MINUTES OF STA MEETING HELD ON 15.9.2014 AT 10.00 A.M. IN THE CONFERENCE ROOM OF THE COMMISSIONER (TRANSPORT)/ CHAIRPERSON (STA)

Meeting of the State Transport Authority (STA) was held under the Chairmanship of the Commissioner (Transport)/Chairperson, STA. The following were present:-

Following operators/ members of the Route Rationalization Committee were also given a personal hearing:- i. Shri G.D. Srivastava, DGM, DMRC ii. Shri Vinod Negi, Association of Gramin Sewa iii. Shri Iqbal Singh, Association of Gramin Sewa iv. Shri Shyam Lal Gola, Association of Stage Carriage Mini Bus Operators v. Shri Sanjay Bathla, Association of Stage Carriage Mini Bus Operators

At the outset, Chairman, STA welcomed all the Members and thereafter, discussions on agenda items were started with the approval of Chairman, STA.

1. CONFIRMATION OF THE MINUTES OF THE LAST STA MEETING HELD ON 16.6.2014

The STA confirmed the minutes of the aforesaid meeting which were circulated vide No.10 (108)/AS/STA/TPT/2013/131 dated 01-07-2014 to all the Members.

Following resolutions were made by STA:-

2. Agenda No.10/2014

I. REPORT OF ROUTE RATIONALIZATION COMMITTEE

A Route Rationalization Committee comprising officers of Transport Department, DTC, DMRC, DIMTS, Delhi Police and four members of Association of operators of Gramin Sewa and Private Stage Carriage buses, was constituted by Transport Department. The Committee was asked to make recommendation on the representations of the operators of private stage carriage buses’, Gramin Sewa and Metro Feeder Buses run by DMRC for modification in their routes. Many of the representations

1 were forwarded by the MLAs of the areas. The requests of the operators were also uploaded on the website of the Department for inviting objections / suggestions from general public as well as operators of the Gramin Sewa / mini buses. These objections / suggestions were also considered by the Committee while preparing the report.

The Committee submitted its report on 5.8.2014. Chairman of the Committee has informed that in the last meeting held on 1.8.2014, only ten out of the thirteen members attended the meeting. Only six members signed the report and remaining (representatives of operators) did not sign the report.

It was decided by the STA Resolution No.7/2014 dated 16.6.2014 that routes of Gramin Sewa shall be beyond outer ring-road and that of private stage carriage mini buses shall be beyond the inner ring-road. The areas beyond outer ring-road were identified by the Committee on the directions of STA through the Resolution No.7.2014 dated 16.6.2014. The Committee identified 46 such routes having around 2000 vehicles which are to be restricted beyond the outer ring-road.

Salient features of the report are reproduced as under:

“Reasons for representations from operators for extension / change of routes were as under:-

i. Routes are parallel to Gramin Sewa Routes/ RTV / DTC/ Cluster Buses. ii. Due to some obstructions by the authority, the existing routes need to be changed. iii. Since the size of the bus has increased after replacement order of February 2012, in some cases the buses cannot move through lanes situated in the existing routes. iv. There is only a single bus on the route making it uneconomical. v. Other reasons.

Committee has stated that the recommendations have been made in accordance with the provisions of section 80 (3) of the Motor Vehicles Act 1988 and it has also been ensured that public gets good connectivity with better and safe journey.

Private stage carriage mini buses-

i. A total of 64 recommendations in respect of 69 routes have been given by the Committee. The Committee has recommended the changes as asked by the operators only in respect of 9 routes. ii. In some cases, the Committee has recommended alternatives other than asked by the operators. iii. In the remaining cases, the requests of the operators have been rejected.

Gramin Sewa - i. Out of a total 166 Gramin Sewa routes, 46 were found to be having some portion of the route beyond the outer ring-road. Alternate routes have been recommended by the committee on 44 of these routes. However, the representatives of the operators were not agreeable for change of these routes. ii. Recommendations have also been given on the representation for route modification by the operators, in case of 30 routes. The committee has agreed to the demand of operators in 6 cases.

Maxicabs –

The operators of maxi cab (point to point) routes no.9101, 9102, 9105, 9107, 9111, 9114 have requested for route modification. None of the requests of the operators have been acceded to by the Committee.

Request of M/s Chaudhary Transport Company :.

The operator M/s Chaudhary Transport Company represented to Committee the proposal of 30 permits/ buses specially given to the company for operation in Chandni Chowk. The company has stated that after ban of cycle-rickshaw in Chandni Chowk area, the applicant company was given 30 permits to ply on that route. However, later on the said order was set aside by the Hon‟ble Supreme Court of India and as a result the buses business came down and was stationed by owners. Therefore, the applicant / owner has requested for allotment of the following routes:- i. F-101 from GTK Bypass to Narela with modification as to Narela - 20 buses ii. F-114 from ISBT to Bakhtawarpur – 5 buses iii. F-902 from Punjabi Bagh Terminal to GH Block, Sultanpuri – 5 buses

However, the Committee observed that the matter does not come under the purview of the Committee. The Committee further stated that it is to be decided by the STA whether these operators can be accommodated for a different route instead of Chandni Chowk Sewa for which the permits were issued.

In this context, it is submitted that the petitioner M/s Chaudhary Transport Company had stated that in April 2012, the Hon‟ble Supreme Court permitted cycle-rickshaws to operate in Chandni Chowk Area and as a result, the petitioner was prohibited from plying its 30 mini buses which were operating on STA permits. He has stated that a huge amount was invested in purchasing mini buses and its operation and maintenance. The vehicles are now lying idle and the staff engaged by it is being paid their salaries

without any work being taken from them, in the absence of any alternative route assigned to it by the STA, Delhi. The operator preferred an appeal in the Delhi High Court for alternate routes.

The Delhi High Court disposed of the petition of M/s Chaudhary Transport Company with direction to STA, GNCTD to take a decision on the pending representation of the petitioner within a period of four weeks under written intimation. In case the STA turns down the request made by the petitioner, it shall be entitled to seek its remedies against the said decision, in accordance with law

As per record, permits to M/s Chaudhary Transport Company were issued on the basis of decision taken by the then Chief Secretary and on the basis of study report submitted by CRRI titled “Transport System Management Plan for Chandni Chowk Area”. The area MP and the then Transport Minister supported the scheme. Initially, DTC was asked to operate these buses but later on it was decided that the scheme may be operated by a private company. DIMTS and DMRC were also asked to operate the scheme, but they declined the offer. A six member technical committee was constituted under the chairmanship of the then Spl. Commissioner, Transport for selection of single operator for the scheme. The two allotment processes initiated on 28.4.2006 and 26.8.2006 did not yield the desired outcome and both processes were cancelled by the Government. The Committee was asked to revise earlier terms and conditions so that the scheme can be made implementable. On the third attempt, M/s Chaudhary Transport Service was selected to operate 30 buses as per the following details: i. Chandni Chowk route – 20 buses (clock wise – Jain Mandir, left turn to Esplanade road, upturn at Meena Bazar-left turn to Chandni Chowk-U turn from Fatehpuri Mosque and return to Jain Mandir. ii. Fountain route – 10 buses (anti-clockwise – Fountain (H.C. Sen Marg) – S.P. Mukherjee Marg, Church Mission Road-Fatehpuri Masjid-Fountain (in a counter clockwise direction).

The fares were different from the normal stage carriage buses. The route length was approximately 4 kms for each route and Rs.5/- was allowed to be charged per trip. No stand fee was applicable to these buses. Permits of 5 years validity were issued. The policy was in relaxation to the existing policy for such buses vide which these buses at that time could ply beyond and beyond outer ring road. It was also envisaged to put a complete ban on operation of cycle rickshaw traffic from 9 AM to 8 PM prior to operation of these buses in the Chandni Chowk Area. The operation of buses was allowed for the above period i.e. 9 AM to 8 PM. One of the conditions of the scheme was that -

“In any circumstances, the operator shall not be allowed to operate these buses on any other stage carriage routes nor the permit shall be converted to contract carriage. In case, the operator is not interested to operate the buses, the operator have to obtain No Objection Certificate from the registering authority to get registered the buses outside the jurisdiction of Delhi”. 4

DMRC Metro Feeder Buses–

10 routes (ML-06, ML-10, ML-13, ML-51,ML-96, ML-96A, ML-90, ML-091, ML-092, ML-93 of the DMRC Metro Feeder Routes were considered by the Committee and recommendations different from the proposal of the DMRC have been made by the Committee. Route No.ML-06 and ML-10 have been recommended to be merged. Representative Member of the DMRC has signed the report of the Committee.

The Committee has observed that Metro Feeder Bus Routes have been designed / demanded from one Metro Station to another, giving the purpose to join two Metro Stations. It has recommended that these routes should be designed at the 90 degree angle to Metro Line and not at 180 degree angle.

Special attention of the Committee:

The Committee has indicated that the conflict / congestion on the routes have occurred due to non- following of section 80 (3) of the M.V. Act strictly. The route of many operators have been changed on the request of operators without bothering the maximum limit of vehicles prescribed / fixed at the time of formation of these routes which is causing adverse results on the routes. List of such Gramin Sewa Routes are mentioned at page 66 of the report.

Conclusion:

The Committee has recommended since many routes have become dead and many have been changed / extended/ amended, a scientific and subjective study is needed to be done for re-formation of the routes. All the routes of RTV / Gramin Sewa / Metro Feeder / Maxi Cab etc. should be designed afresh after a scientific study of routes in such a manner that overlapping of different routes / vehicles would be minimized. Further, all the routes should be allotted through „Draw of Lots‟ with condition that no request of change / extension in route would be considered for the next five years. It has also been recommended that cases where change / extension / change of via / merging have been allowed, the permit should not be transferred for next three years from the date of approval of request.”

STA noted the recommendations of Route Rationalization Committee. Decision in this regard is taken in the next resolution.

Objections / suggestions of operators of Transport Associations & DMRC who are members of the Committee

As already informed by the Chairman of Route Rationalization Committee that 4 Members of the Committee representing the operators of Gramin Sewa and mini stage carriages did not sign the report of the Committee. These members have now also separately submitted their dissent through representation to the Department.

A. Representation of DMRC

DGM (TI), DMRC who is also the member of Route Rationalization Committee though earlier signed the report of the Committee, under protest, had further sent a dissent note in respect of decision of the Committee. It has been stated that 117 old Mini Buses are running on 14 routes and are connecting 18 Metro Stations. With the operation of another fleet of 400 Feeder Buses in near future, DMRC in principle which is to address the issues like minimum idle run from the depot, idle parking at Metro Stations. DMRC also intends to connect maximum number of Metro Stations to accommodate the request of various institutions, elected representatives, RWAs by inclusion of various changes in road network. Keeping these in view, the routes were designed to connect one or more Metro Stations / lines to fulfill the requirement of large number of people. Due to this unavoidable reason, buses are bound to run few kilometers parallel Metro Lines. As such, it is not economically feasible to design all the routes perfectly at 90 degrees of Metro Lines. Routes of Metro Feeder Buses were surveyed long time back when e-rickshaw and Gramin Sewa were not in operation. Route length of Metro Feeder route should be almost at par with the length of RTV routes which is approximately from 15 to 20 kms. Present routes of DMRC feeder buses are of approximately 8 kms. only and the buses are having seating capacity of 27.

It has been stated that the above points were mentioned during the various meetings of the Route Rationalization Committee but the request of the DMRC was not acceded to for one or another reason.

A meeting was convened in the Conference Room of Commissioner (Transport) to discuss various issues relating to Metro Feeder Scheme on 27.8.2014. Director (Ops) DMRC inter alia requested to immediately consider the demand of DMRC for modification of routes. He informed that these routes were designed in the year 2007 and were part of the tender document released by DMRC. Since now DMRC is procuring midi buses in place of earlier mini buses, it is not economically viable to operate these feeder buses on the earlier approved routes. The issue has been represented by the DMRC before Hon’ble Lt. Governor. Director, DMRC also offered to surrender the scheme if their 6 demands including modification of routes are not considered and approved by the Transport Department.

Commissioner (Transport) asked DMRC to send the list of modified routes for the consideration of the STA. Executive Director vide letter dated 29.8.2014 has furnished list of the routes requested to be modified and also some new proposed routes. The details are as under:-

Route No.ML-44 has also been proposed to be amended to connect Delhi Secretariat to Mandi House Metro Station. This is being proposed on the request of Pr. Secretary, Finance, GNCTD, for the benefit of the officials of Delhi Government.

It has been informed that a new route No.ML-104 has also been proposed on the request of Judicial Officers of Saket Court from Nehru Place to Mehrauli Terminal.

MLA, Burari had requested modification (extension) in route no.ML-06 (Keshav Nagar to Vishwavidhaylaya) and ML-55 (Sant Nagar to Punjabi Bagh) for convenience of the residence of his area.

B. Representation of mini bus private stage carriage / Maxi Cab operators

Vide letter dated 4.9.2014 two members of the Committee belonging to mini bus private stage carriage / maxi cab operators have submitted a representation. It has been informed that they do not agree with the recommendations of the Committee. They also did not sign the Committee’s report because their view point was not taken into account while giving recommendations for each route in the report. Applications and requests made during public grievances were also ignored in the report.

It has been stated that when the scheme for mini buses was started by the Department, there used to be smaller mini buses having seating capacity of only 14 which was later increased to 25, with six wheeled vehicles, thus increasing the size of the bus. The routes of erstwhile Metro Feeder buses, which were later merged with the mini stage carriage buses were very small having length of 5-7 kilometers and they now require extension.

These members have represented with following suggestions about the route rationalization for the consideration of the STA: i. “In a very few cases, the Committee had recommended the changes asked by the operators. The STA may allow these changes.” ii. “Even requests of the operators which fall well within the ambit of Section 80 (3) (ii) of the Motor Vehicles Act 1988, has not been agreed to by the Committee by giving bizarre reasons, which is totally unjustified and unfair. Demands of these operators for either extension of the route or change of via may be allowed by the STA. These routes have been demanded by the operators to be modified on the basis of field survey done by them for the convenience of the public.” iii. “During the public hearing held by the Committee some of the operators, whose original requests were not considered to be falling within the ambit of MV Act 1988, have requested for the alternate extension or via change which was in accordance with the said Section of the Act. These operators may also kindly be allowed the change requested by them.” iv. “There are few routes where only single bus operator is plying his bus which is neither beneficial to the operator or to the commuters. These routes can be merged with some nearby similar routes demanded by these operators.” v. “Routes of operators of F-205, F-302 and F-303 were recommended to be curtailed by the Committee as very small portion of their routes were falling within the inner ring road. These recommendations may not be allowed by the STA.” vi. “There are still few operators whose requests for curtailment/ extension/ change of via could not be considered by the Committee due to various reasons.” vii. “Requests of some operators for route modification have been rejected by the Committee for right reasons; hence, there is no objection on these recommendations.” viii. “Request of M/s Chaudhary Transport Company was not entertained by the Committee on the ground that it does not come within the purview of the Committee as this is a special scheme for Chandni Chowk Area. There is objection amongst the operators for granting the Company the routes asked by it i.e. F- 101, F-114 and F-902. As per the terms and conditions of the scheme, the operator of Chandni Chowk Sewa is not allowed to operate its buses on any other stage carriage routes nor the permit can be converted to contract carriage. He can only obtain No Objection Certificate from the registering authority to get registered the buses outside the jurisdiction of Delhi. However, it is upto the STA to decide whether this scheme can be merged with the existing mini bus stage carriage scheme and may allow only those routes where no buses are operating and there is no objection from the other operators and also there is no objection.”

8 ix. “Maxi cab scheme is a point-to-point scheme and are only in 101 in numbers. The operators have basically asked for extension and change of route also. It is requested that at least extension of route should be allowed. These operators may also be given a chance for extension / curtailment of route.” x. “We agree to the recommendation of the Committee that once the route is modified, transfer of permit should not be allowed for three years.”

Detail of routes falling in the above categories has been given in their representations. They have requested to place their above said requests before the STA and also to allow them to appear before the STA to put forth their point of view.

C. Representation of Gramin Sewa operators

Vide representation dated 4.9.2014, members of the Committee belonging to Gramin Sewa Scheme have informed that they do not agree with the recommendations of the Committee. They also did not sign the Committee’s report because view of point was not taken into account while giving recommendations for each route in the report.

It has been stated that they are greatly disturbed and agitated with the decision of the STA dated 12.8.2014 to restrict their operation beyond outer ring road. Moreover, some court cases are pending regarding public notice issued on 23.1.2014 in accordance to Resolution No.16/2013 and 17/2013 dated 12.8.2013 of STA in Hon’ble High Court of Delhi. There are about 2000 Gramin Sewa vehicles and their operators will be adversely affected by this decision of the STA. It is informed that out of the 166 originally allotted routes of Gramin Sewa only about 70 are practically operating and remaining routes are not in operation due to being un- economical. Out of these, 46 routes have been proposed to be restricted by the Committee because they were plying within outer ring road which is approximately 70% of total Gramin Sewa fleet. They requested the following for the consideration of STA:-

i. “To approve recommendations of the Committee on the very few cases where requests of the operators have been agreed to”. ii. “Not to implement any of the recommendation of the Committee regarding change of their 46 routes, some portion of which are falling within the outer ring road. They requested to consider the extension / change of via of routes in these cases also”. iii. “To consider the request for change of via or extension of route in some cases in accordance with the provision of MV Act 1988”.

iv. “To allot alternate/ new routes for operators whose routes are having vehicles much in excess of the capacity of the route. These routes have also been mentioned in the report of the Committee”. v. “Some operators want to rectify route maps provided by DIMTS which are not according to route list and via and this should be corrected”. vi. “As per scheme published by Transport Department the Gramin Sewa was introduced initially upto inner ring road at the time of allotment in the year 2010”. vii. “Requests of some operators could not be taken up by the Committee which may be considered also”.

They have requested to place their above said requests before the STA and also to allow them to appear before the STA to put forth their point of view.

Resolution No.11/2014

On the basis of the requests of the operators, report of the Route Rationalization Committee, various representations of the elected representatives (MLAs/ MPs) and the submissions made by the members of the Route Rationalization Committee (i.e. DMRC / Members of Association of Mini Stage Carriage Buses and Gramin Sewa), STA decided the following:-

(i) Metro Feeder Buses

DGM, DMRC represented the case of DMRC before the STA, for modification of existing routes and also allotment of some new routes. He reiterated that it is not economically viable to run the metro feeder midi buses (which are having seating capacity of 27, on the existing routes of smaller length of 5-10 KMs). Routes of Metro Feeder Buses were surveyed and decided long time back when Gramin Sewa and e-rickshaws were not in operation. The buses are now fitted with GPS and CCTV. Some existing routes are required to be modified and some new routes are also needed to be approved by the STA. DMRC intends to connect maximum number of Metro Stations to accommodate the request of various institutions, elected representatives and RWAs. After a lot of deliberation, the STA approved the following modified routes as per the via requested by DMRC:-

However, in case of new routes proposed by DMRC, STA decided that the Department may study in detail the proposed new routes. It was also decided that DMRC shall ensure that the remaining buses are inducted in its fleet within a period of six months. ii) Mini Bus Private Stage Carriages / Maxi Cabs

Representatives of the operators were invited before the STA to represent their point of view. They repeated the issues already raised by them in their representation, that, four members of the route rationalization committee did not sign the report. DMRC representative signed under protest and further sent a dissent note along with other members. The operators informed that routes to mini buses (having seating capacity of 14 passengers) were originally allotted through a scheme of DMRC. However, after finding the routes unviable, the scheme was later on transferred to STA. Since then, the operators are requesting for modified routes. Old mini buses have now been replaced with six wheel mini buses which are safer and have a seating capacity of 24 passengers, thus making most of the existing routes economically unviable. The requested modification shall benefit the commuters, as there is a huge demand for public transport in these areas. Most of these modifications have been asked by the area representatives i.e. MLAs, MPs etc. STA considered the requests and decided to approve route modifications subject to the report of the Delhi Police from the traffic congestion point of view. The

11 said report of Delhi Traffic Police has been received vide letter No.7226/TE(D-II)/Traffic, dated: 20.10.2014. Therefore, the STA minutes have now been proposed as under:

However, the revised permits shall be issued by STA only after receiving up to date dues (Road Tax, Stand Fee etc.) and particulars of current drivers. Permits, where routes are modified, shall not be transferable for 3 years. Further, the modifications in the routes are temporary and may be reviewed depending on future traffic conditions.

STA decided to give a personal hearing to the operator in the next STA meeting.

(iv) Maxi Cab Routes (Point to Point) 15

STA approved the modification of routes of maxi cabs as per the following details, subject to clearance from the Delhi Traffic Police from the congestion point of view:-

(v) Gramin Sewa Routes

Representatives of the operators of Gramin Sewa repeated the issues already raised by them in their representation which is part of the agenda. They requested that decision of the department to restrict operation of Gramin Sewa should not be implemented as about 1950 of their operators shall be adversely affected by this decision. Sh. Sanjay Jha observed that in many areas between inner and outer ring road, there is still need for Gramin Sewa services as there is no other mode of public transport (beyond outer ring road). Further, in narrow lanes where buses/mini buses cannot move, Gramin Sewa is the alternative mode of transport.

STA decided that this issue, along with other issues raised by the Gramin Sewa operators, may be referred to a sub- committee of the department.

DMRC vide letter dated August 8, 2014 has informed that Minister for Urban Development, GOI has desired to run Metro Feeder Buses from Shivaji Stadium Airport Metro Station to increase the ridership of Airport Line.
