Dear Mr. Fredericks:

The U.S. Nuclear Regulatory Commission (NRC) records indicate that Circuit City Stores Inc. (Circuit City) possesses devices containing low levels of radioactive material. The radioactive material is called tritium, and it is contained within exit signs Circuit City acquired. Upon receipt of such signs, Circuit City became a general licensee of the NRC pursuant to Title 10, Section 31.5 in the Code of Federal Regulations (10 CFR 31.5). It is also likely that Circuit City is a general licensee in one or more of the 35 Agreement States which regulate these signs in their jurisdictions.

Although the tritium contained within these signs does not present a hazard when the signs are used in accordance with the manufacturer’s instructions, NRC regulations nevertheless require that licensees properly account for, transfer, or dispose of the signs so that members of the public are not needlessly exposed to the low-level radiation within them.

It is our understanding that Circuit City is undergoing liquidation and that you intend to sell your offices, stores, distribution centers, and other facilities. The NRC would emphasize that, pursuant to the requirements of 10 CFR 31.5, Circuit City must either properly transfer possession of any tritium signs in your facilities or arrange for the proper disposal of such signs.

In addition, if you find that any tritium exit sign is lost, stolen, missing or damaged, you must make a report to the NRC or to the appropriate Agreement State as required by 10 CFR 20.2201 and 10 CFR 31.5(c)(5). Reports for signs in NRC jurisdiction (which includes U.S. Possessions and Territories) should be made by calling 1-800-532-3469. Attachment 1 contains a list of the contacts in the Agreement States.

Please note that as of March 31, 2009, the Commonwealth of Virginia will become an Agreement State. Should you discover any lost, stolen, missing, or damaged tritium exit signs in Virginia as of March 31, please report this occurrence to the Commonwealth of Virginia contact listed in Attachment 1.

Attachment 2 is a list of tritium exit signs sold to Circuit City in areas of NRC jurisdiction, and contains contact information for the sign manufacturers who can provide you with a more complete inventory of signs purchased by Circuit City for all jurisdictions.
