1.1 DETERMINATION MADE BY THE AUGMENTED ELECTORAL COMMISSION FOR NEW SOUTH WALES

Pursuant to section 73 of the Commonwealth Electoral Act 1918, the augmented Electoral Commission for New South Wales hereby determines that the names and boundaries of the Electoral Divisions into which New South Wales is to be distributed are as shown on the maps certified by the members of the augmented Electoral Commission for New South Wales and lodged in file number 06/1459 at the National Office of the Australian Electoral Commission in Canberra. These maps are numbered in the following sequence:

The augmented Electoral Commission for New South Wales reached this determination on the basis that it determined the boundaries of the electoral divisions in New South Wales, and the names of those divisions, should be as proposed by the Redistribution Committee for New South Wales in its Report published on 30 June 2006, subject to the following changes:

(i) the boundaries of Parkes, Calare, Farrer and Riverina have been revised so as to reduce the area of Parkes and so as to reflect communities of interest between Broken Hill, on the one hand, and the Unincorporated Far West of New South Wales and Menindee on the other; and between areas in the Riverina including the Murrumbidgee local government area;

(ii) the boundaries of Paterson, Newcastle and Hunter have been revised to allow the return of Raymond Terrace to Paterson;

(iii) the boundaries of Parramatta have been revised to bring more of the central business district and historic centre of the into that division;

(iv) the boundaries of the divisions of Sydney, Wentworth and Kingsford Smith have been revised in recognition of community of interest ties within those divisions;

(v) the boundaries of Parramatta and Mitchell, of Macarthur and Hume, of Grayndler and Lowe, of Cowper and Page, of Cowper and Lyne, and of New England and Parkes, have been revised to provide better definition;

(vi) other minor changes shown on the abovementioned maps have been made to the boundaries of Fowler and Werriwa, of Fowler and Prospect, and of Fowler and Macquarie.

1.2 REASONS FOR THE DETERMINATION MADE BY THE AUGMENTED ELECTORAL COMMISSION FOR NEW SOUTH WALES

Representation of New South Wales in the House of Representatives 1. On 17 November 2005 the Electoral Commissioner made a determination of State and Territory entitlements to representation under section 48(1) of the Commonwealth Electoral Act 1918 (the Act). By virtue of the determination, New South Wales is entitled to 49 members of the House of Representatives, one less than its previous entitlement.

Direction for a redistribution of New South Wales electoral divisions 2. Section 59(2) of the Act provides that a redistribution shall be directed whenever a determination under section 48(1) of the Act results in an alteration of the number of members of the House of Representatives to be chosen in a State. Consequently, on 2 December 2005, the Australian Electoral Commission (the Electoral Commission) directed by notice published in the Gazette (S226 Friday 2 December 2005) that a redistribution was to commence in New South Wales.

3. At the end of 2 December 2005, the day determined by the Electoral Commission for the redistribution to begin, the number of electors enrolled for the State was 4 308 595.

4. Redistribution 2006 Statistics which show the electoral enrolment figures as at 2 December 2005 were made available on compact disc and on the Australian Electoral Commission website. In addition, copies were printed upon request at all New South Wales offices of the Australian Electoral Commission. The statistics were given at the following levels: Census Collector District (CCD) Statistical Local Area (SLA) Electoral Division State

Quota 5. Under Section 65(2) of the Act, the Electoral Commissioner determined that the quota of electors for New South Wales was 87 931 ( 4 308 595 divided by 49 members). The permitted range of the margin of allowance of 10% below and above the quota would be 79 138 to 96 724. The Act does not permit any greater variation from the quota to be provided for in a redistribution.

Appointment of the Redistribution Committee for New South Wales 6. The next step in the process leading to a redistribution in New South Wales was the appointment under s.60 of the Act of a Redistribution Committee for the State. On 17 March 2006, this committee was appointed, its members being: Electoral Commissioner Mr Ian Campbell Australian Electoral Officer Mr David Farrell for New South Wales Surveyor-General of New South Wales Mr Warwick Watkins Auditor-General of New South Wales Mr Bob Sendt

Redistribution Committee’s Proposed Redistribution 7. All preconditions having been met, the Redistribution Committee (the Committee) made a proposed redistribution of New South Wales under s.66 of the Act, stating its reasons in writing; caused the notice required by s.68(1)(c) of the Act to be published in the Gazette; and took the other steps required by s.68.

Objections and Comments 8. A total of 1 989 Objections (although a substantial proportion of these were in the same or a similar form) was received, and as well 156 Comments on Objections were received.

Augmented Electoral Commission 9. By s.70(1) of the Act there is established for the purposes of any such redistribution an augmented Electoral Commission for the relevant State or Territory. By virtue of s.70(2) the members of the augmented Electoral Commission for New South Wales (augmented Commission) are the Chairperson of the Electoral Commission (Hon James Burchett QC); the member of the Electoral Commission other than the Chairperson and the Electoral Commissioner (Mr Dennis Trewin); and the persons previously mentioned who constituted the Committee.

Public Inquiry 10. The augmented Commission held a public inquiry into the Objections in Sydney on 24 August 2006 and in Narrabri on 25 August 2006. Arguments were presented on these occasions by 24 persons (at Sydney), and a further 38 persons (at Narrabri), and have been carefully considered by the augmented Commission, together with all the objections and comments. For further details, see Appendices.

The Statutory Mandate of the augmented Electoral Commission 11. By s.73 of the Act, it is the augmented Electoral Commission for New South Wales which must determine, by notice published in the Gazette, the names and boundaries of the electoral divisions into which the State is to be distributed. But that task must be performed in accordance with the requirements of s.73(4) and (4A), which provide: “(4) In making the determination, the augmented Electoral Commission: (a) shall, as far as practicable, endeavour to ensure that the number of electors enrolled in each Electoral Division in the State or Territory will not, at the projection time determined under section 63A, be less than 96.5% or more than 103.5% of the average divisional enrolment of that State or Territory at that time; and (b) subject to paragraph (a), shall give due consideration, in relation to each Electoral Division, to: (i) community of interests within the Electoral Division, including economic, social and regional interests; (ii) means of communication and travel within the Electoral Division; (iv) the physical features and area of the Electoral Division; and (v) the boundaries of existing Divisions in the State or Territory; and subject thereto the quota of electors for the State or Territory shall be the basis for the redistribution, and the augmented Electoral Commission may adopt a margin of allowance, to be used whenever necessary, but in no case shall the quota be departed from to a greater extent than one-tenth more or one-tenth less. (4A) When applying subsection (4), the augmented Electoral Commission must treat the matter in subparagraph (4)(b)(v) as subordinate to the matters in subparagraphs (4)(b)(i), (ii) and (iv).” 12. These statutory requirements are expressed in an hierarchical order which puts, “as far as practicable”, the “endeavour to ensure” a division will fall within the projected enrolment range first; the considerations of “community of interests within [a division] including economic, social and regional interests”, “means of communication and travel within [a division]”, and “the physical features and area of [a division]” second; and “the boundaries of existing Divisions” third – while stating that, subject to these matters, “the quota of electors for the State … shall be the basis for the redistribution” and that “the augmented Electoral Commission may adopt a margin of allowance” not departing from the quota further than by one-tenth more or less.

13. The purpose of para (a) is suggested by the history of the paragraph, which has undergone some transformation by successive amendments. Initially, provision was made by the Commonwealth Electoral Legislation Amendment Act 1983 for what was later described (in section 1.6 of the Report of the Joint Standing Committee on Electoral Matters on The Effectiveness and Appropriateness of the Redistribution Provisions of Parts III and IV of the Commonwealth Electoral Act 1918 – hereafter referred to as “the JSCEM Report”) as “a requirement [to] aim for equal numbers of electors in each of a State’s divisions (electorates) three-and-a-half years after a redistribution”. But, as the JSCEM Report noted (at section 4.3), by 1984 “it was observed that the three-and-a-half year rule had in some areas forced the adoption, on purely numerical grounds, of boundaries which took little account of perceived community of interest”, and the rule “was therefore relaxed [by an amendment of the Act in 1987 allowing a measure of tolerance] to plus or minus two percent from average enrolment” (emphasis added). The JSCEM Report goes on (at section 4.6) to state that the “most contentious issue” at its inquiry in 1995 “was whether the mid-point tolerance [at the date of the Report the required projection was to be made at what was considered a “mid-point” in the redistribution cycle] of two percent does, in fact, provide Redistribution Committees with the flexibility to give ‘due consideration’ to community of interest and the other qualitative criteria”. The JSCEM Report (at section 4.11) concluded, upon this issue, that “based on the evidence received the numerical criteria do not allow ‘due consideration’, in the words of the Act, to be given to the qualitative factors. Rather, the political parties and others attempting to frame electoral boundaries essentially find themselves engaged in a mathematical modelling exercise. In order to relax the enrolment requirements to that extent necessary to allow a realistic degree of flexibility the Committee recommends … that subsections 66(3)(a) and 73(4)(a) of the Electoral Act be amended, so as to extend the variation from average divisional enrolment allowed three-and-half years after a redistribution from two to 3.5 percent.” Later (in section 4.47), the JSCEM Report refers to its recommended amendment as one that “would maintain substantial restrictions on malapportionment [and] would allow other legitimate policy objectives to be more effectively met”. 14. It was pursuant to this recommendation that the amendment was made by which paragraph (a) came to take its present form. The terms of the recommendation, and the discussion which preceded it, make clear the purpose of paragraph (a), as it now stands, and how it was intended to interact with what the JSCEM report calls “other legitimate policy objectives” set out in the various sub-paragraphs of paragraph (b), to which also “due consideration” must be given. As the augmented Commission has so understood the Act, and has considered the objections, comments and arguments, and the proposed redistribution, on this basis, some contentions that were presented, particularly on behalf of The Nationals, suggesting the Committee had understood paragraph (a) in a different sense, need not be discussed here. The augmented Commission’s own examination of the proposed redistribution, and its conclusions, are based, so far as paragraph (a) is concerned, on the view of the provision that emerges from the discussion in the JSCEM Report.

Consideration of the Redistribution Committee’s Proposal, and of Objections, Comments, and Arguments presented at the Inquiry in Sydney and Narrabri 15. Whenever a State loses entitlement to a division, there is likely to be controversy over the question of the particular division to be abolished. The identification of that division was the central problem faced by the Committee and its solution was the issue out of which the great majority of the unusual number of objections arose. For the augmented Commission also the central problem remained the selection of the division that would have to be abolished to reduce the State’s number of divisions to 49 as required by the operation of the Act in the circumstances. But the augmented Commission considered the objections provided no convincing challenge to the logic applied by the Committee: the north-west region has suffered a decline in enrolment share relative to many other parts of the State, which must profoundly affect the drawing of divisional boundaries. Given this relative decline in enrolment share (to which increases in some country divisions on the coast of New South Wales are not relevant, much less an answer), the augmented Commission concluded that the abolition of the division of Gwydir, as proposed by the Committee, was the best solution. 16. Although, as has been explained, the augmented Commission has a small degree of flexibility in respect of numbers to allow it to reflect what have been called the qualitative factors such as the area of a division and the means of communication and travel within it, as well as the question of community of interests within it, the elasticity allowed would not enable the retention of Gwydir, having regard to the projected numbers, without enmeshing the process of redistribution in more serious difficulties affecting a number of other divisions. 17. Because of the number and force of objections relating to the abolition of Gwydir and the consequent enlargement of Parkes, as proposed by the Committee, the augmented Commission decided to hold the public inquiry into objections in Narrabri as well as in Sydney. Many of those presenting submissions at Narrabri, while acknowledging, expressly or implicitly, the north-west region’s relative decline in enrolment share, asserted that this decline was caused by an unprecedentedly prolonged drought, and that recovery in enrolment numbers, as well as economically, would come with the rain. At the same time, it was recognised that any significant uplift in population would not occur overnight. The Act requires the augmented Commission to focus on the projection date, and at that date the picture suggested by the statistics is not one of an arrest to the present relative decline. It is not open to the augmented Commission, bound as it is by the statutory criterion in respect of projected enrolments, to retain all the existing divisions in the west of the State, unless by boundary adjustments which would themselves involve as many problems for the representation of country people as were raised in the objections. Leaving the position as it is in this part of the State, though desired by many of the objectors, is simply not an available option. 18. The greater weight of the objections to the Committee’s abolition of Gwydir and very great enlargement of Parkes rested upon an argument of a different kind. This was that the new Parkes would be unmanageable, not merely because of its size, but also because of the scattered nature of the towns and small settlements, widely separated over a vast area, which it would encompass. The consequent loss of the contact between member and constituent, which lies at the heart of the concept of

representation, was urged by many at the public hearing at Narrabri with passion and eloquence. Of course it was recognised that there are even larger divisions in some other States, but it was suggested, first, that the necessity which justified them did not exist here, and secondly, that at least in the cases that were instanced, such as the division of Grey in South Australia, there was a greater concentration of population in a smaller number of centres, which palliated the problem. 19. While the augmented Commission was not persuaded the Committee’s choice to abolish Gwydir was other than appropriate, and determined to affirm it, the augmented Commission accepted there were good reasons, relating to physical features and area, communities of interest and means of communications and travel, to reduce the area of the proposed Parkes, if that was possible. It also considered that it should seek to reflect the important communities of interest linking the Unincorporated Far West and Menindee with Broken Hill, which the Committee had proposed to bring into the division of Farrer. The augmented Commission found itself able to achieve these aims by revising the boundaries of the division of Parkes so as to draw enrolment numbers in the south from the division of Calare as previously proposed, while yielding areas in the west to the proposed divisions of Calare and Farrer. Through a balancing adjustment to Farrer, the augmented Commission has also been able to meet a community of interest objection in relation to the Murrumbidgee Local Government Area by transferring it from Farrer, as proposed by the Committee, to Riverina. By this means, the total area of the proposed Parkes is reduced from 376 206 square kilometres to 107 108 square kilometres, and, although Calare and Farrer are enlarged (to 237 325 and 199 925 square kilometres respectively), neither approaches the area previously proposed for Parkes. The new boundaries are shown on the maps annexed to this report. 20. A number of objections were raised, on the grounds of communities of interest, economic social and regional, and also on the ground of communications and travel, to the Committee’s proposal to remove Raymond Terrace and Williamtown from Paterson into Newcastle. This proposal, of course, also raised the rather weaker ground relating to boundaries of existing divisions. The Mayor of Port Stephens, Mr Craig Bauman, speaking at the public inquiry in Sydney with the unanimous support, he said, of his councillors and also with the support of the nearby Councils of Great Lakes and Dungog, put the point strongly when he asserted that Raymond Terrace was “the regional, commercial, transport and social hub of the Port Stephens local government area and Paterson”, colourfully rejecting any similar links between Raymond Terrace and Newcastle by claiming they amounted to no more than “we are adjoining local government areas and we both happen to support the ‘Knights’”! 21. The augmented Commission accepted there were strong grounds to restore Raymond Terrace, in particular, to Paterson, if the numbers permitted this course. It decided they would not allow a reversal of the Committee’s decision with respect to Williamtown, but could accommodate the reinclusion of Raymond Terrace in Paterson, if compensating adjustments (including a small correction in the vicinity of Metford Road) were made at the boundaries of the divisions of Paterson, Newcastle and Hunter. Having regard to the strength of the argument relating to Raymond Terrace, it was determined that these changes were desirable and should be made.

22. The Committee proposed significant changes to the boundaries of the . Macquarie, as it stood before the redistribution, was in a part of the State which included seven divisions the projected enrolment of each of which showed a percentage growth above the average for the State. The State average being 6.34%, the seven, with the percentage applicable to each shown in brackets after its name, were: Calare (6.65%) Hume (8.53%) Dobell (9.65%) Hunter (9.66%) Greenway (11.35%) Mitchell (12.66%) Macarthur (14.81%). Of these, Macarthur’s figure was the highest in the State, Mitchell’s the third highest and Greenway’s the fifth highest. Obviously, in this region, there had to be some redrawing of boundaries, the carrying out of which would necessarily involve adjustments in respect of one division requiring adjustments in respect of others. In the process of redrawing boundaries, in order to reflect both the particular demographic changes affecting this region and also the general relative loss of projected enrolment growth in most of the vast area to the west, the Committee recognised that the traditional link between outer suburban and rural areas provided by the Southern Highlands would not be sufficient. It, therefore, identified the Blue Mountains, with their rail and highway connections to the west, and the Hunter region, with its similar rail and highway links to the north-west, as additional pathways for needed movements in divisional boundaries at the interface where rural and outer suburban communities meet and tend to merge. 23. On this basis, the Committee proposed to extend the division of Macquarie into the existing division of Calare to the west to include almost all of the Lithgow local government area (LGA), the Oberon LGA and the greater part of the Bathurst LGA including the city of Bathurst. At the same time, it proposed to transfer most of the Hawkesbury LGA, to the east, from the division of Macquarie to the division of Greenway, and the lower Blue Mountains areas of Lapstone and Glenbrook from the division of Macquarie to the . These changes were, of course, meshed with other changes to the boundaries of Calare, Greenway and Lindsay, and ripple effects extended still further. 24. A considerable number of objections were raised in respect of the proposed division of Macquarie. These embraced both the expansion of the division to include Lithgow, Oberon and Bathurst, and the loss of the Hawkesbury area. It was said there were strong communities of interest, as well as historic ties going back to Governor Macquarie (which have given rise to a contemporary community of interest of a special kind), between the Hawkesbury and the Blue Mountains, while Bathurst in particular, had few links with the Blue Mountains. As to the former point, whenever the imperative of projected enrolment numbers requires a redrawing of electoral boundaries, it is likely some longstanding associations within a particular division will have to be severed. Especially in a growing country such as Australia, a demographic picture will always be apt to be dynamic rather than static. Furthermore,

although the Hawkesbury shares a number of characteristics with the Blue Mountains, the two areas are not the same. In a sense the latter point, as to Lithgow, Oberon and Bathurst, raises the reverse of the argument about the Hawkesbury. For there were also historic links between the Blue Mountains and Bathurst, to which the route across the Blue Mountains opened the gateway. The Committee pointed out that Bathurst was, indeed, for many years in the division of Macquarie, which was named, as Bathurst’s Macquarie River was, after Governor Macquarie. As for Lithgow and Oberon, current strong connections with the Blue Mountains, which cannot be denied, may be seen particularly in the rail and road links to Lithgow, where the CityRail service to Sydney commences; and, in the case of Oberon, via the tourism which extends across the mountains to Jenolan Caves. In both cases, residents of these towns may be involved in activities carried on in the Blue Mountains. It is noteworthy that, although the Oberon Council lodged an objection, the Lithgow Council declined an invitation to do the same. What was said to be the geophysical barrier of the mountains, of which much was made by some objectors, poses an argument that modern transport and communications are making more and more obsolete. 25. It was suggested that workers move in their employment between Bathurst, Orange and Oberon, but not between those centres and the Blue Mountains, and that Orange and Bathurst are so linked as to render their severance by the inclusion of Bathurst in Macquarie undesirable. But in fact, Census statistics show that fewer people (464) live in one of the cities of Bathurst and Orange, while working in the other, than live in one of Bathurst and Lithgow, while working in the other (474), and although Oberon is much smaller than Orange, a similar number (408) live in one of Bathurst and Oberon, while working in the other. Furthermore, the existence of strong transport connections argues for a growing closure between Bathurst and the mountains. This said, the Committee’s decision regarding Bathurst, Oberon and Lithgow was really required by the flow-on effects of the abolition of the division of Gwydir and the absorption of its projected enrolment into other divisions. 26. An aspect of the community of interest argument, as well as an argument based on the means of communication criterion, was the contention that television and radio broadcasting marked a clear division between Bathurst and the Blue Mountains. It is certainly true the services are different, but radio and television do not alter the projected enrolment figures or the other considerations to which attention has been drawn. Were the augmented Commission to reverse the Committee’s proposal in this respect, it would be necessary to make compensatory adjustments which would bring their own similar, or even greater, problems. 27. Having regard to all these considerations, the augmented Commission concluded that the objections to the changes proposed to the division of Macquarie should not be acceded to, and that the Committee’s proposal should be affirmed. 28. A number of objections related to the Committee’s changes to the boundaries of the division of Parramatta, which had the effect of excluding much of the Central Business District of the City of Parramatta. The augmented Commission found itself able, without needing to make compensating adjustments elsewhere, to vary the boundary between Parramatta and Reid so as to bring back into the division of Parramatta, as proposed by it, an important part of the central business district and

historic centre of Parramatta, and it decided to do so. These changes are also shown on the maps annexed to this report. The alterations thereby made to the proposed boundaries of Parramatta had only a small demographic effect, but reflected an important issue of regional community of interest in so far as electors in the division of Parramatta have obvious links with the central business district and the historic centre of the City of Parramatta. 29. A number of other changes were suggested by the , the Liberal Party of Australia and other objectors relating to the divisions in the vicinity of Parramatta, and in particular the divisions of Reid, Greenway, Mitchell and Bennelong. The augmented Commission considered that these objections all failed, either because it was satisfied the Committee’s proposal was preferable as better meeting the requirements set out in the Act, particularly that relating to communities of interest, or because the numbers, if the objections were allowed, would require compensatory adjustments to be made elsewhere with undesirable consequences. However, some small adjustments have been made by the augmented Commission for better boundary definition between the divisions of Parramatta and Mitchell, in the vicinity of Elm Place, Loyalty Road and Darling Mills Creek, North Rocks, and of Pye Avenue, Caprera Road and Windermere Avenue, Northmead. 30. Objections were raised, on community of interest grounds, to changes proposed by the Committee to the boundaries between the divisions of Kingsford Smith and Sydney, Sydney and Wentworth, and Wentworth and Kingsford Smith. In order to come within the permitted range within which the augmented Commission must endeavour to ensure, as far as practicable, the divisional enrolment of each division will fall at the projection time, Sydney needed to shed electors, whereas Wentworth and Kingsford Smith both needed to gain them. The augmented Commission concluded that the existing boundary of Kingsford Smith at Gardeners Road should be moved to the north, and the southern boundary of Wentworth, as proposed by the Committee, should be moved somewhat to the south. Both of these measures accorded, in its opinion, with communities of interest, in the case of Gardeners Road between electors to its south and its north, and in the case of the southern boundary of Wentworth between electors and institutions to the north of the new boundary. There were no adverse consequences, and the projected numbers for Kingsford Smith were brought within the permitted tolerance. Some further numerical adjustment between Wentworth and Sydney remained necessary, but not so great an adjustment as had previously been necessary. Both for that reason and on community of interest grounds, the augmented Commission made some amendment towards the east of part of the western boundary of Wentworth as proposed by the Committee. 31. The augmented Commission also made an adjustment to the south- western boundary of the division of Macarthur abutting the division of Hume in the Picton area; an adjustment to the boundary between the divisions of Grayndler and Lowe in the suburb of Croydon, utilising as part of that boundary Croydon Road and Railway Street; an adjustment to the boundary between the divisions of Cowper and Page in the Middle Creek area to follow Middle Creek and Walters Creek; an adjustment to the boundary between the divisions of Cowper and Lyne in the Kalateenee State Forest area to follow Boundary Road; and an adjustment to the boundary between the divisions of New England and Parkes in the area to

follow the boundary between the shire and the . All of these changes were for better definition of boundaries and they appear on the maps annexed to this report, as do certain very slight adjustments made in the following further respects: (a) the boundary between the divisions of Fowler and Werriwa was redrawn to follow the western end of Hoxton Park Road to its junction with Fifteenth Avenue; (b) the boundary between Fowler and Macquarie was redrawn to include in Macquarie a previously detached section of a Census Collection District; (c) the boundary between Fowler and Prospect was redrawn to follow the Sydney Water Supply Channel to its junction with the Westlink M7, and then the Westlink M7 to Elizabeth Drive. 32. Objection was raised to the Committee’s redrawing of the boundaries of the division of Eden-Monaro, and particularly to the inclusion of an area to the west of the Snowy Mountains watershed including Tumbarumba and Tumut. It was argued that the mountains form a physical barrier, and that the two western towns have little communication or community of interest with the existing division. But the augmented Commission was satisfied the step taken by the Committee was justified by the projected enrolment numbers involved and linkages including economic and regional communities of interest, particularly in relation to the timber industry, and means of communication and travel. Accordingly, it determined to reject the objection and affirm the Committee’s decision. 33. The augmented Commission gave careful consideration to a number of other objections relating to various divisions, but in its opinion, having regard particularly to the impact of any substantial changes on other boundaries, in respect of these matters the Committee’s proposal was preferable. The objectors failed to convince the augmented Commission that the Committee did not appropriately reflect in its proposal the statutory criteria relating to communities of interest, including economic, social and regional interests, means of communication and travel, physical features and area, and boundaries of existing divisions. As regards those objections not otherwise dealt with in its reasons, the augmented Commission adopts the Committee’s application of these criteria in the boundaries it drew.

Names of Certain Divisions affected by Boundary Changes 34. In the light of the changes made to the boundaries of the divisions of Parkes, Calare and Farrer, the augmented Commission considered whether it was appropriate to retain the names, particularly, of “Parkes” and “Calare”, while abolishing the name, as well as the division, of Gwydir. Although there are guidelines which are followed “as a matter of practice” (see Joint Standing Committee on Electoral Matters Report (1995) on The Effectiveness and Appropriateness of the Redistribution Provisions of Parts III and IV of the Commonwealth Electoral Act 1918 at section 8.7), the augmented Commission retains, as the Joint Standing Committee on Electoral Matters stated in the same section, “an open discretion in the naming of divisions”. The augmented Commission gave great weight to the historical importance in New South Wales of Sir Henry Parkes, and it saw no reason to change

the name of the division of Calare simply because it was enlarged in area. It concluded that each of these names should be retained as the name of the division of Parkes and Calare respectively as delineated in its proposed redistribution of New South Wales.

Whether the augmented Electoral Commission’s Proposal is “significantly different” from the Redistribution Committee’s Proposal 35. The augmented Commission’s decision to propose to determine the boundaries and names of the divisions into which the State of New South Wales is to be distributed, by affirming the Committee’s proposal subject to the stated variations, leaves a further question outstanding under s.72(12) of the Commonwealth Electoral Act 1918. This question is whether, “in the opinion of the augmented Electoral Commission”, its proposal is “significantly different” from that of the Committee. 36. Whether the proposals are significantly different is to be decided in the light of the nature of the Committee’s proposal, to which the changes made by the augmented Commission relate. That proposal hinged on the initial decision to abolish the division of Gwydir, in the north-west of the State, on the basis that this region was suffering from a decline in enrolment share relative to many other parts of the State. The augmented Commission has accepted the basal decision, while acceding to some extent to objections concerning particular areas allocated to other divisions in the resulting realignment of boundaries. 37. Whilst some of the areas involved are large, the changes do not alter the substance of the Committee’s solution to the problem of finding the appropriate part of the State from which to delete a division. Each of the other changes made by the augmented Commission may properly be described as an adjustment to meet localised problems, or to effect some improvement to the proposed boundaries. 38. Considering all of the changes together, the augmented Commission is of the opinion that its proposal is not significantly different from the Committee’s proposal within the meaning of s.72(12) and it has so determined.

Determination made by the augmented Electoral Commission for New South Wales 39. For the foregoing reasons stated under s.74 of the Act, the augmented Commission, having considered all objections, comments and submissions, made the determination, the terms of which are set out above, by notice published in the Gazette on the 22nd day of November 2006. The augmented Commission had issued on 13 September 2006 a public announcement in compliance with section 72(10) and (12) of the Act. As a consequence of the opinion stated in para 38, there was no occasion for the augmented Commission to issue the invitation or hold the further inquiry referred to in s.72(12)(d) and (13) of the Act.

1.4 DESCRIPTION OF THE METHOD USED TO CALCULATE THE AREA OF ELECTORAL DIVISIONS

1. The area of electoral divisions in New South Wales has been calculated by aggregating the area of: all land-based Census Collection Districts (CCDs); any parts of land based CCDs; and any ponds, creeks, wetlands or marshes not already included in land-based CCDs, that are wholly contained within the divisional boundary of each electoral division.

2. Areas are spheroidal and are calculated on the Geocentric Datum of Australia (GDA94) spheroid using the Electoral Boundary Mapping System (EBMS), which is based on MapInfo Professional desktop mapping software.

1.5 GENERAL DESCRIPTION OF EACH ELECTORAL DIVISION

3. The tables on the following pages set out how each Electoral Division is constituted and are arranged under Statistical Local Areas (SLAs). Each SLA comprises a number of CCDs as used in the 2001 Population Census.

4. The SLA is the most widely used unit in the presentation of Census data and collectively they cover the whole of New South Wales without gaps or overlaps. In the majority of cases, SLAs correspond to Local Government Areas (LGAs). Where a particular LGA is substantially different from the general run of LGAs in terms of size and economic significance, it may be split into a number of SLAs.

APPENDIX F GUIDELINES FOR THE NAMING OF COMMONWEALTH ELECTORAL DIVISIONS

Several Commonwealth Parliamentary committees have considered guidelines for naming Electoral Divisions. The guidelines below were affirmed by the Joint Standing Committee on Electoral Matters in 1995. The Redistribution Committee for New South Wales and the augmented Electoral Commission for New South Wales took these guidelines into account when considering the names of Electoral Divisions. It should be noted that neither the Committee nor the augmented Commission are in any way bound by them.

Naming after persons

In the main, Divisions should be named after deceased Australians who have rendered outstanding service to their country.

When new Divisions are created the names of former Prime Ministers should be considered.

Federation Divisional names

Every effort should be made to retain the names of original Federation Divisions.

Geographical names

Locality or place names should generally be avoided, but in certain areas the use of geographical features may be appropriate.

Aboriginal names

Aboriginal names should be used where appropriate and as far as possible existing Aboriginal Divisional names should be retained.

Other criteria

The names of Commonwealth Divisions should not duplicate existing State Districts. Qualifying names may be used where appropriate (e.g., Melbourne Ports, Port Adelaide). Names of Divisions should not be changed or transferred to new areas without very strong reasons. When two or more Divisions are partially combined, as far as possible the name of the new Division should be that of the old Division which had the greatest number of electors within the new boundaries. However, where the socio- demographic nature of the Division in question has changed significantly, this should override the numerical formula.
