A BILL

TO

Amend the Town and Country Planning Act 1990 to enable local planning authorities to use sums received under section 106 of the Act for the building and improvement of housing; and for connected purposes.

E IT ENACTED by the Queen’s most Excellent Majesty, by and with the advice and consent of the Lords Spiritual and Temporal, and Commons, in this present BParliament assembled, and by the authority of the same, as follows:—

1 Use of sums paid to a local planning authority (1) The Town and Country Planning Act 1990 is amended as follows. (2) After section 106(2) insert— “(2A) Without prejudice to the generality of section 106(1)(d), any payment received under a planning obligation may be used by the local planning 5 authority for the purpose of building, maintaining or improving residential premises. (2B) In subsection (2A) “residential premises” shall have the same meaning as in the Housing Act 2004.”

2 Short title, commencement and extent 10 (1) This Act may be cited as the Town and Country Planning Act 1990 (Amendment) Act 2010. (2) This Act comes into force at the end of a period of two months beginning with the day on which it is passed. (3) Section 1 does not apply to any planning obligation entered into under section 15 106 of the Town and Country Planning Act 1990 before this Act comes into force. (4) This Act extends to England and Wales.
