CREATION OF SEPARATE WELFARE FUND

In Pursuance to PHQ order No:- PHQ/UTL/welfare/2020-290-92 Dated 20/05/2020, the below mentioned members of the committee met several times in the office chamber of AIG, personnel PHQ UT and discussed and deliberated briefly with regard to framing of new separate welfare fund Rules for of Ladakh.

During meeting the monthly Subscription / Contribution made by Police Personnel and various welfare measures adopted by Police of different states and union of the country like Delhi, Maharashtra, Telangna, Karnataka, Tamil Nadu and Jammu and were examined and studied and examined briefly.

In light of the Government SRO-937 & 938 dated 28/10/2019 explicit separate sanction strength of J&K Police (Gazetted) service and J&K Non (Gazetted) service was accorded to the Union Territory of Ladakh. In this backdrop an exercise for shifting of manpower of either UTs have already taken up at PHQ J&K.

Further, till the complete arrangements in every aspects is put in place the remittance of welfare fund contribution towards relevant heads is being maintained at PHQ J&K and also the cases for claims / assistance viz special relief cases / welfare loans / relief cases / retirement gift cases are also referred to PHQ J&K.

Now in near future Ladakh Police will be having its own rules Governing Ladakh Police welfare fund rules.

In this process a comparison / examination with regard to deduction / subscription and benefit / welfare of the Police Personnel with the available welfare schemes / deductions of J&K Police and other States / UTs was made out.

A brief comparison Chart is enclosed as Annexure “A”.

*****The total strength of J&K Police is around 90608 and their monthly subscription / contribution towards welfare fund is around Rs 4,46,56,560/- (Rupees four Crore forty six Lakh fifty six thousand five hundred and sixty ) per month.

As per J&K Police news letter January to July 2019 (J&K Police has sanctioned / released Rs 40,84,08,898 in favour of Police Personnel / NOKs of Police Martyrs and retired Police personnel under various welfare schemes of J&K Police during January 2019 to ending July 2019. The contribution / subscription of J&K Police from January to July ending 2019 was Rs around 31,34,85,105/-) details of amount sanctioned /released is enclosed. In first 07 Month of 2019, J&K Police has sanctioned / released Rs 15,72,50,000 @ 50.16%. in favour of 105 NOKs of deceased Police Personnel.

*****The total sanctioned strength of Ladakh Police is 2546 and the total Posted strength is 1813 and contribution / subscription as per sanctioned and posted strength of Ladakh Police is Rs 12, 55,155 and 9,03,300 respectively per month.

Now after comparing the existing welfare schemes / rule of J&K police and welfare schemes of other states and UTs it seems that the existing welfare schemes / Rules adopted by J&K Police is much applicable and beneficial to be adopted by Ladakh Police.

In view of above submitted facts the committee is of the view that based on current rate of contribution it will be viable to include the following welfare measure / schemes in Ladakh Police welfare rules.

Based on statistics from both the Districts and IRP Battalion

If we adopt the current rate of relief/ loan of J&K police under different schemes.

The average monthly expenses on different schemes are estimated as under:- 1. The current rate of welfare relief in favour of NOKs of in service deceased Police personnel is Rs 20 Lakh . Based on the current strength of Ladakh Police and Data from the Last few years about 2-3 Police Personnel die in service each year. 2. An average of 50 Police Personnel gets retires from service in Ladakh in a year. Rs37,50,000.- per year will have to be sanctioned @Rs. 3,12,500/- per month as retirement gift retiring Police personnel. Therefore, expense on account of relief to NOKs of deceased Police personnel per annum shall be around 60.0 Lakh. 3. Based on the current strength an average year of service about 50 Police personnel retires from Service every year. Therefore expenses on account of retirement gift shall be around 37,50,000 per annum @ 3,12,500/- per month as retirement gift for retiring Police personnel.

4. Scholarship: - the current average claim for scholarship based on merit is about 09 wards per year. T he total expenses on this account shall be around 01 Lakh per annum @10,000.

5. Welfare loans the following welfare loan provided for Police personnel in the welfare rules of J&K police.

It is preferred that the above provided welfare loans may be retained and sanctioning of said loans are made based on availability of funds and the loan amount are reimbursed in full. There is no financial implication as such. Therefore, the above mentioned welfare loans may be retained and shall be operated only when sufficient funds are available.

Out of total sanctioned / released Rs 40,84,08,898 under various welfare schemes, by J&K Police from January to july 2019, following are the details thereof:

1. Rs 157250000 @ 50.16%.has been sanctioned / released in favour of 105 NOKs of deceased Police Personnel. 2. Rs 12150000 @ 3.87%. Sanctioned and released as special relief in favour of 49 deceased SPOs. 3. Rs 56000000 @ 17.86 Sanctioned and released as Ex-gratia relief in favour of 28 NOKs of Police Martyrs. 4. Rs 45,00,000/- @ 14.29% Sanctioned and released as Ex-Gratia relief in favour of 04 deceased SPOs. 5. Rs 4,84,20,000 @ 15.44% Sanctioned and released as retirement in favour of 770 Officers and Jawan. 6. Rs 10,63,69,000 @ 33.93% Sanctioned / released as welfare loan in favour of 1047 Personnel. 7. Rs 11,73,000/- @ 0.37% Sanctioned and released as welfare relief in favour of 66 Personnel. 8. 4,93,000/- @ 0.14 % Sanctioned and released relief in favour of 131 Personnel who sustained injured in L&O duties or militant attacks. 9. 20. Rs 27,5,000/- @ 0.08% Sanctioned and released as financial assistance to the 09 NOKs of Police Martyrs for marriage of their daughter. 21. Rs 3,70,821/- @ 0.11% Sanctioned and released for organizing sports activities. 22. Rs 70,000/- @ 0.02 % Sanctioned and released to Police Public school Jammu for treatment of 01 Student. 23. Rs 42,000/- @ 0.13% Sanctioned and released as welfare relief in favour of 18 Injured SPOs. 24. 50,00,000/- @ 1.59% Sanctioned and released to DIG AP Jammu for fuel to Department Vehicles by Police pariwar fund in connection with Parliamentary election 2019. 25. Contribution in CPWF (Special welfare fund)

(CONTRIBUTORY WELFARE FUND)

As reflected above the monthly contribution to the CPWF calculated at posted strength is 682195 which add upto Rs 8186340 per annum.

As per the J&K welfare rule following schemes are included under the CPWF.

1. Immediate relief @ Rs 1.00 Lakh 2. Special relief @ Rs. 19.00 Lakh 3. Welfare loan to serving Police personnel @ Rs 1 lakh for marriage / higher education etc. @ up-to Rs 5 lakh for treatment of subscriber @ up-to Rs 3 lakh for treatment of dependent. 4. Retirement Gift @ Rs 0.75 Lakh 5. Award of DGP special reward @10,000/- 6. Scholarship to ward of deceased Police Personnel @ Rs 5000/ per annum. 7. Award of DGP Commendation certificate with cash reward to wards of serving Police personnel securing first 05 position in 10th 12th graduation and PG @ Rs 10,000/- 8. Meritorious Scholarship. 9. Awards of DGP commendation certificate with cash reward to wards of serving Police personnel securing first three Position in national level sports and event @ Rs 5,000/- 3,000 and 2,000 respectively. 10. Based on current posted strength and data of the last few years, about 03 Personnel dies while in service. Therefore, expenditure on account of immediate relief and special welfare relief in favour of NOKs of deceased Police personnel will be assumed Rs 60,00,000/- 11. Based on the current Posted strength and data of current year about 50 Police Personnel retires each year. Therefore, the expenditure on account of retirement gift will be around 37,50,000/- 12. Different welfare loans provided under this fund shall be subjected to availability of funds. Therefore, no immediate financial implication needs to be accounted for in this regard. 13. Based on data from sub units about 10 wards of serving Police personnel apply or award of DGP Special reward / meritorious Scholarship / scholar ship for wards of deceased Police personnel / award of DGP commendation certificate and award for first three position in National Level sports events. Therefore, annual expenses on account of above schemes under CPWF will be around 01 Lakh. Therefore theh total annual expenses on account of different schemes included under the CPWF shall be Rs 60,00,000 +1,00,000 +37,50,000 = 98,50,000/-

Contribution in RPWF

The total annual contribution at current Posted strength comes to be Rs 7,80,840/- per annum. According to the J&K welfare rules the following welfare schemes area included under RPWF.

1. Relief to retired Police personnel up-to Rs 0.50Lakh. 2. Scholarship for first three wards of retired Police personnel who secures highest merit not less than 75% in 10th, 12th and graduations Level examination @Rs 3,000/- annum. 3. At the current rate about RS. 1.5 lakh are disbursed on account of relief to retired police personnel from RPWF. 4. Keeping the upper limit about 10 wards of retired Police personnel applies for Scholarship. Therefore expenses on this account from RPWF will be around 30,000/- per annum.

Based on the above estimate the total annual expenses from RPWF is around 1,80,000/ . Therefore it is estimated that Rs about 5,88,720/- surplus amount will be collected.

Contribution in CPEF (Education fund)

The total annual contribution to this account based on current Posted strength = Rs 6,91,920/- per annum.

As per J&K Police welfare rules the following schemes are included under this fund

1. Free ship to the wards of Police personnel killed while fighting militancy in Police public school. 2. Scholarship to wards of martyrs Police personnel / martyrs SPOs a) Up-to 5th RS 2,400/- annum b) ….6th to 10th Rs 6,000/- annum. c) 11th to graduation (including diploma in technical courses Rs 10,000/- annum d) Technical courses 04 years and above Rs 12,000/- per annum. e) PG or equivalent Rs 12,000/- per annum. f) Md. M.Tech. / PHD or equivalent RS 15,000/- annum. 3. Free boarding and lodging to wards of Police Martyrs in police public school. As of now there is no there are no wards of martyrs studying in police public school. Further, there are 05 Martyrs in Ladakh and there is no reasonable chance of any such case in future due to overall peaceful environment of UT ladakh and it can be reasonably presumed that the number of martyrs shall remain more or less the same in future.

In light of the above points it can be concluded that there will not be any notable expenditure from this fund.

Contribution in CPSF (Sports fund)

The total contribution to this account based on current posted strength = Rs 2,67,360/- every year.

As per the J&K welfare rules 40% of the total contribution in this fund is retained at Districts / units Level were as 60% of the contribution is deposited in CPSF.

As per J&K welfare rules there is no any specific schemes is included under this fund.

CONTRIBUTION IN (CPWF)

The total contribution to this account based on current posted strength is around Rs 4,78,320/- annum. This fund is a sub component of CPWF and the contribution is retained at District / units Hqrs. The following schemes are included under this fund.

1. Welfare relief @upto 25,000/- suitable relief to serving Police Personnel in case of acute hardship, distress or personnel losses caused by unforeseen climate and payment of premium for group insurance covering death / injuries / disability including cost of artificial limbs, training and rehabilitation. 2. Provision of bara khana @ upto 50,000/- on special occasion.

Based on current data about 4.0 lakh.is disbursed from DPWF annually, on account of welfare relief / loan.

(SPO Contributory fund)

The total annual contribution to this account based on current posted strength is Rs 4,35,120/- per annum.

As per the J&K Police welfare rules the following schemes are included under this fund.

1. Suitable medical relief to those SPOs who sustain serious injuries while on duty / suffering from life terminal disease to defray expenses of treatment for the period of Hospitalization in Govt. Hospital only duly certified by the competent medical authority up-to Rs 50,000/- . 2. Free schooling in public School to the wards of martyrs SPOs kill in militancy related incidents during the course of engagement. 3. Immediate relief to NOKs in case of death of SPOs for performing last rites up-to Rs 50,000/-. 4. Special relief to concern NOKs in case of unfortunate death of the subscriber (SPO) who dies during the course of engagement.

There are no SPO martyrs in Ladakh and due o the overall peaceful environment of UT ladakh it can be reasonably / presumed that expenses on this amount will be minimal /negligible in future.

POLICE PARIWAR FUND

This scheme is mainly framed for Police Public events and the notable event under this scheme is the Police public mela organized twice in a year by J&K Police. There is no provision of contribution by Police personnel to this particular fund. The profit / surplus from events like police public mela form the corpus of the fund. The following schemes are included under this fund.

Total estimated expenses under this fund is around 11,50,000/-

There is overall peaceful environment UT in Ladakh and there is minimum chances of getting any Police personnel or SPOs martyred. The maximum expenses from this fund are made in favour of martyred Police personnel / SPOs. Further, expenses for Bara khana is to be made either from Unit welfare fund or Police pariwar fund also the expenses on account of Special relief to concern NOKs in case of unfortunate death of subscriber (SPO) who dies during the course of engagement is to be meet from either from SPOs contributory welfare fund or Police pariwar fund.

In light of the above it can be concluded that there will not be any notable expenditure from this fund.

Based on the above stated details regarding contribution and expenses from various welfare funds it can be concluded that except for CPWF all funds are likely to gross net surplus fund. To maintain the current amount of relief under CPWF are may utilized the surplus fund from other fund till the CPWF becomes self sustaining which will be possible after recruitment to the vacant post. Further, the shortage in the meanwhile can also be compensated from reserve amount proposed to be transferred from J&K.

Ø Therefore in light of the above submitted point it is recommended that:-

CPWF, RPWF, CPSF AND CPEF, may be merged as most of these funds are expected to collect surplus fund except CPWF. Therefore the shortfall in CPWF can be compensated from other funds. 1 As the number of personnel, Martyrs wards and organization hierarchy is very less, all these funds can be managed from PHQ under a single fund. 2 DPWF may be kept with District / unit head for immediate disbursals of relief in case of acute hardship and injuries. 3 SPOs contributory funds may be retained as a separate fund as the current level of contribution is estimated to be sufficient for expenses related to schemes included under the fund on self sustaining basis. 4 The erstwhile state of J&K contributed funds towards various schemes, in line with that we may also request the MHA/ UT administration for similar contribution to Police welfare fund. Those fund to which we need to request the MHA/ UT administration for contribution are as follows:

5. As the welfare funds are contributory in nature, the committee framed under police welfare rules may amend/alter rate of contribution/compensation and include/ exclude schemes under various funds annually as per availability/ sustainability of funds and other factors in the annual welfare meeting.

If approved, we may frame the welfare fund rules for Police UT Ladakh, based on J&K Police welfare fund rules in view of above recommendations and other necessary amendments.
