1.Introduction

1.1 The Program

1. The Air Quality Improvement in the Greater Beijing–Tianjin–Hebei Region—Henan Cleaner Fuel Switch Investment Program will support the transition from coal to cleaner fuel for residential, commercial, and industrial users in selected less-developed counties of Henan Province, thereby reducing a major source of air pollution in the greater Beijing–Tianjin– Hebei region. The outcomes of the program will include: (1) 1.2 million customers connected to cleaner fuel; (2) 316.63 million Nm3 of gas consumed annually; and (3) private and public funding mobilized after 2022. The program will have four outputs:

2. Output 1: Gas network system expanded. The program will construct natural gas network systems, including 26,880 kilometers of medium and low-pressure small diameter distribution pipelines and 12 gas stations, together supplying

3. 316.63 million normal cubic meters of gas to 1.2 million customers by 2023.

4. Output 2: Alternative clean fuel developed. The program will develop 1.7 million cubic meters of annual biogas production capacity using the first utility-scale dry fermentation process plant that makes use of agricultural waste, which is readily available in the target counties.

5. Output 3: Cleaner fuel use awareness enhanced. The program will help change end- user’s use of traditional energy, and enhance awareness about cleaner fuel use and gas safety. It will give special attention to gender impacts, including improved health outcomes and reduced time spent preparing household energy among women.

6. Output 4: Institutional and organizational capacity enhancement. The program will support institutional and organizational capacity enhancement by (i) upgrading the information and management system; (ii) strengthening financial and risk management; (iii) unlocking access to commercial financing; and (iv) increasing implementing agency staffing with gender targets, for sustainable overall program implementation towards 2030.

7. The program considers adopting ADB’s result-based lending (RBL) modality. ADB’s RBL program supports the financing of the program for the time- slice of 2019–2023 in the overall investment program for 2019–2030. The proposed Henan Cleaner Fuel Switch Investment Program (the program) supports the Government’s objectives as outlined in the Three-Year Action Plan to Win Blue Sky War (2018–2020), issued in June 2018. The Action Plan includes policy actions to accelerate (i) closing of heavily polluting industries; (ii) reduce surplus production capacity in industries; (iii) shift to less air polluting transportation modes; and, (iv) build cleaner and less air polluting energy systems to reduce air pollutant

emissions by more than 15% for NOx and SO2, and more than 18% for PM2.5 by 2020 as compared with the emissions level in 2015. In 2018 the provincial government also issued the Three-Year Action Plan for Henan Province to Combat Blue Sky War (2018–2020), which targeted to (i) reduce annual average PM2.5 to 58 μg/m3 by 2020; and, (ii) achieve the annual average national air quality category II standard of 35 μg/m3 by 2023.

8. The program scope during 2019–2023 covers (i) expanding gas network systems including distribution pipelines (26,880 km) and gas stations, thereby replacing the old coal burning facilities; (ii) developing 17 million Nm3 annual production capacity of pilot biogas plant facilities, which can be sourced from wastes from agricultural crops; (iii) strengthening the institutional capacity of Zhongyuan Yuzi Investment Holding Group (ZYIG) and China Tian Lun Gas Holding Limited (CTLG) to raise the additional funding needed to complete the cleaner fuel switch investment program by 2030; and (iv) enhancing awareness about safety of cleaner fuel use and indoor air pollution reduction among the gas end users, with special attention to gender impacts. The program is aligned with national and provincial development plans and the Asian Development Bank’s (ADB) country partnership strategy for the PRC, 2016–2020.

9. The Henan Provincial Government is the executing agency (EA) and has overall responsibility for the program. The IA is the Zhongyuan Yuzi Investment Holding Group (ZYIG), a state owned enterprise (SOE) under the Henan Provincial finance bureau, who is responsible for implementing and monitoring the activities in the program through the Yu- Tian New Energy Company (YTNE), a joint venture between ZYIG and the private China Tian Lun Gas Holding Limited (CTLG). A program coordination committee comprised of ZYIG, YTNE, provincial development and reform commission, provincial finance bureau, and other relevant provincial government agencies, was established to provide oversight and strategic guidance in implementing the program.

10. Overall program involuntary resettlement. For output 1, the laying out of transmission and distribution pipelines will induce temporary land occupation impacts. Construction of storage substations will require acquisition of collective land or state-owned land. In the event that collective land has to be acquired for the storage substations, considering the size of the regulatory and storage facility in semi-urban and rural areas, the involuntary resettlement and land acquisition impact is deemed less significant. For output 2, collective land acquisition will be induced by construction of the pilot biogas plant. The site for the biogas plant has been selected and classified as Category B for resettlement. These components will trigger involuntary resettlement impacts. Outputs 3 and 4 will not trigger involuntary resettlement impacts. Therefore, the classification of the program as ADB category B for resettlement is confirmed.

11. Institutional Arrangements. The Henan Provincial Government is the executing agency and has overall responsibility for the program. The implementing agency is the Zhongyuan 2 EM Report on RP Implementation (No.1)-BTH Henan Project

Yuzi Investment Holding Group (ZYIG), a state-owned enterprise under the Henan Provincial Finance Bureau, which is responsible for implementing and monitoring the activities in the program through the Yu-Tian New Energy Co. Ltd. (YTNE), a joint venture between ZYIG and the private China Tian Lun Gas Holding Limited. A program coordination committee comprised of ZYIG, YTNE, the Provincial Development and Reform Commission, Provincial Finance Bureau, and other relevant provincial government agencies was established to provide oversight and strategic guidance in implementing the program.

12. A program management office was established within ZYIG, which has management responsibility for the program. YTNE has day-to-day implementation responsibility for the program. The executing and implementing agencies have established a safeguards unit within YTNE, with suitably qualified social staff (Mr. Zhou Liujie at ZYIG +86 18339290908, and Mr. Zhang Daowei at YTNE +86 18625588331 as well as corresponding staffs at local subsidiary companies).

13. For the pilot biomass gas plant, YTNE is committed to employing qualified environmental management staff, and to preparing and implementing the EMP. Training will be provided to support EMP development and implementation.

14. In the PRC, responsibility for enforcement of land laws and regulations rests with the land resource authorities at each level of government. For biogas land and substations, YTNE will submit land use applications to the local government, which will acquire the land, pay compensation, transfer the collective land to state-owned land, and sell the use rights to YTNE. The local government will issue the Real Property Ownership Certificate. This is a common practice in the PRC. ZYIG, as a state-owned enterprise, has a good relationship with local governments and coordinates land acquisition with the local land resource bureau. Also, YTNE engaged a resettlement consultant to help prepare the resettlement plan, and conduct due diligence and social compliance audits in accordance with the agreed social safeguard management guidelines. Safeguard experts from the program implementation consultants were mobilized to assist in the day-to-day safeguards implementation. Because YTNE relies on the local government to conduct the land acquisition, the staff has limited experience in handling resettlement safeguard issues. Three training workshops on SPS and the PRC’s related laws and regulations have been provided to the relevant staff on 20 May, 9 July and 5 August 2019. Future training will also be conducted and will continue throughout program implementation.
