The Montana State Library and MontanaLibrary2Go members want a statewide option for popular e-content that is cost-effective, sustainable and accessible. To fulfill these needs, the state needs a first-rate digital collection partner to help increase eBook and eAudiobook circulation, as well as save money and free up library staff time. cloudLibrary™ is that partner.

We understand that the State of Montana has been using for many years. bibliotheca is excited to share our innovations and features that have outpaced your current digital content provider. With the help of our proposed cloudLibrary™, libraries across Montana will experience an easy-to-use digital content solution that will help them maximize user rates, enhance patron service and greatly increase digital circulation.

Popular Titles. cloudLibrary™ is committed to providing your patrons with access to the newest and most popular content. We work directly with more than 150 content providers, who provide us access to more than 105,000 publishers, such as: Penguin Random House, HarperCollins, Macmillan, Simon & Schuster, as well as hundreds of smaller eBook and eAudiobook publishers. Some vendors only provide exclusive content, which receives little usage. cloudLibrary™ provides content your patrons actually want, such as titles from Publishers Weekly’s top eBook and eAudiobooks list, and many more. This approach to collection development will maximize your return on investment.

In addition to more than 1,520,545 and 141,803 eAudiobooks, cloudLibrary™ offers a full collection of popular eComics and graphic novels available for your library to purchase, and for your patrons to browse and check out at any time. Recently, cloudLibrary™ added a Marvel Comic Collection of 350 full-color comics.

Share Content. Via our optional cloudLink, MontanaLibrary2Go members, as well as other State libraries have the opportunity to share their digital collections. Similar to inter-library loan, cloudLink allows libraries to share their digital collection with other libraries across the State. Ease and flexibility are key to this cost-effective and unique offering. Our team prioritizes each library’s digital content to its patrons, so if a patron has a title checked out or on hold it will never be seen by any other library. The only way a title can be seen is if patrons are not using that title and it is available on the virtual shelf ready to be borrowed.

We have a dedicated content transfer team to assist MontanaLibrary2Go with transferring content from any provider, including OverDrive.  Customized Checkout Experience. The optional cloudLibrary™ checkout module allows patrons to choose a checkout experience that works best for them. Heather has worked in the worlds of libraries and publishing since 1998, starting as an adult circulation desk attendant at the Fargo Public Library in North Dakota. For almost 14 years, she wrote and edited for Library Journal magazine in New York City, winning the 2010 RUSA Louis Shores Award for BookSmack!, a collection development and readers’ advisory newsletter.

In December 2015, she joined bibliotheca in the role of cloudLibrary™ VP, collection development and publisher relations. Her goals are to grow the cloudLibrary™ collection further, incorporating world languages and high-quality self-publishing, and to develop fair eBook usage models that give libraries the flexibility to conduct better collection development with digital content.

She earned an associate’s in Journalism from Bismarck State College in Bismarck, ND; a bachelors in English with a writing minor from Minnesota State University in Moorhead, MN; and a Master of Fine Arts in creative writing (fiction) from The New School in New York, NY.

The State is asking all interested parties to submit a response containing the following information: Your interest in providing the services/supplies. cloudLibrary™ is poised to leverage its nearly 10 years of digital-content lending expertise to greatly enhance the patron experience and user rates for libraries across Montana. As our customers agree, cloudLibrary™ is a high-quality, easy-to-use platform with strong search capabilities.

We would be honored to demonstrate the cloudLibrary™ app and its new assist and checkout modules with your consortium. Such a demonstration will prove how cloudLibrary™ is hands down the best choice for the State of Montana.

Brief description of past experience providing similar services/supplies. bibliotheca has provided library automation services for more than 50 years. And, cloudLibrary™ has helped libraries and consortia around the world for nearly 10 years better connect with their patrons and communities through the easiest-to-use digital content lending solution in the industry. cloudLibrary™ prides itself on the simple, elegant and user-friendly nature of its app. No other desktop or mobile digital content platform for eBooks and eAudiobooks puts such an emphasis on a clean, simple look. This entices users and results in a high first-time success rate. cloudLibrary™ allows users to stream or download content, and the experience for both is a high-quality, easy-to-use platform with strong search capabilities. bibliotheca understands the unique needs that libraries like those in Montana face in today’s digital world. We immerse ourselves in library trend conversations that allow us to better enhance our digital-lending products and services. In addition, cloudLibrary™ has more experience migrating digital content than any other vendor in the market. We have a dedicated content transfer team to assist the MontanaLibrary2Go consortium with transferring its owned content from any vendor, including OverDrive. bibliotheca has completed more than 250 content transfers from OverDrive, Axis 360, RBDigital, EBSCOhost, etc., to cloudLibrary™. Migrating content to the cloudLibrary™ is an extremely easy process and takes a minimum of 6 – 8 weeks. Our team’s job is not done until your staff is completely satisfied.

Your best estimated time frame for completing the project. cloudLibrary™ has an established implementation process designed to make it easy to develop an eBook and eAudiobook collection so your library system can begin lending. The following is a standard project implementation timeline we propose for libraries. Our normal implementation time from project beginning to end takes six to eight weeks to complete, beginning when we receive your customer analysis form information. This process is designed to move as fast or as slow as you would like. Depending on the timeframe and requirements of the State, we would be able to create a custom timeline.

Content Requirements

1. What formats does the respondent provide for purchasing or licensing content? bibliotheca is committed to providing your patrons with access to the newest and most popular content. Some vendors only provide exclusive content, which receives little usage. bibliotheca provides content patrons actually want, such as titles from Publishers Weekly top eAudiobooks list and many more. This approach to collection development will maximize your return on investment. cloudLibrary™ works directly with more than 150 content providers, who provide us access to over 105,000 publisher’s content, and more than 1.7 million eBooks and over 180,000 eAudiobooks. Unlike, other vendors who only offer proprietary content, which restricts libraries from possibly transferring purchased content to another vendor at a later date, bibliotheca’s content can easily be transferred.

Owned Content. By purchasing content owned in perpetuity, or metered models, as most eBook and eAudiobooks are sold today, the library creates an asset that can used for years by member libraries. We believe over time the ownership model creates longer term value for the library.

Unique Pay-Per-Use Options. The cloudLibrary™ also offers an optional pay-per-use model which is a cost-effective way to provide an ever-expanding digital catalog of titles for your patrons. Offering pay-per-use gives patrons access to digital content outside your current owned collection – expanding your current collection with simultaneous access content, thus reducing long hold times. Only when patrons borrow titles from the pay-per-use collection will their library be charged a small fee for each checkout. These fees are much less than buying the content for your main collection – saving libraries money, all while providing patrons with the extended eBook and eAudiobook content they desire. This can be activated on an individual library basis for their own patrons. There are also a variety of controls to the pay per use offering that allow for further control of budgets and costs per checkout. bibliotheca follows publisher ownership licensing models. We promote ownership of the digital material offered in our system. Publishers have the final say on the rights to their material. All digital content vendors can provide the same pricing models, as the model is largely determined by the publisher. These policies are subject to change and vary by the publisher.

Libraries have consistently fought for open standards for years, if any vendor provides proprietary methods to access content, such as Kindle Paperwhite devices, this is an inherent disservice to the mission of libraries. In addition, cloudLibrary™ has a collaborative partnership with Library Simplified to utilize its SimplyE app. This open-source software is a nice compliment to cloudLibrary to extend your libraries’ eBook and eAudiobook collection.

Describe the process for delivering catalog records to the consortium for participating libraries. bibliotheca provides free brief MARC records at any time. For Full MARC records, we are partnered with eBibliofile, SkyRiver and OCLC for an additional fee from those partners. Some ILSs provide API connections which allow for automatic integration of MARC records.

Our free brief MARC records are delivered via our Reports Module. Libraries can download .mrc files that are automatically generated overnight for the previous day’s purchase or request records for a specific timeframe at any time.

Yes. cloudLibrary™ does not notify end users when a title hold is cancelled. However, when a hold title is removed or not purchased from the collection that title switches to a patron suggestion so the library knows that a patron wished to check out that title. If a patron wants to remove a hold, the platform does prompt them to make sure they want to remove their hold.

Please provide your company’s data security policy. bibliotheca sets high security measures for the data held on its systems and we are continually working to increase our cyber resilience within the business and across our products. We use a mixture of encryption; Enterprise Antivirus and Malware; complex password protection requirements; locked filing cabinets; restricted access; and secure cloud services. Where we store data off premise, we have taken suitable due diligence on the GDPR compliance and security measures of these services. Please see the section on ‘Using Sub Processors’ for more information.

Physical access to the bibliotheca group offices is monitored by access control. Access to data within the office environment is tightly controlled and bibliotheca operate a “clear desk” policy. Any physical printouts of data are processed immediately and subsequently scanned and shredded.

Administrative and technical roles are defined within bibliotheca and data requirements mapped to them. Data held internally is access controlled and only available to staff with specific access needs, in order to deliver contracted services on behalf of a Customer. All access to data is logged and routinely reviewed for inappropriate access. bibliotheca uses a layered security model, using a variety of security technologies such as IDS, and best practice methodologies to help identify and pro-actively react to security issues should they occur. Our systems have platform and data resiliency, that in combination with security measures, helps ensure the integrity of the data that we process on behalf of our Customers. bibliotheca is Cyber Essentials Certified, we adopt best practices in information security to protect customers and employee data against cyber-attacks.

Access to our sub-processor data centers is physically and functionally secured according to the principles established under ISO 27001. For example, access to data centers are regularly reviewed, audited, monitored and logged. Physical access is limited through CCTV and intrusion detection systems.

On detection of a data breach or intrusion, the relevant Supervisory Authority will be notified of the activity within 72 hours of discovery. If the breach is deemed to affect the rights and freedoms of individuals, bibliotheca will ensure all affected parties are informed. bibliotheca will follow the steps outlined in our Incident Management policy and process. A record is made of the breach which can be made available at the request of the ICO or other appropriate supervisory authorities.

8. Please describe available authentication methods for end-users to sign in and check out items. The cloudLibrary™ app authenticates with your library’s ILS via a SIP2 connection or API. If a library does not have an ILS, we can authenticate via a cloudLibrary™ hosted barcode setup, which allows libraries to upload card numbers.

When it comes time to transfer an existing collection, the cloudLibrary™ team will do all the work for you. We have more experience migrating digital content than any other vendor in the market. We have a dedicated content transfer team to assist the MontanaLibrary2Go consortium with transferring its purchased content from any vendor, including OverDrive. bibliotheca has completed more than 250 content transfers from OverDrive, Axis 360, RBDigital, EBSCOhost, etc., to the cloudLibrary™ platform. Migrating content to cloudLibrary™ is an extremely easy process and takes a minimum of 6 – 8 weeks. Our team’s job is not done until your staff is completely satisfied.

Unlike other vendors, cloudLibrary™ provides your account will have a dedicated project manager. Ryan Haindfield, cloudLibrary™ Customer Success Manager, He will conduct your team training for the cloudLibrary™ platform and guide your libraries from the deployment process to a successful launch. This unique guidance will ensure your digital lending experience is a success day in and day out. cloudLibrary™ training includes guides, videos, live webinars and optional in-person training. All training on the cloudLibrary™ will include program set-up, administrative and security features, report creation, normal use, reporting features, statistical features and technical support process.

GDPR Assurance Statement for customers

Executive Summary

As Data Processors and Data Controllers we are aware of our obligations to comply with the ‘General Data Protection regulations’ (GDPR). We have adapted our policies, processes and other controls where we identified that changes where required for GDPR. bibliotheca will maintain an active role in staying up-to-date with changes, through case law, and will update our own policies, processes and controls as required to deliver compliance for all of our Customers.

To achieve GDPR compliance we worked with GDPR and Cyber security specialists and legal experts to:

• Prepare all our staff with GDPR awareness training • Implement security measures to improve the protection of data • Update our contracts and service agreements • Improve the rights of data subjects to control their own data • Improve process controls for data destruction and deletion • Improve and amend Privacy Policies • Appointment of a Data Protection Officer

The remainder of this document describes in detail how bibliotheca is delivering its responsibilities under GDPR, as your supplier of products and services. Supporting this document are product specific compliant statements which will be made available upon request.

Data Collection, Obligations and Purpose bibliotheca processes the following categories of personal data:

- Customer Data - local authority/library staff data such as contact name, email address, telephone number, job title. Further information can be found within the Privacy Notice at www.bibliotheca.com - Library Patron data – bibliotheca’s products and services may process personal data of library patrons. Since the library is the controller of this data they should be aware of the lawful basis of processing this data. Further information on the processing, storage and retention of such personal data, which can be processed by bibliotheca’s products, is contained in the product specific compliance statements.

Where bibliotheca is the Data Controller the data will be collected and processed in accordance with GDPR. Where bibliotheca is the Data Processor for our customers, the customer will determine the purpose and means, of bibliotheca’s processing of personal data, relating to library patrons and provide instructions to bibliotheca to process this data in accordance with this purpose. bibliotheca will process personal data only for the purpose of providing, supporting and improving bibliotheca’s product and services, using effective and appropriate technical and organisational protective security methods and measures. bibliotheca will not use personal data for any other purpose. bibliotheca will ensure that its employees, sub-processors and other agents engaged on our behalf will respect the confidentiality of the personal data we process and comply with the terms of this statement even after the end of their employment, engagement or contract. bibliotheca will provide support and assistance to Customers regarding requests from data subjects for access to, rectification, erasure, restriction, portability, blocking or deletion of personal data that bibliotheca processes on behalf of Customers. bibliotheca will investigate personal data breaches and notify the Supervisory Authority and the Customer. bibliotheca will prepare Data Protection Impact Assessments (DPIA) where appropriate and necessary, in consultation with the Supervisory Authority. bibliotheca does not process special category data relating to Customers or library users.

Governance bibliotheca has assessed its requirement in order to comply with GDPR. We are committed to improving, documenting and monitoring our processes and procedures to ensure we follow GDPR compliant methods. We believe that treating personal data and sensitive data as securely as possible, and recognising the rights that individuals have, with regards to their data, is in the best interests of the Company, its employees, its customers, and vendors. bibliotheca is committed to complying with the 6 core principles of GDPR and protection of the 8 data subject rights. Should a customer receive a Subject Access Request from one of their customers bibliotheca will take all reasonable steps to support this. bibliotheca has implemented policies and procedures, which are regularly reviewed and are GDPR compliant. bibliotheca has appointed a Data Protection Officer (DPO). The DPO role reports to the Global Executive Team. The DPO has the relevant knowledge and experience suitable for this position. The DPO will continually ensure that bibliotheca’s commercial and operational activities are delivered in compliance with the prevailing data protection regulations in our jurisdiction. This role will monitor and report compliance, handle communication and co- ordinate bibliotheca’s data protection activity.

Security bibliotheca sets high security measures for the data held on its systems and we are continually working to increase our cyber resilience within the business and across our products. We use a mixture of encryption; Enterprise Antivirus and Malware; complex password protection requirements; locked filing cabinets; restricted access; and secure cloud services. Where we store data off premise we have taken suitable due dilligence on the GDPR compliance and security measures of these services. Please see the section on ‘Using Subprocessors’ for more information.

Physical access to the bibliotheca group offices is monitored by access control. Access to data within the office environment is tightly controlled and bibliotheca operate a “clear desk” policy. Any physical printouts of data are processed immediately and subsequently scanned and shredded.

Administrative and technical roles are defined within bibliotheca and data requirements mapped to them. Data held internally is access controlled and only available to staff with specific access needs, in order to deliver contracted services on behalf of a Customer. All access to data is logged and routinely reviewed for inappropriate access. bibliotheca uses a layered security model, using a variety of security technologies such as IDS, and best practice methodologies to help identify and pro-actively react to security issues should they occur. Our systems have platform and data resiliency, that in combination with security measures, helps ensure the integrity of the data that we process on behalf of our

Customers. bibliotheca is Cyber Essentials Certified, we adopt best practices in information security to protect customers and employee data against cyber-attacks.

Access to our sub-processor data centres is physically and functionally secured according to the principles established under ISO 27001. For example, access to data centres are regularly reviewed, audited, monitored and logged. Physical access is limited through CCTV and intrusion detection systems.

On detection of a data breach or intrusion, the relevant Supervisory Authority will be notified of the activity within 72 hours of discovery. If the breach is deemed to affect the rights and freedoms of individuals, bibliotheca will ensure all affected parties are informed. bibliotheca will follow the steps outlined in our Incident Management policy and process. A record is made of the breach which can be made available at the request of the ICO or other appropriate supervisory authorities.

Storage and Archiving bibliotheca stores personal information data on Third Party processors, who are contracted as Sub-processors; see section ‘Using Subprocessors’ for more information. This data is held off-site from bibliotheca in data centres. The data centres are in secure locations and access to data is secured according to roles within those organisations. bibliotheca processes are in place to centralise storage of all data in tightly defined secure digital systems and processes. Where manual processes exist, these have been mapped and safeguards implemented to control the storage and access to this data. Overarching principles are in place to drive digitisation and safe destruction of manual records.

Using Sub-processors

Where possible bibliotheca will seek written consent from the Data Controller prior to appointing any sub-processors (also referred to as sub-contractors or third parties). Accompanying this document is a sub-processor consent form listing all sub-processors who bibliotheca engages with, who may process personal data.

All sub-processors who bibliotheca engage with will be required to demonstrate robust compliance with GDPR and other protective security requirements. As your data processor, bibliotheca will inform you, the Controller, of any intended changes concerning the addition or replacement of other sub-processors.

Transfer of Personal Data

Internal Data flows within bibliotheca are closely monitored and access is granted according to the roles and responsibilities outlined in our Security processes.

• Where bibliotheca shares data with Third Parties, we ensure that our partners employ appropriate protective security measures and are themselves compliant with GDPR. • Where data is transferred within bibliotheca, the transfers occur over secured systems, with access rights granted according to a principle of minimum access. Physical data storage is minimised and full control is maintained and auditable. • bibliotheca has facilities to send and receive encrypted email where required. • bibliotheca limits the amount of personal data which is transferred outside of the European Economic Area (EEA). o Where a Customer is using the bibliotheca cloudLibrary™ product this is hosted in the United States. o Third Party hosted providers such as Azure have EU-US privacy shield certification. • Personal data will only be transferred to countries, outside of the EEA, whose data protection laws have been assessed as adequate by the European Commission, or where adequate safeguards, such as the EU-US Privacy Shield or EU Model Contract Standard clauses, are in place. • bibliotheca has obtained EU-US and CH-US Privacy Shield certification.

Training

All bibliotheca team members who handle EU Citizen personal data have undertaken GDPR training, in the form of eLearning. This activity was part of our GDPR preparations and co- ordinated by our project team. We have also held team briefings and involved all staff in specific pieces of GDPR work to ensure there is understanding, engagement and accountability.

Refresher training will be planned at an appropriate point in time, dependent on the individual's role and responsibilities. This will be led by the Data Protection Officer. Our team have been made aware that unlawful access to data and/or disclosure of personal data is prohibited through training, briefings and discussions. We will be amending contracts of employment and consulting with our team about this amendment, to further embed this legislation into our organisation’s culture. All of our team, including the Global Executive Team, Senior Management, the security and IT team, our Helpdesk and all other staff have been involved in GDPR awareness sessions. The GDPR preparation project has been sponsored by a member of the Global Executive Team.
