EXPORTER AND IMPORTER GUIDELINES

INTRODUCTION

According to the Russian Law cosmetic products to be sold or used in the country require mandatory certification, i.e. they should be approved by relevant Russian authorities in terms of compliance to national standards. This concerns both locally produced and imported goods

The main objectives of certification: . Proves compliance of products to Russian hygiene and safety requirements . Is required for Customs clearance procedures at the Russian border . Is required for sale and use of products on the Russian market . Allows advertisement of the products

MANDATORY CERTIFICATES

Mandatory certificates for cosmetics are: . State Registration of Customs Union (, Kazakhstan, Belarus) . GOST R Declaration of Conformity

STATE REGISTRATION OF CUSTOMS UNION Since July 1st, 2010 the Russian system of sanitary testing & sanitary certification has been subjected to changes due to formation of Customs Union between Russia, Kazakhstan and Belarus. Due to this fact the earlier issued Sanitary- Epidemiological conclusion is now replaced by State Registration of Customs Union or by testing valid inside all territory of member’s union. Consequently new list determines products which are now under State Registration or under testing requirements of Customs Union. In accordance with this list cosmetics are subject to the State Registration of Customs Union.

The aim of the State Registration of Customs Union is to confirm that products conform to applicable hygienic standards and sanitary regulations in Russia and proves that the product is safe for human health when used under normal conditions.

The State Registrations of Customs Union are only issued by local certification bodies authorized by Federal Service for Supervision in the Area of Consumer Rights and Welfare Protection. They are edited by product or by category of homogeneous products and are not limited in time with validy within the territory of Russia, Kazakhstan and Belarus.

The State Registrations of Customs Union are a pre-requisite for obtaining GOST R Certificate of Conformity or GOST R Declaration of Conformity.

Following tests and analyses are performed on the selected samples: . Organoleptic and physical-chemical, . Microbiological, . Toxicological, . Clinical.

NB: Sanitary-Epidemiological conclusions as well as State Product Registrations issued before 01 July 2010 are valid until 01 January 2012.

GOST R DECLARATION OF CONFORMITY By virtue of the Decree No. 982 dated of December 1st, 2009 and entered into force on February 15th, 2010 cosmetics are subject to mandatory GOST R Declaration of Conformity.

This is the official document where an importer or retailer assures that his products meet Russian safety regulations. The Declaration of Conformity is a pre-requisite for product placement onto the Russian Market and is required for Customs clearance. Its validity could vary from 1 to 3 years or concern only one shipment depending on the export volume and exporter’s / importers needs.

The Declaration of Conformity is issued by groups of products assembled according to the Russian internal OKP classification, customs codes and standards. Thus, one list of products may be covered by several Declarations.

Registration of the Declaration of Conformity by the GOST R Certification body is based on the following: . Test protocols from laboratories accredited by Russian authorities . A State Registration of Customs Union . Sometimes a voluntary GOST R Certificate of Conformity . Technical documents presented by the applicant

A declared product should be marked by the registered GOST R sign (called Mark of Conformity) without identification number of certification body (compared to GOST R certified product) to demonstrate compliance with applicable Russian standards.

VOLUNTARY CERTIFICATES: VOLUNTARY GOST R CERTIFICATE OF CONFORMITY

By virtue of the Decree No. 982 entered into force on February 15th, 2010 the mandatory GOST R Certificate of Conformity is not any more required for cosmetics. Nevertheless voluntary certification scheme may be applied. Exporters or importers initiate voluntary certification with the aim to formally prove the conformity of their products to the applicable Russian standards and/or to facilitate the registration of GOST R Declaration of Conformity for importers and retailers.

The validity of the voluntary Certificate of Conformity could vary from 1 to 3 years or concern only one shipment depending on the export volume and exporter’s/importers needs. This document is issued by groups of products assembled according to the Russian internal OKP classification, customs codes and standards. Thus, one list of products may be covered by several Certificates.

DOCUMENTATION REQUIRED

Documentation required in order to obtain the State Registration, GOST R Declaration of Conformity and GOST R Certificate of Conformity: . Application form for Certification; . Declaration of conformity of the products to the European standards (free form on letter-head paper) ; . ISO certificate or any other factory certification (if obtained); . Certificate of Trade issued by the Federation of the Perfumery Industry; . Authorization for placing of product on the national or international market ; . List of products to certify with Russian translation (full Russian line); . Labels and instruction of use (or drafts) translated into Russian; . Conservation conditions / validity of the products / type of packaging used; . Copy of the contract with the local distributor / shipment invoice (for the single shipment certification); . Importer’s details; . Technical data sheet (composition, type, qualitative and quantity formulas…); . Test/analysis reports (internal or from a third party laboratory), if any; . Manufacturer’s Declaration that he produces cosmetics since …..(date), without any claims or reclamations from clients; . Document issued by 3rd party approving the safety of products; . Samples of products in required quantity defined by the certification body (in sale packaging);

Additional documents may be required during the certification procedure.

LABELLING AND GOST R MARKING

All the information located on the product, packaging and notices shall be in . Mandatory information is as follows: . Function of the product, unless it is clear from the presentation of the product. . Name and address of the manufacturer with indication of country. . Name and address of the company powered by manufacturer to receive consumer reclamations and claims. . Brand, if any (can remain in Latin letters). . Nominal content given by volume (cm3 or ml) or weight (g) and/or quantity, except in the case of packaging containing less than 5 ml or 5 g and free samples. . List of ingredients in descending order according to the INCI formula. The list shall be preceded by the word « Ingredients » which shall be translated in Russian language. The list of ingredients may remain in Latin letters. Perfumes and aromatic compositions are not to be detailed, but indicated as one ingredient. For products containing ethyl alcohol it is necessary to indicate the type of alcohol used. Perfumes shall be marked with percentage of alcohol contained. . Date of durability (best used before…month/year) or date of producing (month, year) + durability (number of months or years). . Storage conditions, if product requires special storage conditions (t°, humidity). . Accurate application, if necessary . Warnings, if any . GOST R sign (so called Mark of conformity) proving the conformity of the product to Russian safety requirements.

Where it is impossible for reasons of size or shape to print all information on the packaging, it is recommended to mention the name and function of the product on its face side and to appear other information on the back side or in an enclosed leaflet.

The product may contain other information in regards to its properties, effect or advertising information. The manufacturer is responsible for terms as: « moisturizing » , « anti dandruff », « sun protection », « water resistant », « Made with natural materials », …

Information shall be clear and legible and the marking shall be resistant to the conservation, transportation and sales

USE OF RUSSIAN LANGUAGE All the information located on the product, packaging and notices shall be in Russian language. Amongst mandatory markings, only the composition (INCI) and the commercial brand can remain in Latin letters. If the manufacturer’s name and address are in Latin letters, they shall be coupled with transcription in Russian letters.

GOST R SIGN (MARK OF CONFORMITY) The declared or certified products shall carry the Gost-R sign, called Mark of Conformity. It proves that product meets safety requirements and was controlled by certification body accredited by (Federal Agency for Technical Regulation and Metrology). Thus the consumer has a guarantee of product quality he would buy. The size of the Mark of Conformity on the product should not be inferior to 4 mm (for declared and voluntary certified products the identification number of certification body is not mentioned).

FEES

There is no standard price-list for Russian certification services, since its cost is very much dependable on such factors as complexity of the file, of the products quantity to test and to certify and of the certification scheme.

Expenses will usually consist of the following elements: . Cost of product analyses/tests in accredited laboratory; . Audit expenses, including travel costs for inspectors and their accommodation (in required); . Cost of certificates issued; . Translation services; . Overhead expenses.
