Appendix Title: Local Government Re-organisation – Judicial Review Portfolio Holders: Cllr Graham Payne, Leader Cllr Rod Eaton, Change and Integration Portfolio Holder Reporting Officer: Nicola Mathiason - Head of Legal and Democratic Services Andrew Pate - Chief Executive Key Decision: No ______________________________________________________________ Purpose • To decide whether to redirect the Council's legal efforts and resources, from a separate judicial review, to support for the Shrewsbury and Atcham and Congleton appeal. Background • On 8 August 2007 Cabinet agreed that the Council should commence legal proceedings for Judicial Review against the Secretary of State’s decision about Local Government Reorganisation in Wiltshire. The Council’s case has been ‘on hold’ until the result of the Shrewsbury and Congleton Judicial Review was known. The judgement in this case has now been delivered. The judicial review was unsuccessful. The High Court Judge held that the Secretary of State had common law powers available to her to carry out the process, that she did not have to be satisfied that a proposal met the criteria at the time of the assessment and that she had not acted irrationally. Key Issues • Advice has been taken from our Counsel (who also acts for Shrewsbury and Congleton) on whether we should now continue with our case in the light of the Shrewsbury judgement. We have been advised that unless the Shrewsbury judgement is appealed successfully we cannot effectively progress our case. The grounds of our case are similar and the arguments we would raise are much the same as Shrewsbury raised. We have been advised that we should focus on supporting an appeal by Shrewsbury and Congleton. -
What the Crown May Do
WHAT THE CROWN MAY DO 1. It is now established, at least at the level of the Court of Appeal (so that Court has recently stated)1, that, absent some prohibition, a Government minister may do anything which any individual may do. The purpose of this paper is to explain why this rule is misconceived and why it, and the conception of the “prerogative” which it necessarily assumes, should be rejected as a matter of constitutional law. 2. The suggested rule raises two substantive issues of constitutional law: (i) who ought to decide in what new activities the executive may engage, in what circumstances and under what conditions; and (ii) what is the scope for abuse that such a rule may create and should it be left without legal control. 3. As Sir William Wade once pointed out (in a passage subsequently approved by the Appellate Committee2), “The powers of public authorities are...essentially different from those of private persons. A man making his will may, subject to any rights of his dependants, dispose of his property just as he may wish. He may act out of malice or a spirit of revenge, but in law this does not affect his exercise of power. In the same way a private person has an absolute power to release a debtor, or, where the law permits, to evict a tenant, regardless of his motives. This is unfettered discretion.” If a minister may do anything that an individual may do, he may pursue any purpose which an individual may do when engaged in such activities. -

COMAN The Congleton accounts: further evidence of Elizabethan and Jacobean drama in Cheshire Last summer, while conducting my research into the influence on Elizabethan and Jacobean drama of schoolmasters and household tutors in the northwest of England - viz, Cheshire, Lancashire, Shropshire (Salop) and Westmorland (Cumbria) - I came across some evidence of dramatic activities in Congleton that I believe are as yet undocumented but are significant in several respects . Since it was a chance discovery right at the end of my stay, what is presented here is only a cursory examination of the records, not a thorough and complete study . In the Cheshire County Record Office, I had occasion to consult Robert Head's Congleton Past and Present, published in 1887 and republished presumably as a centenary tribute in 1987, and History of Congleton, edited by W .B. Stephens and published in 1970 to celebrate the 700th anniversary of the town's royal charter.' Although my immediate concern was with the history of Congleton Grammar School and any possible dramatic activity connected with it, I was struck by references to the town's notorious week-long cockfights and bearbaits, and the even more intriguing assertions that the cockpit was usually in the school and that the schoolmaster was the controller and director of the pastime, reclaiming all runaway cocks as his own rightful perquisites . Head's book gave an entry from the borough's accounts : `1601. Payd John Wagge for dressyige the schoolhouse at the great cock fyghte . ..0.0.4d'. Because the aforementioned sports and pastimes were said to have drawn all the local gentry and nobility to the schoolhouse, the schoolmaster might also have undertaken some dramatic activities ; the town could have attracted touring companies at such times . -

GENERAL DESCRIPTION OF THE AREA 1.1 Physical process level 1.1.1 Classification One of the youngest natural coastlines of England is the Holderness Coast, a 61 km long stretch of low glacial drift cliffs 3m to 35m in height. The Holderness coast stretches from Flamborough Head in the north to Spurn Head in the south. The Holderness coast mainly exists of soft glacial drift cliffs, which have been cut back up to 200 m in the last century. On the softer sediment, the crumbling cliffs are fronted by beach-mantled abrasion ramps that decline gradually to a smoothed sea floor. The Holderness coast is a macro-tidal coast, according to the scoping study the classification of the coast is: 2. Soft rock coasts High and low glacial sea cliffs 1.1.2 Geology About a million years ago the Yorkshire coastline was a line of chalk cliffs almost 32 km west of where it now is. During the Pleistocene Ice Age (18,000 years ago) deposits of glacial till (soft boulder clay) were built up against these cliffs to form the new coastline. The boulder clay consists of about 72% mud, 27% sand and 1% boulders and large Fig. -

Election results from the immediate post-reorganisation period were painstakingly collected by Alan Willis largely, although not exclusively, from local newspaper reports. From the mid- 1980s onwards the results have been obtained from each local authority by the Elections Centre. The data are stored in a database designed by Lawrence Ware and maintained by Brian Cheal and others at Plymouth University. Despite our best efforts some information remains elusive whilst we accept that some errors are likely to remain. Notice of any mistakes should be sent to [email protected]. The results sequence can be kept up to date by purchasing copies of the annual Local Elections Handbook, details of which can be obtained by contacting the email address above. Front cover: the graph shows the distribution of percentage vote shares over the period covered by the results. The lines reflect the colours traditionally used by the three main parties. The grey line is the share obtained by Independent candidates while the purple line groups together the vote shares for all other parties. Rear cover: the top graph shows the percentage share of council seats for the main parties as well as those won by Independents and other parties. The lines take account of any by- election changes (but not those resulting from elected councillors switching party allegiance) as well as the transfers of seats during the main round of local election. -

Glossary Page 13 2 BACKGROUND Congleton received its first charter in 1272, with civic government developing gradually until the ancient Borough was dissolved under the Municipal Corporations Act 1835. The reformed Congleton Urban District Council was a non-county borough, responsible for a range of local government functions within the geographical area of Congleton Town. It served as a principal authority within a two tier local government system, sharing duties with Cheshire County Council. This system continued until March 1974, when its powers transferred to the new District (Borough) of Congleton, formed in April 1974 by the merger of 5 former urban and rural authorities including Congleton BC. Both Congleton Borough Council and Cheshire County Council ceased to exist from 1st April 2009, be- ing replaced by the new Cheshire East Borough Council which serves as a unitary principal authority. Congleton Town Council is one of the largest of 108 town and parish councils within Cheshire East. It was inaugurated in 1980 to provide the local council tier of local government for the town of Congleton. It became fully operational in April 1981 and exists to serve as a vehicle of local opinion and to provide an effective link between the local residents/council tax payers and Cheshire East Council, to express local feelings and interests and to comment on all developments within the Town. -
The 'Roll Back'
1. INTRODUCTION 1.1 The purpose of this policy guidance is to provide a proactive and consistent approach within the planning system to enable the ‘roll back’ of permanent residential and agricultural dwellings/farmsteads that are at risk from coastal erosion. This policy guidance is proposed as an interim measure, to be used primarily as a development control tool, until it can be incorporated into the Council’s Local Development Framework (LDF)1. This guidance is not a statutory document and therefore does not carry the same weight as a policy contained within the LDF. 1.2 The LDF is in its preliminary stages, and will contain a number of statutory Development Plan Documents (DPDs) on specific planning topics such as housing, employment and the environment. It is intended that this policy guidance is included in the ‘Preferred Options’ version of the Housing DPD, scheduled to be published in June 2006 for public consultation. The weight attached to the policy will therefore increase throughout this process leading up to formal adoption. The full time-scale for the LDF is set out in the Council’s Local Development Scheme (LDS)2. 1.3 ‘Roll back’ is a term used to describe relocating property and infrastructure further inland from the eroding coast. The concept of ‘roll back’ stems from policy aims set out in the East Riding Integrated Coastal Zone Management Plan3, which seek to manage coastal change by promoting alternatives to hard-engineered coastal protection works. 1.4 Integrated Coastal Zone Management (ICZM) is a relatively new approach to coastal management, promoted by the European Commission as a means of involving the local community in addressing environmental, social and economic challenges that arise in coastal areas.
