A RETURN TO LILIPUT: THE LICRA v. YAHoo! CASE AND THE REGULATION OF ONLINE CONTENT IN THE WORLD MARKET By Marc H. Greenberj ABSTRACT Over the past three years, a see saw battle has raged in Paris, France and in the heart of Silicon Valley in Santa Clara County, California, over the regulation of content on the Internet. The arena for this battle is the case of LICRA v. Yahoo!, which pits two non-profit human rights groups in France against giant Internet search engine and information portal Yahoo!, Inc. ("Yahoo"). The issues are (1) whether Yahoo may be prosecuted in France under French law for maintaining both auction sites that sell Nazi-related items and information sites promoting Nazi doctrine and (2) whether U.S. courts should enforce the resulting judgment. The first section of this Article presents the laws governing Internet content providers and the jurisdictional regime that gave rise to this see saw battle. The second section examines a series of court proceedings. The first two proceedings in France in 2000 resulted in a French court order directing Yahoo to add geo-location filtering software to its servers in Santa Clara. The subsequent California district court litigation filed in 2001 resulted in summary judgment for Yahoo. This judgment is on appeal. The third and final section explores the global implications of the French and U.S. proceedings. The section concludes that the international community should restructure certain principles governing international jurisdiction in Internet cases and adopt shared guidelines on online content available to the world market. These changes would promote the principle of international comity while allowing the Internet to retain most of its unique, borderless nature. -

Hybrid Constitutional Courts: Foreign Judges on National Constitutional Courts ROSALIND DIXON* & VICKI JACKSON** Foreign judges play an important role in deciding constitutional cases in the appellate courts of a range of countries. Comparative constitutional scholars, however, have to date paid limited attention to the phenomenon of “hybrid” constitutional courts staffed by a mix of local and foreign judges. This Article ad- dresses this gap in comparative constitutional schol- arship by providing a general framework for under- standing the potential advantages and disadvantages of hybrid models of constitutional justice, as well as the factors likely to inform the trade-off between these competing factors. Building on prior work by the au- thors on “outsider” models of constitutional interpre- tation, it suggests that the hybrid constitutional mod- el’s attractiveness may depend on answers to the following questions: Why are foreign judges appoint- ed to constitutional courts—for what historical and functional reasons? What degree of local democratic support exists for their appointment? Who are the foreign judges, where are they from, what are their backgrounds, and what personal characteristics of wisdom and prudence do they possess? By what means are they appointed and paid, and how are their terms in office structured? How do the foreign judges approach their adjudicatory role? Litigating the Immunities of International Organizations in Europe: The ‘Alternative- Remedy’ Approach and its ‘Humanizing’ Function RESEARCH ARTICLE LUCA PASQUET ABSTRACT CORRESPONDING AUTHOR: Luca Pasquet There is a clear normative tension between the immunities of international Assistant Professor of Public organizations and the human rights to a court and to a remedy. Most national International Law, Utrecht jurisdictions around the world have so far failed to recognize such a normative conflict University, NL and applied immunities irrespective of their consequences on individual claimants. [email protected] However, following the Waite and Kennedy jurisprudence of the European Court of Human Rights, a number of European national jurisdictions have accepted the idea that applying international organizations’ immunities may lead to breach the right KEYWORDS: to a court in case the claimants do not have access to an alternative remedy. Substantive Hierarchy in Constitutions in Theory and Practice Ahmed Oudah Al-Dulaimi,* Jacob Deem,** & Maher Faisal Saleh*** Abstract This article examines whether all constitutional rules and principles have the same value and occupy the same level of importance within a constitutional system, or is there some kind of hierarchy among them. The significance of these questions arises when constitutional rules come into conflict with one another. In this case, constitutional courts will be in an unenviable position to decide on such conflict, because this conflict is not between rules in different positions within the legal order (e.g., constitutions v normal legislation), but between rules whose values are derived from one source: the constitutional order. This paper suggests a number of mechanisms to overcome this conflict. Firstly, it argues that such a conflict must be characterised as a significant dilemma, and declared as a constitutional problem. Secondly, it argues that the existence of substantive hierarchies within constitutions must be textually and judicially recognised. Finally, it proposes that this conflict cannot be overcome by adopting the power that has been assigned to the constitutional court as a negative legislator. However, there is a need to extend the role of constitutional courts to become positive legislators in order to reconcile the conflicted constitutional provisions without stripping the constitutional values from them. To achieve this end, this article develops a framework for understanding how conflicting constitutional principles should be reconciled by exploring the idea of substantive hierarchies within constitutions.
