MOTION TO HOLD A MEETING IN A CLOSED SESSION It is in order for the Board to pass a motion to close the Chair McCallum meeting to the public pursuant to Section 69 (2) (b), (c), and (d) of the Police Act, which states: (2) if it believes that any of the following matters will arise in a meeting or hearing held by it, a board or committee may order that the portion of the meeting during which the matter will arise be held in private: (b) a matter concerning a person's financial or personal affairs, if the person's interest in the matter outweighs the public's interest in the matter; (c) a matter concerning labour contract discussions, labour management relations, layoffs or another personnel matter; (d) a matter concerning information that a person has requested he or she be allowed to give in private to the board or committee. Certified correct: __________________________________ ___________________________________ Melissa Granum, Executive Director Doug McCallum, Chair Page 4 REPORT DATE: September 10, 2020 REGULAR BOARD MEETING DATE: September 15, 2020 BOARD REPORT # 2020-R004 TO: Surrey Police Board FROM: General Manager, Policing Transition FILE: 7400-01 SUBJECT: Establishing the Surrey Police – A Framework for Critical Decisions RECOMMENDATION The General Manager, Policing Transition recommends that the Board receive this report for information. PURPOSE This report outlines a framework for the key critical decisions which will take place in coming months to establish and operate the Surrey Police Service (SPS). BACKGROUND On August 6, 2020, the Board adopted a motion to create the SPS. The BC Police Act [RSPC 1996] (the Police Act) defines roles and responsibilities for the Board, the Chief Constable, the municipality and others in making decisions regarding a municipal police service. Decision-making on issues related to the establishment and operation of the SPS must be consistent with the Police Act. Creating a municipal police service requires multiple complex and interrelated decisions and the Police Act provides guidance as to the appropriate authorities for decision making on several issues. However, the Police Act does not provide explicit direction for the transfer of policing responsibilities from a contracted policing model under the Municipal Police Unit Agreement (MPUA) to an independent municipal police service. Therefore, the critical decisions required in coming months are derived from the Police Act as well as the practical considerations required during a transition of this type. DISCUSSION A corresponding City of Surrey Corporate Report has also been prepared and forwarded to Council for the September 14, 2020 Council meeting. Broadly speaking, the Police Act defines the decision-making authority of the Board regarding matters of governance, accountability and transparency. Specifically, the Board’s powers include: • Employing all sworn and civilian staff of the SPS; • Setting policy and providing direction to the Chief Constable; • Overseeing the budget; and - 2 - • Authority for Service or Policy Complaints against the SPS1. Similarly, the Police Act defines the decision-making authority of the Chief Constable as focused on operational and organizational matters regarding how policing services are delivered. Specifically, the Chief Constable’s powers include: • Exercising powers and performing duties assigned to the Chief Constable; • Ensuring compliance with the Director of Police Services’ standards as they relate to a municipal police department; • Performing the duties and functions respecting the preservation of peace, the prevention of crime and offences against the law; and • Overseeing the operation of the municipal police department2. The Police Act also defines the decision-making authority of the municipality as focused on matters regarding funding of police services. Specifically, the municipality’s authority includes: • Bearing the expenses necessary to generally maintain law and order in the municipality; • Providing adequate accommodation, equipment and supplies for the operation of and use by the municipal police service and the detention of persons in police custody3; and • Providing to the Board advice on the municipality’s priorities, goals and objectives4.

The outcome of this consultation is critical for the sustainability of the modern police service and one which we must get right. I did write to the Home Secretary on 24 July requesting further information and was disappointed not to receive a response or the requested exemplifications. This lack of information coupled with the short consultation time scales and the timing of the release over the summer, while Parliament is in recess, has prevented me from making an informed response thus undermining the consultation process. I would be grateful if you would consider issuing the exemplifications requested and re-starting the consultation process to allow for an informed and transparent exchange with those in the police service to take place. In the absence of exemplifications I have asked my office to calculate the potential impact of the proposed model on Greater Manchester Police using the data sources quoted in the consultation document. Our best estimates show that Greater Manchester Police would lose £52m (12.7%) per annum under the proposed model. Other police areas have estimated losses of up to 20% and, when coupled with the impact of the impending Spending Review, cuts at these levels could call in to question the viability of a sustainable policing service in Greater Manchester and other areas. Furthermore, I note that the combined impact of cuts that will impact on demand on policing from the Spending Review to the Home Office and other Government departments has not been addressed in these proposals.

    SURREY POLICE - PAPER FOR JULY PCC MANAGEMENT MEETING Review of BME recruitment, retention and progression 1. PURPOSE 1.1. The purpose of this paper is to brief the Police and Crime Commissioner on the current position regarding police constable recruitment at Surrey Police and on efforts to improve Black Minority Ethnic (BME) representation at all ranks. 1.2. The content presented within this paper originally formed part of a larger review paper commissioned by the Deputy Chief Constable and presented to the Equality, Diversity and Human Rights (EDHR) Board on 16th May 2014. 2. BACKGROUND REPRESENTATION 2.1. The Police Service has struggled nationally to attract and retain a diverse workforce and is not reflective of national BME representation with current statistics showing 5% representation within officers and 7.6% within staff, compared to 14% BME representation across the population of England and Wales. 2.2. Specifically in Surrey the demographic of the county has continued to evolve and BME representation has almost doubled over recent years according to census data, from 5% in 2001 to 9.6% in 2011. 2.3. By comparison, total BME representation across Surrey Police is currently recorded as 4%, with projected growth not expected to exceed 5% over the next 10 years if all factors remain stable. 2.4. My experience has been that when an item on the agenda is specifically marked as being continued to a date certain, as was the case here, that is notice to the public and applicants alike that the matter is off the agenda for that meeting and will not be discussed. Had we known that the matter would be discussed at today’s meeting, both my client and I certainly would have attended. That said, I understand that the Board has raised the following questions that it hopes can be addressed at or before the meeting Monday evening.
