The Commission has installed a telex with an automatic answering device which gives the conversion rates in a number of currencies. This service is available every day from 3.30 p.m. until 1 p.m. the following day.

Users of the service should do as follows: — call telex number Brussels 23789; — give their own telex code; — type the code 'cccc' which puts the automatic system into operation resulting in the transmission of the conversion rates of the EUA; — the transmission should not be interrupted until the end of the message, which is marked by the code 'ffff'.

COURT OF JUSTICE

Action brought on 25 May 1979 by Eisenwerk-Gesellschaft Maximilianshiitte mbH against the Commission of the European Communities (Case 83/^9)

An action against the Commission of the European Communities was brought before the Court of Justice of the European Communities on 25 May 1979 by Eisenwerk- Gesellschaft Maximilianshiitte mbH, whose registered office is in Sulzbach-Rosenberg, represented by Prof. Dr Bodo Borner of Cologne, with an address for service in Luxembourg at the Chambers of Dr Ernest Arendt, 34b Rue Philippe II.

The action is against the Commission Decision of 9 April 1979 concerning a fine imposed on Eisenwerk-Gesellschaft Maximilianshiitte mbH of Sulzbach-Rosenberg in pursuance of Articles 61 and 64 of the ECSC Treaty (K (79) 419).

The applicant claims that the Court should: 1. Annul the defendant's Decision K (79) 419 of 9 April 1979, notified on 23 April 1979; 2. Order the defendant to pay the costs.

Reference for a preliminary ruling by the Bundesfinanzhof by order of that court of 24 April 1979 in the case of Firma Richard Meyer-Uetze KG v. Hauptzollamt Bad Reichenhall (Case 84/79)

Reference has been made to the Court of Justice of the European Communities by an order of the Bundesfinanzhof (Vllth Senate) of 24 April 1979, which was received at the Court Registry on 25 May 1979, for a preliminary ruling in the case of Firma Richard Meyer-Uetze KG, Uetze, Hanover, v. Hauptzollamt Bad Reichenhall, on the following questions: 1. Must the words 'uniform free domicile price' in Article 8 (2) of Regulation (EEC) No 803/68 (i) of the Council of 27 June 196& on the valuation of goods for customs purposes be interpreted as meaning that such price must be uniform for all destinations within the customs territory of the Community ? 2. If the answer to Question 1 is in the affirmative, may the fact that uniform free domicile prices apply to only one Member State be taken into account, and if SCK how ? 3. How is the second sentence of Article 8 (2) of Regulation (EEC) No 803/68 of the Council of 27 June 1968 on the valuation of goods for customs purposes to be interpreted in relation to the requirements with regard to the evidence to be produced ?

An action against the Commission of the European Communities was brought before the Court of Justice of the European Communities on 26 May 1979 by Korf Industrie und Handel GmbH & Co. KG, whose registered office is in Baden-Baden, represented by Dr Werner Bruckhaus, Max Kreifels, Dr Hanns H. The action is against the Commission Decision of 9 April 1979 concerning a fine imposed on Korf Industrie und Handel GmbH & Co. KG, Baden-Baden, in pursuance of Articles 61 and 64 of the ECSC Treaty.

The applicant claims that the Court should:

1. Declare that the Decision of the Commission of the European Communities of 9 April 1979 regarding a fine imposed on Korf Industrie und Handel GmbH & Co. KG, Baden-Baden, under Articles 61 and 64 of the ECSC Treaty is null and void; 2. Alternatively, reduce the fine imposed on the applicant; 3. Order the defendant to pay the costs.

Annul the individual decision of the Commission of 2 May 1979 regarding the applicant company, with or without a prior declaration of the illegality of Decision 962/77/ECSC of 4 May 1977 (Official Journal of the European Communities No L114 of 5 May 1977); 3. In the alternative, reduce the fine imposed by the Commission on the applicant by the decision of 10 in proportion to the reduced amount of any sales which may be found to be irregular; 4. Reference has been made to the Court of Justice of the European Communities by an order of the Seventh Senate of the Bundesfinanzhof (Federal Finance Court) of 24 April 1979, which was received at the Court Registry on 31 May 1979, for a preliminary ruling in the case of Gebriider Bagusat KG, Possenhofen v. Hauptzollamt (Principal Customs Office) Berlin-Packhof on the following question:

Must tariff subheading 20.06 B I of the Common Customs Tariff be interpreted as meaning that it also includes fruit which has been put up in a mixture of alcohol, flavouring and water containing 12 % alcohol by weight (in the proportion of 70 % fruit, 30 % liquid) so as to preserve it during transportation in casks and which is intended for the chocolate industry ?
