The Agencies/Contractors should fulfill the following requirements.

1. The Agency/Contractor should be registered with the competent authority, such as Regional Labor Commissioner (State or Central), empowered to issue the license to carry out such business and the license should be valid as on date (copy to be enclosed).

2. The Agency/Contractor should produce the latest Certificate issued by i) the DG Resettlement (DGR) along with Registration No., (or) ii) Valid license from the AP State Government under Private Security Agencies (Regulation) Act, 2005 (PSARA-2005) (copy to be enclosed).

3. Duly attested copies of the latest Income Tax Returns with PAN No., EPF, ESI and GST registration (as applicable) to be enclosed.

4. The Agency/Contractor should have been continuously in the field of providing services to Central/State Govt. Depts./Organization or Public Sector Undertakings (PSUs) for a minimum period of Three years ending with the financial year 2017‐2018 [proof shall be enclosed] – Experience certificate(s) from at least any TWO such Departments to be enclosed.

The Tender Form contains two parts – ANNEXURES I & II. All the agencies shall submit in the prescribed tender form designed by CSIR‐NIO, Visakhapatnam.

1. ANNEXURE – I (TECHNICAL): Contains Technical details i.e. Firm Registration, Experience, IT Returns / Annual Audit Statements, EPF, ESI, Service Tax (as applicable), etc.

2. ANNEXURE – II (FINANCIAL): Relates to Financial Bid, i.e. rates as per latest AP government order to be quoted in the prescribed Format including the statutory payments, such as EPF, ESI, Bonus and GST (as applicable) along with Service Charge.

3. Each agency should submit the tender in parts, Part A (Technical Bid) & Part B (Financial Bid). Both the bids along with the tender form shall be submitted in a sealed cover duly mentioned the name and address of the tenderer on the cover.

4. Bids will be evaluated by a committee constituted by the Scientist-in-Charge, CSIR-NIO, Visakhapatnam as per the criteria stipulated in the tender document. The tenders should be on the specified form (non-transferable) obtainable from office of the Scientist-in-Charge, CSIR-NIO, Regional Centre, 176, Lawsons Bay Colony, Visakhapatnam – 530 017 between 9.30 am to 12.30 pm on all working days on payment of Rs. 500/- in cash (non–refundable) and/or by post by sending Demand Draft for a sum of Rs. 550/- (which includes Rs. 50/- for postal Charges). The Demand Draft should be drawn in favor of the “Scientist-in-Charge, CSIR-NIO, Visakhapatnam”, and payable at SBI, Kirlampudi Layout, Visakhapatnam. Any other form of payment will not be accepted. Further, the tender form can be downloaded from the CSIR-NIO website www.nio.org under the head “Tenders”. In this case the tender cost of Rs 500/- in the form of DD/BC/PO in favor of Scientist-in-Charge, CSIR-NIO, Visakhapatnam may be attached along Technical Bid and submitted with the tender on the due date with the requisite EMD.

Completed Tenders in the prescribed form, along with necessary enclosures duly filled, accompanied by EMD of Rs. 25,000/- through Demand Draft/Bankers Cheque drawn in favor of “Scientist-in-Charge, CSIR-NIO, Visakhapatnam”, payable at SBI, Kirlampudi Layout, Visakhapatnam, sealed and superscribed “Tender for providing Round-the-clock Security Services” addressed to “Scientist-in-Charge, CSIR-National Institute of Oceanography, Regional Centre, 176, Lawsons Bay Colony, Visakhapatnam 530 017” will be received up to 2.00 p.m. on 03-10-2018. Tenders received after the due date and time will not be considered. The tenderer will be responsible for timely submission of the tender documents, complete in all respects and the same should be sent by Registered/Speed post of Post only. Tender sent through private couriers will not be accepted. However, the tenders can also be submitted in person at CSIR-NIO on or before due date and time.

The tenders will be opened on the same day, i.e. 03-10-2018 at 3.00 p.m. in the office of the SCIENTIST-IN- CHARGE in the presence of tenderers, if any. The tenders shall be valid for 90 days from the date of opening.

Interim enquiries will not be entertained. Tenders submitted without EMD shall be rejected summarily. The Tender is subjected to the terms and conditions attached herewith.

Director, CSIR-NIO in public interest reserves the right to accept or reject any or all the tenders either in full or part thereof without assigning any reason whatsoever and also to impose/relax any terms and conditions of the tender and his decision on all matters in this regard shall be final & binding.

Terms & Conditions

 The Agency/Contractor should be registered with the competent authority, such as Regional Labor Commissioner (State or Central), empowered to issue the license to carry out such business and the license should be valid as on date.  The Agency/Contractor shall produce (i) the latest Certificate issued by the DG Resettlement along with valid Registration No. (or) ii) valid license issued by the AP Government under the Private Security Agencies (Regulation) Act 2005 (PSARA-2005) (copy to be enclosed).  The Agency/Contractor should have sufficient experience in carrying out similar contracts for the last Three Years in providing services to at least TWO Central/State Government organizations/PSUs. (Copies of experience certificates to be enclosed).  The Agency should have its registered office within the city of Visakhapatnam (Proof shall be enclosed – office registration certificate and the rental/lease agreement/house tax certificate)  The contract shall be valid initially for TWO YEARS, which can be extended for one or more years on satisfactory performance of the initial period of the contract. NIO reserves the right to curtail or extend the validity of contract on mutual consent on the same rates and terms & conditions for such period upon the satisfactory functioning of the agency.  The agency should submit an attested copy of PAN card issued by the Income Tax department along with copy of latest income tax return. Payment to be made is subject to deduction of tax at source as per rules.  Service Tax, as applicable, shall be deducted at source and the same will be deposited with the Service Tax Department.  Particulars showing proof of Registration with EPF, ESI and GST Authorities, as applicable, copies to be submitted.  The tenderer submitting tender would be deemed to have inspected the premises, considered and accepted all the terms and conditions of contract. No verbal or written enquiries will be entertained in respect of acceptance or rejection of the tender.  The tenderer should quote the latest rates as per the Minimum Wages Act of 1948, revised from time to time and applicable as per the Gazette of . The rate of wages and allowances should be in full conformity with the latest rates notified by the AP State Government for the services of security and other relevant statuaries. Any tender which is not in such conformity will be summarily rejected.  Bonus amount will be reimbursable /payable by CSIR-National Institute of Oceanography at the end of the annual contract period, subject to eligibility/fulfillment of conditions laid down under Labor Laws/ Bonus Act, for such payment.  The prices quoted by the agency should be inclusive of all charges and taxes. Contractor should quote the service charges in Rupees per Person per Month.  Quote for Service Charge should be fairly reasonable and feasible taking into consideration of TDS deducted, as applicable, and should not be less or equal to the TDS or otherwise the tender may be liable for rejection.  Besides any amount to be quoted at L1 level should not be unreasonable. If found unreasonable, the tender will be rejected without assigning any reason.  The contractor shall ensure that payment of wages to the contractual employees is made by the 7th of every month and wage slips are issued to every employee. The contractor shall make payment to the workers by depositing the payment towards the wages in their bank accounts and submit the bank details to the office duly certified by the bank, with the bill for verification and reimbursement.  The Contractor shall abide by all laws and regulations and statutory obligations in force from time to time including labor laws and shall indemnify the CSIR-National Institute of Oceanography from any claims in this regard.  It will be the sole responsibility of the contractor to abide by the provisions of all the statutory acts as applicable to the workers engaged by him for performance of this contract.  In the event of the contractor committing a default or breach of any of the provisions of the Labor Laws, including the provisions of the Contract Labor Regulation & Abolition Act, 1970 as amended from time to time or furnishing any information, or submitting or filing any statement under the provisions of the said regulations and rules which is materially incorrect, they shall without prejudice to any other liability pay to the Director, CSIR-NIO, a sum as may be claimed by CSIR-National Institute of Oceanography. 3

 The personnel of the Contractor should observe only 3 closed holidays in a calendar year irrespective of number of holidays observed by the Institute as per the list given by the Institute from time to time. The 3 closed holidays normally cover Republic Day, Independence Day & Mahatma Gandhi’s Birthday.  The services of employees of Contractor should be made available in three shifts basis on all days on six-day week basis in a month irrespective of holidays except on Sundays.  If it is observed at any stage that the quality of the work is not satisfactory, the contract/ work order as a whole may be terminated and Security deposit forfeited. The Contractor will have no claims whatsoever on the CSIR-National Institute of Oceanography.  The successful bidder on receipt of award of work shall execute an agreement with CSIR-NIO on the above conditions before commencement of work. Any charges for preparing such document should be borne by the agency.  The contractor shall be responsible for fulfilling all his obligations towards the persons deployed under law, namely, under the Minimum Wages Act. PF Act, ESI Act, Bonus Act, Shops and Establishment Act, etc. as applicable and amended from time to time. The contractor shall be responsible for deposit of employees and Principal employer’s share of statutory contribution towards ESI/EPF with the concerned department/authorities at his own level and maintenance of such record as per rules.  The contractor shall be required to submit a copy of Challan/ abstract/ ECR (Electronic Challan Receipt) statement of the amount deposited on account of the statutory contributions along with the bill for reimbursement, failing which the payment of service charges of the following month will be with- held. The payment will be released to him towards his service charges after deduction of income tax or any other Government dues, after the submission of attested copies of Recovery Schedules and other statements in the required formats for all employees, copy of Bank Challan(s)/Scroll(s) as a proof of having deposited the said amount for the period concerned before the reimbursement of the wages bill of staff is claimed. The contractor shall ensure that the cheques issued by him should not be dishonored under any circumstances. He will also arrange to open such EPF/ESI accounts of all the employees deployed by him.  The successful Contractor if operating from outside of Visakhapatnam but having branch office in the city will have to obtain EPF/ESI sub-codes in Visakhapatnam within 2 months of award of Contract for administrative convenience.  Any breach of the compliance of such formalities on more than two occasions during the tenure of the contract shall invite action for imposition of penalty, apart from the cancellation of the contract without any notice. The responsibility for issuance of Annual Statements of EPF deposits and ESI cards to its employees solely lies with the Contractor.  SECURITY DEPOSIT: The successful bidder will be required to submit a Bank Guarantee or by way of FDR pledged in favor of “Scientist-in-Charge, CSIR-National Institute of Oceanography, Visakhapatnam”, for an amount equivalent to two months’ contract value as Security Deposit, which will be of interest-free and valid for a period of 30 months. If contract extends for further One Year period, the validity of Bank Guarantee will be extended for another 18 months. Bank Guarantee will be returned after successful completion of the contract. The security deposit will be forfeited in case of breach of contract.  The successful bidder should provide two sets of Uniform + Identity Card + 1 Pair of Safety Shoes (wherever required) to all the Security Guards within 15 days of award of work and to be replaced as and when required. All the guards should have minimum qualification of VIII class or equivalent and age preferably below 50 years and should be properly dressed in Company uniform.  The Tenderer should also provide torch light /portable emergency lamp and whistle to the /guards on night duty. All the guards should have also been trained in Fire Fighting.  In the event of any dispute or difference that may arise from the agreement, the decision of the Director, CSIR-NIO shall be final and binding on both the parties.  NIO will not be responsible for any legal dispute between contractor and workers deployed by them.  EMD: The tender must be accompanied by an Earnest Money Deposit (EMD) of Rs. 25,000/- (Rupees Twenty Five Thousand Only) in the form of Demand Draft drawn in favor of “Scientist-in-Charge, CSIR- National Institute of Oceanography, Visakhapatnam”. Tenders received without valid EMD will be summarily rejected.  The earnest money deposit (EMD) shall be forfeited if the successful tenderer fails to accept the award of work.  No interest shall be payable on the earnest money. The EMD of the unsuccessful tenderers shall be refunded within TWO months on request and the EMD of the successful tenderers shall be adjusted as part of the security deposit. 4

 Any action on the part of the tenderer to influence any officer of the CSIR-National Institute of Oceanography or canvassing in any form shall make the tender liable for rejection. No Interim enquiries will be entertained and if any tenderer found to do so, his tender will be rejected even he is found to be L-1.  It shall not be binding on the part of the “Scientist-in-Charge, CSIR-National Institute of Oceanography, Regional Centre, Visakhapatnam” to accept the lowest tender.  Director, CSIR-NIO reserves the right to accept/reject any or all the tender/s in part or full without assigning any reason

Tenders complete in all aspects addressed to the “Scientist-In-Charge, CSIR-National Institute of Oceanography, 176 Lawsons Bay Colony, Visakhapatnam – 530017” shall reach his office by 2:00 PM on 03-10-2018 in a sealed cover superscried “Tender for providing Round-the-clock Security Services”.
