The application has been approved with an additional condition as follows and the renumbering of subsequent conditions:

16. MATS00 No work shall commence to paint or stain the external timber cladding in the development hereby approved until a scheme for the painting or staining of all external cladding has been submitted to and approved in writing by the Local Planning Authority. The scheme shall include details of the proposed treatment and finish to the timber deck as well as areas of external timber cladding. The works shall be carried out in accordance with the approved details and shall be maintained in that condition in perpetuity unless otherwise agreed in writing with the Local Planning Authority.

The second to last sentence of the Committee Report has also amended to take out reference to the replacement dwelling policy which in this case is not relevant and instead refers only to Core Policy J:

The cost implications of the project if it goes ahead including the fact the applicant is prepared to replace an existing unsound dwelling and afford future protection to the remainder of the village has satisfied Officers that this is a special case and would not undermine the objectives of Core Policy J. Approval is recommended without a local occupancy condition.

Background

The Hedgerow Removal Notice was for the removal of a 160m length of hedgerow. The reason given by the applicant for the removal was to improve farm efficiency.

Decision

A site survey and consultations showed the hedgerow did not meet any of the criteria for an ‘important’ hedge under the 1997 Hedgerow Regulations. Consent for removal was therefore issued.

Background

A Hedgerow Removal Notice submitted on 10 November 2015 was for the removal of two lengths of hedgerow, totalling 153.4 metres. The reason given by the applicant for the removal was to improve efficient use of agricultural land.

A Hedgerow Removal Notice relating to these hedgerows had previously been submitted in March 2013. The hedgerows were found to meet the criteria for an ‘important’ hedgerow’ under the Regulations on historical grounds, due to the hedgerows being recorded on the Scalby Inclosure map dated 1771, which is held at the North County Record Office and therefore a Hedgerow Retention Notice was issued for both hedgerows on 2 May 2013.

An appeal against the Hedgerow Retention Notice was lodged with the Planning Inspectorate on 4 June 2013. A number of grounds of appeal were stated, including that the Hedgerow Retention Notice was factually incorrect as it included sections of field which did not include any bushes. Details of this matter were given to Members of the Planning Committee on 12 December 2013, at which time the Authority was awaiting a decision from the Planning Inspector.

On 14 December 2013, the Planning Inspector, having sought legal advice, notified the appellant that it would only be possible for the appointed Inspector to modify a hedgerow retention notice in relation to which an appeal is allowed, not in relation to which an appeal is dismissed. The inspector proposed, as the most expedient way forward, that the appellant should lodge a fresh removal notice with an amended plan; the Authority should then withdraw the previous retention notice and reissue a new retention notice in response to the fresh appeal. This course of action has now been taken by the appellant and the Authority and on 22 January 2016 the Planning Inspectorate confirmed that their file had been closed and no further action would be taken on the appeal.

Decision

Following a re-survey of the hedgerows and an examination of existing records, both hedgerows were found to meet the criteria for an ‘important hedgerow’ under the Regulations on historical grounds, due to the hedgerows being recorded on the Scalby Inclosure map dated 1771, which is held at the County Record Office.

In view of these findings, having taken account of the reasons put forward for the hedgerow removal and DETR guidelines, a new Hedgerow Retention Notice was issued for both hedgerows and the previous Retention Notice withdrawn.
