Charter for Torfaen County Borough Council and Community and Town Councils

Introduction

The Community and Town Councils of Cwmbran, Pontypool, , Croesyceiliog & Llanyrafon, Henllys and Ponthir and Torfaen County Borough Council have agreed to publish a charter which sets out how we aim to work together for the benefit of local communities whilst recognising our respective responsibilities as autonomous, democratically elected statutory bodies.

The charter is designed to build on existing good practice and embrace the shared principles of openness, respect for each other‟s opinions, honesty and our common priority of putting citizens at the centre. This charter is based on equality of partnership and is not a top-down arrangement.

Local Governance

We will be clear about the expectations that we have of each other in order to facilitate a smooth working relationship. In this regard, we will define the way in which we interact with each other. We will be clear about the role of councillors at all levels in their relationships with regard to community leadership.

The Local Councils Partnership Committee meets quarterly. Two representatives, or nominated substitutes, attend from each Community and Town Council. Ordinarily, this would be the Leader/Chair/Nominated Representative of the Council, together with the Clerk to the Council. Torfaen is represented by the Leader of the Council or his Nominated Representative (who Chairs the meetings), the Senior Members‟ Services Officer (who services the Committee) and Officer Representatives* of each Council Department/ Service Area. *Chief Officers & Technical Officers from Torfaen attend as and when their presence is required in order to offer advice on specific areas of discussion and to answer questions.

The overarching purpose of the Committee is to discuss local government matters of mutual concern. The Committee provides comments and seeks to make recommendations to the appropriate decision-making body.

Consultation

Joint working and engagement

Community Strategy - this is now the Single Plan

We recognise the strategic importance of the Single Plan as the overarching strategic vision and priorities for the local area. Furthermore, we recognise that the Single Plan will only be fully effective if it is informed by the grass roots experiences from within our communities.

Accordingly it recognises the valuable input of the Community Councils in the formulation of the Single Plan, using the LCPC for consultation purposes and allowing feed back.

Local Elections

Fair and open elections are the bedrock of local democracy. We will ensure that elections are freely and fairly contested, and encourage local people to become involved in local democracy.

Consultation on equipped play areas will cover major installations/rationalisations (except for health and safety measures), and to identify play areas that the Community Council may wish to enhance within their locality.

Planning Group Development Control Building Control Local Development Plan preparation Community Councils are consulted on all Planning Applications in accordance with Planning Legislation. Planning Consultation replies will not be acknowledged unless there is a specific request to do so on a particular case or if the letter sought clarification on any aspect of the planning application. A full set of planning application forms, plans and any supporting information will be sent with the consultation. Planning Officers are available to attend Community Council meetings to answer questions on certain significant planning proposals at the discretion of the Head of Development Control. The Council has implemented Third Party Speaking Rights at Planning Committee which means that a representative of Community/Town Councils is able to personally address the Planning Committee where they have previously objected in writing to a planning application. This replaces the current site meeting procedures following deferral of an application. Community Councils will no longer be able to participate at committee site visits following deferral of an application and will not be invited. Further information and details on how to register an intention to speak at Planning Committee can be obtained from Ros Gwynn, Democratic Services Officer on (01495) 766057. There will also be consultation on the Torfaen Local Development Plan and associated Sustainability Appraisal and Supplementary Planning Guidance, including a programme for the preparation of the latter. A Planning Focus Group (comprising representatives from all Community Councils and Officers of the Planning Division) meets quarterly to discuss all issues relating to Regulatory matters.
