I. PROJECT OVERVIEW

A. Project Background 1. The Madhya Pradesh District Road II Sector Project (MPDRIISP) will improve transport connectivity in the state by rehabilitating and upgrading Major District Roads (MDR). The Project constitutes: (i) rehabilitating and upgrading of MDRs, (ii) improving road maintenance and asset management, and (iii) developing an efficient accident response system. Madhya Pradesh Road Development Corporation Ltd (MPRDC) specifically targets MDRs to form key linkage between rural, semi urban and urban areas and complete the state roads connectivity. 2. Government of Madhya Pradesh (GoMP) through MPRDC has started the improvements of MDR network for meeting the supply demand gap of the traffic in near future. The main objectives are to improve the regional as well as inter and intra-state transport connectivity thereby improving access to services and making the State attractive to developers and investors. The detailed project report (DPR) was prepared for 57 stretches of existing MDRs with total length of about 1,468.2451 kms under 25 packages for widening and reconstruction in the state of Madhya Pradesh. During implementation, six subproject roads were declared as state highway (SH), there by requiring construction of 7.0 meters carriageway. This change has resulted in increase of corridor of impact (COI) from earlier envisaged 5.5 meters. The details of the packages having increased COI are tabulated below:

II. OBJECTIVES OF REVISED DUE DILIGENCE REPORT (DDR)

3. The original due diligence reports (DDR) for the all subprojects were prepared and disclosed in December 2016 and November 2017. The DDRs covered the

The DDRs confirm that no land acquisition is required and 12 to 20 meters right-of- way (ROW) is available with the MPRDC. The DDRs confirm that construction of subprojects does not cause any resettlement impacts. With increase in COI from 5.0 to 7.0 meters due to declaration six subprojects as SH, the revised assessment was conducted to identify resettlement impacts, if any on non-title holders in the additional width. The objectives of the revised DDR are as below:

 To assess whether the sub-project causes any resettlement impacts (temporary/ permanent, partial/full) impacts on structures and livelihoods non-titled displaced persons (DP) and / or displaced households (DH).

 To collect evidence (documents, photographs and videography) to understand/ identify resettlement impacts, if any.

 In case, the resettlement impacts were identified during the due diligence, need to prepare the resettlement plan (RP) as per the agreed entitlement matrix and implement the corrective action plan.

 To organize public consultation in all the villages along the subproject roads to discuss the resettlement impacts; if any and inform them about Grievance Redress Mechanism (GRM).

III. METHODOLOGY FOR DUE DILIGENCE REPORT

4. A survey of the subproject roads with public consultations, focus group discussions (FGDs) along with videography was carried out along the subproject roads with respective MPRDC officials and supervision consultants. Following methodological techniques have been adopted for preparing revised DDR (i) Field based assessment; (ii) Public consulutations with public representatives (Gram Panchayat) and local communities; and (iii) evidence-based photo and videography along the subproject roads. 5. A survey in the villages has been carried out by supervision consultant, along with the Contractor’s representative and the MPRDC officials. The main objective of the survey was to identify the affected assets and affected households; if any and to prepare a RP accordingly for compensating and providing necessary assistance to the eligible affected people based on ADB Safeguard Policy Statement (SPS), 2009. Photographs and videography of the road were taken to i) understanding the condition of the existing road and ii) assessment of the resettlement impacts

IV. SUBPROJECT COMPONENTS AND DESIGN CRITERIA

6. The subprojects activities involve improvement of existing MDRs within the available RoW. The road widening activities primarily will comprise of raising the embankment at certain locations and its stabilization including the construction of retaining wall if required, especially near water bodies overlay on the existing carriageway, junction improvement and construction of minor bridges, culvert and RCC drain in built-up section. 7. The typical cross sections in built-up area, rural areas, and overlay locations are shown in Figure-1.

V. SUBPROJECT ASSESSMENT, SCREENING AND CATEGORIZATION

8. The existing RoW of the subproject roads varies from 12 meters to 20 meters, which is not properly demarcated on ground. The corridor required for construction of the road is available and has not been encroached upon. As such, there is no impact on structures, crops, trees or livelihood belonging to titled or non-titled persons. The average distance of proprietary land, structure and agricultural land was found to be 12 meters to 20 meters and the photographs depicting the availability of ROW is attached with Appendix-1. 9. Keeping in view the unavailability of the uniform RoW and existing ribbon development along the subproject roads, multiple design criteria are adopted to ensure avoidance of any adverse impacts to the roadside settlers. Based on the review of detailed design report and social assessment report for individual subprojects, summary findings of these six subprojects are presented below:

A. Khatakia to Suthaliya via. NH-3, Kumbraj, Barod, Mragwas, Batawda, Chanchoda, Binaganj, Teligaon (MDR-6-10) 10. The subproject road segment of MP-MDR–06-10 starts from T junction at Khatakia Village on NH-3 and ends at Binaganj on NH-3. The subproject road passes through Mudara, Kumbhraj, Jatkhede, Mohanpur, Badod, Nathukapura, Pipalradikala, Sayani, Bakanya, Mirgbas, Batawada, Dumdumpura, and Chahoda village. The road does not include any land aquistion as same has been confirmed in the original DDR prepared at the time of loan processing. The ROW is also available between 12 to 20 meters and during the site visits, it was confirmed that no encroachment has taken place. MPRDC confirms that subproject does not involve any land acquisition or involuntary resettlement (IR) on titled/ non-titled and the construction activities is carried out within the existing ROW. The public consultantions with the local revenue officers and gram panchayat confirming no resettlement impacts are envisaged due to construction of raod project is attached as appendix-2. The subproject road is categorised as ‘C’ for IR as per SPS, 2009. B. Maharajpur-Sahajpur Road (MP-MDR-31-08) 11. The subproject road starts at T-junction of km. 287 on NH-26 at Maharajpur village with existing road and terminates on Km. 24.447 at Sahajpur. The subproject road falls in of Madhya Pradesh. The project road passes through Maharajpur, Simariya, Dobhi, Rasena Devri, Pakwara, Saraivan, Nevaikala and Sahejpur villages. Land use pattern is predominantly agricultural, habitation & forest. The road does not include any land aquistion as same has been confirmed in the DDR prepared at the time of loan processing. The ROW is also available between 12 to 20 meters and during the site visits it was confirmed that no encroachment has taken place. MPRDC confirms that subproject does not involve any land acquisition or IR on titled/ non-titled and the construction activities is carried out within the existing ROW. The public consultantions with the local revenue officers and gram panchayat confirming no resettlement impacts are envisaged during construction of raod project is attached as appendix-2. The subproject road is categorised as ‘C’ for IR as per SPS, 2009.

C. Rampayali-Garra Chouki road (MP-MDR-42-16) 12. The subproject road starts Km 0+000 at + Junction with existing road (L/s , R/s ) in Rampayali Village and terminates on Km. 27.56 at T- Junction with SH 54 (Km. 18/4, L/s Bonkatta-Tumsar & R/s ). Project Road has a vital importance from view of connectivity with State Highway 54. The road also connects with existing road network (Agasi-Khairlanji Road and Rampayali - Waraseoni - Road) which adjoins to SH 54, SH 26 and SH 11. As the project road is directly connected to SH-26, it shows the growing importance of the highways. The subproject road passess from Rampayli to Garra Chowki via of Rampayli, Kanhar Tola, Amai, Chikhla Sale Badi, Yerwa Ghat, Miragpur, sanwar and Garra Villages. The road does not include any land aquistion as same has been confirmed in the DDR prepared at the time of loan processing. The ROW is also available between 12 to 20 meters and during the site visits it was confirmed that no encroachment has taken place. MPRDC confirms that subproject does not involve any land acquisition or IR on titled/ non-titled and the construction activities is carried out within the existing ROW. The public consultantions with the local revenue officers and gram panchayat confirming no resettlement impacts are envisaged due to construction of subproject is attached as appendix-2. The subproject road is categorised as ‘C’ for IR as per ADB SPS, 2009.

D. Chourai-Panjara-Chand Road (MP-MDR-40-10) 13. The start point of subproject road at Km 0+000 at T-Junction in Chourai SH- 19 (L/s Chhindwara & R/s Pachmarhi) to Chand covers the villages of Barelipar, Khoot Pipariya, Rajalwadi, Panjara, Badiwada, Bhand Pipariya. The subproject road connects with , Chhindwara, Seoni and other important Blocks and Tehsil Headquarters located enroute. The road does not include any land aquistion as same has been confirmed in the DDR prepared at the time of loan processing. The ROW is also available between 12 to 20 meters and during the site visits it was confirmed that no encroachment has taken place. MPRDC confirms that subproject does not involve any land acquisition or IR on titled/ non-titled and the construction activities is carried out within the existing ROW. The public consultantions with gram panchayat and local revenue officers confirming no encroachment are envisaged due to construction of road project is attached as appendix-2. The subproject road is categorised as ‘C’ for IR as per ADB SPS, 2009.

E. Chand-Bichhua-Khamarpani Road (MP-MDR-40-10) 14. The subproject road starts at Km 0+000 at T-Junction with Chhindwara – Chand Road in Chand Block (L/s Seoni, R/s Chhindwara), and terminate at T-Junction with NH-547 in Raymond Chowk (L/s , R/s Chhindwara), Chhindwara District. The road passes through Barelipar, Khoot Pipariya, Rajalwadi, Panjara, Badiwada, Bhand Pipariya Villages. The road does not include any land aquistion as same has been confirmed in the DDR prepared at the time of loan processing. The ROW is also available between 12 to 20 meters and during the site visits it was confirmed that no encroachment has taken place. MPRDC confirms that subproject does not involve any land acquisition or IR on titled/ non-titled and the construction activities is carried out within the existing ROW.. The public consultantions with the gram panchayat and local revenue officers confirming no encroachment are envisaged due to construction of raod project is attached as appendix-2. F. Kotma - Jaithari - Rajendragram Road (MP-MDR) 15. The subproject, road section falls under Anuppur district of Madhya Pradesh. The subproject road starts from section-1 Bhalumada village & terminates at Km 24/10 of Anuppur – Venkatnagar road at Khuntatola and section-2 starts from Anuppur – Venkatnagar Road in Jaitpur town & terminates at Anuppur – Road (SH-9) near Rajendragram with 52.205 km length of the project road. The existing road passes through predominantly agriculture/ barren lands and scattered urban and village settlements like Bhalumada, Gabhikha, Bharatola, Chowndi, Pattatola, Barbaspur, Cholna, Chatapatar, Khuntatola, Jaithari, Gobri Village, Gorela Village, Girwi Village, Bhagra Village, Karodhai Village, Rajendragram etc. The road does not include any land aquistion as same has been confirmed in the DDR prepared at the time of loan processing. The ROW is also available between 15 to 20 meters and during the site visits it was confirmed that no encroachment has taken place. MPRDC confirms that subproject does not involve any land acquisition or IR on titled/ non-titled and the construction activities is carried out within the existing ROW. The public consultantions with the gram panchayat and local revenue officers confirming no encroachment are envisaged due to construction of raod project is attached as appendix-2. The subproject road is categorised as ‘C’ for IR as SPS, 2009.

VI. PUBLIC CONSULTATION AND PARTICIPATION

16. The public consultations were conducted by the representatives of MPRDC and supervision consultant with the local communities, stakeholders along the road location and public representatives from the gram panchayat. During public consultation, it was informed to all the stakeholders about the entitlement matrix of the project and compensation process for the land acquisition, private properties and loss of livelihood of title and non-titled persons. During public consultations, GRM was also explained to the villagers for lodging complains about impact on social aspects i.e. land acquisition, loss of structures and loss of livelihood. 17. The responses that emerged during public consultations with local communities are outlined below:

 Local communities have appreciated the road construction work and they have clearly indicated that none of them were displaced of their shelters in the village the subproject road;  No permanent or partial impacts on residential as well as commercial structures have been observed along the project road.  Improved subproject road has provided accessibility to markets and agriculture operations;  Upgraded road has generated employment and business opportunities;  Reduction in travel time and vehicle operating cost;  Better access to health care center, education, market place and other social services; and

 Better quality of life and living standards. 18. Public Consultations were organized through Focus Group Discussion (FGD). It is a technique of group interview wherein participants from similar backgrounds engage in discussion based on their personal experiences with a moderator who raises specific topic. FGD is conducted in order to generate a rich understanding of participants about their experiences, beliefs, attitudes and needs related to the topic. 19. The public consultations were conducted to comprehend expectation from subproject and also to understand the need and concerns of the local people including vulnerable and elderly population. The list of the participants was documented and photographed during consultation are attached as appendix-3. Community’s Overall Response to the Sub-Projects 20. To assess social benefits and impacts of the project, a community consultation focusing on the evaluation of change of scope was conducted. Adequate number of community consultation conducted along the subprojects, approached heads of village panchayats, falling under the subproject roads and concern documentation was done depicting improvement of road sections. The location wise details along with a list of participants and photographs are enclosed in appendix-3. During the discussion and consultation with the villagers, residing along the subproject roads, it was clearly affirmed that they have not been affected by the subprojects construction and none of them was displaced or disposed of their shelters. The letter from sarpanch is attached as appendix-2.

21. During the preparation of the DDR, joint field visits were conducted by Divisional Manager, MPRDC and other officials and respective supervision Consultant. It was confirmed that the design options considered for the subprojects have fully avoided the impact, the road design and improvement work are further limited to existing formation width in settlement areas and all the works were carried out within the available ROW, which are free from all the encumbrances and did not involve any land acquisition/ resettlement impact. The photographs depicting the available ROW are attached as appendix-1. A videography of the road has also taken up of the entire length showing available ROW and is available at MPRDC Bhopal office in Social Safeguards Unit.

VII. GRIEVANCE REDRESS MECHANISM

22. The Grievance Redress Committee (GRC) has been established at the MPRDC state level and at the Project Implementation Unit (PIU) level to assure accessibility for public. The GRCs are expected to resolve grievances of the public within a stipulated time. Information about establishment of GRC was circulated in local panchayat offices and also displayed on the notice board of Contractors Offices. 23. The grievance / complaints may be lodged directly to the contractor or PIU at the site level. To the extent possible efforts will be made by the contractor, CSC or PIU to address these complaints immediately on site. Only those complaints that cannot be addressed immediately at the site level will be submitted to the state level GRC. The respective receiver of the complaint will make necessary assistance for completing the complaint form or lodging a written complaint to illiterate complainants. 24. The state level GRC at MPRDC, Bhopal and Divisional Level / PIU level GRC has been constituted vide no 21415 dated 31 March 2017. The order copies are attached as appendix-4.

VIII. INSTITUTIONAL ARRANGEMENT AND IMPLEMENTATION

25. The Executing Agency (EA) for the project is GoMP through MPRDC. MPRDC is wholly owned by GoMP. A Chief Engineer at MPRDC headquarter has been designated as person in charge for project implementation. MPRDC has appointed a social safeguard expert (SSE) for implementation and monitoring of social safeguard requirements. The SSE at MPRDC headquarters, reports to the Chief Engineer, is responsible for ensuring compliance with social safeguards of project roads. The SSE is supported by three R&R cum Social Development Specialists from each construction supervision consultants (CSC) on an intermittent basis. 26. MPRDC has twelve divisional offices (Bhopal, Jabalpur, Sagar, , Chambal, , , Sidhi, , Narmadapuram, Seoni and Rewa) acting as PIU and each is headed by a Divisional Manager (Tech.) who is of the rank of executive engineer and is responsible for overall implementation in the field. At PIUs, one officer of the rank of assistant engineer has been given the additional

IX. CONCLUSION

27. While collecting data from site and preparing this revised DDR, the observations and analysis show that there is no issue related to land acquisition LA), resettlement or payment of compensation on subproject roads and construction of the project does not involve any permanent or temporary/ partial or full resettlement impact (structures /livelihood) on title or non-title holders. MPRDC confirms that subprojects do not involves any land acquisition or IR impacts on titleholders/ non-titleholders and sub-projects continue to be categoriesed as ‘C’ for IR and Indigenous People (IP) as per SPS, 2009 and and no RP is required to be prepared. IR and IP impact categorization checklists are attached as appendix-5 & appendix-6 respectively.
