Information sheet for inspection of Hon’ble Member, Board of Revenue, Odisha, Cuttack on the Office of the Tahasildar, Khondmals, Phulbani ***********

Date of Inspection:

1. Introduction :

This Tahasil has started functioning as part and parcel of the Kandhamal Sub-Division & entered in to Tahasil pattern w.e.f. 01.09.1963. This Tahasil comprises of 231 Revenue Villages covering the geographical area of 477.82 Sq K.M. After bifurcation of Tahasils w.e.f. 2008 as per Notification No. 33533/R & DM dtd. 06.08.2008 of Govt. in Revenue & Disaster Management Department,Odisha,Bhubaneswar, it consists of 06 R.I Circles, 11 Gramp Panchyats, 01 Block, 03 Police Stations and 01 Municipality.

2. Accommodation :

This office has been functioning in its own building since 1963 at Phulbani in the district of Kandhamal.

3. Incumbency :

Sri Priyaranjan Prusty, OAS working as Tahasildar, Khondmals, Phulbani since 7.6.2012. prior to him Sri Bira kishore Panda, OAS was the Tahasildar, Khondmals, Phulbani.

This Tahasil office was last inspected by Sri RabiNarayan Mishra, OAS-I ( SB ), Additional, District, Magistrate, Kandhamal, Phulbani. On 29.12.2012.

The inspection report of the ADM , concerned was released vide his office Memo No 1776 dated 31.12.2012. Compliance to inspection report has been submitted vide this Tahasil, Office Memo No 933 dated 17.04.15. The A.D.M. in his inspection observed the maintainance of records, tours and night halts of Tahasildar, consignment of files and registers and case records as well.

Tours:

As per book circular 41 read with Memo No 47289/ R dated 1.10.1988 of erstwhile Revenue Department the Tahasildar is required to perform 150 days tour with 60 days night halt in a year.

During his inspection, the ADM concerned instructed the Tahasildar, Khondmals to direct the field staff to submit their tour dairies in time which has been followed properly. The same has been approved by the Sub- Collector, Kandhaml. Hence satisfactory.

During the inspection of the Addl. District Magistrate,Kandhamal observed the maintenance of Registers, Files and Case Records.

The Following register has been maintained in this office. On observation it is found that they are maintained properly.

1. Guard Files. 2. Register of letter Received. 3. Register of letter issued. 4. Accounts of Postage Stamp Register. 5. Index Register. 6. Register of Assembly Question. 7. Register of Registered letter Received. 8. Register of periodical reports and returns. 9. Log book. 10. Register of Service Book:-During the inspection the ADM concerned observed that the register of service book has not been maintained. In the mean while the register of service has been maintained properly. 11.Register of increment:- Maintained properly.

Disciplinary Proceeding

It is ascertained that from the observation of ADM during his inspection dated 19.12.2012, no disciplinary Proceeding was pending for inquiry in this Tahasil. No register in this regard has been opened.

Pension Case

It was observed by the Additional District Magistrate that one pension case was pending in this Tahasil. One Golapi Nayak joined on 12.05.06 and expired on 19.10.11. Her GIS pass book has not yet been received from Finance Deptt. although her GIS premium has been deposited. Her appointment is coming under Contributory Pension Scheme. The Tahasildar was instructed to take immediate step for settlement the same.

But till todate her pension claim has not been settled for no legal heir certificate of the deceased employee has been submitted and no pension paper has been submitted by her legal heir.

Now it is observed that 11 employees have been retired/ expired from the year-2008. Out of which pension cases of 10 NOs of employees retired / expired have already been settled.

One Jahria Pradhan retired from Government Service on attaining the age of superannuation. He has not submitted his pension paper till todate. However provisional pension of Sri Pradhan has already been sanctioned vide this Tahasil Office Order No 613 dated 4.03.15.

Bill Budget:-

Pay Accuteance Roll:- The ADM has instructed to enter the TV numbers by obtaining from the District Treasury and note in appropriate column in each Accuteance Rolls as well as in the Bill Register which has been already complied to.

Fire Accident :- It was observed by the ADM that 43 Nos of cases were reported till the end of the year 2012-13. Allotment for assistance to offer victims was for 1,23,000/- . Out of which 1,22,200/- has been disbursed among the victims of 2011-12. Rs 83,300/- has been disbursed during 12-13 from available cash. The Tahasildar is instructed to move the District Administration for placement of allotment under Fire Relief to recoup the expenditure made from the available cash.

In the meanwhile the expenditure made from the available cash towards fire relief has been recouped as allotment received under HBA, Clothing and Utensil. A sum of Rs 17,600/- incurred from the available cash is still to be recouped. The Tahasildar is instructed to make correspondence to District Administration for placement of funds for such recoupment

Process Establishment.-

Out of 2140 No of processes only 7 Nos of local processes were to be served till the date of inspection of the Additional District Magistrate,Phulbani The Tahasildar was advised by the ADM concerned to ensure timely service of processes before the date of hearing. Those have already been complied to.

Sri Manoranjan Sahu is in-Charge of the seat . 161 Nos of local processes and 51 Nos of Foreign Processes have been handed over to the process server concerned till date. out of which all the processes have already been served and returned to the issuing court .

Monthly Cash Analysis:-

During the inspection of the Additional District Magistrate it was observed that no monthly cash analysis had been done since inception of this Tahasil. The Tahasildar was instructed to take cash analysis in each month and report compliance.

On observation it is found that compliance to the observation of the Additional District Magistrate concerned has been done. Cash analysis is being done regularly.

Lease ( Agriculture )

During the inspection the Additional District Magistrate observed that out of 37 cases, 14 families were provided with agriculture land leaving a balance of 23 cases pending. The Tahasildar was instructed to take steps for settlement of Agricultural land with the identified landless families by the end of December ,2012 and report compliance.

It is now observed that all the 23 pending cases have been disposed of by 31.12.2012 and the identified landless families have been provided with the Agricultural land.

Lease ( House Site )

The ADM in his inspection, instructed to finalise 89 pending cases out of total 436 immediately and report compliance.

It is observed that the pending cases have been finalized and the deserving families have been provided with house site in time.

Alienation:-

The Tahasildar was instructed to dispose off 36 Nos of Alienation cases early. It is observed that 7 Nos of allienation cases out of pending 36 Nos of cases have been finalized . Steps are being taken to finalise the balance 29 Nos of Pending cases. Now it is observed that 40 nos of alienation cases are pending till todate. The Tahasildar is instructed to take immediate steps to finalize the same.

OLR- 8 ( A )

The ADM in his inspection observed that a sum of Rs 59,962/- was collected in 3 cases out of the targeted amount of Rs 4,00,000/-. 18 nos of case were pending for conversion by 29.12.2012. The Tahasildar was instructed to take all-out efforts to achieve the target before March- 2013.

It is now observed that the sum of Rs 2,85,093/- has been collected after finalization of 18 nos of conversation cases by the end of March-2013.

It is intimated that the target is fixed by the District administration tentatively. However the actual collection is Rs 3,45,055/- ( Rs 59,962 + 2,85,093/- ) up to the end of March-2013/.

Encroachment Cases:-

It was observed, during the inspection of the ADM, that 69 nos of rural encroachment cases and 1970 Urban Encroachment cases were pending. It was instructed to the Tahasildar, Khondmal to take steps for settlement of un- objectionable encroachment cases with eligible encroachers and evict the encroachers from the objectionable land.

It is now observed that all the pending urban encroachment cases are including 32 Nos of religious constructions objectionable by nature. Hence no case has been finalized.

Notices have already been issued but no eviction has been made due to various reasons.

Out of 69 rural encroachment cases ,37 nos are religious structures. Rest 12 nos of cases are of house sites. The notices have been issued for eviction of the encroachers. The Tahasildar is instructed to take immediate steps for eviction of the same.

O.P.D.R:-

It was observed during the inspection of the Additional District Magsitreate concerned that 351 nos of cases were brought forward from the previous year to the year 2012. Out of which 101 cases have been disposed off till November,2012. The Tahasildar was instructed to look into the matter, reconcile the cases, issue revised MPR onwards and report compliance.

It is observed that 363 nos. of OPDR cases are pending by 31.03.2015, including 244 pending cases of 2012. Out of which 208 nos. of cases have been disposed off and rest 155 nos. of cases are pending for disposal. The Tahasildar was instructed to take steps for disposal of the pending cases.

Register No 10 A ( Register of R.R. Books received by Tahasildar)

It was observed by the ADM concerned that total 446 nos of R.R Books including 46 nos those were brought forward from previous year were pending. Out of which 235 nos of R.R Books were issued leaving a balance of 211 Books. But as 250 nos of R. R Books were physically available with the Head Clerk, the Tahasildar was instructed to verify the stock position till the date of inspection i.e 29.12.2012 and report compliance.

It is now ascertained from the register of R.R Books that the Tahasildar has verified the Book and signed on 29.09.2013 .Hence complied to.

Sairat:- During the inspection of the ADM on 29.12.2012 it was observed that out of offset price of Rs 1,60,450/- towards the auction of 3 nos of Sairat cases available in this Tahasil, Rs 40,115/- was collected. The Tahasildar was instructed to collect the balance offset-price by 31.12.2012 positively and report compliance.

It is now observed that total no of offset price i.e 1,60,450 has already been collected from 3 nos of auctioned resources and deposited in proper account.

Grievance :-

It was observed by the ADM during his inspection on 29.12.2012 that out of 37 Grievance received, 19 were disposed off leaving a balance of 18 nos of Grievance petitions.

The Tahasildar was instructed to dispose off the balance 18 Grievance petitions.

It is now observed that grievance petitions have not yet been disposed off due to non receipt of the reports from the Revenue Inspectors concerned.

Board of Revenue, Odisha, Cuttack has conducted Audit on this Tahasil and released Audit Reports as at Annexure-A.

2. Inspection Report of A.G Odisha, Bhubaneswar

The A.G.Odisha ,Bhubaneswar has conducted Audit on this Tahasil and released Inspection Reports which is at Annexure-B

3. Displinary Proceeding Cases : During the inspection of Sri Rabi Narayan Mishra, OAS-1, ADM, Kandhamal, Phulbani no disciplinary proceeding cases was pending .

4.Pension Cases

One pension was pending in the name of Golapi Nayk, sweeper the night watcher in this confection has not been sanctioned due to non submission of pension paper.

5.Misc. appropriation of Govt. Money during the year 2014-15

No Misc. appropriation of Govt. Money has been detected in Audit.

6.Court of Tahasildars, Khondmals, Phulbani

There were 2400 cases are pending in the court of the Tahasildar, Khondmals, Phulbani as on 01.01.2014. 1072 Nos of cases have been instituted during the year 2014 and the total 3472 no of cases for disposal. Out of which 753 cases were disposed off during the year-2014 leaving a balance of 2719.

7. Certificate Cases

As ascertained from Register there are 155 certificate cases pending till March-2015 involving cash of Rs 3,55,391/-.

8. Record Room

In this regard 19 No of Copy applications have been disposed off out of 127, leaving a balance of 108 till 23.047.2015 is pending. 9. Nizarat:-

10. Advance Position

As regards advance position there is an amount of Rs 500.00 in permanent Advance Cash.

11. Collection of Revenue

The total collection of Revenue for the current financial year 2014-15 is of Rs 2,89,40,487.90 P as against current Demand of Rs 2,01,94,825.50 P. D.C.B

12. Grievance Cells

As ascertained from the Register of Grievance cell 18 Nos of Grievance petition are pending till date due to wanting of R.I inquiry report.

13. R.T.I Information

The following staff are declared as officers under Rule-3 of Odisha RTI Act-2005. Sri Subash Chandr Kanhar. He is declared as Public Information Officer of the office of the Tahasildar,Khondmals. Sri Manoranjan Sahu is declared as Assistant Public Information Officer of this office and Sri Priya Ranajn Prusty, OAS- I, Tahasildar, Khondmals, Phulbani is Ist Apple ate Authority, According to rule 4 (1 ) of Odisha RTI Act- 2005. A citizen desires of any information may apply for in Form No- A to the PIO with the required fee in shape of Treasury Challan, IPO or Cash as specified in the scheduled under the appropriate Head of Amount.

14. Mutation Case

As per Notification No 31920 / R & D.M Deptt. BBSR Dated 28.07.2008Since the settlement operation is going on from-2008 prior to 2008 no mutation cases was pending in this Tahasil.

15. Stock of Revenue Receipt Books Stock of Revenue Receipt book Register is maintained for issuing to the concerned R.Is for collection of Revenue. During the year 2014-15, 335 Nos of Revenue Receipt books have been issued leaving a balance of 165 Nos are in hand.

16. Encroachment Cases Urban / Rural

As on March-2015 total 434 nos of encroachment cases ( Rural ) are instituted out of which 385 have been disposed off and leaving balance of 49 cases are pending for disposal due to wanting of inquiry report from concerned R.Is. With regard to Encroachment cases (Urban) 1970 Nos of cases are pending till date.

17. Lease Cases in the Court of the Tahasildar

As on 23.04.2015 only 5 nos. of lease cases are pending out of 50 cases in the Court of Tahasildar.

18. Alienation Cases in the Court of Tahasildar

With regard to alienation cases in the Court of Tahasildar, Khondmals, Phulbani. 4 nos of cases are instituted during 2015 and previous balance cases was 36 which comes to a total of 40 nos of cases for disposal. Only 8 (eight ) cases have been disposed off during period from the year 2012 to 2015.

19. Conversion of land under OLR Act. 8 (A)

Out of 100 nos of cases of 8 (A) conversion of land under OLR 8 (A) Act. 5 (five) cases has been settled during the year 2015 remaining 95 cases are pending for disposal which relates to previous year.

20. Be-Bandobast

With regard to Be-Bandobast cases it is observed that no Be-Bandobast case is initiated in this Tahasil.

CONCLUSION

During Inspection, it is observed that the present Tahasildar of Khondmals Tahasil is a dynamic and cooperative Government Officer who worked hard and help the advance party for submission and production of information for smooth preparation Draft Inspection Note . The Staff of this Office are also dutiful and sincere by nature who extended their full cooperation under supervision of the Tahasildar for preparation of the draft inspection report .However the Tahasildar is instructed to take quick action with regard to disposal of the case records etc by conducting the Court on more dates. Collection of revenue is satisfactory during his incumbency . He is desired to keep keen interest towards collection arrear revenue regularly for the interest of the Government. The function of this Tahasil is over all satisfactory.
