Palavras-chave: Comunicação, Cinema, Circulação Informal, Internet, BitTorrent, Pirataria, Cinefilia. vii Abstract This research analyses the phenomenon of informal film circulation on Internet, building a systematic orientation within the vast universe of distribution networks. Piracy is a cultural activity that corresponds to a range of collective interests of global dimension and relates to regulatory policies, critical intellectual property, civil disobedience, market, technological innovations participatory culture and informal economies. This study explores the relations between BitTorrent networks, cinema distribution and ciber- cinephilia, pointing to networks with hybrid nature, where informal and formal media converge, technical elements combine, niches and global cultures dialogue, moral sensibilities-relativize, speeches, daily practices and political actions are developed and where markets are transformed. We have shown that, within the space of unauthorized circulation, specialized distribution hubs have their own symbolic dimension, which manifest particular senses about cinema, under the influence of a movie buff and multicultural imaginary. It has been accepted for inclusion in Journal of Law and Policy by an authorized editor of BrooklynWorks. THE COPYRIGHT ALERT SYSTEM: A POTENTIAL UNFAIR BURDEN ON SMALL BUSINESS OWNERS Rachel A. Schneidman* The Copyright Alert System (CAS) confers on Internet Service Pro- vider’s (ISPs) the power to use “mitigating measures” against alleged copyright infringers in order to discourage piracy. This power is a result of a voluntary agreement between the ISPs, the Motion Picture Associa- tion of America, and the Recording Industry Association of America. Alt- hough the effectiveness of the CAS and the privacy concerns it raises have been analyzed in academic literature, the possible encumbrance of the CAS on small business owners has not been sufficiently considered. This Note argues that while the CAS may be a valuable tool in im- peding online piracy, it has the potential to unfairly burden small busi- ness owners. Specifically, this Note asserts that the CAS’s scope should be expanded to include all broadband users, including residential and business users of every size.

  • FAQ's on the Center for Copyright Information and Copyright Alert
FAQ’s on The Center for Copyright Information And Copyright Alert System 1. How significant is online content theft? • Content theft is estimated to cost the U.S. economy $58 billion, 373,000 American jobs and $16 billion in lost employee earnings every year, and to cost federal, state and local governments $2.6 billion each year in lost tax revenue. However, data suggests1 that most users (up to 70%) would stop content theft once alerted that it is occurring, that it is illegal and that there are consequences associated with continuing to engage in it. A new educational center and system of alerts – similar to credit card fraud alerts – will help address this problem. The alerts will let subscribers know when their accounts have been identified for possible content theft, advise subscribers of the serious consequences associated with it, and encourage them to stop it from occurring again. 2. What is the Center for Copyright Information? • The Center for Copyright Information (“CCI”) will focus on educating subscribers about the importance of copyright protection and lawful ways to obtain movies and music online. The Center will also help to develop and confirm “best-practices” for a new system of progressive Copyright Alerts, similar to credit card fraud alerts, which will alert subscribers when potential content theft is identified on their Internet accounts. The Center is being established jointly by the film, music, and television industries in partnership with Internet Service Providers (ISPs) and will benefit from guidance by consumer advocates and technical experts serving on its advisory committee or providing other expert services.

  • Operation D-Elite Results in Jail Time for Bittorrent Admin by Jessie B
Operation D-Elite Results in Jail Time for BitTorrent Admin By Jessie B. Sweetland Daniel Dove, an administrator of EliteTorrent.org, a peer-to-peer (P2P) BitTorrent site was convicted on July 28, 2008 of one count each of conspiracy and copyright infringement for his involvement with the site. On September 9, 2008 Dove was sentenced to a term of 18 months of incarceration and a $20,000 fine. The FBI and the U.S. Immigration and Customs Enforcement (ICE) shut the site down on May 25, 2005 as part of Operation D-Elite. Agents of the FBI and ICE targeted EliteTorrent primarily for its illegal distribution of copyrighted movies. The Department of Justice reported that the site had a copy of Star Wars Episode III: Revenge of the Sith available for download six hours before it was shown in theatres. Users downloaded the movie 10,000 times within the following 24 hours. At its peak the site had over 125,000 users that downloaded approximately 700 movie titles over 1.1 million times. Several other BitTorrent sites have shut down in recent years, including LokiTorrent and SuprNova.org due to threats of legal action or a legal shut down. Shutting down BitTorrent sites does little to deter users of P2P networks. As quickly as one site shuts down users move to other sites, many of which are hosted outside of the United State and therefore are harder for the United States government to control. Dove’s conviction follows the convictions of several other administrators’ for the P2P network, including Grant Stanley and Scott McCausland who each received five months incarceration, followed by five months home confinement and a $3,000 fine.

Cohen certifies that this is the approved version of the following dissertation: Content Control: The Motion Picture Association of America’s Patrolling of Internet Piracy in America, 1996-2008 Chairperson: Tamara Falicov Date approved: Abstract This historical and political economic investigation aims to illustrate the ways in which the Motion Picture Association of America radically revised their methods of patrolling and fighting film piracy from 1996-2008. Overall, entertainment companies discovered the World Wide Web to be a powerful distribution outlet for cultural works, but were suspicious that the Internet was a Wild West frontier requiring regulation. The entertainment industry’s guiding belief in regulation and strong protection were prompted by convictions that once the copyright industries lose control, companies quickly submerge like floundering ships. Guided by fears regarding film piracy, the MPAA instituted a sophisticated and seemingly impenetrable “trusted system” to secure its cultural products online by crafting relationships and interlinking the technological, legal, institutional, and rhetorical in order to carefully direct consumer activity according to particular agendas. The system created a scenario in which legislators and courts of law consented to play a supportive role with privately organized arrangements professing to serve the public interest, but the arrangements were not designed for those ends.

  • Movie Tags & Meaning of It
Movie Tags & meaning of it Original Sources CAM - A cam is a theater rip usually done with a digital video camera. A mini tripod is sometimes used, but a lot of the time this wont be possible, so the camera make shake. Also seating placement isn't always idle, and it might be filmed from an angle. If cropped properly, this is hard to tell unless there's text on the screen, but a lot of times these are left with triangular borders on the top and bottom of the screen. Sound is taken from the onboard microphone of the camera, and especially in comedies, laughter can often be heard during the film. Due to these factors picture and sound quality are usually quite poor, but sometimes we're lucky, and the theater will be fairly empty and a fairly clear signal will be heard. TELESYNC (TS) - A telesync is the same spec as a CAM except it uses an external audio source (most likely an audio jack in the chair for hard of hearing people). A direct audio source does not ensure a good quality audio source, as a lot of background noise can interfere. A lot of the times a telesync is filmed in an empty cinema or from the projection booth with a professional camera, giving a better picture quality. Quality ranges drastically, check the sample before downloading the full release. A high percentage of Telesyncs are CAMs that have been mislabeled. TELECINE (TC) - A telecine machine copies the film digitally from the reels. Sound and picture should be very good, but due to the equipment involved and cost telecines are fairly uncommon.
