The road bonds currently held by the Alliance on behalf of both East Ayrshire Council and South Ayrshire Council are considered to be sufficient to complete the outstanding roadworks on each development site.

RISK IMPLICATIONS

24. Inadequate road bond values expose the roads authority to a potential shortfall if the roadworks have to be completed by them if the developer defaults. If the road authority is required to complete a development road then only the cost up to the value of the road bond can be recovered from the provider. Any shortfall has to be met by the roads authority.

25. The value of road bonds that are more than three years old are reviewed to determine their adequacy. Where a shortfall is identified the developer will be advised to increase the value of the road bond held when an application is made for an extension to the RCC.

(i) Notes the position regarding road bonds currently held by the Ayrshire Roads Alliance on behalf of East Ayrshire Council and South Ayrshire Council; (ii) Notes the findings from an internal audit of road bonds; (iii) Agrees that progress updates are provided to future meetings of the Joint Committee on an annual basis; (iv) Otherwise, notes the content of this report.
