A hearing will be held in this case before the Florida Elections Commission on August 14,2013, at 10:00 am, or as soon thereafter as the parties can be heard, at the following location: Senate Office Building, Room SllO, 404 South Monroe Stteet, Tallahassee, FL .32399.

Failure to appear in accordance with this notice will constitute a waiver of yom right to participate in the hearing Continuances will be granted only upon a showing of good cause. Motions or other matelials received after 5:00pm. on August 9, 2013 (the Friday before the meeting) may not be considered by the Commission

This hearing will be conducted pursuant to Section 106.25, Florida Statutes, which governs yom participation as follows:

If you are the Respondent, you may attend the hearing, and you or your attorney will have 5 minutes to present yom case to the Commission. However, some cases (including those in which consent orders or recommendations for no probable cause are being considered) may be decided by an en masse vote and, unless you request to be heard or the Commission requests that your case be considered separately on the day of the hearing, yom case will not be individually heard.

If this is a hearing to consider an appeal from an automatic fine, the Filing Officer has imposed a fine on you for your failure to file a campaign treasurer's report on the designated due date and, by filing an appeal, you have asked the Commission to consider either (I) that the report was in fact timely filed; or (2) that there were unusual circumstances that excused the failure to file the report timely You are required to prove your case If the Commission finds that the report was filed timely or that there were unusual circumstances that excused the failure, it may waive the fine, in whole or in part The Commission may reduce a fine after considering the factors in Section 106..265, Florida Statutes .. If the Commission finds that the report was not timely filed and there were no unusual circumstances, the fine will be upheld.

If this is a hearing to consider a consent order before a determination of probable cause has been made, the Commission will decide whether to accept or reject the consent order. SUMMARY: Miami-Dade County Democratic Executive Committee is a political party executive committee (PPX) registered in Miami-Dade County The PPX's chair is Annette Taddeo-Goldstein and its treasurer is Arthur Costa The PPX is appealing the fine claiming that the 2012 Q4 Report was untimely filed due to the PPX reorganizing their executive board According to Ms .. Taddeo-Goldstein, the PPX elected a new executive board during the period when the 2012 Q4 Report became due .. She states that none of the new executive board members were made aware of any filing deadlines nor did they have access to the Miami-Dade County's EFS system until they met with their SOE on 2/22/13

On 12/16/11, the Division sent a letter informing this PPX of recent legislation changes that would affect campaign finance reports .. The letter encouraged the reader to go to the Division's website to familiarize themselves with the changes to ensure continued compliance with applicable laws On 2/20/13 at I :29 p.m., the Miami-Dade County SOE sent the PPX an email reminding them that the 2012 Q4 had not been filed. Additionally, reminder emails are sent by the SOE as a courtesy and are not required by statute

The Q4-12P Campaign Treasurer's Report flied with our office was sUbmitted on 3/20/2013 Since this report was not filed by the appropriate filing date, a fine Is being assessed for each late day pursuant to Florida Statute 106.07(8)(b).

As such, fines are calculated at a rate of $50. 00 per day for the first 3 days and thereafter, $500 00 per day for each late day. Most, if not all, letters we send are returned to us We may need an updated mailing address or simply please be advised that our letters are certified & that if you see certified mail from us, you should make a note to retrieve it because it is typically due to a deficiency in reporting.

We would like to request updated paperwork, so we have documentation related to the change in guard The documents needed are:

We need a copy of your current roster

During the 2012 election many candidate oaths received were incomplete, not filled out correctly or the wrong form was used You may want to consider giving a little training to your candidates or put a sample of a properly filled out form on your website They need to remember to write the precinct# & have the form notarized

We would like to get a formal opinion on the interpretation of their bylaws with regards to how many ( committeemen/women go on the ballot based on the number of registered voters

As such, please see the enclosed 2012 Campaign Treasurer Reporting Dates document, and review it carefully ..

At the local level, the Miami-Dade Board of County Commissioners (the Board) passed Ordinance 11-8'7, adopted on 11/13/11, amending Sections 12-17 and 12-21 of the Code of Miami-Dade County regarding the filing of your campaign finance reports with the Supervisor of Elections All entities filing with Miami-Dade County are now required to submit campaign finance reports only online. The original signed hardcopies ar·e no longer_reguired.

You will continue to file reports electronically through the Miami-Dade Elections website; however now your online submission must be received no later than midnight of the day designated, per Florida Statute 106. 0705(3) Any report that is received electronically after the designated date will be considered late and shall be subject to a fine in accordance with Florida Statute 106. 07

Lastly, the Board also passed Ordinance 11-93 on 12/06/11, amending Section 12-14 of the Code of Miami-Dade County pertaining to absentee ballot handling.. This amendment added penalties for picking up and/or returning absentee ballots in excess of those authorized in accordance with Miami-Dad.e County's designee policy The amendment further clarifies that the absentee ballot policy applies to the pick-up and return of ballots by hand, mail, or other methods. Failure to comply can now result in a fine not to exceed one thousand dollars ($1 ,000 00) or imprisonment in the County jail for a period not to exceed sixty (60) days, or by both such fine and imprisonment Section 12-14 of the Code of Miami-Dade County will now be provided with all absentee ballot data requests fulfilled by our Public Services Counter

He wanted to assign a deputy treasurer but I told him that he needs a treasurer and then he can assign a Deputy I reset the password to password so he could enter the information and send us the report. I also told him that the fines are $50 for the 1st three days and after that it goes to $500 a day until we receive the hard copy of the report

This letter included pertinent information that has been affected by recent legislative changes.. At the State level, House Bill 1355 passed the legislature, making significant changes to the Election Laws of the State of Florida Among them was the Primary Election date being moved up two weeks and thus the 2012 Miami-Dade County Primary Election will take place on August 14, 2012. Since qualifying dates and campaign finance report dates correspond with the election date, these important dates have all changed. As such, please see the enclosed 2012 Campaign Treasurer Reporting Dates document, and review it carefully

At the local level, the Miami Dade Board of County Commissioners (the Board) passed Ordinance 11-87, adopted on 11/13/11, amending Sections 12-17 and 12-21 of the Code of Miami-Dade County regarding the filing of your campaign finance reports with the Supervisor of Elections All entities filing with Miami .. Dade County are now required to submit campaign finance reports only online. The original signed hardcopies are no ,longer required.

You will continue to file reports electronically through the Miami-Dade Elections website; however now your online submission must be received no later than midnight of the day designated, per Florida Statute 106.0705(3) Any report that is received electronically after the designated date will be considered late and shall be subject to a fine in accordance with Florida Statute 106 07

To sign-·in, please continue using your currently designated user lD and password When submitting your campaign reports electronically, you will now be required to use an electronic signature pin. Your temporary signature pin is 1234 and your campaign treasurer's signature pin is 5678. For security reasons, you are encouraged to reset these with unique four digit signature pins

Power outages or p10gram failure does not constitute unusual circumstances unless it is established that reasonable precautions to assme the safety of the equipment 01 the ability of the program to perform as anticipated were taken before the events causing failme of the equipment or program. Evidence must include a written statement made under oath in the presence of a notary or other person authorized to administer oaths indicating the cause and the duration of the power outage and the reasonable precautions taken to assure the safety of the equipment or the ability of the program to perform as anticipated 6.. The abrupt and unexpected loss of the campaign treasurer, over which you had no contr·oL I he loss of the campaign treasmer does not constitute unusual circumstances if the appealing party failed to monitor the campaign treasurer's perfmmance before his or her departure or if the appealing party failed to assure prompt preparation of the report after the treasurer's departme. Evidence must include a written statement made under oath in the presence of a notary or other person authorized to administer oaths explaining the departure of your treasurer and the steps taken to monitor the treasurer's performance before his or her departure You may, of course, send any additional evidence that you believe supports your position that yom report was timely filed or that the reason you failed to timely file your report was due to unusual circumstances Rule 2B-L005(3), Florida Administrative Code, provides that if you send additional documentary evidence, the Commission must receive it no later than 20 days from the date of this letter.. ZB-1.005 Appeal of Fines Imposed by Filing Officers (1) To appeal a fine imposed pursuant to Section 106 .. 04(8) or 106 07(8), F S, the candidate, chairman of a political committee, or treasurer of a committee of continuous existence shall file a notice of appeal.
