RESOLVED –

That the Minutes of 21 January, 2019, be approved as a correct record.

2. EXCLUSION OF THE PUBLIC

RESOLVED –

That under Section 100(A)(4) of the Local Government Act, 1972, the public be excluded from the meeting for the following item of business on the grounds that it involved the likely disclosure of exempt information as defined in the Paragraph indicated in Part 1 of Schedule 12A of the Act:-

Impact of Unitary on Statutory Roles (Paragraphs 1 and 4)

3. IMPACT OF UNITARY ON STATUTORY ROLES

The Committee was aware that a new Council would be established on 1 April, 2020. The Structural Changes Orders bringing this into effect were currently before Parliament. Officers who held statutory roles, namely the Head of the Paid Service, Monitoring Officer and Section 151 Officer would be particularly impacted as a result of the transition to unitary local government.

During the shadow period there would be a TUPE consultation process with all staff regarding the transfer of employees to the new authority. A redundancy consultation would be specifically required for the Head of the Paid Service, Monitoring Officer and Section 151 Officer.

The Committee considered a report on the proposed early exit of the Chief Executive (the Head of the Paid Service), the division of his responsibilities between the existing Directors up to 31 March 2020 and the likely future position in relation to the Monitoring Officer and Corporate Directors (including the Section 151 Officer) during the implementation period. A report on the latter would be brought at a later date.

The report before Members set out the costs and savings associated with the early exit of the Chief Executive and after due consideration, it was unanimously

RESOLVED –

(1) That Council be recommended to approve the proposed early exit of the Chief Executive and Head of the Paid Service on the terms set out in the Committee report, and the consequential arrangements relating to the senior and statutory roles during the transition to unitary local government (as also set out in the Committee report).

REVIEW OF POLLING DISTRICTS AND POLLING PLACES 2019

1 Purpose 1.1 To approve the Polling Districts and Polling Places schedules as draft proposals for formal consultation

2 Recommendations

2.1 That the schedules of Polling Districts and Polling Places attached as Appendices A and B to this report be approved as draft proposals for formal consultation

3 Supporting information 3.1 The Electoral Registration and Administration Act 2013 introduced a change to the timing of compulsory reviews of UK Parliamentary polling districts and polling places. All local authorities need to conduct their review every five years and need to conduct their review between 1 October 2018 – 31 January 2020. 3.2 Polling Districts are the areas created by the division of a constituency, ward, or division into smaller parts, within which a polling place can be determined which is convenient to electors. A Polling Place is the building or area in which a poll takes place and will be selected by the Returning Officer. A Polling Station is the actual room or building where the poll takes place. 3.3 This review will not cover the boundaries of District Wards, Parishes, County Divisions or Parliamentary Constituencies. These follow separate processes. 3.4 All Members, Town & Parish Councils, political parties and residents of were given the chance to comment on existing polling arrangements and make initial representations which would be taken into consideration when developing the draft proposals. Additionally, various disabled access groups were notified, invited to comment and encouraged to advise their contacts of the review. Existing booking agents at polling stations were also contacted and asked to complete a questionnaire regarding polling station accessibility. 3.5 Appendix A is the schedule of polling places for the Aylesbury Constituency and Appendix B is the schedule of polling places for the Constituency. 3.6 Appendix C contains a list of polling stations, their electorate and the number electors registered to vote by post. This was information used to inform the initial consultation. 3.7 Appendix D is a summary of comments received 1 April – 29 April 2019. 3.8 The Chief Executive has the power to make variations to the current arrangements after consultation which enables any issues that arise between the statutory reviews to be addressed.

Page 7 4 Options considered 4.1 The draft proposals recommend that the vast majority of polling arrangements be unchanged. 4.2 The initial invitation for comments prior to consultation may have resulted in a more suitable polling place for Village Centre at the Stoke Mandeville Methodist Church on Eskdale Road. Electoral Officers need to investigate this possibility.

5 Reasons for Recommendation 5.1 The established practice of using the Parish as the building block in rural areas is the most sensible way of defining the polling districts and, in turn, the polling place. In the town, the sub-division of wards into polling districts provides the opportunity for polling places/polling stations to be located more locally for individual communities.

Steve Ezra (Chairman of Stoke Mandeville 23 April Regarding Stoke Mandeville Village Centre, Eskdale Road: Community Association) With regards to using the Centre as a Polling Station, we do not have a problem with facilitating scheduled dates provided that we are advised well in advance, please note that our regular hirer’s book in November for the whole of the following year. I appreciate that we have to comply with legislation and cancel any hires already booked. However, we are a Registered Charity but do not receive any financial help with the running and maintenance of the facilities for the Parish of Stoke Mandeville and rely entirely on income earned from our hirer’s. Unscheduled dates are more problematic for the reasons stated above, have you considered using the Stoke Mandeville Methodist Church as a Polling Station as they have similar facilities and a car park also being situated in Eskdale Road and have far less regular bookings than our Centre?
