3 Each processor shall make all of the prescribed deductions from the producer’s settlement and shall remit these deductions to the Board within 30 days of processing. 4 Each producer who markets turkey to any party other than a processor shall forward the levies referred to in section 1 directly to the Board within 30 days of the marketing. 5 Each levy remittance, either by a processor or by a producer, shall include the following information as prescribed on a Board-approved form: (a) the name, address and phone number of the producer on whose behalf the levy is being submitted; (b) the number of kilograms of live turkey sold and the date of sale; and (c) the total amount of levies deducted and submitted. 6 This Order will remain in effect for a period no longer than ten years from the date this Order is approved by the Agri-Food Council. PRODUCER LICENCE Order No. 18/13. The TURKEY FARMERS OF SASKATCHEWAN Board, pursuant to the provisions of The Turkey Marketing Plan Regulations and The Agri-Food Act, 2004, hereby determines and orders as follows: 1 A “person” shall include an individual, corporation, cooperative, trust and any other entity designated as a person under The Interpretation Act, 1995 or the Income Tax Act (Canada) and shall include members of a family unit, specifically, the person, spouse, siblings, parents and issue of this person, and operating as a single economic unit. 2 Any person producing and marketing more than 99 turkeys in a calendar year in Saskatchewan is required to hold quota and must be licensed by the Board. 3 Before January 15th of each year, all licensed producers shall apply to the Board for licence renewal using a Board-provided application form which shall include all information requirements as per section 22 of the regulations as well as the following information: (a) the name and contact information for an individual who may be contacted in the case of an emergency, including the death of the quota holder; (b) if applicable, the name, contact information and percentage share of each person who has a beneficial interest in the quota; and (c) with respect to the production unit at which the applicant’s identified quota would be produced, the name, contact information and percentage share of each person who has a beneficial interest in that unit. 4 Each licence application shall include a $25.00 licensing fee payable to the Turkey Farmers of Saskatchewan on the date of the application. 118 THE SASKATCHEWAN GAZETTE, JANUARY 17, 2014

5 New licences shall meet all licensing requirements specified in sections 3 and 4 of this Order, except that applications shall be received at least 30 days prior to the commencement of production. 6 Renewed licences shall: (a) be issued to qualifying persons by the last day of the current production year for the upcoming production year; and (b) take effect on the first day of the production year in which the licence is effective. 7 The Board may renew a producer’s licence if the licensee: (a) meets the requirements set out in clause 23(2)(a) of the regulations; and (b) is in compliance with the Act, the regulations and all orders of the Board, as well as all terms and conditions of the producer’s current licence. 8 No licence shall be issued or renewed if the applicant fails to meet any requirement of the Act, the regulations or an order of the Board. 9 All licences expire on the last day of the production year. 10 Any licence issued shall identify the quota allocated to the licensee for that production year. 11 No licensed producer shall hold more than one Board-issued licence. 12 In the case of a partnership or shareholder arrangement, unless otherwise specified, it is assumed that the applicant is the designated representative of that license. 13 Any person involved in the production and marketing of turkey who violates section 2 of this Order may be liable for a charge of $8.00 for each turkey produced and marketed, with payment due within 30 days of the Board-issued invoice with interest to be charged at a rate of 2% per month on any unpaid invoices after 60 days of issuance. 14 This Order will remain in effect for a period no longer than ten years from the date this Order is approved by the Agri-Food Council. The TURKEY FARMERS OF SASKATCHEWAN Board, pursuant to the provisions of The Turkey Marketing Plan Regulations and The Agri-Food Act, 2004, hereby determines and orders as follows: 1 A “person” shall include an individual, corporation, cooperative, trust and any other entity designated as a person under The Interpretation Act, 1995 or the Income Tax Act (Canada) and shall include members of a family unit, specifically, the person, spouse, siblings, parents and issue of this person, and operating as a single economic unit. 2 Any person engaged in the marketing of turkey or turkey products shall submit to the Board information relating to the marketing of turkey or turkey products on request of the Board. 3 By the 25th day of each month, each hatchery and agent shall submit to the Board, on the Board’s Poult Information Form, complete information with respect to: (a) hatch dates and number of poults hatched; (b) customer names, addresses, farm legal land descriptions and the number of poults sold per customer; and (c) any other such information as specified by the Board. 4 Within 20 days of slaughter, each processor shall submit to the Board a complete list of all producer shipments of turkeys received for slaughter on a form approved by the Board which shall require the following information to be submitted with respect to each producer shipment: (a) the producer’s name; (b) the slaughter date; (c) the number of birds shipped; (d) the number of dead on arrival; (e) the number of birds slaughtered; (f) the weights for each load; and (g) the grade for each load. 5 Processors shall provide the Board with the following information with respect to the processing of 100 or more turkeys for any unlicensed person in any calendar year within five business days of the completion of the custom processing: (a) the name, address and telephone number of the person for whom the processing was performed; (b) the number of turkeys processed; THE SASKATCHEWAN GAZETTE, JANUARY 17, 2014 121

(c) the type of processing performed (bagged or further processed); and (d) the date on which the processing took place. 6 Failure to provide any of the information listed above will result in an administrative penalty of up to $500 per week depending on the information that is required. 7 Each time an administrative penalty is assessed, the Board shall provide the person upon whom the penalty is being issued with written notice of the issuance of the penalty which shall include: (a) a statement regarding the penalty amount to be assessed; (b) the ability of the person to respond to the penalty within 10 business days; and (c) the rationale for the issuance of the penalty. 8 The board must consider any response provided by a party notified of the assessment of an administrative penalty before the penalty is enforced and following this consideration must provide written notice of the Board’s decision as to whether or not to proceed with the issuance of the penalty and the rationale for the Board’s decision. 9 A processor, hatchery and/or agent shall permit any auditor or inspector appointed by the Board to access all production and marketing records. 10 A processor, hatchery and/or agent shall provide to the Board production and marketing information with respect to any customer involved in the production and/or marketing of 100 or more turkeys in a calendar year. 11 This Order will remain in effect for a period no longer than ten years from the date this Order is approved by the Agri-Food Council. QUOTAS Order No. 22/13. The TURKEY FARMERS OF SASKATCHEWAN Board, pursuant to the provisions of The Turkey Marketing Plan Regulations and The Agri-Food Act, 2004, hereby determines and orders as follows: 1 The following classes are established for the allocation of turkey: (a) “broiler” means a turkey that weighs less than 6.2 kilograms; (b) “hen” means a turkey that weighs between 6.2 and 10.8 kilograms; (c) “tom” means a turkey that weighs over 10.8 kilograms; and (d) “mature” or “breeder” means a female turkey that has produced hatching eggs or a male turkey that has produced semen. 122 THE SASKATCHEWAN GAZETTE, JANUARY 17, 2014

2 The Board shall allocate to a producer quota for the upcoming production year on the conditions that the producer has: (a) maintained a licence; and (b) demonstrated the ability to market the number of kilograms of allocated turkey in the previous production year. 3 Quota allocations: (a) shall be stated on a producer’s licence as the number of live kilograms that are to be produced; (b) may include parameters as to the class of turkey to be produced to fill the kilogram requirements specified in the allocation; and (c) shall be issued for the duration of the production year. 4 Should there be an increase to the provincial allocation during the production year as a result of decisions made by the Turkey Farmers of Canada, the Board shall allocate that additional quota through the use of permits to licensed producers. 5 Permits shall be issued to producers for the remainder of the production year based on: (a) each individual producer’s ability to produce; (b) processor requirements; and, (c) for those producers who qualify for the increase, on a pro rata basis. 6 Permits shall be treated as addendums to producer licenses and shall not alter any producer’s quota status. 7 From time to time, the Turkey Farmers of Canada may approve the provision of additional allocation to a province to meet processor-specific kilogram requests; such allocated kilograms are referred toas “processor‑requested quota” and are allocated to producers based on their decision regarding which processor receives their live product. 8 When the Board receives an allocation for processor-requested quota, the following process is applied: (a) producers marketing product to the requesting processor are identified and notified of the possibility to receive additional quota, with timelines provided with respect to notifying the board whether the additional quota would be accepted; and (b) for all producers accepting the processor-requested quota, all such quota is distributed on a pro rata basis through permits. 9 The board shall deem processor-requested quota permits to be produced before all other allocations. 10 Any sale of quota must be reviewed and approved in principle by the Board. 11 This Order will remain in effect for a period no longer than ten years from the date this Order is approved by the Agri-Food Council. QUOTA LIMITS Order No. 23/13. The TURKEY FARMERS OF SASKATCHEWAN Board, pursuant to the provisions of The Turkey Marketing Plan Regulations and The Agri-Food Act, 2004, hereby determines and orders as follows: 1 The following definitions are applied in this Order: (a) “person” shall include an individual, corporation, cooperative, trust and any other entity designated as a person under The Interpretation Act, 1995 or the Income Tax Act (Canada) and shall include members of a family unit, specifically the person, spouse, siblings, parents and issue; and (b) “interest” shall be determined by deeming a person to have full ownership of any corporation, partnership or cooperative such person has ownership in, or any other contractual or other relationship with respect to the ownership of the quota with which such person is involved. 2 No person may hold more than 18.0% of the total quota allocated by the Board. 3 For the purpose of section 2, a person’s total quota holdings shall include the sum of: (a) the quota held by that person as an individual; (b) the quota held by spouses and minor children; (c) the full quota of any corporation, partnership, cooperative or any other entity in which a person has an ownership interest; and (d) any quota in which the person has an ownership interest as a lessee of quota. 4 The Board shall not allocate, reallocate or approve the lease of any quota if, as a result of that allocation, reallocation or lease, any person would hold quota in excess of that allowed pursuant to this Order. 5 Subject to section 9 of the Act, the Board may reduce, suspend or cancel quota if the licensed producer to whom it was allocated or the person to whom it has been leased: (a) has failed to observe, perform or carry out the provisions of the Act, these regulations or an order of the Board; (b) is not utilizing or has voluntarily given up all or part of that producer’s quota or portion leased; (c) has not received the approval of the Board for any change of ownership interest in relation to that producer if a quota has been allocated or leased in the name of a company; or (d) has had their licence cancelled or suspended. 6 Quota that has been cancelled pursuant to section 5 shall be returned to the Board for auction in accordance with procedures described in a subsequent quota auction order. 7 No producer shall be compensated for any quota cancelled pursuant to section 5. 8 Quota that is allocated to a licensed producer shall relate to and be assigned to a particular production unit(s) that is situated in Saskatchewan, with the specific land location of that production unit indicated on the allocation notice. 9 This Order will remain in effect for a period no longer than ten years from the date this Order is approved by the Agri-Food Council. 124 THE SASKATCHEWAN GAZETTE, JANUARY 17, 2014

OVER AND UNDER PRODUCTION Order No. 25/13. The TURKEY FARMERS OF SASKATCHEWAN Board, pursuant to the provisions of The Turkey Marketing Plan Regulations and The Agri-Food Act, 2004, hereby determines and orders as follows: 1 Any producer who, during a production year, produces and markets more than 100% of the maximum number of kilograms of quota allocated for that production year shall: (a) have their subsequent production year’s quota reduced by the number of kilograms of quota produced and marketed by which the allocation was exceeded during the previous production year; and (b) pay to the Board a penalty of $0.22 per live kilogram of turkey marketed in excess of the allocated quota. 2 Failure to pay an invoiced penalty to the Board within 30 days of the date of the invoice will result in an interest charge applied to the penalty at a rate of 2% per month. 3 Any producer whose accumulated reductions to quota as a result of overproduction exceed the annual quota allotment for the immediately subsequent production year shall not produce or market in excess of 99 turkeys during that subsequent production year. 4 Licensed producers who produce and market less than 100% of their allocated kilograms during a production year but not less than 95% of the allocated kilograms will have this deficit added to their immediately subsequent production year. 5 If a producer fails to market 95% of the allotted quota for two consecutive years, he or she shall lose half of his or her average shortfall over the two years, unless, in the opinion of the board, extenuating circumstances exist. 6 With respect to section 5, a shortfall shall be the difference between the amount produced and the amount represented by 95% of the allotted quota. 7 Any quota withheld from a producer due to circumstances described in section 5 shall be redistributed on a pro rata basis through the use of permits to existing licensed producers who agree to produce the additional production. 8 This Order will remain in effect for a period no longer than ten years from the date this Order is approved by the Agri-Food Council. QUOTA TRANSFER Order No. 26/13. The TURKEY FARMERS OF SASKATCHEWAN Board, pursuant to the provisions of The Turkey Marketing Plan Regulations and The Agri-Food Act, 2004, hereby determines and orders as follows: 1 This Order pertains solely to the transfer of quota from one licensed producer to another licensed producer. 2 For a transfer of quota to be considered by the Board, both parties, the transferee and the transferor, must complete and submit to the Board a Quota Transfer Application which includes the following information requirements: (a) the name and licence number of each party; (b) the amount of quota that is subject to the transfer; (c) details with respect to the production unit from which the quota is to be transferred, including the amount of quota to remain in that unit were the transfer to be approved; 126 THE SASKATCHEWAN GAZETTE, JANUARY 17, 2014

(d) details with respect to the production unit to which the quota is to be transferred into, including the amount of quota that would be produced in that unit were the transfer to be approved; (e) if applicable, with respect to multiple quota holder arrangements: (i) letters of support for the transfer must be attached to the Quota Transfer Application form from each individual, partner or shareholder of both the transferee and the transferor applicants who have a beneficial interest in a production unit involved in the transfer; and (ii) a revised statement as to the division of ownership of each production unit involved if the transfer were allowed to occur; and (f) any other information the Board deems necessary. 3 For the Board to consider the transfer of quota, (a) a completed Quota Transfer Application form must be submitted; (b) neither the transferee’s nor the transferor’s licence may have any outstanding indebtedness to the Board for levies or penalties; and (c) both the transferee’s and the transferor’s licences must be in full compliance with the Act, the regulations and all orders of the Board. 4 Any application for the transfer of quota must be submitted to the Board office at least 6 weeks prior to the intended date of transfer. 5 Board approval for a transfer to take place must be provided 30 days prior to the intended date of transfer. 6 Upon the approval of a transfer, the Board will, within one week of the approval date, reissue producer licences to both the transferee and the transferor with amendments to the terms and conditions of each licence to reflect the change in quota allocated to each party with an effective date of the licence to coincide with the date of the transfer. 7 This Order will remain in effect for a period no longer than ten years from the date this Order is approved by the Agri-Food Council. LICENCE SUSPENSION, CANCELLATION AND REINSTATEMENT Order No. 27/13. The TURKEY FARMERS OF SASKATCHEWAN Board, pursuant to the provisions of The Turkey Marketing Plan Regulations and The Agri-Food Act, 2004, hereby determines and orders as follows: 1 Subject to section 9 of the Act, the licence of any producer who violates a provision of the Act, The Turkey Marketing Plan Regulations or any order or direction of the Board may be suspended or cancelled. 2 If a producer’s licence has been suspended under section 1, the licence may be reinstated if the Board is satisfied that the producer is in full compliance with the Act, the regulations and all orders of the Board. 3 A producer whose licence has been suspended may lease their quota following the procedures of Order No. 29/13 (Quota Leasing) or may transfer their quota following the procedures of Order No. 26/13 (Quota Transfer). 4 With respect to section 3, if a lease is not requested by the suspended producer, the Board shall allocate that producer’s allocation to all other licensed producers on a pro rata basis in which case the pro rata distribution cannot be reversed during that production year. 5 A producer whose licence has been cancelled under the provisions of this Order shall have their quota re‑allocated on a pro rata basis to all other licensed producers until a quota auction can take place for the sale of the entire quota associated with the cancelled licence. 6 With respect to section 5, the quota auction must be held within six months of the cancellation of the licence. 7 Any decision of the board regarding the suspension, cancellation or reinstatement of a licence must be provided in writing to the affected producer, including: (a) the rationale for the decision; (b) any terms and conditions associated with the Board’s decisions; (c) in the case of a suspension, the duration of the suspension; and (d) in the case of a suspension or cancellation, any processes that must be undertaken for reinstatement to be considered. 8 This Order will remain in effect for a period no longer than ten years from the date this Order is approved by the Agri-Food Council. Order No. 27/13 is made pursuant to section 26, clause 5(a) and 7(ee) and subclauses 7(x)(i) and (ii) of The Turkey Marketing Plan Regulations and shall be effective upon the date of this Order. QUOTA LEASING Order No. 29/13. The TURKEY FARMERS OF SASKATCHEWAN Board, pursuant to the provisions of The Turkey Marketing Plan Regulations and The Agri-Food Act, 2004, hereby determines and orders as follows: 1 All transactions in which a licensed producer leases their quota (leaser) to another licensed producer (lessee) must adhere to the requirements outlined in this Order. 2 A lease application must be made on the basis of kilograms of quota to be leased in a given production year. 3 A complete, written lease quota application signed by both the leaser and lessee must: (a) be submitted to the Board office before the end of the production year; (b) be limited to one production year at a time; (c) indicate the number of live kilograms to be leased; and (d) include any other information that the Board requires. 4 Licensed producers shall make every reasonable effort to produce their allotted quota. 5 Any lease authorization granted by the Board may be subject to terms and/or conditions that the Board considers appropriate in the circumstances. 6 The Board shall not allow a lease of quota from a leaser to a lessee if: (a) either party has outstanding service charges, overproduction penalties or levies payable to the Board; or (b) the proposed lessee would exceed the quota limit established by the regulations and orders of the Board. 7 Upon the approval of a lease application, the Board will, within one week of the approval date, reissue producer licenses to both the leaser and the lessee with amendments to the terms and conditions of each licence to reflect the change in quota allocated to each party with an effective date of the licence to coincide with the date of the lease. 8 Upon the granting of a lease, the lessee is: (a) responsible for the marketing of turkey in accordance with these regulations; and (b) liable for: (i) all service charges and levies assessed pursuant to these regulations; and (ii) any judgment obtained in respect of service charges or levies assessed pursuant to these regulations. 9 No subleasing of quota is permitted. 10 This Order will remain in effect for a period no longer than ten years from the date this Order is approved by the Agri-Food Council. GENERAL AUCTION PARAMETERS Order No. 30/13. The TURKEY FARMERS OF SASKATCHEWAN Board, pursuant to the provisions of The Turkey Marketing Plan Regulations and The Agri-Food Act, 2004, hereby determines and orders as follows: 1 The Board shall convene an auction when a three-year rolling average of fluctuations in non-processor requested quota indicates a 3% or more increase in Saskatchewan production has occurred. 2 Non-processor requested quota shall be defined as the difference between Saskatchewan’s TotalC ommercial Allocation and its Further Processed Requests and Whole Bird Requests at the end of each production year as reported by the Turkey Farmers of Canada. 3 The amount of quota to be auctioned shall equate to an amount consistent with the 3% or more increase in Saskatchewan production as determined by the processes outlined in section 1. 4 Parties that may participate in a Board quota auction are licensed producers and qualifying individuals participating in the Board’s New Entrant Program. 5 The Board may hold an auction that is specific to New Entrant Program participants. 6 The auction shall be conducted in accordance with a Board Order established for the specific auction as per subsection 34(3) of the Regulations. 7 This Order will remain in effect for a period no longer than ten years from the date this Order is approved by the Agri-Food Council. 130 THE SASKATCHEWAN GAZETTE, JANUARY 17, 2014
